The tort exists to deter the use of the legal system for improper personal ends.<\/p>\n\n\n\n<h3 id=\"h-essential-elements\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Essential_Elements\"><\/span>Essential Elements<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">To establish a claim, the plaintiff must generally prove the following:<\/p>\n\n\n\n<h4 id=\"h-1-prosecution-by-the-defendant\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"1_Prosecution_by_the_Defendant\"><\/span>1. Prosecution by the Defendant<span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">The defendant must have instituted or actively continued the proceedings. Merely giving information to the authorities, without more, is ordinarily insufficient.<\/p>\n\n\n\n<h4 id=\"h-2-absence-of-reasonable-and-probable-cause\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"2_Absence_of_Reasonable_and_Probable_Cause\"><\/span>2. Absence of Reasonable and Probable Cause<span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">The defendant must have lacked an honest belief, founded on reasonable grounds, that the proceedings were justified. The mere fact that the prosecution ultimately fails does not, by itself, establish absence of reasonable and probable cause.<\/p>\n\n\n\n<h4 id=\"h-3-malice\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"3_Malice\"><\/span>3. Malice<span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">The proceedings must have been instituted or continued with malice. Malice is not limited to personal spite or hatred; it includes any improper motive such as revenge, embarrassment, pressure, or the pursuit of an advantage unrelated to the proper administration of justice.<\/p>\n\n\n\n<h4 id=\"h-4-termination-in-favour-of-the-plaintiff\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"4_Termination_in_Favour_of_the_Plaintiff\"><\/span>4. Termination in Favour of the Plaintiff<span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">The earlier proceedings must have ended in a manner favourable to the plaintiff. An acquittal may satisfy this requirement, but the nature of the termination must be examined carefully; not every form of termination confers a right of action.<\/p>\n\n\n\n<h4 id=\"h-5-damage\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"5_Damage\"><\/span>5. Damage<span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">The plaintiff must have suffered legally recognised damage, which may include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Damage to reputation;<\/li>\n\n\n\n<li>Damage to person (including mental distress or loss of liberty);<\/li>\n\n\n\n<li>Damage to property or financial interests; and<\/li>\n\n\n\n<li>Legal expenses and other recoverable consequential losses.<\/li>\n<\/ul>\n\n\n\n<h3 id=\"h-malice-and-absence-of-reasonable-and-probable-cause\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Malice_and_Absence_of_Reasonable_and_Probable_Cause\"><\/span>Malice and Absence of Reasonable and Probable Cause<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">These two requirements are distinct. A person may honestly and reasonably believe that another has committed an offence even if that belief later proves incorrect; in such a case a claim for malicious prosecution will ordinarily fail. Conversely, an improper motive alone is insufficient if reasonable and probable cause existed. The plaintiff must therefore establish both the absence of reasonable and probable cause and the presence of malice, together with the remaining elements of the tort.<\/p>\n\n\n\n<h3 id=\"h-leading-authorities\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Leading_Authorities\"><\/span>Leading Authorities<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Savile v. Roberts (1698)<\/strong> \u2013 an early English decision that recognised an action for damage caused by wrongful criminal proceedings.<\/li>\n\n\n\n<li><strong>Hicks v. Faulkner (1878)<\/strong> \u2013 frequently cited for the meaning of reasonable and probable cause: an honest belief in the guilt of the accused, based upon reasonable grounds.<\/li>\n\n\n\n<li><strong>Amin v. Jogendra Kumar Bannerjee (1947)<\/strong> \u2013 Privy Council decision emphasising the requirement of favourable termination of the earlier proceedings.<\/li>\n\n\n\n<li><strong>West Bengal State Electricity Board v. Dilip Kumar Ray (2007)<\/strong> \u2013 Supreme Court of India restatement of the essential ingredients of the tort.<\/li>\n<\/ul>\n\n\n\n<h2 id=\"h-abuse-of-legal-process\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Abuse_of_Legal_Process\"><\/span>Abuse of Legal Process<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<h3 id=\"h-meaning-0\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Meaning-2\"><\/span>Meaning<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Abuse of legal process occurs when a person uses a lawful legal procedure or process for an improper, collateral or unauthorised purpose rather than for the purpose for which the process was designed. A lawful process must not be converted into an instrument of oppression or private coercion.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Example:<\/strong> A obtains a court order for a legitimate purpose but deliberately employs it to threaten or coerce another person into surrendering an unrelated right. They will intervene where proceedings are used to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Harass an opponent;<\/li>\n\n\n\n<li>Delay resolution of a dispute;<\/li>\n\n\n\n<li>Obtain an advantage unrelated to the proceedings;<\/li>\n\n\n\n<li>Coerce a settlement;<\/li>\n\n\n\n<li>Damage reputation or business; or<\/li>\n\n\n\n<li>Circumvent the proper purpose of judicial procedure.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Remedies include dismissal of the proceedings, award of costs, and other appropriate sanctions.<\/p>\n\n\n\n<h2 id=\"h-position-in-india\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Position_in_India\"><\/span>Position in India<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Indian constitutional courts frequently invoke the concept of \u201cabuse of the process of the court\u201d where proceedings are found to be frivolous, vexatious, or instituted for improper purposes. The inherent jurisdiction of the High Courts may be exercised to prevent abuse of the process of any court and to secure the ends of justice (now under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, corresponding to the former Section 482 of the Code of Criminal Procedure, 1973).<\/p>\n\n\n\n<h2 id=\"h-illustrations\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Illustrations\"><\/span>Illustrations<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<h3 id=\"h-malicious-prosecution-0\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Malicious_Prosecution-2\"><\/span>Malicious Prosecution<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">A, motivated by a personal dispute and without any reasonable basis, deliberately causes criminal proceedings for theft to be instituted against B. B is subsequently acquitted. If the remaining elements are established, B may maintain an action for malicious prosecution.<\/p>\n\n\n\n<h3 id=\"h-abuse-of-process\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Abuse_of_Process\"><\/span>Abuse of Process<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">A obtains a legitimate court order for a specific purpose but uses the process to threaten B into relinquishing an unrelated legal right. The process is employed for a collateral purpose and may amount to abuse of process.<\/p>\n\n\n\n<h2 id=\"h-balancing-competing-interests\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Balancing_Competing_Interests\"><\/span>Balancing Competing Interests<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Both doctrines protect individual liberty and the integrity of the justice system. The right to approach courts and law-enforcement authorities must not be converted into a weapon of harassment or oppression. At the same time, the law must not deter genuine complaints: a person who institutes proceedings in good faith is not liable merely because those proceedings ultimately fail. The law therefore seeks to balance the right to seek justice against the need to protect individuals from misuse of the justice system.<\/p>\n\n\n\n<h2 id=\"h-conclusion\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Malicious prosecution and abuse of legal process are complementary safeguards against the misuse of legal machinery. Malicious prosecution guards against the wrongful institution or continuation of proceedings without reasonable and probable cause and with malice. Abuse of process addresses the improper or collateral use of legal procedures for purposes for which they were never intended.
