A false and defamatory statement can now be published instantly through social-media platforms, websites, blogs, online reviews, or messaging applications and can reach millions of people within seconds.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The principal difficulties include identifying anonymous users, determining where the harm occurred when content crosses national borders, dealing with rapidly shared or reposted material, and deciding the responsibility of online intermediaries. Questions also arise as to whether and when platforms should be liable for defamatory content posted by their users.<\/p>\n\n\n\n<h2 id=\"h-privacy-invasion-and-misuse-of-personal-data\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Privacy_Invasion_and_Misuse_of_Personal_Data\"><\/span>Privacy Invasion and Misuse of Personal Data<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Modern technology enables organisations to collect, store, analyse, and share enormous quantities of personal information, including location data, browsing habits, financial information, biometric data, and private communications.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Unauthorised disclosure, data breaches, intrusive surveillance, or misuse of personal information may cause substantial harm even when there is no immediate physical injury or financial loss. Traditional privacy principles are therefore being adapted to address digital surveillance, data misuse, identity-related harms, and informational privacy. Data-protection legislation has also become an important part of this developing area.<\/p>\n\n\n\n<h2 id=\"h-product-liability-in-the-age-of-artificial-intelligence-and-smart-technology\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Product_Liability_in_the_Age_of_Artificial_Intelligence_and_Smart_Technology\"><\/span>Product Liability in the Age of Artificial Intelligence and Smart Technology<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Traditional product liability generally concerns physical products that are defective in design, manufacture, or warnings. Modern technology has complicated this distinction because products increasingly contain software, algorithms, sensors, and autonomous decision-making systems.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Consider an autonomous vehicle that causes an accident or an AI-enabled medical device that produces an incorrect recommendation. Liability may potentially involve the manufacturer, software developer, supplier, operator, or user, depending on the circumstances. Courts must also consider the difficult boundary between legitimate regulation of harmful design and imposing liability for ordinary risks associated with using digital services.<\/p>\n\n\n\n<h2 id=\"h-medical-malpractice-and-emerging-technologies\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Medical_Malpractice_and_Emerging_Technologies\"><\/span>Medical Malpractice and Emerging Technologies<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Medical negligence has entered a new technological era with the increasing use of telemedicine, robotic surgery, AI-assisted diagnosis, remote monitoring, and automated clinical decision-support systems.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">When an AI-assisted diagnosis is wrong or a robotic system causes injury, several questions may arise:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Was the healthcare professional negligent in relying on the technology?<\/li>\n\n\n\n<li>Was the technology itself defective?<\/li>\n\n\n\n<li>Were adequate warnings or instructions provided?<\/li>\n\n\n\n<li>Did the healthcare provider properly supervise the system?<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The traditional standard of reasonable professional care must therefore be applied to circumstances in which technology increasingly forms part of medical decision-making.<\/p>\n\n\n\n<h2 id=\"h-cyber-torts-and-digital-harm\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Cyber_Torts_and_Digital_Harm\"><\/span>Cyber Torts and Digital Harm<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The digital environment has also created new forms of civil wrongdoing, including unauthorised access to computer systems, cyberstalking, online harassment, identity-related harms, interference with digital assets, and intentional or negligent transmission of malicious software.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Although some conduct is specifically regulated by criminal and cyber laws, tort law may provide additional civil remedies where a person suffers recognised harm. The challenge lies in identifying the appropriate traditional tort\u2014such as negligence, trespass, privacy violation, or intentional interference\u2014or developing legal principles capable of addressing genuinely new forms of digital injury.<\/p>\n\n\n\n<h2 id=\"h-autonomous-systems-and-allocation-of-responsibility\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Autonomous_Systems_and_Allocation_of_Responsibility\"><\/span>Autonomous Systems and Allocation of Responsibility<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">As machines become increasingly capable of acting without immediate human intervention, the traditional concept of human fault becomes more difficult to apply. Autonomous vehicles, drones, industrial robots, and AI agents may make decisions based on data and algorithms rather than direct human instructions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A central question is therefore: Who should bear the loss when an autonomous system causes harm? What has changed is the nature, scale, and complexity of the risks.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Technology often develops much faster than legislation and judicial doctrine. Consequently, courts are increasingly required to apply established principles to unfamiliar circumstances while maintaining a balance between individual protection, corporate responsibility, technological innovation, and public interest.<\/p>\n\n\n\n<h2 id=\"h-conclusion\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Modern tort law is no longer confined to traditional injuries such as road accidents, defective products, or physical trespass. It increasingly encompasses digital defamation, privacy and data misuse, artificial intelligence, autonomous technology, cyber harms, climate-related damage, social-media risks, and technology-driven medical negligence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The central challenge for modern tort law is to ensure that technological progress does not create a legal vacuum in which serious harm goes without an effective remedy. At the same time, liability must be developed carefully so that legitimate innovation is not unnecessarily discouraged.
