Perhaps you are also paying rent. The money invested in the flat remains blocked, while the property you were supposed to receive years ago is still incomplete.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For a homebuyer, this is not merely a contractual inconvenience.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It can be a serious financial and legal crisis.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The important question is therefore not simply:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">&#8220;Can I file a case against the builder?&#8221;<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">The real question is:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">&#8220;What is the most effective remedy in my circumstances \u2014 possession, refund with interest, compensation, RERA proceedings, a Consumer Commission complaint, or action within an insolvency process?&#8221;<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court&#8217;s recent judgment in <em>Parsvnath Developers Ltd. v. Mohit Khirbat &amp; Ors.<\/em>, 2026 INSC 170, decided on 20 February 2026, is particularly important for homebuyers dealing with delayed possession. The Court upheld consumer-forum relief against the developer and directed possession after obtaining the requisite Occupancy Certificate, while affirming compensation by way of interest at 8% per annum in the relevant cases.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But <em>Parsvnath<\/em> must be understood correctly.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is not a judgment saying that every delayed homebuyer automatically gets a refund.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is not a judgment saying that every buyer automatically gets 18% interest.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And it is not a judgment that makes RERA and Consumer Commissions interchangeable.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The law is more nuanced.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For a homebuyer with substantial money at stake, that nuance matters.<\/p>\n\n\n\n<h2 id=\"h-1-the-supreme-court-s-latest-message-in-parsvnath-developers\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"1_The_Supreme_Courts_Latest_Message_in_Parsvnath_Developers\"><\/span>1. The Supreme Court&#8217;s Latest Message in Parsvnath Developers<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The dispute in <em>Parsvnath Developers Ltd. v. Mohit Khirbat<\/em> arose from delayed delivery of flats.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The National Consumer Disputes Redressal Commission had granted relief to the buyers, including compensation calculated by way of interest.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The developer challenged the orders before the Supreme Court.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court dismissed the appeals.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Importantly, the Court did not treat the builder&#8217;s contractual compensation mechanism as an automatic ceiling on the buyer&#8217;s statutory consumer remedy.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For the relevant appeals, the Court directed the developer to obtain the requisite Occupancy Certificate and hand over possession within six months, while continuing the compensation determined by the NCDRC until then. In the connected matter, the Court affirmed entitlement to compensation by way of interest at 8% per annum for the specified period.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This has a practical message for homebuyers:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A developer cannot necessarily escape meaningful statutory compensation merely by pointing to a restrictive delay clause in its own agreement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But the exact relief depends upon the facts and the remedy being pursued.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That distinction is essential.<\/p>\n\n\n\n<h2 id=\"h-2-delayed-possession-can-amount-to-deficiency-in-service\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"2_Delayed_Possession_Can_Amount_to_Deficiency_in_Service\"><\/span>2. Delayed Possession Can Amount to Deficiency in Service<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The legal principle did not begin with <em>Parsvnath<\/em>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court has been dealing with delayed housing projects for decades.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In <em>Lucknow Development Authority v. M.K. Gupta<\/em>, (1994) 1 SCC 243, the Supreme Court recognised the consumer-law implications of housing construction and the availability of compensation for loss and injury caused by deficient service.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The principle subsequently became particularly important in private builder disputes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In <em>Pioneer Urban Land &amp; Infrastructure Ltd. v. Govindan Raghavan<\/em>, (2019) 5 SCC 725, the Supreme Court considered an agreement containing one-sided terms and dealt with the consequences of substantial delay in handing over possession.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court&#8217;s jurisprudence makes an important point:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A homebuyer cannot ordinarily be required to remain indefinitely bound to a project when the developer has committed an unreasonable delay.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That principle is particularly relevant where the buyer no longer wants to remain financially tied to the project.<\/p>\n\n\n\n<h2 id=\"h-3-but-delayed-possession-does-not-automatically-mean-refund\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"3_But_Delayed_Possession_Does_Not_Automatically_Mean_Refund\"><\/span>3. But Delayed Possession Does Not Automatically Mean Refund<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This is where many articles on builder disputes oversimplify the law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A delay may give rise to several possible remedies.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The buyer may want:<\/p>\n\n\n\n<h3 id=\"h-option-1-possession\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Option_1_%E2%80%94_Possession\"><\/span>Option 1 \u2014 Possession<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The buyer may still want the flat.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This can be a rational decision where:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the project is substantially complete;<\/li>\n\n\n\n<li>the location remains attractive;<\/li>\n\n\n\n<li>the property has appreciated substantially;<\/li>\n\n\n\n<li>the buyer needs the home;<\/li>\n\n\n\n<li>the developer is financially capable of completing the project; and<\/li>\n\n\n\n<li>possession can realistically be obtained.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">In such a case, the buyer may seek possession together with appropriate compensation for delay.<\/p>\n\n\n\n<h3 id=\"h-option-2-refund\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Option_2_%E2%80%94_Refund\"><\/span>Option 2 \u2014 Refund<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The buyer may have lost confidence in the developer.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The project may be years behind schedule.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Construction may have virtually stopped.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The developer may be financially distressed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The buyer may no longer want to remain locked into the project.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In such circumstances, refund with appropriate interest and compensation may become the more appropriate remedy.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court has recognised this distinction in its earlier delayed-possession cases.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In <em>Kolkata West International City Pvt. Devasis Rudra<\/em>, the Supreme Court upheld refund in circumstances involving substantial delay and modified the interest to 9% per annum.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, the legal question is not simply:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">&#8220;Was there a delay?&#8221;<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">It is:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">&#8220;What remedy is appropriate in light of the nature and extent of the delay and what the buyer actually wants?&#8221;<\/p>\n<\/blockquote>\n\n\n\n<h2 id=\"h-4-section-18-of-rera-is-extremely-important\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"4_Section_18_of_RERA_Is_Extremely_Important\"><\/span>4. Section 18 of RERA Is Extremely Important<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">For a delayed homebuyer, Section 18 of the Real Estate (Regulation and Development) Act, 2016 is one of the most important statutory provisions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The basic structure is straightforward.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Where the promoter fails to complete or is unable to give possession in accordance with the agreement for sale by the specified date, Section 18 provides an important choice.<\/p>\n\n\n\n<h3 id=\"h-if-the-allottee-wants-to-withdraw\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"If_the_Allottee_Wants_to_Withdraw\"><\/span>If the Allottee Wants to Withdraw<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The allottee can demand return of the amount received by the promoter, with interest at the prescribed rate and compensation in the manner provided by the Act.<\/p>\n\n\n\n<h3 id=\"h-if-the-allottee-does-not-want-to-withdraw\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"If_the_Allottee_Does_Not_Want_to_Withdraw\"><\/span>If the Allottee Does Not Want to Withdraw<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The allottee is entitled to interest for every month of delay until possession is handed over, at the prescribed rate.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The statutory language therefore creates an important distinction between:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>withdrawal from the project; and<\/li>\n\n\n\n<li>continuing with the project while receiving delay interest.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">This is why a lawyer should not simply advise every delayed buyer:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">&#8220;File for refund.&#8221;<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">The first question should be:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Does the buyer actually want to exit the project?<\/p>\n\n\n\n<h2 id=\"h-5-is-rera-interest-automatically-9\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"5_Is_RERA_Interest_Automatically_9\"><\/span>5. Is RERA Interest Automatically 9%?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">No.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is a common misconception.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Section 18 refers to the rate prescribed under the applicable legal framework.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The applicable rate therefore needs to be examined with reference to the relevant State rules and the statutory provisions, rather than assuming a universal 9% rate.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This distinction becomes even more important when the claim is made before a Consumer Commission.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Consumer jurisprudence has developed its own approach to reasonable interest and compensation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">RERA interest and consumer-forum compensation should not be treated as though they are governed by one universal mathematical formula.<\/p>\n\n\n\n<h2 id=\"h-6-what-does-the-supreme-court-say-about-18-interest\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"6_What_Does_the_Supreme_Court_Say_About_18_Interest\"><\/span>6. What Does the Supreme Court Say About 18% Interest?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The answer is important because exaggerated claims about &#8220;18% Supreme Court interest&#8221; are increasingly appearing online.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In <em>Rajnesh Sharma v. M\/s Business Park Town Planners Ltd.<\/em>, 2025 INSC 1149, decided on 24 September 2025, the Supreme Court increased the interest awarded to the buyer to 18% in the circumstances of that particular case.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But the Court did not create a general rule that delayed homebuyers are entitled to 18%.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The circumstances of that case mattered, including the developer&#8217;s own contractual treatment of interest and the prolonged delay.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, a responsible lawyer should never tell every homebuyer:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">&#8220;The Supreme Court has fixed 18% interest.&#8221;<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">That would be legally misleading.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The correct proposition is:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court may award a higher rate where the facts justify it, but the rate remains fact-sensitive and 18% is not an automatic tariff for every delayed-possession dispute.<\/p>\n\n\n\n<h2 id=\"h-7-can-the-builder-say-my-agreement-only-provides-5-per-square-foot\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"7_Can_the_Builder_Say_%E2%80%9CMy_Agreement_Only_Provides_%E2%82%B95_Per_Square_Foot%E2%80%9D\"><\/span>7. Can the Builder Say: &#8220;My Agreement Only Provides \u20b95 Per Square Foot&#8221;?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This is where <em>Parsvnath Developers<\/em> becomes particularly useful.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Builder agreements frequently contain clauses under which the developer agrees to pay a relatively small amount for delay.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For example, a buyer may have paid \u20b91 crore or \u20b92 crore, but the agreement may provide only a nominal amount per square foot per month as delay compensation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The developer may then argue:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">&#8220;You signed the agreement. Therefore, you are limited to the contractual amount.&#8221;<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">That argument does not necessarily end the matter.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In <em>Parsvnath Developers<\/em>, the Supreme Court upheld the consumer-forum approach to compensation despite the developer&#8217;s reliance upon its contractual arrangement. The NCDRC&#8217;s compensation by way of 8% interest was sustained, and the Court directed lawful possession after obtaining the Occupancy Certificate.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is an important protection for consumers.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But it should not be overstated.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The judgment does not mean that every contractual clause in every builder agreement is automatically void.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The precise question is whether the contractual provision is inconsistent with the statutory consumer protection framework and whether the compensation awarded by the forum is justified on the facts.<\/p>\n\n\n\n<h2 id=\"h-8-can-the-builder-force-you-to-wait-forever\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"8_Can_the_Builder_Force_You_to_Wait_Forever\"><\/span>8. Can the Builder Force You to Wait Forever?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">No.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This principle comes particularly from the Supreme Court&#8217;s earlier delayed-possession jurisprudence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In <em>Pioneer Urban v. Govindan Raghavan<\/em>, the Supreme Court dealt with substantial delay and one-sided contractual provisions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court recognised that a buyer cannot reasonably be expected to wait indefinitely for possession.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Similarly, in <em>Kolkata West International City v. Devasis Rudra<\/em>, the Supreme Court upheld refund where the circumstances justified such relief.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The law therefore recognises an important distinction:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>A reasonable construction delay is one thing.<\/li>\n\n\n\n<li>An indefinite and unreasonable delay is another.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The longer the delay becomes, the stronger the argument may become for the buyer to reconsider whether continuing with the project is commercially and legally sensible.<\/p>\n\n\n\n<h2 id=\"h-9-what-if-the-builder-finally-offers-possession\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"9_What_If_the_Builder_Finally_Offers_Possession\"><\/span>9. What If the Builder Finally Offers Possession?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This is a situation I frequently regard as requiring careful legal analysis.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Suppose the promised possession date was five years ago.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The buyer files proceedings.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The builder then sends a letter:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">&#8220;Your flat is ready. Please take possession.&#8221;<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">The developer may argue that the dispute has now disappeared.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is not necessarily correct.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Several questions must be examined:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Is the flat genuinely complete?<\/li>\n\n\n\n<li>Has the Occupancy Certificate been obtained?<\/li>\n\n\n\n<li>Are statutory approvals in place?<\/li>\n\n\n\n<li>Is the possession offer legally valid?<\/li>\n\n\n\n<li>Has the buyer already exercised a legally recognised right to seek refund?<\/li>\n\n\n\n<li>Was the delay so substantial that the buyer was entitled to terminate?<\/li>\n\n\n\n<li>Does the buyer still want the property?<\/li>\n\n\n\n<li>What does the applicable statute provide?<\/li>\n\n\n\n<li>What proceedings have already been initiated?<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court&#8217;s <em>Parsvnath<\/em> judgment is particularly instructive because the Court itself directed the developer to obtain the requisite Occupancy Certificate before handing over possession in the relevant cases.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This reinforces a basic proposition:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">A builder&#8217;s letter saying &#8220;possession is ready&#8221; is not necessarily equivalent to lawful possession.<\/p>\n<\/blockquote>\n\n\n\n<h2 id=\"h-10-rera-or-consumer-forum-which-one-should-you-choose\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"10_RERA_or_Consumer_Forum_%E2%80%94_Which_One_Should_You_Choose\"><\/span>10. RERA or Consumer Forum \u2014 Which One Should You Choose?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This is perhaps the most important practical question.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And there is no responsible answer that says:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">&#8220;Always choose RERA.&#8221;<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">Nor is it correct to say:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">&#8220;Always file before the Consumer Commission.&#8221;<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">The choice depends on the facts and the relief required.<\/p>\n\n\n\n<h2 id=\"h-11-when-rera-may-be-the-more-appropriate-route\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"11_When_RERA_May_Be_the_More_Appropriate_Route\"><\/span>11. When RERA May Be the More Appropriate Route<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">RERA may be particularly useful where the buyer wants regulatory and project-related relief.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For example:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Enforcement of promoter obligations;<\/li>\n\n\n\n<li>Possession;<\/li>\n\n\n\n<li>Interest under Section 18;<\/li>\n\n\n\n<li>Refund;<\/li>\n\n\n\n<li>Statutory compliance;<\/li>\n\n\n\n<li>Project-related information;<\/li>\n\n\n\n<li>Defects and deficiencies;<\/li>\n\n\n\n<li>Promoter violations;<\/li>\n\n\n\n<li>Registration-related issues; and<\/li>\n\n\n\n<li>Other relief falling within the RERA framework.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">RERA was created specifically to regulate the real-estate sector and protect the interests of allottees.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For a project that is still active and capable of completion, RERA can therefore be an important strategic forum.<\/p>\n\n\n\n<h2 id=\"h-12-when-a-consumer-commission-may-be-more-appropriate\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"12_When_a_Consumer_Commission_May_Be_More_Appropriate\"><\/span>12. When a Consumer Commission May Be More Appropriate<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Consumer law can be particularly important where the dispute involves:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Deficiency in service;<\/li>\n\n\n\n<li>Unfair contractual terms;<\/li>\n\n\n\n<li>Prolonged delay;<\/li>\n\n\n\n<li>Refund;<\/li>\n\n\n\n<li>Compensation;<\/li>\n\n\n\n<li>Interest;<\/li>\n\n\n\n<li>Litigation expenses; and<\/li>\n\n\n\n<li>Consequential loss that can be established on the evidence.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court has repeatedly recognised the consumer jurisdiction of commissions in builder-buyer disputes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In <em>Imperia Structures Ltd. v. Anil Patni<\/em>, 2020 INSC 625, the Supreme Court held that RERA did not eliminate the jurisdiction of consumer fora. The remedies under the two statutes could coexist.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That remains a critical point.<\/p>\n\n\n\n<h2 id=\"h-13-rera-did-not-automatically-destroy-consumer-jurisdiction\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"13_RERA_Did_Not_Automatically_Destroy_Consumer_Jurisdiction\"><\/span>13. RERA Did Not Automatically Destroy Consumer Jurisdiction<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This is one of the most important legal developments for homebuyers.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">After RERA came into force, many developers argued that consumer complaints were no longer maintainable because RERA had created a specialised mechanism.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court rejected that broad proposition in <em>Imperia Structures<\/em>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The existence of RERA did not, by itself, bar a consumer complaint.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, a buyer should not be told:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">&#8220;Since RERA exists, you have no right to approach the Consumer Commission.&#8221;<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">That is incorrect.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But there is an equally important qualification.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Concurrent remedies do not mean that a buyer should mechanically file every possible proceeding simultaneously.<\/p>\n\n\n\n<h2 id=\"h-14-can-you-file-both-rera-and-consumer-cases\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"14_Can_You_File_Both_RERA_and_Consumer_Cases\"><\/span>14. Can You File Both RERA and Consumer Cases?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This requires strategic caution.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The fact that two statutes provide remedies does not mean that filing parallel proceedings for identical relief is always a good idea.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Questions may arise concerning:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Election of remedies;<\/li>\n\n\n\n<li>Parallel proceedings;<\/li>\n\n\n\n<li>Abuse of process;<\/li>\n\n\n\n<li>Inconsistent findings;<\/li>\n\n\n\n<li>Issue estoppel;<\/li>\n\n\n\n<li>Limitation;<\/li>\n\n\n\n<li>Execution;<\/li>\n\n\n\n<li>Withdrawal of proceedings; and<\/li>\n\n\n\n<li>Conflicting orders.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, before filing a second proceeding, the lawyer should examine what has already been filed and what relief has been claimed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A well-planned case is often more valuable than two poorly coordinated cases.<\/p>\n\n\n\n<h2 id=\"h-15-refund-interest-and-compensation-are-not-three-automatic-cheques\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"15_Refund_Interest_and_Compensation_Are_Not_Three_Automatic_Cheques\"><\/span>15. Refund, Interest and Compensation Are Not Three Automatic Cheques<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Another common misconception needs to be addressed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A buyer may say:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">&#8220;I want my entire money back, 18% interest, rent, mental agony, compensation and damages.&#8221;<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">The lawyer&#8217;s job is not simply to copy all those words into the prayer clause.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Each head of relief needs a legal and factual foundation.<\/p>\n\n\n\n<h3 id=\"h-refund\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Refund\"><\/span>Refund<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Depends upon the applicable statute, facts and election to withdraw.<\/p>\n\n\n\n<h3 id=\"h-interest\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Interest\"><\/span>Interest<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Depends upon the statutory or judicial framework and the facts.<\/p>\n\n\n\n<h3 id=\"h-compensation\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Compensation\"><\/span>Compensation<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">May be awarded where the legal framework permits it and the facts establish the relevant loss or injury.<\/p>\n\n\n\n<h3 id=\"h-rent\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Rent\"><\/span>Rent<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Should be supported by evidence where claimed as consequential financial loss.<\/p>\n\n\n\n<h3 id=\"h-mental-agony\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Mental_Agony\"><\/span>Mental Agony<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">May be recognised under consumer jurisprudence, but it is not an automatic fixed amount in every builder dispute.<\/p>\n\n\n\n<h3 id=\"h-litigation-costs\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Litigation_Costs\"><\/span>Litigation Costs<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">May also be awarded, but the amount is discretionary.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The legal strategy should therefore be to establish the actual consequences of the developer&#8217;s default rather than simply demand every possible remedy without evidence.<\/p>\n\n\n\n<h2 id=\"h-16-why-parsvnath-matters-so-much-to-homebuyers\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"16_Why_Parsvnath_Matters_So_Much_to_Homebuyers\"><\/span>16. Why Parsvnath Matters So Much to Homebuyers<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The significance of Parsvnath is practical.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It shows that a developer cannot necessarily use the contract as a shield against statutory consumer protection.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court affirmed NCDRC relief that included compensation by way of interest and required lawful possession with an Occupancy Certificate in the relevant cases.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For a buyer, this means the legal analysis should not stop at:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">&#8220;What does the builder agreement say?&#8221;<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">The lawyer should also ask:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">&#8220;What does consumer law permit the forum to award?&#8221;<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">That is a very different approach.<\/p>\n\n\n\n<h2 id=\"h-17-what-if-the-builder-has-become-insolvent\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"17_What_If_the_Builder_Has_Become_Insolvent\"><\/span>17. What If the Builder Has Become Insolvent?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This is where the case changes dramatically.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Suppose you have a \u20b92 crore claim against a developer.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">You obtain a favourable RERA or Consumer Commission order.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Then you discover that the developer has entered the Corporate Insolvency Resolution Process (CIRP).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Your position is no longer the same as that of an ordinary decree-holder dealing with a solvent company.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Insolvency and Bankruptcy Code, 2016 becomes critically important.<\/p>\n\n\n\n<h2 id=\"h-18-homebuyers-are-financial-creditors-under-the-ibc\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"18_Homebuyers_Are_Financial_Creditors_Under_the_IBC\"><\/span>18. Homebuyers Are Financial Creditors Under the IBC<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court in Pioneer Urban Land &amp; Infrastructure Ltd. v. Union of India, (2019) 8 SCC 416, upheld the statutory treatment of amounts raised from real-estate allottees as financial debt.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This was a major development.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A genuine homebuyer can therefore fall within the category of financial creditors for the purposes of the IBC framework.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But there is a very important distinction:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Being a financial creditor does not mean that the IBC is simply another forum for obtaining an individual refund.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">IBC is fundamentally a collective insolvency-resolution mechanism.<\/p>\n\n\n\n<h2 id=\"h-19-can-one-homebuyer-start-cirp-against-the-builder\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"19_Can_One_Homebuyer_Start_CIRP_Against_the_Builder\"><\/span>19. Can One Homebuyer Start CIRP Against the Builder?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Ordinarily, not by filing alone.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The IBC contains a special threshold for real-estate allottees.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Section 7 application must, in the ordinary case, be filed jointly by:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>not less than 100 allottees of the same real-estate project<\/li>\n\n\n\n<li>or<\/li>\n\n\n\n<li>10% of the total number of allottees under that project,<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">whichever is less, subject to the statutory framework.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This was introduced to prevent an individual allottee from using insolvency proceedings as a pressure mechanism against a project without satisfying the legislative threshold.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But this does not mean that an individual homebuyer loses the right to participate in an already-admitted CIRP.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Once CIRP is properly underway, the homebuyer&#8217;s claim can be submitted within the insolvency process.<\/p>\n\n\n\n<h2 id=\"h-20-the-supreme-court-s-important-2025-judgment-mansi-brar-fernandes\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"20_The_Supreme_Courts_Important_2025_Judgment_Mansi_Brar_Fernandes\"><\/span>20. The Supreme Court&#8217;s Important 2025 Judgment: Mansi Brar Fernandes<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">In Mansi Brar Fernandes v. Shubha Sharma &amp; Anr., 2025 INSC 1110, the Supreme Court considered the difficult question of speculative investors in real-estate insolvency.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The case is important because the Court examined transactions involving features such as assured returns and buy-back arrangements.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court was concerned with whether persons who were essentially acting as speculative investors could invoke Section 7 of the IBC as though they were genuine homebuyers seeking possession.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court&#8217;s reasoning must be read carefully.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It does not mean:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">&#8220;A homebuyer cannot use IBC.&#8221;<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">Nor does it mean:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">&#8220;RERA has replaced IBC for all homebuyers.&#8221;<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">The point is narrower.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Where the transaction and surrounding circumstances demonstrate that the person was acting as a speculative investor rather than a genuine allottee seeking a home, that distinction can become relevant to initiation of insolvency proceedings.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The judgment therefore provides an important warning against treating IBC as a simple debt-recovery weapon.<\/p>\n\n\n\n<h2 id=\"h-21-genuine-homebuyer-vs-speculative-investor\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"21_Genuine_Homebuyer_vs_Speculative_Investor\"><\/span>21. Genuine Homebuyer vs Speculative Investor<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The distinction can become particularly important where the transaction contains unusual features.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For example:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>guaranteed buy-back;<\/li>\n\n\n\n<li>assured returns;<\/li>\n\n\n\n<li>extraordinary short-term returns;<\/li>\n\n\n\n<li>post-dated repayment arrangements;<\/li>\n\n\n\n<li>commercial investment structures;<\/li>\n\n\n\n<li>unusual contractual arrangements; or<\/li>\n\n\n\n<li>evidence that possession was never genuinely intended.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">A genuine family buying a home to live in is obviously a different factual situation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court&#8217;s analysis in Mansi Brar Fernandes should therefore not be used to frighten genuine homebuyers away from their lawful remedies.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Instead, it should be understood as a warning:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The legal character of the transaction matters.<\/p>\n\n\n\n<h2 id=\"h-22-what-happens-when-cirp-is-admitted\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"22_What_Happens_When_CIRP_Is_Admitted\"><\/span>22. What Happens When CIRP Is Admitted?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This is an area where homebuyers need to be particularly careful.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Once CIRP is admitted, the statutory moratorium under Section 14 of the IBC becomes relevant.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Generally, institution or continuation of proceedings against the corporate debtor and execution of monetary judgments and decrees are affected by the moratorium.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, a homebuyer who has already obtained a RERA or Consumer Commission order for payment should not assume:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">&#8220;I have won, so I can immediately recover the money.&#8221;<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">The insolvency process may now govern the monetary claim.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The buyer may need to submit the claim to the Resolution Professional in accordance with the applicable insolvency framework.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The amount ultimately recovered may depend upon the resolution process and the approved resolution plan.<\/p>\n\n\n\n<h2 id=\"h-23-does-a-rera-order-become-worthless-after-insolvency\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"23_Does_a_RERA_Order_Become_Worthless_After_Insolvency\"><\/span>23. Does a RERA Order Become Worthless After Insolvency?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">No.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But its practical effect changes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A final RERA order establishing the buyer&#8217;s entitlement may be an important document supporting the buyer&#8217;s claim.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The same applies to an order of a Consumer Commission.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But the buyer cannot ordinarily use the order to bypass the collective insolvency process once the IBC moratorium and resolution framework apply.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is why a buyer facing a financially distressed builder needs an integrated RERA\u2013consumer\u2013IBC strategy, rather than treating each statute as an isolated remedy.<\/p>\n\n\n\n<h2 id=\"h-24-what-is-project-wise-insolvency\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"24_What_Is_Project-Wise_Insolvency\"><\/span>24. What Is Project-Wise Insolvency?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Real-estate insolvency presents a special problem.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Imagine a developer owns ten projects.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Project A is 90% complete.<\/li>\n\n\n\n<li>Project B is stalled.<\/li>\n\n\n\n<li>Project C is almost complete.<\/li>\n\n\n\n<li>Project D has serious land problems.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">If the entire corporate entity collapses into liquidation, thousands of homebuyers in otherwise viable projects could suffer unnecessarily.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court has therefore dealt with project-specific approaches in real-estate insolvency.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The judicial approach is aimed at protecting viable projects and genuine homebuyers rather than automatically treating the entire developer&#8217;s business as one indivisible asset.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But this area must be described carefully.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Project-wise resolution is an important and developing legal approach; it should not be presented as though the IBC contains a simple universal statutory rule that every builder&#8217;s insolvency must be conducted project by project.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The precise legal position depends upon the statute as amended, the project, the insolvency proceedings and the orders of the adjudicating authorities.<\/p>\n\n\n\n<h2 id=\"h-25-what-should-a-homebuyer-do-if-the-builder-is-insolvent\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"25_What_Should_a_Homebuyer_Do_If_the_Builder_Is_Insolvent\"><\/span>25. What Should a Homebuyer Do If the Builder Is Insolvent?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">If there are signs that your builder is in financial trouble, do not wait until the project collapses completely.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Immediately investigate:<\/p>\n\n\n\n<h3 id=\"h-first-is-cirp-already-admitted\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"First_%E2%80%94_Is_CIRP_Already_Admitted\"><\/span>First \u2014 Is CIRP Already Admitted?<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Check the NCLT\/NCLAT record and the developer&#8217;s insolvency status.<\/p>\n\n\n\n<h3 id=\"h-second-who-is-the-resolution-professional\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Second_%E2%80%94_Who_Is_the_Resolution_Professional\"><\/span>Second \u2014 Who Is the Resolution Professional?<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">If CIRP has commenced, identify the Resolution Professional and the claim process.<\/p>\n\n\n\n<h3 id=\"h-third-has-a-claim-form-been-filed\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Third_%E2%80%94_Has_a_Claim_Form_Been_Filed\"><\/span>Third \u2014 Has a Claim Form Been Filed?<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Make sure the claim is properly submitted and supported.<\/p>\n\n\n\n<h3 id=\"h-fourth-is-there-an-authorised-representative-for-homebuyers\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Fourth_%E2%80%94_Is_There_an_Authorised_Representative_for_Homebuyers\"><\/span>Fourth \u2014 Is There an Authorised Representative for Homebuyers?<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Understand how the homebuyer class is represented in the Committee of Creditors.<\/p>\n\n\n\n<h3 id=\"h-fifth-what-is-happening-to-the-project\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Fifth_%E2%80%94_What_Is_Happening_to_the_Project\"><\/span>Fifth \u2014 What Is Happening to the Project?<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Do not look only at the corporate balance sheet.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The actual condition of the particular project matters enormously.<\/p>\n\n\n\n<h3 id=\"h-sixth-is-there-a-resolution-plan\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Sixth_%E2%80%94_Is_There_a_Resolution_Plan\"><\/span>Sixth \u2014 Is There a Resolution Plan?<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Read what the plan proposes for:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>possession;<\/li>\n\n\n\n<li>refund;<\/li>\n\n\n\n<li>delayed interest;<\/li>\n\n\n\n<li>construction;<\/li>\n\n\n\n<li>common areas;<\/li>\n\n\n\n<li>approvals;<\/li>\n\n\n\n<li>timelines; and<\/li>\n\n\n\n<li>homebuyer claims.<\/li>\n<\/ul>\n\n\n\n<h2 id=\"h-26-what-documents-should-you-keep\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"26_What_Documents_Should_You_Keep\"><\/span>26. What Documents Should You Keep?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">If your flat is delayed, preserve every important document.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">At minimum, maintain:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>booking form;<\/li>\n\n\n\n<li>allotment letter;<\/li>\n\n\n\n<li>Agreement for Sale\/Builder Buyer Agreement;<\/li>\n\n\n\n<li>payment receipts;<\/li>\n\n\n\n<li>bank statements;<\/li>\n\n\n\n<li>home-loan documents;<\/li>\n\n\n\n<li>EMI statements;<\/li>\n\n\n\n<li>builder demand letters;<\/li>\n\n\n\n<li>possession letters;<\/li>\n\n\n\n<li>emails;<\/li>\n\n\n\n<li>WhatsApp communications;<\/li>\n\n\n\n<li>brochures;<\/li>\n\n\n\n<li>advertisements;<\/li>\n\n\n\n<li>promised possession dates;<\/li>\n\n\n\n<li>construction photographs;<\/li>\n\n\n\n<li>RERA registration details;<\/li>\n\n\n\n<li>RERA orders;<\/li>\n\n\n\n<li>Consumer Commission orders;<\/li>\n\n\n\n<li>legal notices;<\/li>\n\n\n\n<li>Occupancy Certificate;<\/li>\n\n\n\n<li>Completion Certificate;<\/li>\n\n\n\n<li>rent receipts;<\/li>\n\n\n\n<li>evidence of other financial losses; and<\/li>\n\n\n\n<li>insolvency notices, if any.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Do not delete old emails because you believe they are irrelevant.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A builder&#8217;s earlier promise that possession would be delivered by a particular date can become important evidence.<\/p>\n\n\n\n<h2 id=\"h-27-build-a-chronology-before-filing-the-case\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"27_Build_a_Chronology_Before_Filing_the_Case\"><\/span>27. What If You Have Paid \u20b91 Crore, \u20b92 Crore or More?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">High-value homebuyer disputes deserve a different level of preparation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If the financial exposure is \u20b91 crore or \u20b92 crore, an error in forum selection or relief strategy can itself have serious financial consequences.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Before filing, I would want to know:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>What exactly does the Agreement for Sale say?<\/li>\n\n\n\n<li>What was the promised possession date?<\/li>\n\n\n\n<li>What is the actual construction status?<\/li>\n\n\n\n<li>Is the project RERA registered?<\/li>\n\n\n\n<li>Has the promoter obtained an Occupancy Certificate?<\/li>\n\n\n\n<li>How much has been paid?<\/li>\n\n\n\n<li>How much is financed through a bank?<\/li>\n\n\n\n<li>Has the buyer paid rent simultaneously?<\/li>\n\n\n\n<li>Has the buyer already issued a notice?<\/li>\n\n\n\n<li>Has any RERA or consumer proceeding already been filed?<\/li>\n\n\n\n<li>Is the builder financially distressed?<\/li>\n\n\n\n<li>Has CIRP commenced?<\/li>\n\n\n\n<li>What does the buyer actually want \u2014 possession or exit?<\/li>\n\n\n\n<li>What evidence exists for consequential loss?<\/li>\n\n\n\n<li>Is there any settlement or possession offer already made?<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Only after answering those questions can one sensibly decide the litigation route.<\/p>\n\n\n\n<h2 id=\"h-30-the-real-question-is-not-rera-or-consumer-court\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"30_The_Real_Question_Is_Not_%E2%80%9CRERA_or_Consumer_Court%E2%80%9D\"><\/span>30.
