Someone says, \u201cThe police can arrest him tonight.\u201d Another person advises, \u201cGo straight to the Supreme Court.\u201d Someone else says, \u201cSurrender and take regular bail.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In my experience, this is precisely the moment when a family should stop reacting emotionally and start acting strategically.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A High Court&#8217;s refusal of anticipatory bail is certainly serious. But it does not necessarily mean that every legal remedy has ended.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Depending upon the facts of the case, the accused may still approach the Supreme Court and seek appropriate relief, including interim protection from arrest. The Court does not grant anticipatory bail merely because an accused says that the FIR is false.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court has to balance two important considerations:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The individual&#8217;s personal liberty.<\/li>\n\n\n\n<li>The investigating agency&#8217;s need to conduct a fair investigation.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">That balance remains central to anticipatory bail jurisprudence even after the introduction of the BNSS.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There is also an important statutory limitation. The family should not spend the next several days debating whether to approach the Supreme Court.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The immediate questions should be:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>What exactly did the High Court say?<\/li>\n\n\n\n<li>Why was anticipatory bail refused?<\/li>\n\n\n\n<li>What offences are involved?<\/li>\n\n\n\n<li>Has the accused joined the investigation?<\/li>\n\n\n\n<li>Is custodial interrogation genuinely required?<\/li>\n\n\n\n<li>Has the charge-sheet been filed?<\/li>\n\n\n\n<li>Has cognizance been taken?<\/li>\n\n\n\n<li>Are any warrants pending?<\/li>\n\n\n\n<li>Has any proclamation proceeding been initiated?<\/li>\n\n\n\n<li>What material does the prosecution have against the accused?<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court petition should not merely repeat:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cThe FIR is false and the accused is innocent.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">It should explain why the High Court&#8217;s reasons require reconsideration.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is a much stronger approach.<\/p>\n\n\n\n<h2 id=\"h-can-the-supreme-court-give-interim-protection-from-arrest\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Can_the_Supreme_Court_Give_Interim_Protection_From_Arrest\"><\/span>Can the Supreme Court Give Interim Protection From Arrest?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Yes, where the circumstances justify it.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This can be extremely important after a High Court rejection.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court may, in an appropriate case, grant interim protection while the matter is being considered.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Such protection may be expressed through words such as:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cNo coercive steps shall be taken.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">But families must understand what this means.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is temporary judicial protection according to the terms of the order.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>It is not an acquittal.<\/li>\n\n\n\n<li>It does not mean that the FIR has disappeared.<\/li>\n\n\n\n<li>It does not necessarily mean that the investigation has been stayed.<\/li>\n\n\n\n<li>And it certainly does not mean that the accused can stop cooperating with the investigating agency.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">If the Supreme Court says that the accused must join investigation, he must join investigation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If the Court imposes a travel restriction, that restriction must be followed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If the Court directs cooperation, the accused cannot use the interim order as an excuse to obstruct the investigation.<\/p>\n\n\n\n<h2 id=\"h-one-important-example-gourav-pathak-v-state-of-u-p\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"One_Important_Example_Gourav_Pathak_v_State_of_UP\"><\/span>One Important Example: Gourav Pathak v. But the precise role attributed to each accused may be different.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The defence should therefore identify:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">What exactly does the prosecution say this particular accused did?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A person who is alleged to have personally committed the offence may stand differently from someone whose involvement is alleged only through association or a particular transaction.<\/p>\n\n\n\n<h3 id=\"h-3-is-custodial-interrogation-really-necessary\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"3_Is_Custodial_Interrogation_Really_Necessary\"><\/span>3. Has the Accused Cooperated With the Investigation?<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">A person who has repeatedly appeared before the Investigating Officer, answered questions and supplied documents is in a materially different position from someone who has avoided investigation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If the accused has cooperated, documentary proof should be preserved.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Police notices, attendance records, replies and communications may become important.<\/p>\n\n\n\n<h3 id=\"h-5-criminal-antecedents\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"5_Criminal_Antecedents\"><\/span>5. Criminal Antecedents<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The Court will generally want to know whether the accused has previous criminal cases.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A person with no criminal antecedents may rely upon that circumstance.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But a clean record is not a guarantee of anticipatory bail.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Likewise, the existence of previous cases does not automatically mean that bail must be refused.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The nature and status of those cases matter.<\/p>\n\n\n\n<h3 id=\"h-6-possibility-of-absconding\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"6_Possibility_of_Absconding\"><\/span>6. Possibility of Tampering With Evidence<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The Court may also consider whether the accused could:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>destroy evidence;<\/li>\n\n\n\n<li>influence witnesses;<\/li>\n\n\n\n<li>contact the complainant;<\/li>\n\n\n\n<li>manipulate documents;<\/li>\n\n\n\n<li>interfere with electronic evidence.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">This is one reason why an accused should never attempt to \u201csettle\u201d matters by threatening or pressuring the complainant after a bail rejection.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A single message can later become part of the prosecution&#8217;s case.<\/p>\n\n\n\n<h3 id=\"h-8-is-the-fir-actually-a-criminal-case-or-a-disguised-civil-dispute\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"8_Is_the_FIR_Actually_a_Criminal_Case_or_a_Disguised_Civil_Dispute\"><\/span>8. Is the FIR Actually a Criminal Case or a Disguised Civil Dispute?<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">This issue frequently arises in:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>property disputes;<\/li>\n\n\n\n<li>partnership disputes;<\/li>\n\n\n\n<li>commercial transactions;<\/li>\n\n\n\n<li>loan disputes;<\/li>\n\n\n\n<li>matrimonial conflicts;<\/li>\n\n\n\n<li>contractual disputes.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">A civil dispute does not automatically make the criminal case false.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But if the surrounding documents strongly suggest that criminal proceedings have been used purely as a pressure tactic, that factual background can become relevant to the bail decision.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The important word is evidence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A lawyer should not simply write \u201cthe FIR is malicious.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The petition should demonstrate why.<\/p>\n\n\n\n<h2 id=\"h-what-happens-if-the-charge-sheet-has-already-been-filed\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_Happens_If_the_Charge-Sheet_Has_Already_Been_Filed\"><\/span>What Happens If the Charge-Sheet Has Already Been Filed?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This is another area where incorrect advice is common.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Many families are told:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cThe charge-sheet has been filed, so anticipatory bail is impossible.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">That statement is too broad.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court has recognised in Bharat Chaudhary v. State of Bihar, (2003) 8 SCC 752, that the filing of a charge-sheet or taking of cognizance does not, by itself, automatically eliminate the possibility of anticipatory bail in an appropriate case.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The facts and procedural stage still matter.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There is, however, an important distinction.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If the accused has already been arrested, anticipatory bail is no longer the remedy.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The accused then has to consider regular bail.<\/p>\n\n\n\n<h2 id=\"h-what-if-warrants-have-been-issued\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_If_Warrants_Have_Been_Issued\"><\/span>What If Warrants Have Been Issued?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The situation becomes considerably more serious.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If a person has deliberately avoided the legal process and warrants have been issued, the defence must address that immediately.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is dangerous to continue behaving as though the case is simply an ordinary anticipatory-bail application.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court has repeatedly taken a strict view where an accused is deliberately absconding or has been declared a proclaimed offender.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In Lavesh v. State (NCT of Delhi), (2012) 8 SCC 730, the Supreme Court held that a person who is absconding and has been declared a proclaimed offender ordinarily cannot claim anticipatory bail as a matter of course.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court&#8217;s decision in Srikant Upadhyay v. State of Bihar, 2024 INSC 202, is also important. Merely filing an application for anticipatory bail does not automatically stop proclamation proceedings when there is no interim protection.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The message is simple:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Do not disappear after your anticipatory bail is rejected.<\/li>\n\n\n\n<li>Running away can make the next legal application substantially harder.<\/li>\n<\/ul>\n\n\n\n<h2 id=\"h-can-a-second-anticipatory-bail-application-be-filed\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Can_a_Second_Anticipatory_Bail_Application_Be_Filed\"><\/span>Can a Second Anticipatory Bail Application Be Filed?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Sometimes, yes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But filing the same application again is not a sensible strategy.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Suppose the High Court rejects anticipatory bail today.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Changing lawyers tomorrow and filing the identical application with exactly the same facts does not magically create a new case.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Courts generally expect a real change in circumstances before a successive bail application is entertained on substantially the same facts.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A later development may sometimes be significant.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For example:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>a material change in the investigation;<\/li>\n\n\n\n<li>new documentary evidence;<\/li>\n\n\n\n<li>a change in the accused&#8217;s alleged role;<\/li>\n\n\n\n<li>bail granted to a similarly placed co-accused;<\/li>\n\n\n\n<li>a significant change in the procedural position;<\/li>\n\n\n\n<li>new circumstances affecting custodial interrogation.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">But whether such a development is sufficient depends on the facts.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The principles concerning successive bail applications have been discussed by the Supreme Court in cases including Kalyan Chandra Sarkar v. Rajesh Ranjan and State of M.P. v. Kajad.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The important principle is judicial discipline:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>A second application should not become a disguised attempt to obtain a rehearing of the same application without any material change.<\/strong><\/p>\n\n\n\n<h2 id=\"h-should-you-go-to-the-supreme-court-or-surrender\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Should_You_Go_to_the_Supreme_Court_or_Surrender\"><\/span>Should You Go to the Supreme Court or Surrender?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This is perhaps the most difficult question families ask.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There is no universal answer.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Sometimes an urgent Supreme Court challenge is appropriate. In another case, surrender followed by regular bail may be the better legal strategy.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The decision should be based on:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The High Court&#8217;s reasoning;<\/li>\n\n\n\n<li>Seriousness of the offence;<\/li>\n\n\n\n<li>Investigation status;<\/li>\n\n\n\n<li>Possibility of custodial interrogation;<\/li>\n\n\n\n<li>Criminal antecedents;<\/li>\n\n\n\n<li>Cooperation with investigation;<\/li>\n\n\n\n<li>Existence of warrants;<\/li>\n\n\n\n<li>Charge-sheet status;<\/li>\n\n\n\n<li>Strength of the prosecution material;<\/li>\n\n\n\n<li>Possibility of obtaining interim protection.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">An experienced lawyer should examine these factors before recommending one course.<\/p>\n\n\n\n<h2 id=\"h-a-simple-example\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"A_Simple_Example\"><\/span>A Simple Example<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Suppose a businessman is accused of cheating.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The High Court refuses anticipatory bail saying:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cCustodial interrogation is required.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">But the prosecution already possesses:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The contracts;<\/li>\n\n\n\n<li>Bank statements;<\/li>\n\n\n\n<li>Emails;<\/li>\n\n\n\n<li>Invoices;<\/li>\n\n\n\n<li>Company records.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The accused has appeared before the Investigating Officer whenever called and has not attempted to contact the complainant.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That may provide material to argue before the Supreme Court that arrest and custody are unnecessary.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Now consider a different case.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Suppose the accused has:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Ignored repeated notices;<\/li>\n\n\n\n<li>Failed to appear;<\/li>\n\n\n\n<li>Transferred disputed money;<\/li>\n\n\n\n<li>Contacted witnesses;<\/li>\n\n\n\n<li>And has warrants pending.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The strategy will obviously be very different.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is why anticipatory bail cannot be reduced to a formula.<\/p>\n\n\n\n<h2 id=\"h-cybercrime-and-mule-account-cases\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Cybercrime_and_%E2%80%9CMule_Account%E2%80%9D_Cases\"><\/span>Cybercrime and \u201cMule Account\u201d Cases<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Cybercrime cases create another layer of difficulty.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A bank account may be alleged to have been used for receiving or transferring fraudulent money. The account holder may then be accused of facilitating the offence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But one must distinguish between:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Ownership of an account and knowledge of the criminal activity.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">They are not automatically the same thing.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The investigation may examine:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Who opened the account;<\/li>\n\n\n\n<li>Who operated it;<\/li>\n\n\n\n<li>Who had access to the mobile phone;<\/li>\n\n\n\n<li>Where transactions originated;<\/li>\n\n\n\n<li>Who withdrew the money;<\/li>\n\n\n\n<li>Where the money ultimately went;<\/li>\n\n\n\n<li>Whether the account holder received any benefit;<\/li>\n\n\n\n<li>Communications between the accused and other persons;<\/li>\n\n\n\n<li>Linked devices;<\/li>\n\n\n\n<li>KYC information;<\/li>\n\n\n\n<li>Transaction patterns.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, if an accused is facing a cybercrime FIR because a bank account is allegedly connected to fraudulent transactions, the defence should not simply say:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cThe account belongs to me, but I know nothing.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">The entire transaction history needs to be examined.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">At the same time, account ownership alone is not proof of conspiracy or fraud.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The prosecution still has to establish the relevant elements of the alleged offence.<\/p>\n\n\n\n<h2 id=\"h-the-five-most-common-mistakes-families-make\" class=\"wp-block-heading\"><span class=\"ez-toc-section\"
