Court decisions and expert writings help explain the rules.

The International Court of Justice (ICJ) settles disputes between countries that accept its jurisdiction. There is no world government, but the rules still create real legal duties.

Meaning of Municipal Law

Municipal Law is the body of law that applies inside one country. It regulates individuals, private organisations and public authorities.

Sources usually include the Constitution, laws passed by the legislature, court decisions, rules made by the government and accepted customs.

It is enforced by police, courts, administrative bodies and other state institutions. Breaking it can lead to fines, imprisonment, damages or other penalties.

In India, key sources are the Constitution, parliamentary and state laws, and court judgments.

Main Differences Between International Law and Municipal Law

The following table compares International Law and Municipal Law across their principal features, sources, institutions and enforcement mechanisms.

Basis

International Law

Municipal Law

Meaning

Rules between countries and other international subjects

Rules inside one country

Scope

Peace, security, diplomacy, trade, human rights, etc.

Crime, contracts, property, family, tax, administration

Territorial application

International relations (can also apply inside or outside countries)

Mainly inside the country’s territory

Principal subjects

States, international organisations, sometimes individuals

Individuals, companies and government bodies

Source of authority

Treaties, custom, general principles

Constitution and national law-making bodies

Basis of obligation

Treaties and customary rules

Constitution, statutes and court decisions

Consent

State consent important for many treaties and courts

Individual consent not needed; International rules can, in many cases, apply directly inside a country without needing a special new law from Parliament. Supporters of monism believe that law is essentially one and the same, whether it operates at the international or national level. However, even under monism, not every international rule automatically overrides every domestic law — the exact effect still depends on the country’s Constitution and the nature of the particular rule.

Dualistic Theory

This theory treats International Law and Municipal Law as two completely separate and independent systems. They have different sources, different subjects and different spheres of operation. Under a strict dualist approach, an international treaty does not become part of domestic law merely because a country has signed or ratified it. The treaty must first be transformed or incorporated into national law through legislation before domestic courts can enforce it. This theory is closely associated with the writings of scholars such as Heinrich Triepel and Dionisio Anzilotti.

Transformation and Delegation Theories

The Transformation Theory says that international rules must be deliberately changed or “transformed” into the form of domestic law (usually by an Act of Parliament) before they can be applied by national courts and authorities.

The Delegation Theory takes a slightly different view: International Law itself leaves it to each state to decide, through its own constitutional system, how international obligations will be given effect inside the country. In other words, the method of implementation is delegated to the national legal order.

Both these approaches help explain why the domestic application of International Law differs from one country to another.

Position of International Law in India

Article 51(c): Directs the State to foster respect for international law and treaty obligations. The Supreme Court held that giving away Indian territory under an international agreement is not a simple executive act. It required a constitutional amendment under Article 368 because the transfer affected the territory of India as defined in the Constitution. This case made it clear that international agreements involving important constitutional matters (like territory) must follow the proper domestic constitutional procedure.

Jolly George Varghese v. Bank of Cochin (1980)

The Court examined whether a person could be imprisoned for failing to pay a civil debt when he had no means to pay. Article 11 of the International Covenant on Civil and Political Rights (ICCPR) prohibits imprisonment merely for inability to fulfil a contractual obligation. The Supreme Court said that international human-rights rules can help interpret Indian law, but they cannot override clear provisions of domestic statutes. The Court used the ICCPR to give a more liberal and humane interpretation to the relevant Indian law, showing that international norms can influence domestic decisions when they are consistent with the Constitution and existing legislation.

Vishaka v. State of Rajasthan (1997)

In the absence of any specific Indian law on sexual harassment at the workplace, the Supreme Court relied on the Convention on the Elimination of All Forms of Discrimination against Women (CEDAW) and other international instruments. The Court laid down detailed guidelines (known as the Vishaka Guidelines) to protect women at work. It held that international conventions that are consistent with the fundamental rights in the Indian Constitution can be used to fill gaps in domestic law until Parliament enacts a proper statute. This case is a leading example of how courts can creatively use International Law to protect rights when Municipal Law is silent.

Gramophone Company of India Ltd. v. Birendra Bahadur Pandey (1984)

The Court observed that the rules of customary International Law are treated as part of the law of the land in India, unless they conflict with an Act of Parliament or a clear rule of domestic law. The decision reinforced the principle that Indian courts should respect and apply customary international law as far as possible, but domestic statutes will prevail in case of a direct conflict. This case is often cited to explain India’s generally receptive attitude towards customary International Law.

Critical Evaluation

International Law is sometimes called “weak” because there is no central world police or parliament. Enforcement can be difficult. However, it still creates real binding duties, courts and consequences (sanctions, responsibility, reparations). Municipal Law also faces problems (delays, corruption, weak institutions). The real difference is in structure, sources and enforcement methods, not in whether one is “real law” and the other is not.

Conclusion

International Law governs relations among countries and other international actors. Municipal Law governs life inside a country. They differ in sources, subjects, institutions, enforcement and sanctions. Yet they are linked: international rules influence national laws and courts, while national institutions implement international commitments.
