As an important theory of legal positivism, it treats law as a separate system of legal norms, independent of morality, religion, politics, sociology, and metaphysics. Kelsen’s main aim was to study law scientifically, without mixing it with other subjects. He argued that law deals with what ought to be done (Sollen), while facts describe what is (Sein). He called it the Pure Theory of Law because he believed that legal science should focus on legal norms rather than moral judgments or external influences. His contribution to drafting the Austrian Constitution of 1920 also influenced constitutional law, judicial review, and international law.
<div id="ez-toc-container" class="ez-toc-v2_0_88 Grundnorm

2.1 Norm

A norm is simply a rule or standard that tells people how they ought to behave. According to legal philosopher Hans Kelsen, a legal norm specifies both what people should or should not do and what consequences follow if the rule is broken.

Example: The law states that theft is prohibited and sets a punishment for it. Here, the prohibition against stealing is the norm, and the punishment is its legal consequence.

2.2 Grundnorm

Grundnorm is a German term meaning “basic norm” or “fundamental rule.” Kelsen created this concept to answer a basic question: Why is any law valid, and where does legal authority ultimately come from?

A legal system works like a chain of authority:

A rule is valid because a statute allows it.

A statute is valid because parliament passed it following established procedures.

Parliament gets its power from the Constitution.

Eventually, you reach the top of the chain. The ultimate, foundational rule that gives the entire legal system its legitimacy is the Grundnorm.

In countries with a written constitution, the Constitution serves as the practical Grundnorm. Every legislation, government order, and court judgment must align with it. If a law violates the Constitution, it loses its validity and is struck down.

Core Features of the Pure Theory

Hierarchy of Norms

Law forms a hierarchical structure, often illustrated as a pyramid, in which each lower-level norm derives its validity from a higher-level norm. A statute is valid because it is enacted in accordance with the Constitution, while the validity of constitutional norms ultimately rests on the Grundnorm (basic norm), which forms the assumed foundation of the entire legal system.

The Normative Nature of Law: The Distinction Between Causality and Normativity

Law consists of norms that prescribe what ought to be done (Sollen). These norms establish legal consequences, including sanctions, for specified forms of conduct. Unlike natural science, which explains causal relationships (cause → effect), legal science examines normative relationships in which a specified condition gives rise to a legal consequence or sanction (condition → sanction).

Legal Validity as a Formal Concept

A norm is legally valid if it has been created in accordance with a higher norm that authorises its creation. Thus, legal validity depends on compliance with the established legal hierarchy, not on the norm’s moral value, fairness, justice, or reasonableness.

Strict Separation of Law and Morality

Legal science must describe the law as it is, not as it ought to be from a moral or political standpoint. Morality may inspire or criticise law, but it forms no part of the concept of law itself. This separation is the hallmark of the theory’s “purity.”

Law as Normative Science

Law is a normative science, not a natural science, because it deals with rules that guide human behaviour. These rules form an organised system based on a basic norm called the Grundnorm.

Kelsen distinguishes between Sein (what is) and Sollen (what ought to be). Social facts may explain how laws are made, but they cannot alone determine whether a law is legally valid.

Example: The fact that people commit theft is a social reality (Sein), while the legal rule prescribing punishment for theft is a norm (Sollen).

Refined Legal Positivism

The theory concerns only positive law—norms actually created or recognised by competent authorities—regardless of their moral content.

The Grundnorm (Basic or Primary Norm)

The Grundnorm is the most important idea in Kelsen’s theory. It is the basic starting point that sits at the very top of the legal pyramid.

It is not a written article in any constitution. It is only a theoretical assumption that legal experts accept so that the whole legal system can be treated as valid and binding.

In simple words:

We assume one highest rule is true. Because of that assumption, every lower rule (constitution → Acts of Parliament → government orders → court judgments) becomes valid.

4.1 Common Ways of Expressing the Grundnorm

The constitution must be obeyed.

The first constitution-making act is valid.

4.2 Clear Country Examples

Country or Legal System

Example from the Original Text

India

The Constitution of India acts as the Grundnorm. Hart’s idea of the “rule of recognition” is one famous alternative.

Critics also call the Grundnorm circular: we assume the system is valid in order to prove that it is valid.

Advantages of Kelsen’s Pure Theory of Law

Universality

The theory can be applied to any legal system in the world because it looks only at the structure of rules, not at culture, religion, or morality.

Example: The same hierarchical model works for India’s Constitution, the U.S. Constitution, and even international law.

Better Than Austin’s Theory

John Austin said law is just the command of a sovereign backed by punishment. Kelsen improved this by showing law as a hierarchy of norms, not merely commands. Example: A traffic rule is not just a police order; it is valid because higher laws (Acts and Constitution) authorise it.

Explains Constitutional Supremacy

It clearly shows why the Constitution stands above ordinary laws and why courts can strike down unconstitutional laws (judicial review).

Example: In India, the Supreme Court can cancel a law if it violates the Constitution — this follows Kelsen’s hierarchy.

Value-Neutrality

The theory allows us to study and compare different legal systems without saying which one is morally better.

Example: We can analyse the legal structure of a democratic country and a non-democratic country using the same pure method.

Accepts Many Sources of Law

Legislation, court decisions (precedent), customs, and international treaties can all be part of the legal system as long as a higher norm authorises them.

Example: A long-standing custom can become law if the Constitution or a statute recognises it.

Clear Link Between State and Law

Kelsen says the State is nothing but the legal order itself. This avoids mixing pure political power with legal authority.

Example: A government order is valid only because the legal system (not just political force) authorises it.

Continuing Relevance

Hans Kelsen’s ideas remain relevant in constitutional law and international law. His theory explains the hierarchy of legal norms, under which lower-level laws must conform to higher-level laws. For example, in India, an ordinary law that violates the Constitution can be declared unconstitutional by the courts. His ideas also help explain the role of constitutional courts in judicial review and provide a useful framework for understanding the basic structure doctrine, developed by the Indian Supreme Court in Kesavananda Bharati v. State of Kerala (1973).

Under this doctrine, Parliament cannot alter the basic structure of the Constitution through a constitutional amendment. In international law, Kelsen’s work supports the systematic study of legal rules and their relationship, including the role of treaties and international legal obligations. Thus, his theory continues to help explain the validity, hierarchy, and functioning of legal systems.

Criticisms of Kelsen’s Pure Theory of Law

Too Abstract and Far From Real Life

The theory only tells us whether a law is valid according to higher rules. It does not explain why ordinary people actually obey the law, or how money, power, and inequality affect the legal system.

Example: It can say a tax law is valid, but it cannot explain why rich people sometimes escape taxes while poor people cannot.

Ignores Justice and Fairness

Because Kelsen keeps morality completely outside law, his theory has no way to judge whether a law is good or bad, just or unjust.

Example: Even a cruel law that treats people unfairly can still be called “valid law” under this theory.

Sources of Law Are Not Always Hierarchical

Critic C.K. Allen pointed out that custom, legislation, and court decisions (precedent) often work side by side, not strictly one above the other as Kelsen claimed.

Grundnorm Secretly Brings Natural Law Back

Scholar Hersch Lauterpacht said the Grundnorm (basic norm) is like a hidden natural-law idea. It is assumed to be valid without any legal authority creating it — something Kelsen himself wanted to avoid.

Grundnorm Is Only an Assumption

The basic norm is not a real written rule. It is just a theoretical starting point. Critics say this makes the whole theory circular: we assume the system is valid in order to prove it is valid.

Underestimates the Role of Judges

Kelsen mostly sees judges as people who simply apply existing rules. In reality, judges (especially in constitutional and international courts) often create and develop new law through interpretation.

Western Bias

Some modern writers feel the theory is based mainly on European and American constitutional systems. It may not fully fit countries that have mixed systems of formal law, customary law, and traditional practices.

Why Is Kelsen’s Theory Called the “Pure” Theory of Law?

Hans Kelsen called it the Pure Theory of Law because he wanted to study law separately from morality, religion, politics, sociology, and other external influences. According to him, legal science should focus on what the law is, rather than what it ought to be from a moral or political point of view. The word pure means that the study of law should be limited to legal norms, without judging whether they are morally good, fair, or just. In simple words, Kelsen aimed to study law as law, independent of other subjects.

Simple examples of this purity:

A law that forces people to pay a very high tax may be harsh and unpopular, but under Kelsen’s pure approach it is still valid law if the legislature followed the correct constitutional procedure.

A court decision that many people consider unjust remains legally valid as long as the judge applied the existing higher rules correctly.

International treaties between countries are treated as binding norms even if some people think they are morally unfair — the pure theory looks only at whether the proper legal process was followed.

This strict separation gives the theory two main qualities:

Strength → It becomes precise, scientific, and can be applied to any legal system in the world (India, USA, Germany, or international law) without mixing local morals or politics.

Weakness → Critics say this purity makes the theory too distant from real life. By ignoring justice and social context, it cannot tell us whether a law is good or bad — only whether it is legally valid.

Conclusion

Hans Kelsen’s Pure Theory of Law provides a clear and logical way to understand how a legal system works. By organizing law into a step-by-step hierarchy resting on a basic rule—the Grundnorm—it explains why laws are valid and why a constitution holds supreme authority, without mixing law with morality or politics.

Although critics point out that it ignores fairness, social reality, and justice, Kelsen’s ideas remain highly relevant today. They provide a precise framework to analyze courts, constitutions, and international law across the world—showing that every legal rule, big or small, ultimately derives its force from a single foundational point.

I Remove Me (Ego): Covenant of Abandonment and Waiver of the Individual Ego see

Trademark Infringement Action Sustained Despite Suspension of Drug Licence

Limitation Is a Mixed Question of Law and Fact

Understanding Doubtful Torts: Dealing with Uncertainties in Civil Wrongs

Sex Norms Across Cultures: Historical Foundations, Religious Influences, and Contemporary Shifts

Hans Kelsen’s Pure Theory of Law Introduction Hans Kelsen (1881–1973) was an Austrian jurist and legal philosopher who developed the Pure Theory of Law in the early twentieth century.
