It has four essential elements: population, territory, government, and sovereignty. According to Woodrow Wilson, a state is “a people organised for law within a definite territory.” In simple words, a state is a political and legal organisation that makes and enforces laws, maintains order, and governs the people living within its territory.

A state is different from a government and a nation. The state is a permanent political entity, whereas the government is the group of people who administers it and may change through elections or other means. A state is a legal and political concept, while a nation refers to a group of people who share a common history, culture, language, or identity. When a nation and a state largely coincide, the political entity is generally called a nation-state.

The Four Essential Elements of a State

According to international law and political theory, a state generally has four essential elements: population, territory, government, and sovereignty. Population refers to the people who live in the state, while territory means the geographical area over which the state exercises control. Government is the system or authority responsible for making laws, maintaining order, and administering the state. Sovereignty means the state’s supreme authority within its territory and its independence from external control. Together, these four elements form the basic foundation of a state.

Essential Element

Meaning

Population

The people who live in the state.

Definite Territory

The geographical area over which the state exercises control.

Government

The authority responsible for making laws, maintaining order, and administering the state.

Sovereignty

The state’s supreme authority within its territory and independence from external control.

3.1 Population (Human Community)

Population is an essential element of a state because a state cannot exist without people. There is no fixed minimum or maximum number of people required to form a state. For example, India and China have populations exceeding one billion, while Vatican City has a very small population. Both are recognised as states.

3.2 Definite Territory (Geographical Boundary)

A state must have a definite geographical territory where its population lives and its government exercises authority. A nomadic group that moves from place to place without a settled territory does not, by itself, constitute a state. The territory of a state generally includes its land, internal waters, territorial waters, and the airspace above them. For example, Russia has a vast territory, while Tuvalu is a small island state.

3.3 Government (Administrative Machinery)

Government is the machinery through which a state makes decisions, maintains law and order, and exercises its authority. It makes and implements laws, protects people, and administers public affairs. Government generally consists of three main organs:

The Legislature: Makes laws.

The Executive: Implements and enforces laws.

The Judiciary: Interprets laws and administers justice.

Without an effective governing authority, it becomes difficult for a state to maintain order and perform its functions.

3.4 Sovereignty (Supreme Power)

Sovereignty means the supreme authority of a state to govern its people and territory and to act independently in international affairs. It has two main aspects: internal sovereignty and external sovereignty.

Internal Sovereignty: Refers to the state’s authority to make and enforce laws within its territory.

External Sovereignty: Means that the state is independent of the authority of other states and is free from external control in exercising its sovereign powers, subject to its obligations under international law.

Sovereignty distinguishes an independent state from a territory that is legally subject to another state.

Kinds of States

States can be classified according to their sovereign status, internal structure, and system of governance. On the basis of sovereign status, states may be independent or dependent. An independent state has sovereignty and controls its internal and external affairs, while a dependent state relies on another state for certain matters, particularly defence or foreign relations.

On the basis of internal structure, states may be unitary, federal, or confederal. In a unitary state, the central government holds the main authority, as in the United Kingdom. In a federal state, powers are divided between the central government and regional governments, as in India and the United States. In a confederation, independent states join together for common purposes while retaining most of their powers.

On the basis of the system of governance, states may be classified as monarchies, democracies, or authoritarian states. In a monarchy, the head of state is usually a king or queen, and the position is generally inherited. In a democracy, people choose their representatives through elections. In an authoritarian state, political power is concentrated in the hands of one person or a small group, and political freedom is often restricted. These classifications help us understand how states are organised and governed.

A. Based on Sovereignty and External Freedom

Independent (Sovereign) States

Independent states have the authority to manage their internal affairs and foreign relations without being legally subject to another state. They can make their own laws, govern their people, and maintain relations with other countries. Examples include India, Japan, Brazil, and France.

Dependent States

Dependent states or territories are political entities that do not possess complete sovereignty and may depend on another state for certain matters, such as defence or foreign affairs. Examples include Puerto Rico, which is a US territory, and historical protectorates such as British Bechuanaland (now Botswana) before its independence in 1966. The Cook Islands and Niue are self-governing states in free association with New Zealand. However, their legal statuses differ, so not all can be classified as dependent states in exactly the same sense.

B. Based on Internal Structure and Distribution of Power

Unitary States

In a unitary state, the central government holds the main governing authority. Regional and local governments exercise powers granted to them by the central government. Examples include France and Japan, as well as the United Kingdom, where powers are also devolved to certain regions.

Federal States

In a federal state, the Constitution divides powers between the central government and regional governments, such as states or provinces. Each level of government exercises authority within its assigned areas. Examples include India, the United States, Canada, and Australia.

Confederations

A confederation is an association of sovereign states that join together for common purposes, such as defence, trade, or cooperation. The member states retain most of their powers, while the central authority generally has limited powers. A historical example is the United States under the Articles of Confederation from 1781 to 1789. The European Union has some confederal features, but it is a unique political and legal organisation rather than a traditional confederation.

C. Based on the System of Governance and Authority

Democratic States

In a democratic state, political power ultimately rests with the people, who choose their representatives through regular elections. The government is expected to respect the Constitution, the rule of law, and citizens’ rights. Examples include India, Canada, and Germany.

Monarchical States

A monarchical state has a king, queen, emperor, or sultan as its monarch, usually holding the position by inheritance. Monarchies are generally divided into two types.

Absolute Monarchy: The monarch exercises extensive governing powers, as in Saudi Arabia.

Constitutional Monarchy: The monarch’s powers are limited by the Constitution or established laws, and elected representatives exercise most political authority, as in the United Kingdom and Japan.

Authoritarian and Totalitarian States

In an authoritarian state, political power is concentrated in the hands of one ruler or a small group, and political opposition and civil liberties are often restricted. A totalitarian state goes further by seeking extensive control over political, social, and sometimes private life. North Korea is commonly cited as an example of a highly authoritarian state with totalitarian features.

Conclusion

The state remains the foundational building block of political organization and global legal order. It is far more than a mere collection of people or a geographic spot on a map; it is a permanent entity defined by the indispensable convergence of population, definite territory, an organized government, and supreme legal sovereignty.

While all states share these core elements, their operational styles differ significantly across the globe. From unitary to federal systems, and from constitutional democracies to monarchies, the structure of a state dictates how political power is distributed and exercised.
