There is a government, police, courts, and prisons. Break the law and you can be punished.

International law looks different. There is no world government, no global police, and no permanent prison for countries. This difference is the heart of the debate.

Why Some Say It Is Not Real Law

Critics (following Austin) point out:

No higher authority: All countries are legally equal. No one can order them around the way a government orders its citizens.

Weak enforcement: Other countries may protest, impose sanctions, or go to court. But powerful states often ignore the rules without serious punishment.

Based on consent: Most rules exist only because states agree to them. A country can usually leave a treaty. National law does not need daily consent from every person.

Political reality: Power and national interest often matter more than strict rules. Some call it “soft law” or just morality dressed up as law.

Why Others Say It Is Real Law

Modern experts reject Austin’s narrow view. They say international law is genuine because:

Countries treat it as binding. Governments constantly talk about treaties and court rulings as legal duties, not mere advice.

It has clear sources: treaties, custom, general principles of law, and court decisions (listed in the Statute of the International Court of Justice).

Real institutions exist: the International Court of Justice, International Criminal Court, World Trade Organization dispute body, and human-rights courts all apply it.

Sanctions do work: economic penalties, loss of reputation, exclusion from groups, and (in extreme cases) UN-authorised military action. The fear that “if I break the rules, others will break them against me” is a strong practical force.

It works every day: trade, air travel, postal services, and diplomacy run smoothly under these rules. States obey most of them most of the time. Perfect obedience is not required—even national laws are broken.

It has grown stronger since World War II, with detailed rules on human rights, the environment, genocide, and war crimes.

Law does not need a single world government to be real. What matters is that rules are accepted as binding, have recognised sources, and affect behaviour.

A Balanced View

International law is different from national law. It is decentralised, depends on state consent and cooperation, and has weaker enforcement. In that sense it is imperfect.

Yet it is still law. It creates rights and duties, is applied by courts, shapes government behaviour, and is treated as obligatory by the world community. Calling it “not law” ignores modern reality.

Think of it as the rules of a club whose members are independent countries. The club has no strong central boss, but members still follow the rules because membership brings benefits and breaking them brings costs. The rules are real, even if imperfect.

“The Vanishing Point of Jurisprudence”

The English jurist T.E. Holland described international law as “the vanishing point of jurisprudence.” He meant that international law stands at the outer limits of the science of law because it lacks some features of national legal systems, such as a central sovereign authority, compulsory jurisdiction of courts in every case, and a strong system of enforcement.

Simple examples:

There is no world government that can always force a state to obey international law.

Enforcement often depends on cooperation, economic sanctions and international public opinion. For example, sanctions were imposed on Russia following its annexation of Crimea in 2014, but Russia continued to control the territory.

International law is based on treaties, customary international law and other recognised sources; not every rule depends on the consent of each state in every instance.

Traditionally, international law mainly governed relations between states. Today, individuals can also be held responsible for certain international crimes, including through the International Criminal Court.

Holland’s statement is only partly true in the modern world. International law plays an important role in trade, human rights, environmental protection and international relations. International courts also decide disputes, and states generally comply with many international rules to protect their reputation and maintain cooperation.

However, international law still lacks a central authority with powers comparable to those of a national government. Therefore, Holland’s phrase highlights the relative weakness of enforcement in international law compared with domestic law.

Examples of Violations of International Law by Different Countries

International law has been violated by several countries, including powerful states. For example, Russia’s annexation of Crimea in 2014 was widely condemned as a violation of Ukraine’s territorial integrity, while Iraq’s invasion of Kuwait in 1990 violated the prohibition on the use of force under the UN Charter.

The United States’ invasion of Iraq in 2003 was widely challenged under international law because it lacked a generally accepted legal basis; the legality of the invasion remains highly controversial. The US-led invasion was not authorised by a new, explicit Security Council resolution, although the United States and the United Kingdom argued that earlier resolutions provided authority.

The US invasion of Panama in 1989 was also widely criticised by the UN General Assembly as a violation of international law. Furthermore, the US detention and treatment of prisoners at Guantánamo Bay, including allegations of torture and prolonged detention without trial, raised serious concerns under international human rights and humanitarian law.

These examples demonstrate that even powerful states may act contrary to international legal rules, while enforcement often depends on political cooperation and the willingness of the international community to respond.

The United Nations General Assembly expressly condemned the US military intervention in Panama in 1989 as a violation of international law.

Similarly, UN human rights experts found that the United States had failed to comply with certain international obligations concerning detention and treatment at Guantánamo Bay.

These cases illustrate Holland’s point: even when international law is violated or its enforcement is challenged, there is no world government with the same direct enforcement powers as a national government.

Conclusion

International law is a genuine form of law, although it differs from national law in its structure and enforcement. As John Austin’s theory highlights, it lacks a central sovereign authority and a strong system of compulsory enforcement. However, it establishes recognised legal rules, creates rights and duties for states and individuals, and is applied by international courts and institutions. Although countries sometimes violate these rules, such violations do not prove that international law is not law, just as violations of domestic law do not make national law invalid. The examples of international conflicts and unlawful conduct show that enforcement remains a major challenge, particularly when powerful states refuse to cooperate. Therefore, international law is best understood as a distinct but genuine system of law—imperfect in enforcement, yet essential for maintaining peace, justice, cooperation and order in the international community.

Unraveling IP Violations: A Comparative Analysis of Copyright and Patent Infringement

New Face of Criminal Law: 7 Legal Trends Everyone Should Watch in 2026

Supreme Court on Section 69 BNS: Broken Promise to Marry Is Not Automatically a Crime

International Divorce in UAE: Dubai Divorce Law, Custody & Financial Settlements

Understanding International Commercial Arbitration: Foundations and Legal Framework

Introduction International law is the set of rules that countries agree to follow when dealing with each other.
