Families arrange their savings, take education loans and plan their expenses on the basis of the fee structure disclosed at the time of admission. When a college substantially increases its fees after the course has begun, the consequences can be serious. Students may find themselves facing an unexpected financial burden, with little practical opportunity to withdraw without losing time, money or an academic year.

Table of Contents

Toggle

Mid-Course Fee Hike in Professional Colleges: What the Supreme Court Has Ruled

1. Roy Engineering College & Anr. v. State of West Bengal & Ors., 2026 INSC 1120, decided on 14 October 2026.

The judgment examines the relationship between fee regulation, the financial requirements of educational institutions and the legitimate expectations of students and their parents. It also considers the role of statutory fee-fixation authorities and the circumstances in which a revised fee structure may operate during an ongoing course.

The decision is particularly relevant to students and parents concerned about a mid-course fee hike in professional colleges, as well as private institutions and regulatory authorities responsible for determining and implementing educational fees.

Its message requires careful reading. The Court did not establish an absolute prohibition against every fee revision during a course. Equally, it did not give educational institutions unrestricted authority to impose higher fees on students who have already taken admission.

The judgment instead highlights the importance of advance fee disclosure, properly functioning regulatory mechanisms and a cautious approach to changes that affect students after admission.

1. What Was the Dispute Before the Supreme Court?

The dispute arose in West Bengal after the State Government issued Notification No. 466-Edn-(T)/10M-04/2004 (Part IV), dated 16 October 2023. The notification revised the fee structure applicable to private self-financing institutions offering courses in engineering, technology, pharmacy, architecture and related disciplines.

Dr. B.C. Roy Engineering College subsequently revised its fees on 15 December 2023. The increase was reported to be approximately 37.5 per cent.

The difficulty was that admissions for the 2023–24 academic year had already been completed before the State notification was issued.

Students and their parents had therefore taken admission on the basis of the fee structure available to them at that time. A substantial increase introduced afterwards altered the financial terms on which they had committed themselves to the course.

For a family budgeting its expenses over four years, an increase of this magnitude is not a minor administrative adjustment. It can affect the affordability of the entire degree.

The college, on the other hand, was operating within a regulatory environment in which fee revision had been delayed. The litigation consequently involved more than a disagreement between an institution and its students. It raised questions about the responsibilities of the State, the functioning of fee-fixation mechanisms and the consequences of regulatory delays.

The central issue was whether the revised fee structure could be applied to students who had already been admitted before the notification dated 16 October 2023.

2. What Did the Calcutta High Court Decide?

The dispute first reached the Calcutta High Court.

On 15 January 2026, a Single Judge dismissed the writ petitions. The matter then proceeded to a Division Bench, which delivered its judgment on 23 March 2026.

The Division Bench protected students who had been admitted before 16 October 2023. It directed that the revised fee structure should apply only to students admitted on or after that date. It also directed the refund or adjustment of excess amounts collected from the protected group of students.

The distinction was important. Students admitted after the revised notification could be treated under the new fee structure, whereas students admitted earlier were protected by the directions in the litigation.

The matter eventually reached the Supreme Court.

The Supreme Court examined the reasoning adopted by the High Court and the directions that had been issued. Its treatment of these two aspects must be distinguished: the Court disagreed with parts of the Division Bench’s reasoning but ultimately affirmed its operative directions concerning the affected students.

That distinction is essential to understanding the judgment correctly.

3. What Did the Supreme Court Actually Hold?

The Supreme Court’s decision addresses the competing interests involved in regulating professional education.

Educational institutions need sufficient funds to maintain infrastructure, employ qualified teachers, provide laboratories and libraries, and meet the costs of delivering education. A fee structure that ignores these legitimate requirements may undermine the quality of education.

Students and their parents, however, also need financial certainty. They should ordinarily be able to understand the financial commitment involved before deciding whether to accept admission.

The Court recognised that these interests must be considered together. Neither the financial requirements of an institution nor the expectations of students can be examined in isolation.

The judgment is especially significant for its discussion of advance fee disclosure and the circumstances in which a fee revision may be justified after admission.

It also clarifies that the result of the litigation cannot be understood simply as a declaration that every mid-course fee increase is unlawful. The Court disagreed with aspects of the High Court’s reasoning concerning retrospective operation and the use of equity and estoppel, while affirming the final directions protecting the relevant students.

The practical consequence is that the operative relief in this case remains important, but the reasoning must not be overstated as a universal prohibition applicable to every institution and every fee revision in India.

4. Why Must Colleges Disclose Fees Before Admission?

One of the most important principles emerging from the judgment is that students should ordinarily know the fees payable for the entire course before they take admission.

This is not merely a matter of good administration. It is closely connected with informed choice.

A student choosing between two engineering colleges may consider academic reputation, location, placement opportunities, hostel facilities and total expenditure. If the fee structure disclosed at admission does not provide a reliable picture of the financial commitment, the student cannot make a fully informed decision.

The problem becomes more serious once the course has begun. Students may have already paid admission fees, purchased books, arranged accommodation, relocated to another city or taken an education loan. Changing institutions may no longer be a realistic option.

The Supreme Court’s discussion in paragraph 36(ii) emphasises that the authorities must notify the fees payable for the entire course before admission. A variation during the course is contemplated only in exceptional circumstances, such as an unforeseen increase in expenditure.

The underlying principle is straightforward: fee certainty should be the rule, while mid-course variation should remain exceptional.

This approach also promotes transparency. When students know the financial terms in advance, institutions can be held accountable for the fee structure under which admissions were offered.

For students facing a mid-course fee hike in professional colleges, this part of the judgment provides an important starting point for examining whether the increase is legally justified.

5. Does the Judgment Completely Prohibit Mid-Course Fee Increases?

No. That would be an overstatement of the Supreme Court’s decision.

The Court recognised that exceptional circumstances may justify a variation in fees during an ongoing course. Its discussion refers, in particular, to unforeseen increases in expenditure.

There may be circumstances in which an institution faces genuine and unexpected financial pressures that could not reasonably have been anticipated when the original fee structure was determined. Extraordinary economic conditions or changes in the statutory framework may also require consideration through an appropriate regulatory mechanism.

But the existence of a financial difficulty does not, by itself, establish a legal right to impose any increase the institution considers necessary.

A proposed revision must be assessed under the applicable statutory framework, the relevant fee-fixation rules and the directions of the competent authorities. The nature of the expenditure, the reasons for the increase, the timing of the decision and the manner in which the revised fee is applied may all be relevant.

An institution should therefore be able to explain why a revision is necessary, why the circumstances could not reasonably have been anticipated and what regulatory approval or determination is required.

A general assertion that operating costs have increased should not automatically be treated as sufficient justification for imposing a substantial additional burden on students midway through their education.

At the same time, students should not assume that every increase is invalid merely because it occurs after admission. The legality of a particular revision depends on its facts and the governing regulatory framework.

6. What Role Do Fee-Fixation Committees Play?

Fee-fixation committees are an important part of the regulatory framework governing professional education.

Their function is to examine the financial aspects of educational institutions and determine fees through an appropriate process. This helps prevent arbitrary fee demands while recognising that institutions must have adequate resources to maintain educational standards.

In paragraph 36(i), the Supreme Court emphasised the statutory foundation and public purpose of these committees. It also observed that High Courts should scrutinise their functioning to ensure that they operate efficiently and possess the necessary expertise and integrity.

This observation has practical significance.

A fee dispute may not arise solely because a college has acted improperly. Delays in constituting committees, completing assessments or issuing fee notifications can also create uncertainty for institutions and students.

The judgment acknowledges the importance of an effective regulatory system rather than treating fee disputes as a matter involving only the individual college and its students.

For a student challenging a fee increase, the relevant questions may include:

Was the revised fee determined or approved by the competent authority?

Was the prescribed procedure followed?

Were the relevant financial circumstances properly considered?

Was the fee structure disclosed before admission?

Does the governing framework permit the revision to apply to students already enrolled?

Has the institution complied with the applicable notification and judicial directions?

These questions help identify whether the dispute concerns the amount of the fee, the authority that determined it, the procedure followed or the date from which the revision is being applied.

7. What Is the Relevance of AICTE Regulations?

The regulatory framework governing technical education is also relevant to disputes about fees.

The AICTE framework, including the applicable provisions of the AICTE Regulations, 1994, must be considered alongside the relevant State legislation, fee-fixation arrangements and notifications.

Regulation 7 of the 1994 Regulations forms part of the framework referred to in discussions concerning fees and their disclosure. The precise obligation in a particular case must, however, be assessed by examining the applicable regulatory text and the rules governing the institution and course.

The relevant AICTE Approval Process Handbook for the academic year in question may also contain provisions concerning fee disclosure, institutional approvals and compliance requirements.

Institutions and students should therefore avoid relying on a general statement about AICTE rules without checking the provisions applicable to the particular academic year.

The broader point remains that fee determination and disclosure must comply with the governing regulatory framework. A college cannot establish the legality of a mid-course fee hike merely by pointing to its own financial requirements while ignoring the applicable rules.

8. Does the National Education Policy, 2020, Prohibit Mid-Course Fee Hikes?

The National Education Policy, 2020, places considerable emphasis on access, affordability, quality and the accountability of educational institutions.

Its provisions concerning higher education provide a broader policy context for discussions about reasonable fees and the need to make education accessible to students from different financial backgrounds.

However, the National Education Policy is not, by itself, a complete statutory code governing every fee dispute. Its policy objectives must be read alongside the applicable legislation, regulations, State notifications and binding judicial decisions.

A student challenging a fee increase should therefore identify the specific legal provision or regulatory requirement that applies to the dispute rather than relying solely on the general objectives of the policy.

The policy is relevant to the wider discussion, but the legal outcome will ordinarily depend on the governing regulatory framework and the facts of the individual case.

9. How Does the Judgment Fit Within Earlier Supreme Court Decisions?

The regulation of fees charged by private professional institutions has been considered by the Supreme Court on several occasions.

In T.M.A. Pai Foundation v. State of Karnataka, (2002) 8 SCC 481, the Court examined the rights of educational institutions and the permissible extent of State regulation.

In Islamic Academy of Education v. State of Karnataka, (2003) 6 SCC 697, the Court addressed fee regulation and the role of committees in the context of professional education.

In P.A. Inamdar v. State of Maharashtra, (2005) 6 SCC 537, the Court considered the regulation of admissions and fees in private professional educational institutions, including safeguards against profiteering and capitation fees.

In Modern Dental College and Research Centre v. State of Madhya Pradesh, (2016) 7 SCC 353, the Court examined the constitutional validity of regulatory measures concerning admissions and fees in private professional colleges.

These decisions provide the broader legal context in which the relationship between institutional autonomy and public regulation must be understood.

The judgment in Dr. B.C. Roy Engineering College addresses a more specific practical difficulty: the consequences of changing a fee structure after students have already been admitted.

The important point is not that the earlier cases establish an absolute prohibition against every fee revision. Rather, they help explain why fee regulation must balance the legitimate financial requirements of institutions with safeguards against arbitrary or unreasonable demands.

The precise application of these principles will depend on the statutory framework and facts of each dispute.

10. Can a College Rely on a Clause in Its Prospectus Allowing Fee Revision?

Some institutions include clauses in their prospectuses or admission documents stating that fees may be revised in the future.

Such a clause may be relevant, but it should not be treated as a complete answer to every legal objection.

A prospectus cannot override a binding statute, a valid regulatory requirement or a judicial direction. Nor does the mere inclusion of a general fee-revision clause necessarily establish that every later increase is lawful.

The institution must still comply with the applicable fee-fixation mechanism and any restrictions governing the timing and application of revised fees.

Students should examine the wording of the clause carefully. It may be necessary to determine whether the provision identifies the circumstances in which fees can be revised, whether the revision requires approval from a competent authority and whether it can lawfully affect students already admitted.

The Supreme Court’s treatment of the High Court’s reasoning also makes it important not to reduce the dispute to a simple argument about contractual expectations or estoppel. The legal question must be examined within the governing regulatory framework.

A clause in the prospectus is therefore one part of the analysis, not necessarily the end of it.

11. Are Students Entitled to a Refund of Fees Already Collected?

The Supreme Court affirmed the final directions of the Calcutta High Court concerning the students protected in this litigation.

Those directions related to the applicability of the notification dated 16 October 2023 and the refund or adjustment of excess fees collected from the relevant students admitted before that date.

This is an important practical outcome. Students falling within the protected group can rely on the operative directions in the case when seeking the relief applicable to them.

However, the scope of that relief must be understood correctly.

The judgment does not automatically establish a nationwide right for every student to recover every fee increase imposed during an ongoing course. The refund or adjustment directions arose from the particular notification, admissions and proceedings before the Court.

A student in another State, or at an institution governed by a different fee structure, must examine the applicable notification, regulations, admission documents and any relevant court orders.

Where a student believes that excess fees have been collected contrary to an applicable judicial direction or regulatory requirement, the student should preserve the fee receipts, admission documents and relevant correspondence. A written representation to the institution and competent fee authority may be an appropriate first step, depending on the governing rules.

The legal basis for a refund should be identified before proceedings are initiated.

12. What Should Students Do If Their College Increases Fees Midway Through the Course?

Students who receive a notice announcing a substantial fee increase should not rely solely on informal discussions or general statements about the law. They should first establish the precise basis of the demand.

A practical approach is to proceed as follows.

Step 1: Obtain the Original Fee Structure

Keep a copy of the prospectus, admission letter, fee schedule and any document specifying the fees payable for the course.

These documents help establish the financial terms communicated when admission was offered.

Step 2: Obtain the Revised Fee Notice

Preserve the college’s notice announcing the increase, including its date, the amount of the increase and the date from which the revised fees are demanded.

If the notice refers to a government notification or fee-committee order, obtain a copy of that document as well.

Step 3: Ask for the Legal Basis of the Increase

Write to the college requesting the order or rule under which the revision has been made.

Ask whether the increase was approved by the competent authority and why it is being applied to students who were admitted under an earlier fee structure.

A written response is generally more useful than an informal oral explanation.

Step 4: Check the Applicable Regulations

The relevant State notification, fee-committee rules, AICTE requirements and other applicable regulations should be examined.

The question is not simply whether the college has increased its fees. It is whether the institution was legally entitled to make that particular revision and apply it to that particular group of students.

Step 5: Make a Written Representation

Where the demand appears inconsistent with the governing rules or a binding court order, students may submit a representation to the institution and the competent regulatory authority.

The representation should identify the relevant documents, explain the objection and specify the relief sought.

Step 6: Obtain Legal Advice Before Taking Further Action

If the dispute remains unresolved, a lawyer can examine whether the facts support a challenge before the appropriate forum.

Students should be cautious about withholding fees without advice. Depending on the circumstances, non-payment may expose them to additional disputes concerning enrolment, examinations or other academic matters.

The appropriate response depends on the governing rules, the nature of the demand and the available remedies.

13. Can Students Challenge an Unlawful Fee Increase Before the High Court?

In an appropriate case, students may seek relief under Article 226 of the Constitution of India.

The High Court’s writ jurisdiction may be relevant where a fee demand involves an alleged violation of statutory rules, an unlawful exercise of regulatory power, failure to follow a binding notification or non-compliance with a judicial direction.

The availability and suitability of a writ petition depend on the facts. The Court may consider the nature of the grievance, the applicable statutory remedies, the conduct of the parties and whether the dispute raises a question requiring judicial intervention.

A student should not assume that every disagreement over fees will automatically result in a favourable writ order. The case must be supported by the relevant documents and a clear legal basis.

Depending on the applicable framework, it may be appropriate to approach the competent fee-fixation committee or other statutory authority before seeking judicial relief.

Where a High Court has decided the matter, a further challenge before the Supreme Court may be considered in an appropriate case, including through a special leave petition under Article 136. The grant of special leave is discretionary; it is not an automatic appeal as of right in every matter.

The most effective legal strategy is usually built around the precise regulatory violation or legal error alleged, rather than a general assertion that the increase is unfair.

14. What Does the Judgment Mean for Colleges and Regulatory Authorities?

The decision is also relevant to institutions and the authorities responsible for regulating them.

For colleges, the practical lesson is that fee planning should be undertaken with sufficient care and in coordination with the applicable regulatory process. Institutions should disclose the prescribed fee structure clearly and should not assume that a later financial difficulty automatically permits a revised demand against students already enrolled.

Where an exceptional revision is genuinely necessary, the institution should identify the relevant legal authority, document the circumstances and follow the prescribed procedure.

Regulatory authorities also have an important responsibility. Delays in determining or notifying fees can create uncertainty for both institutions and students. A properly functioning fee-fixation mechanism should work transparently, efficiently and in time for students to understand the financial commitment before admission.

The Supreme Court’s observations concerning fee-fixation committees are particularly relevant in this regard. Effective regulation requires not only legal authority but also competent administration and timely decision-making.

Ultimately, students should not be left to bear the consequences of avoidable regulatory uncertainty without proper consideration of their rights.

15. What the Supreme Court Judgment Does Not Mean

The decision should not be read more broadly than its reasoning and operative directions permit.

It does not establish that every fee increase during a course is automatically illegal.

It does not give every student in India an automatic right to a refund whenever a college revises its fees.

It does not mean that educational institutions must ignore genuine and unforeseen increases in expenditure.

Nor does it mean that a prospectus clause, standing alone, resolves every dispute in favour of the institution.

The judgment must be read as a whole, with particular attention to the distinction between the Supreme Court’s observations on the High Court’s reasoning and its decision to affirm the final directions protecting the relevant students.

The sound approach is to examine the governing regulations, the timing of admission, the date and terms of the revised fee notification, the competent authority’s decision and the precise relief sought.

That approach respects both the judgment and the limits of what it decided.

Frequently Asked Questions

1. Can a private engineering college increase fees after admission?

A fee increase after admission is not automatically unlawful in every circumstance. However, the applicable regulatory framework must be followed, and a mid-course variation should be assessed carefully. The Supreme Court has emphasised advance notification of the fees payable for the entire course, while recognising that exceptional circumstances may justify a variation.

2. What did the Supreme Court decide in the Dr. B.C. Roy Engineering College case?

In Dr. B.C. Roy Engineering College & Anr. v. State of West Bengal & Ors., 2026 INSC 1120, the Supreme Court disagreed with aspects of the Calcutta High Court Division Bench’s reasoning but affirmed its final directions concerning the application of the West Bengal notification dated 16 October 2023 and refund or adjustment for the protected group of students.

3. Can a college impose a 30% or 40% fee hike during a course?

The percentage alone does not determine whether the increase is lawful. The relevant questions include whether the revision was authorised under the applicable rules, whether the competent authority approved it, whether the prescribed procedure was followed and whether the revised fee can lawfully apply to students already admitted.

4. Are students entitled to a refund if a college collects increased fees unlawfully?

A refund may be available where it is supported by an applicable judicial order, statutory provision or other legal basis. In the West Bengal litigation discussed here, the Supreme Court affirmed the High Court’s directions concerning refund or adjustment for the protected students. The relief cannot automatically be extended to every fee dispute nationwide.

5. Can students approach the High Court against an unreasonable fee increase?

Students may seek relief under Article 226 where the facts and law justify judicial intervention, including in appropriate cases involving statutory violations or unlawful regulatory action. The availability of alternative statutory remedies and the specific circumstances of the dispute may also be relevant.

6. Does a fee-revision clause in the college prospectus make every increase valid?

No. A prospectus clause must be read alongside the applicable laws, regulations, fee-fixation orders and judicial directions. Its presence does not, by itself, establish that every subsequent increase is legally permissible.

7. Can colleges increase fees because their operating costs have risen?

Genuine increases in expenditure may be relevant, particularly where circumstances were unforeseen. However, an institution must still comply with the governing regulatory framework. A general claim of increased costs does not, by itself, establish an unrestricted right to revise fees during a course.

Conclusion: Fee Certainty Matters, but the Legal Position Must Be Examined Carefully

Professional education requires substantial investment from both institutions and families. Colleges need adequate resources to provide quality education, but students also need to know what they are committing themselves to before they accept admission.

The Supreme Court’s decision in Dr. B.C. Roy Engineering College & Anr. v. State of West Bengal & Ors. brings this tension into focus. Its discussion reinforces the importance of notifying the fees payable for the entire course before admission and treating mid-course variations as exceptional rather than routine.

At the same time, the judgment does not create an absolute ban on every fee revision or an automatic right to a refund in every dispute. Its reasoning and operative directions must be understood in their proper context.

For students facing a mid-course fee hike in professional colleges, the first step is to examine the original fee structure, the revised demand, the applicable notification and the legal authority relied upon by the institution. The available remedy will depend on those documents and the governing rules.

For colleges and regulatory authorities, the decision is a reminder that timely fee determination and transparent disclosure are essential to a fair and predictable system of professional education.

A fee dispute should not be approached merely as a disagreement over money. It is also a question of regulatory compliance, informed choice and the balance between institutional sustainability and the legitimate expectations of students.

Facing a Sudden College Fee Hike? Know Your Legal Rights Before You Pay More.

Has your engineering, pharmacy or other professional college increased its fees after admission? Are you being asked to pay substantially more than the amount disclosed when you enrolled?

An unexpected fee hike can put years of financial planning at risk. But before accepting the demand or taking a step that could affect your education, it is important to understand whether the increase complies with the applicable regulations and judicial directions.

The Supreme Court has emphasised the importance of notifying students of the fees payable for the entire course before admission, while recognising that variations may be justified in exceptional circumstances. Whether a particular mid-course fee hike is legally challengeable depends on the facts, the applicable rules and the documents involved.

Don’t rely on assumptions or informal assurances. Get your documents examined and understand your available legal options.

Seek Legal Guidance from an Experienced Supreme Court Advocate

Adv. However, variations during an ongoing course should be exceptional and must comply with the applicable regulatory framework.

Exceptional Circumstances Matter: Unforeseen increases in expenditure may justify consideration of a fee revision, but financial difficulties alone do not give a college unrestricted authority to increase fees.

Supreme Court Judgment of 14 October 2026: In Dr. B.C. Roy Engineering College & Anr. v. State of West Bengal & Ors., 2026 INSC 1120, the Supreme Court disagreed with aspects of the Calcutta High Court’s reasoning but affirmed its final directions concerning the revised fee notification and refund or adjustment for the protected group of students.

Refund of Excess College Fees: Students covered by the operative directions in this case may rely on those directions regarding refunds or adjustments. The ruling does not create an automatic nationwide refund entitlement for every fee dispute.

Role of Fee-Fixation Committees: Statutory fee-fixation committees play an important role in regulating professional college fees. Their functioning should be efficient, transparent and supported by appropriate expertise and integrity.

AICTE Regulations and State Rules: Whether a fee increase is lawful depends on the applicable AICTE requirements, State notifications, fee-fixation rules and other relevant legal provisions.

A Prospectus Clause Is Not Conclusive: A clause allowing fee revision does not automatically validate every subsequent increase. It must be read alongside applicable laws, regulations and binding judicial directions.

Students Can Explore Legal Remedies: Depending on the facts, students may submit a written representation to the college or competent regulatory authority and, where legally justified, seek relief before the High Court under Article 226 of the Constitution.

Documents Are Essential: Students challenging a mid-course fee hike should preserve their admission letter, original fee schedule, revised fee notice, payment receipts and relevant regulatory orders.

In summary: The Supreme Court’s decision reinforces the importance of advance fee disclosure and careful regulation of mid-course fee increases. Whether a particular increase can be challenged depends on the applicable rules, the facts of the case and the relief available under the law.

Bridging the Gap: Law Colleges as Catalysts for Legal Aid and Social Justice

Medical College Admission Denied?
