It focuses on justice and holding the offender accountable.

Example: A person who deliberately commits murder should receive a punishment that matches the seriousness of the crime.

Criticism: If applied too harshly, it can turn into revenge instead of justice.

Deterrent Theory

This theory aims to prevent crime by creating fear of punishment. It works in two ways:

General deterrence: Discourages other people from committing similar crimes.

Specific deterrence: Discourages the particular offender from committing more crimes.

Example: Punishing someone for drunk driving may stop others from driving under the influence of alcohol.

Criticism: Harsh punishment does not always succeed in preventing crime.

Preventive Theory

This theory seeks to stop offenders from committing further crimes by limiting their ability to do so.

Example: Imprisonment can temporarily keep a dangerous offender away from the community.

Criticism: Too much reliance on imprisonment can harm individual liberty and may not deal with the root causes of crime.

Reformative or Rehabilitative Theory

This theory looks at the offender’s circumstances and tries to change the person into a responsible member of society. It focuses on education, skill training, counselling, treatment, and rehabilitation.

Example: Giving education and job training to prisoners so they can live law-abiding lives after release.

Criticism: Rehabilitation does not always work, and public safety must still be protected.

Expiatory Theory

This theory stresses repentance, remorse, and the offender’s willingness to make amends for the wrong done.

Example: An offender shows genuine remorse and, where the law allows, compensates the victim for the loss caused.

Criticism: Remorse alone cannot replace proper punishment for serious crimes.

Restorative Justice Theory

Restorative justice focuses on repairing the harm caused by the crime. It encourages the offender to accept responsibility and, where suitable, make amends to the victim and the community.

Example: In an appropriate case, an offender may compensate the victim or take part in a restorative justice process.

Criticism: It may not be suitable for certain serious offences or when the victim cannot take part freely and safely.

Purposes of Punishment

The main purposes of punishment are:

Justice: To hold offenders accountable for their wrongdoing.

Deterrence: To discourage the offender and others from committing crimes.

Prevention: To protect society from further offending.

Reformation: To help offenders change their behaviour.

Rehabilitation: To prepare offenders for return to society.

Restoration: To repair the harm caused to victims and communities.

Public protection: To maintain peace, security, and public confidence in the legal system.

A balanced criminal justice system uses these purposes together rather than relying on only one of them.

Measures and Forms of Punishment

These are the different kinds of penalties the law may impose:

Death Penalty

The most severe form of punishment. Article 20 protects against certain retrospective criminal laws, double jeopardy, and forced self-incrimination. Article 21 protects life and personal liberty and requires that any deprivation of liberty follow a procedure established by law. Article 14 guarantees equality before the law and equal protection of the laws.

Important Judicial Decisions

Bachan Singh v. A sound criminal justice system combines different approaches:

Retribution ensures accountability.

Deterrence discourages crime.

Prevention protects society.

Reformation and rehabilitation help offenders change.

Restorative justice addresses the harm suffered by victims.

The right approach depends on the nature of the offence, the circumstances of the offender, the interests of the victims, and the need to protect society.

Conclusion

Punishment is not merely a way of causing suffering to an offender. It is a tool of justice, public protection, and social order. Effective punishment must be lawful, proportionate, and fair. Serious crimes may call for severe penalties, but rehabilitation, victim compensation, and community-based measures can also play a useful role in appropriate cases.

The ultimate goal of criminal justice is to balance accountability, crime prevention, public safety, the interests of victims, and the possibility of reform.

Punishment under BNS

Victim Compensation And The Role Of Technology In Victim Support

Victimology And Restorative Justice: Evolving Legal Frameworks In India

Changing Aspects of Victimology: From Compensation to Digital Rehabilitation

Penological Purposes Of Capital Punishment

Introduction Punishment is a penalty given by the State to a person found guilty of a crime.
