Rafikul Islam & Others v. It declined to accept the petitioners’ factual defences as grounds for terminating the proceedings at the preliminary stage.

Importantly, the refusal to quash the case is not a finding of guilt. The complainant further alleged that they subsequently lived together in Bardhaman.

The complaint also contained allegations of sexual assault, confinement, threats and physical assault involving the principal accused and members of his family. The prosecution relied on the materials collected during the investigation, including the injury report concerning the alleged assault at a family residence.

Following an application under Section 156(3) CrPC, Nimta Police Station Case No. 885/2021 was registered. The investigation resulted in a charge sheet invoking, among other provisions, Sections 416, 419, 420, 498A, 323, 120B, 506 and 34 of the Indian Penal Code, 1860.

The accused approached the High Court seeking to have the criminal proceedings quashed. Their arguments included challenges to the complainant’s account, the nature of the relationship, the validity of the alleged marriage and the significance of departmental proceedings concerning one of the petitioners.

The Court had to determine whether those submissions justified terminating the prosecution without a trial.

Calcutta High Court on ‘Love Jihad’: No Distinct Offence Defined by Central Law

One of the significant aspects of the decision was the Court’s treatment of the expression “love jihad”.

The judgment extract states that there is “no single central legislation or Act” defining or recognising “love jihad” as a distinct legal offence. The Court also found that the characterisation had no bearing on its assessment of the alleged deception.

The distinction matters. A politically or socially charged expression does not, by itself, establish the ingredients of a criminal offence. Criminal liability must arise from the applicable statute and the facts alleged, rather than from the label attached to a relationship.

The Court’s approach was therefore to examine the alleged concealment of identity and marital status, the allegations of assault and intimidation, and the material collected during the investigation. It did not treat the expression “love jihad” as a substitute for the legal analysis required under the relevant provisions of the IPC.

The Court also found no material establishing an attempt at religious conversion in the circumstances described in the judgment extract. The case was assessed on the allegations and offences actually before the Court, not on an assumed conversion-related motive.

Does Concealing Religion Automatically Amount to Cheating?

No. Concealment of religious identity does not automatically establish cheating or cheating by personation. Whether a criminal offence is made out depends on the applicable statutory ingredients and the evidence in the particular case.

Sections 416 and 419 IPC concern cheating by personation, while Section 420 addresses cheating and dishonestly inducing delivery of property. The prosecution must establish the elements required by the particular offence; the mere existence of a relationship or a misrepresentation does not automatically prove every element of these provisions.

The question before the High Court, however, was not whether the accused had already been proved guilty. It was whether the allegations and investigative materials justified quashing the prosecution before trial.

The petitioners disputed the complainant’s version and relied on their own factual explanations. The Court considered those defences unsuitable for final determination in a Section 482 proceeding.

The issue of consent also required careful consideration. Section 90 IPC addresses circumstances in which consent is not valid consent for the purposes of the Code, including where it is given under a misconception of fact in circumstances covered by the provision. Whether the alleged concealment had the legal effect asserted by the prosecution would depend on the facts and evidence.

The Court did not hold that every concealment of religion vitiates consent or constitutes a criminal offence. It declined to resolve the disputed factual questions at the quashing stage.

Why the Court Refused to Quash the Proceedings Under Section 482 CrPC

Section 482 CrPC preserves the High Court’s inherent power to prevent abuse of the process of a court and to secure the ends of justice. The power is important, but it is not intended to replace a criminal trial whenever the accused disputes the prosecution’s version.

In applying this principle, the Court considered the Supreme Court’s guidance in Neeharika Infrastructure Pvt. Ltd. v. State of Maharashtra, 2021 SCC OnLine SC 315, on the limited scope of judicial interference with criminal investigations and proceedings.

The Court also considered Rajiv Thapar v. Madan Lal Kapoor, (2013) 3 SCC 330, which addresses the circumstances in which defence material may justify quashing criminal proceedings. Defence material must meet a stringent standard; disputed factual claims cannot simply be accepted as conclusive at the preliminary stage.

The central question was whether the prosecution materials, taken at face value, disclosed a basis for continuing the case. The Court concluded that the allegations and materials could not be rejected on the grounds advanced by the petitioners.

Allegations Against Family Members and the Injury Report

The proceedings also involved allegations against other petitioners concerning an assault at a residence in Murshidabad.

The Court considered these allegations alongside the injury report. It did not regard the allegations as inherently improbable or so plainly insufficient that the proceedings against the concerned petitioners should be terminated at the threshold.

The significance of this assessment was limited to the quashing application. Whether the allegations are ultimately established remains a matter for the criminal court after considering the evidence.

Departmental Inquiry Does Not Automatically End Criminal Proceedings

The petitioners also relied on the outcome of departmental proceedings concerning one of them.

The High Court did not treat the departmental inquiry as conclusive of the criminal allegations. Departmental proceedings and criminal prosecutions serve different purposes and operate under different standards of proof. An outcome in one does not automatically determine the other.

The Court considered whether the departmental findings demonstrated that the criminal prosecution was an abuse of process. It concluded that they did not provide a sufficient basis to quash the proceedings in their entirety.

The Court also considered the argument concerning Section 498A IPC and the alleged marriage. Even if the applicability of that provision required further examination, a challenge to one charge would not, by itself, justify terminating the entire prosecution where other allegations could independently warrant a trial.

What the Judgment Does—and Does Not—Establish

The decision draws an important distinction between a descriptive label and a legally defined offence.

The Court did not recognise “love jihad” as a separate offence. Nor did it hold that concealment of religious identity automatically amounts to cheating, invalidates consent or establishes criminal liability.

Instead, it assessed whether the allegations concerning identity, marital status, assault and intimidation, together with the investigative materials, justified allowing the prosecution to proceed.

The ruling also reinforces the limits of Section 482 CrPC. A High Court may intervene where the legal requirements for quashing are met, but it ordinarily does not resolve contested questions of credibility and fact that require evidence at trial.

Final Order

The Calcutta High Court dismissed C.R.R. No. 3501 of 2022 and disposed of the connected applications identified in the judgment. The interim order was vacated.

The practical effect is that the criminal proceedings were not terminated at the quashing stage. The dismissal does not amount to a conviction, and the allegations must still be determined through the applicable criminal process.

Frequently Asked Questions

1. Why did the High Court refuse to quash the criminal case?

The Court found that the allegations and investigative materials disclosed issues that could not appropriately be resolved in a Section 482 CrPC proceeding. The petitioners’ factual defences required consideration through the criminal process.

4. Can a departmental inquiry determine the outcome of a criminal case?

Not automatically. Departmental proceedings and criminal prosecutions have different purposes and standards of proof. The result of a departmental inquiry does not, by itself, require a criminal prosecution to be quashed.

Conclusion

The Calcutta High Court’s decision is significant for its distinction between the expression “love jihad” and offences recognised by criminal law. A label cannot replace statutory ingredients, and a disputed allegation is not a finding of guilt. The Court refused to quash the proceedings because the allegations and materials required further judicial examination, leaving the merits to be determined through the criminal process.

Need Legal Advice?
