Commonly referred to as the Imperative Theory, Command Theory, Sanction Theory, or Theory of Sovereignty, his concept emphasizes that legal systems fundamentally rely on authoritative authority, id="Austins_Definition_of_Law">Austin’s Definition of Law

Austin defined positive law as the command of a sovereign, addressed to subjects who are under an obligation to obey, and backed by the threat of a sanction for disobedience.

In simple terms:

Law = Command of a political superior + Duty to obey + Sanction for non-obedience.

Example: The Bharatiya Nyaya Sanhita, 2023 – Section 303 (2). If a person steals, the State may prosecute and punish that person. The prohibition is a command; the duty is not to steal; the sanction is fine or imprisonment.

Classic Legal Example: Speed Limit Laws

A command issued by a sovereign, backed by sanctions.

Element

Explanation

The Sovereign

The state parliament or legislature (the supreme political authority whose authority is habitually obeyed).

The Command

Do not drive faster than 60 km/h in this zone.

The Duty

Drivers are legally obligated to follow this rule.

The Sanction

If you break the speed limit, you face a monetary fine, penalty points, or license suspension.

Austin carefully distinguished positive law (made by political superiors) from other rules such as moral principles, religious precepts, and social customs. Only the former qualify as “law properly so called.”

Essential Elements of Austin’s Theory

Command

A command is an expression of a wish by a superior that an inferior should do or refrain from doing something, coupled with the possibility of an evil (sanction) if the wish is disregarded.

Example: A statute requiring citizens to pay income tax is a command directing taxpayers to pay the prescribed amount by the due date.

Sovereign

The sovereign is a person or body of persons whom the bulk of the society habitually obeys, while the sovereign itself does not habitually obey any other earthly political superior.

In simple language, the sovereign is the highest political authority in an independent political society. Austin’s model assumes that this authority is legally unlimited.

Duty

A legal duty arises when a person is required by a command to act or forbear from acting in a particular way.

Example: When the law requires payment of tax, every person to whom the command is addressed has a legal duty to pay it.

Sanction

A sanction is the evil or adverse consequence (usually punishment) that the sovereign attaches to disobedience of a command. Austin regarded the possibility of sanction as essential to distinguish a true legal command from a mere request or piece of advice.

Example: A person who commits murder faces the sanction of life imprisonment or the death penalty under the relevant criminal law.

Habitual Obedience

The majority of people in an independent political society habitually obey the sovereign. This habitual obedience is what identifies the sovereign and distinguishes it from ordinary officials.

Main Features of Austin’s Theory

Law is a command – it expresses the will of the political superior.

Law emanates from the sovereign – only the supreme political authority can make positive law.

Law imposes duties – subjects are under an obligation to obey.

Law is backed by sanctions – disobedience is followed by the threat of punishment.

Law and morality are distinct – the legal validity of a rule does not depend on its moral quality.

The sovereign is supreme – there is no higher earthly political authority above the sovereign.

Separation of Law and Morality

Austin insisted on a clear distinction between “law as it is” and “law as it ought to be.” The question whether a rule is legally valid is separate from the question whether it is morally just or desirable.

Example: A tax statute that many people regard as unfair remains legally valid so long as it is the command of the sovereign. Its moral quality is a different inquiry.

This separation is a central tenet of legal positivism. Austin did not say morality is unimportant; he only insisted that legal validity and moral evaluation must be kept distinct.

Criticism of Austin’s Theory

Austin’s theory was influential, yet it faces several well-known objections.

Not All Laws Are Commands

Many modern laws confer powers rather than impose duties.

Example: The law that enables a person to make a valid will (Succession Act) or to enter into a contract does not command anyone to make a will or a contract. It merely gives a power. Such power-conferring rules cannot easily be fitted into the command model.

Customary Law

Some legal rules arise from long-continued custom rather than from an express command of the sovereign. Austin’s theory struggles to explain the origin and binding force of customary law.

Constitutional Limitations

In modern constitutional democracies the legislature is not legally unlimited. Written constitutions impose restrictions on legislative power.

Indian illustration: In Kesavananda Bharati v. State of Kerala (1973) the Supreme Court held that Parliament’s amending power is limited by the basic structure of the Constitution. This idea of limited sovereignty is difficult to reconcile with Austin’s unlimited sovereign.

International Law

Austin classified international law as “positive international morality” rather than positive law because there is no single sovereign above all States. Today, however, international law is widely accepted as law, supported by treaties, customary rules, and institutions such as the International Court of Justice and the United Nations.

Sanctions Are Not Essential to Every Legal Rule

People often obey law because they regard it as legitimate, fair, or socially necessary, not merely from fear of punishment. Moreover, some legal rules (e.g., certain facilitative or constitutive rules) do not prescribe sanctions at all.

Importance of Austin’s Theory

Despite its limitations, Austin’s analysis made lasting contributions:

It promoted the systematic and scientific study of law.

It sharply distinguished legal validity from moral judgment.

It focused attention on the link between law, political authority, and enforcement.

It laid the foundation for later developments in legal positivism (notably the work of H.L.A. Hart, who refined and criticised Austin’s command theory).

Conclusion

John Austin explained law primarily as the command of a sovereign backed by sanctions. The four key concepts—command, sovereign, duty, and sanction—remain useful for understanding the role of political authority and coercion in a legal system.

At the same time, the theory cannot fully account for power-conferring rules, customary law, constitutional limitations on sovereignty, or modern international law.
