id="Structure_of_the_Judiciary">Structure of the Judiciary

India has a hierarchical court system:

Supreme Court of India

Supreme Court of India: The highest court. It is the final authority on constitutional matters and hears appeals from High Courts. It also has original jurisdiction in disputes between the Centre and States or between States.

High Courts

High Courts: Each state (or group of states) has a High Court. These courts supervise subordinate courts and hear appeals from lower courts. They also deal with important constitutional and civil/criminal matters.

Subordinate Courts

Subordinate Courts: These include District Courts, Sessions Courts, Civil Courts, and Magistrate Courts. Most cases begin here. District Judges handle serious civil and criminal cases, while Magistrates deal with less serious offences.

Specialised Courts and Tribunals

Besides regular courts, there are specialised bodies such as Family Courts, Consumer Forums, Labour Courts, and various Tribunals (for tax, service matters, etc.). These help reduce the burden on regular courts and provide faster resolution in specific areas.

How Justice Is Delivered

Criminal Cases

A criminal case usually starts with a complaint or First Information Report (FIR) at a police station. The police investigate, collect evidence, and file a charge sheet in court. The court then conducts the trial. The accused is presumed innocent until proven guilty. Both the prosecution and the defence present evidence and arguments. After hearing both sides, the judge delivers the judgment. If convicted, the court decides the punishment according to law. Appeals can be filed in higher courts.

Civil Cases

Civil disputes (property, contracts, family matters, etc.) begin when a person files a plaint (petition) in the appropriate court. The other party is given a chance to reply. The court examines documents, hears witnesses, and decides the rights and liabilities of the parties. Remedies may include compensation, injunctions, or specific performance of contracts.

Appeals and Review

If a party is dissatisfied with a decision, they can appeal to a higher court. The higher court examines whether the lower court correctly applied the law and whether the evidence supports the decision.

Key Features of the System

Independence of Judiciary

Independence of Judiciary: Judges are protected from executive interference. This ensures impartial decisions.

Rule of Law

Rule of Law: No one is above the law. Even the government must follow legal procedures.

Access to Justice

Access to Justice: Free legal aid is available to the poor through Legal Services Authorities. Lok Adalats (people’s courts) help settle disputes amicably and quickly.

Fair Trial

Fair Trial: The accused has the right to know the charges, engage a lawyer, cross-examine witnesses, and present a defence.

Public Interest Litigation (PIL)

Public Interest Litigation (PIL): Any citizen can approach the court on behalf of the public or disadvantaged groups if a legal right is being violated.

Challenges in the System

Despite its strengths, the system faces serious problems:

Huge backlog of cases leading to long delays.

Shortage of judges and inadequate infrastructure.

High cost of litigation for ordinary citizens.

Complex procedures that confuse common people.

Limited awareness about legal rights, especially in rural areas.

Weakening Judicial Independence

These delays often mean that “justice delayed is justice denied.”

Reforms and Improvements

Several steps have been taken to improve the system:

e-Courts Project

e-Courts Project: Digitisation of case records, online filing, and virtual hearings to make the process faster and more transparent.

Alternative Dispute Resolution

Alternative Dispute Resolution: Mediation, arbitration, and Lok Adalats encourage settlement outside formal courts.

Fast Track Courts

Fast Track Courts: Special courts for cases involving women, children, and other priority matters.

New Criminal Laws

New Criminal Laws: Recent replacement of older criminal codes aims to simplify procedures, improve investigation standards, and speed up trials.

Legal Aid and Awareness

Legal Aid and Awareness: Continuous efforts to provide free legal help and educate people about their rights.

Conclusion

India’s justice delivery system is based on strong constitutional principles of fairness, equality, and independence. While it has delivered justice in countless cases and protected democratic values, delays and access problems remain major concerns. Continuous reforms, better infrastructure, more judges, greater use of technology, and stronger legal awareness are essential to make justice truly accessible, speedy, and meaningful for every citizen.

A strong and efficient justice system is the foundation of a healthy democracy.
