It separates law from morality. According to this school, a rule is law simply because it has been properly made by the authority that has the power to make it—not because it is good, just, or moral.

The central idea is: “Law is law, whether good or bad.” The task of a jurist is to analyse and understand the structure, concepts, and working of existing law, not to judge it on ethical grounds.

The Analytical School is illustrated by Austin’s classic example of a sovereign’s statute that commands “anyone who commits theft shall be imprisoned for up to three years,” which is valid law solely because it issues from the political superior and is backed by the sanction of imprisonment, irrespective of whether the penalty is considered morally just or harsh; similarly, Bentham praised precise penal codes that clearly define offences and punishments so citizens know exactly what the sovereign commands, while Hart’s refined version is seen in the Indian Constitution functioning as a “rule of recognition”—a statute such as a taxation law or the Bharatiya Nyaya Sanhita remains valid positive law if enacted according to constitutional procedure, even if critics regard it as unfair, because its legal status derives from formal pedigree rather than moral content.

Main Thinkers of the Analytical School

Two names stand out:

Jeremy Bentham (1748–1832)

He is regarded as the founder of this approach. Bentham believed that law should be clear, logical, and useful for the greatest number of people. He strongly criticised vague and outdated laws and pushed for systematic legal reform based on utility (usefulness).

John Austin (1790–1859)

Austin is the most famous representative of the Analytical School. In his book The Province of Jurisprudence Determined, he defined law as “the command of the sovereign, backed by sanctions.” According to Austin, the sovereign is a person or body that is habitually obeyed by the bulk of the population and does not itself obey any higher authority. He carefully distinguished law from other rules such as moral rules, religious rules, or customs that lack sovereign command.

H.L.A. Hart and the Development of Legal Positivism

Later thinkers such as H.L.A. Hart refined these ideas. Hart moved away from the strict “command” theory and explained law as a system of primary rules (which tell people what to do) and secondary rules (which tell officials how to make, change, and apply the primary rules).

Key Features of the Analytical School

Focus on Positive Law: It studies only man-made law (positive law), not natural law or divine law.

Separation of Law and Morality: What the law is and what the law ought to be are two different questions.

Command Theory: Law is essentially a command of the sovereign enforced by sanctions (punishment or coercion).

Scientific and Logical Analysis: Jurists should analyse legal concepts such as right, duty, ownership, possession, liability, etc., in a clear and systematic way.

Sovereign Authority: The existence of a clear sovereign is essential for the existence of law.

Importance of the Analytical School

This school brought clarity and precision to the study of law. Before it, legal thinking was often mixed with religion, morality, and philosophy. The Analytical School helped lawyers and judges concentrate on the actual rules that courts apply. It also encouraged the codification and systematic arrangement of laws, which is visible in many modern legal systems.

Criticisms of the Analytical School

Despite its strengths, the Analytical School has faced strong criticism:

It ignores the moral and social aspects of law. A purely bad or unjust law can still be treated as valid law under this theory.

Austin’s idea of a single sovereign does not fit well with modern democratic states, federal systems, or international law.

Customs, conventions, and judicial decisions often create law without a clear “command.”

It gives little attention to how law actually develops in society and how people experience it.

Conclusion

The Analytical School of Jurisprudence remains foundational in legal education. It teaches us to look carefully at the structure and language of law and to distinguish between legal validity and moral desirability. While later schools (Sociological, Historical, Realist) have shown the limitations of a purely analytical approach, the clarity and discipline introduced by Bentham and Austin continue to influence how lawyers, judges, and scholars analyse legal rules even today.

In simple words, the Analytical School asks us to first understand what the law is, before we start arguing about what the law ought to be.

Different Schools of Jurisprudence: Meaning, Main Ideas and Examples

Austin’s Definition of Law: The Imperative, Command, Sanction and Sovereignty Theory

Meaning, Nature and Scope of Jurisprudence

The State and Sovereignty: Concepts, Theories and the Indian Constitutional Framework

The Law v/s A Law: Understanding the Classification and Distinction

Analytical School of Jurisprudence The Analytical School of Jurisprudence is one of the most important approaches to studying law.
