Yet its practical meaning becomes particularly important when the Supreme Court is called upon to examine contentious questions involving electoral integrity, restrictions on public protests and the exercise of executive power.

These concerns have returned to the forefront following recent remarks by Senior Advocate Kapil Sibal, who alleged that the Union government was attempting to bring important institutions under its influence. While expressing concern about the state of institutional independence, Sibal maintained that he continued to have faith in the Supreme Court’s ability to resist such pressure.

His remarks deserve examination beyond the immediate political controversy. They raise fundamental questions about the separation of powers, the constitutional position of the Supreme Court and the standards by which judicial independence should be assessed.

What Did Kapil Sibal Say About the Supreme Court?

At a press conference reported on 18 October 2026, Kapil Sibal alleged that the government had pursued a broader strategy of institutional capture since 2014. According to the reported remarks, he referred to institutions such as the media, universities and the offices of governors, arguing that the Supreme Court remained an important institution whose independence was yet to be overcome.

Sibal expressed confidence that the government would not succeed in bringing the Court under its control.

The distinction between his allegation and his expression of confidence is significant. He was not merely criticising individual judicial decisions. His argument concerned the institutional environment in which the judiciary operates and the possibility that political influence could gradually weaken constitutional checks and balances.

Such allegations are serious. They should neither be accepted as established fact without supporting evidence nor dismissed without examining the institutional circumstances to which they refer.

The relevant question is whether constitutional safeguards continue to operate effectively when the Court is asked to review decisions made by the executive or other public authorities.

Why Did Sibal Question the Court’s Role in the SIR Controversy?

The immediate political background to Sibal’s remarks was the controversy surrounding the Special Intensive Revision (SIR) of electoral rolls and concerns about restrictions imposed in connection with protests against Chief Election Commissioner Gyanesh Kumar.

SIR exercises are intended to revise electoral rolls and improve their accuracy. However, questions arise when voters, political parties or civil society groups allege that eligible voters have been excluded, that procedural safeguards are inadequate or that the revision process could affect electoral participation.

These concerns have particular constitutional significance because the right to participate in elections depends, in practice, on the integrity of electoral registration and the fair administration of election laws.

Sibal had reportedly expressed frustration with the process of approaching the Supreme Court over alleged wrongful additions and deletions in electoral rolls. His comments reflected a broader concern about whether judicial proceedings were providing timely and effective relief to those challenging the revision process.

However, criticism of the Court’s response must be distinguished from proof that the judiciary has lost its independence.

A court may reject a petition, defer a decision, grant limited relief or require a matter to be pursued through a statutory procedure without necessarily acting under political influence. Equally, the existence of judicial review does not, by itself, establish that every grievance has received an adequate remedy.

The central issue is therefore not simply whether the Supreme Court intervenes, but whether its decisions demonstrate principled, impartial and effective application of the law.

The Delhi Protest Restrictions and the Right to Dissent

The controversy also involved protests at Jantar Mantar concerning demands for the resignation of the Chief Election Commissioner.

According to the reports cited in the original account, restrictions affecting public transport and other services, along with detentions connected with the protests, prompted judicial scrutiny. The Supreme Court reportedly questioned the proportionality of certain restrictions and issued directions concerning the movement of public transport and the treatment of protesters.

These developments placed the constitutional right to protest at the centre of the debate.

The right to assemble peacefully is protected under Article 19(1)(b) of the Constitution. The freedom to express opinions and criticise public authorities is also protected under Article 19(1)(a). These rights are essential to democratic participation, particularly when citizens seek accountability from constitutional bodies.

Neither right is absolute. The State may impose reasonable restrictions on grounds recognised by the Constitution, including public order. Authorities may also regulate demonstrations to protect public safety and prevent serious disruption.

The legal question is whether such restrictions are supported by law, pursue a legitimate objective and remain proportionate to the circumstances.

A restriction imposed to prevent a demonstrable threat to public order may stand on a different footing from a blanket measure that unnecessarily interferes with ordinary movement or peaceful dissent.

If the reported judicial directions are accurately described, they illustrate the role of judicial review in examining whether executive action has gone beyond what the circumstances reasonably require.

Nevertheless, a particular order should be assessed on its actual wording, reasoning and legal effect. It would be premature to treat an interim direction concerning a protest as a definitive ruling on the wider question of institutional capture.

Judicial Independence Is Part of the Constitution’s Basic Structure

The constitutional position on judicial independence is considerably firmer than the political arguments surrounding Sibal’s remarks.

In Kesavananda Bharati v. State of Kerala (1973), the Supreme Court established the basic structure doctrine. Parliament has extensive power to amend the Constitution under Article 368, but that power cannot be used to destroy its basic structure.

Judicial independence and the constitutional system of checks and balances are integral to this framework.

The doctrine is important because it places substantive limits on constitutional amendments that could fundamentally undermine the institutions responsible for enforcing constitutional restraints.

Judicial independence is not simply a privilege enjoyed by judges. It is a constitutional safeguard intended to ensure that disputes involving the government, individual citizens and public authorities are decided according to law rather than political convenience.

Without an independent judiciary, constitutional guarantees could become difficult to enforce precisely when individuals need protection against the exercise of public power.

The principle also works in both directions. Judicial independence does not authorise courts to assume the functions of the legislature or executive. Courts must remain within their constitutional jurisdiction, provide reasons for their decisions and respect the institutional boundaries established by the Constitution.

An independent judiciary must therefore be free from improper influence while remaining accountable to the law.

The Judges Cases and the Collegium System

One of the most important institutional safeguards associated with judicial independence is the method used to appoint judges to the higher judiciary.

Articles 124 and 217 govern appointments to the Supreme Court and High Courts, respectively. Their interpretation has been shaped by a series of landmark decisions commonly known as the Judges Cases.

In Supreme Court Advocates-on-Record Association v. Union of India (1993), generally known as the Second Judges Case, the Supreme Court established the primacy of the Chief Justice of India’s institutional opinion in judicial appointments, subject to a consultative process involving senior judges.

The Third Judges Case, arising from the Presidential Reference decided in 1998, clarified the collegium’s composition and consultation requirements.

Together, these decisions established the framework under which recommendations for appointments and transfers of higher-court judges are considered through the collegium system.

The system has attracted criticism, particularly concerning transparency, accountability and the limited public visibility of the reasons behind some recommendations.

Those concerns are legitimate subjects of constitutional debate. However, criticism of the collegium’s operation should not be confused with the separate question of whether judicial appointments should be subject to executive control.

The challenge is to protect judicial independence while ensuring that appointments are transparent, principled and based on merit.

Why the Supreme Court Struck Down the NJAC

The debate over appointments reached a decisive stage in Supreme Court Advocates-on-Record Association v. Union of India (2015), the National Judicial Appointments Commission (NJAC) case.

Parliament had enacted the 99th Constitutional Amendment and the National Judicial Appointments Commission Act, 2014, to replace the collegium system with a commission involving judicial and non-judicial members.

In a 4:1 decision, the Supreme Court struck down the constitutional amendment and the legislation.

The majority concluded that the NJAC framework compromised judicial independence, particularly by weakening judicial primacy in appointments and allowing non-judicial members to exercise significant influence over the selection process.

The judgment restored the collegium system.

The decision remains central to the constitutional understanding of judicial independence in India. It demonstrates that even a constitutional amendment supported by Parliament and the requisite number of states can be invalidated if it violates the Constitution’s basic structure.

At the same time, the NJAC judgment does not establish that every government proposal affecting the judiciary is unconstitutional. Its significance lies in the constitutional limits it places on arrangements that would undermine the judiciary’s institutional independence.

The Constitutional Provisions That Matter

Several provisions of the Constitution and electoral legislation are relevant to the issues raised by Sibal’s remarks.

Article 50: Separation of the Judiciary from the Executive

Article 50, a Directive Principle of State Policy, directs the State to take steps to separate the judiciary from the executive in the public services of the State.

Although it is not independently enforceable in the same manner as a fundamental right, it reflects the constitutional commitment to keeping judicial functions separate from executive administration.

Articles 124 and 217: Appointment of Judges

These provisions establish the constitutional framework for appointments to the Supreme Court and High Courts. It does not place the Election Commission beyond judicial review.

Representation of the People Act, 1950

Section 21 addresses the preparation and revision of electoral rolls, including the provision for special revision in the circumstances specified by the statute.

The legality of an SIR exercise must therefore be assessed with reference to the applicable statutory framework, the Election Commission’s constitutional powers and the procedural safeguards governing the process.

Article 19: Freedom of Speech and Peaceful Assembly

Articles 19(1)(a) and 19(1)(b) protect freedom of speech and expression and the right to assemble peacefully and without arms. Restrictions must satisfy the relevant constitutional requirements.

Prohibitory Orders and Criminal Procedure

Restrictions on public gatherings may also involve statutory powers to prevent public-order disturbances. The applicable legal provision depends on the date, circumstances and nature of the order.

The Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS), contains provisions concerning urgent orders in cases of nuisance or apprehended danger. Section 163 is particularly relevant to certain prohibitory orders.

Any assessment of a particular restriction must identify the provision actually invoked and examine whether the statutory conditions were satisfied.

Taken together, these provisions demonstrate that the Constitution does not place public authorities beyond scrutiny. It establishes a framework within which their powers must be exercised and reviewed.

What Is the Current Position on the SIR Litigation?

The SIR controversy raises difficult questions about the relationship between the Election Commission’s authority to maintain electoral rolls and the need to protect eligible voters from wrongful exclusion.

The Election Commission has a legitimate responsibility to maintain accurate electoral rolls. Electoral integrity depends on preventing ineligible entries as well as ensuring that eligible citizens are not arbitrarily removed.

Challenges to a revision exercise must therefore be evaluated on their legal and factual merits, including the statutory procedure, the evidence supporting alleged irregularities and the availability of effective remedies.

The original draft refers to a May 2026 Supreme Court judgment concerning the Bihar SIR and to pending petitions challenging aspects of the wider revision process.

Those developments should be verified against the relevant judgments, orders and official case records before publication. The precise scope of any ruling, the relief granted and the status of related petitions cannot safely be inferred from a news report alone.

The distinction matters. A decision upholding the Election Commission’s authority to conduct a revision would not necessarily validate every individual deletion or every procedural step taken during the exercise. Conversely, evidence of isolated errors would not automatically establish that the entire exercise was unconstitutional.

A sound legal analysis must distinguish the general validity of the process from challenges to particular decisions or alleged irregularities.

Does Judicial Intervention Disprove Allegations of Institutional Capture?

One argument against Sibal’s position is that the Supreme Court continues to examine executive action, hear challenges to electoral processes and issue directions when legal violations are established.

The reported scrutiny of restrictions connected with the Delhi protests is relevant to that argument. If a court questions excessive restrictions or directs authorities to comply with constitutional requirements, it demonstrates that judicial review remains an operative safeguard.

However, the existence of judicial intervention does not conclusively settle the wider question of institutional independence.

A court’s independence cannot be measured solely by counting decisions that favour or oppose the government. Nor can it be assessed simply by whether the Court accepts the arguments of the Opposition.

The more meaningful questions concern the quality of judicial reasoning, consistency in applying legal principles, procedural fairness, timely access to remedies and the willingness to scrutinise the exercise of public power without regard to political consequences.

Critics of the government may argue that institutional influence can develop gradually through appointments, administrative pressure or changes in the broader environment in which public institutions function.

The opposing view is that such allegations require concrete evidence and should not be treated as established facts merely because a court’s decisions are controversial or its relief is narrower than a litigant expected.

Both considerations matter. Judicial independence must be protected against genuine interference, but public confidence also depends on avoiding unsupported conclusions about judicial motives.

The Government’s Position and the Limits of Political Allegations

The allegation that a government is attempting to capture the Supreme Court is a serious political charge. It should not be confused with a judicial finding that such capture has occurred.

The constitutional debate over judicial appointments, the role of the executive and the operation of the collegium has continued across successive governments. Questions about institutional independence are therefore not confined to one political administration.

Supporters of the government’s position may argue that elected governments have a legitimate role in constitutional governance, that Parliament can debate reforms to judicial appointments and that the Election Commission must retain sufficient authority to administer electoral law.

They may also contend that judicial decisions should be judged on their legal reasoning rather than on whether they align with a particular political position.

These arguments have constitutional weight. The executive and legislature are not prohibited from criticising judicial decisions or proposing lawful institutional reforms.

The critical distinction is between legitimate constitutional disagreement and an attempt to undermine judicial independence through improper pressure or arrangements that violate the basic structure.

A government may disagree with a judgment. Parliament may legislate within its constitutional authority. Neither circumstance, by itself, establishes institutional capture.

Similarly, allegations of political influence should be investigated and evaluated on evidence rather than accepted or rejected solely on the basis of political allegiance.

Why Judicial Independence Matters Beyond the Courtroom

The debate surrounding Kapil Sibal’s remarks extends beyond the relationship between the government and the Supreme Court.

Judicial independence affects how ordinary citizens experience the Constitution. It matters when a voter challenges an alleged wrongful deletion from an electoral roll, when a journalist contests an unlawful restriction, when a citizen questions an administrative decision or when an individual seeks protection against arbitrary state action.

The assurance that such disputes will be decided by an impartial court is essential to the rule of law.

At the same time, independence must be accompanied by institutional credibility. Delays, inconsistent reasoning, limited transparency and difficulties in obtaining timely relief can weaken public confidence even where no improper interference has been established.

The responsibility to preserve that confidence does not rest exclusively on judges. The executive must respect judicial authority, the legislature must remain within constitutional limits, lawyers must present arguments responsibly and public officials must comply with lawful judicial directions.

Political leaders, too, have a responsibility to distinguish between legitimate criticism and allegations that require substantiation.

The strength of a constitutional democracy lies not in the absence of institutional conflict, but in its ability to resolve such conflicts through lawful processes.

Conclusion: The Test of Supreme Court Independence

Kapil Sibal’s remarks have brought an enduring constitutional concern back into public discussion: whether India’s institutions can continue to exercise their powers independently when political disagreements become increasingly intense.

The legal foundations of judicial independence are well established. The basic structure doctrine, the Judges Cases and the NJAC judgment provide substantial constitutional protection against measures that would fundamentally undermine the judiciary’s autonomy.

Articles 32 and 226 provide important mechanisms for constitutional review, while Articles 124 and 217 form part of the framework governing higher judicial appointments. The Supreme Court also retains the authority to examine executive and electoral action within its jurisdiction.

But constitutional safeguards are not self-executing guarantees of public confidence. Their effectiveness depends on how institutions apply them in practice.

The appropriate response to allegations of institutional capture is therefore neither automatic acceptance nor reflexive dismissal. It is careful examination of the evidence, the relevant legal framework and the actual conduct of constitutional authorities.

The reported judicial scrutiny of the Delhi protest restrictions may be relevant to assessing the Court’s response in that particular dispute. The SIR litigation, meanwhile, requires close attention to statutory procedure, electoral rights and the remedies available to affected voters.

Ultimately, the independence of the Supreme Court must be judged by its ability to apply the Constitution impartially, scrutinise the exercise of public power and provide meaningful remedies where the law requires them.

That standard must remain the same regardless of which political party holds office. It is this consistency, rather than the rhetoric of any individual political controversy, that will determine whether public confidence in India’s highest court is sustained.

Need Legal Guidance on Constitutional Rights or Supreme Court Matters?

When constitutional rights, judicial remedies or complex legal disputes are at stake, understanding your legal options can make a crucial difference. What did Kapil Sibal say about the independence of the Supreme Court of India?

Senior Advocate Kapil Sibal reportedly alleged that the Union government was attempting to bring important institutions, including the Supreme Court, under its influence. He expressed confidence that the Court would resist such attempts. His remarks arose amid concerns about electoral-roll revisions under the Special Intensive Revision (SIR) process and restrictions on protests against the Chief Election Commissioner. The allegation is a political claim and should be distinguished from any judicial finding of institutional interference.

2. Is judicial independence part of the basic structure of the Indian Constitution?

Yes. Judicial independence is recognised as an essential feature of the basic structure of the Indian Constitution. In Kesavananda Bharati v. State of Kerala (1973), the Supreme Court established that Parliament cannot use its constitutional amending power to destroy the Constitution’s basic structure. Subsequent judgments, including the NJAC judgment of 2015, reinforced the importance of protecting judicial independence from arrangements that would undermine the judiciary’s institutional autonomy.

3. How does the collegium system protect the independence of the Supreme Court and High Courts?

The collegium system governs recommendations for appointments and transfers of judges to the Supreme Court and High Courts. It developed through the Second Judges Case (1993) and the Third Judges Case (1998), which established and clarified the judiciary’s primacy in higher judicial appointments. In 2015, the Supreme Court struck down the National Judicial Appointments Commission (NJAC) framework, holding that it violated the basic structure by compromising judicial independence. The collegium system consequently remained in place.

4. Can the Supreme Court of India review government decisions concerning electoral rolls and public protests?

Yes. The Supreme Court can exercise judicial review over government action and decisions of constitutional authorities, subject to its jurisdiction and applicable law. Article 32 allows individuals to approach the Supreme Court for the enforcement of fundamental rights, while Article 226 empowers High Courts to issue writs for fundamental rights and other legal purposes. Challenges involving Special Intensive Revision (SIR) of electoral rolls may raise questions about statutory compliance and voters’ rights. Restrictions on peaceful protests may also be examined under Articles 19(1)(a) and 19(1)(b), subject to constitutionally permissible restrictions.

5. What legal remedies are available if a person’s fundamental rights are violated by government action in India?

A person whose fundamental rights have been violated may seek appropriate legal remedies depending on the facts and applicable law. Article 32 provides a constitutional remedy before the Supreme Court for enforcing fundamental rights, while Article 226 gives High Courts broad writ jurisdiction. Depending on the dispute, other statutory remedies, appeals or proceedings before the appropriate authority may also be available. Because the correct legal strategy depends on the nature of the alleged violation, the evidence and procedural requirements, consulting a qualified advocate can help clarify the available options.

Key Takeaways: Kapil Sibal on Supreme Court Independence

Kapil Sibal on Supreme Court independence: Senior Advocate Kapil Sibal has raised concerns about alleged attempts to influence India’s constitutional institutions, including the Supreme Court, highlighting the importance of judicial autonomy in a democratic system.

Judicial independence and the Indian Constitution: Judicial independence is an essential feature of the Constitution’s basic structure and protects the judiciary’s ability to decide disputes impartially, without improper political or executive influence.

Kesavananda Bharati judgment, 1973: The landmark Supreme Court judgment established the basic structure doctrine, limiting Parliament’s power to amend the Constitution in ways that destroy its fundamental constitutional features.

NJAC judgment, 2015: The Supreme Court struck down the National Judicial Appointments Commission framework, holding that it compromised judicial independence. The strength of India’s constitutional democracy depends on institutions exercising their powers independently and respecting established constitutional boundaries.

Election Commission of India, Supreme Court & Article 324: Constitutional Analysis of Electoral Transparency, SIR and Appointment of Election Commissioners

The Crisis of Neutrality: India’s Election Commission Under Scrutiny

From Collegium to Commission: Learning from the UK and US Models of Judicial Appointments

Election Commissioner Appointment Act 2023: Supreme Court Split Verdict and Constitution Bench Issue

The Role of Judges in India: A Legal and Constitutional Analysis

Kapil Sibal on Supreme Court Independence: Can the Judiciary Resist Political Pressure?
