A. Hart, one of the foremost legal philosophers of the twentieth century and a leading exponent of the Analytical School of Jurisprudence, presented his theory of law in his seminal work The Concept of Law (1961). Hart rejected the earlier command theory of law, notably advanced by John Austin, which viewed law merely as the command of a sovereign backed by threats of sanction. Instead, he argued that law is best understood as a complex social system of rules that both guides human conduct and provides the institutional mechanisms for creating, changing, identifying, and applying those rules. At the heart of Hart’s theory lies the idea that a developed legal system consists of the union of primary and secondary rules.

Table of Contents

Toggle

Introduction

2. Primary Rules

Primary rules are duty-imposing rules that directly regulate the behaviour of individuals. They prescribe what people must do or refrain from doing and thereby impose obligations. Classic examples include the prohibitions against theft, murder, assault, and other forms of harm. These rules create the basic framework of social order by telling members of society how they ought to conduct themselves in relation to one another. In a simple or primitive society, primary rules may exist alone; however, such a system suffers from serious defects—uncertainty about what the rules are, static character that makes change difficult, and inefficiency in the resolution of disputes.

Secondary Rules

Secondary rules are rules about rules. They do not themselves impose duties of conduct in the same direct manner; rather, they confer powers and establish procedures that enable a society to identify, modify, and enforce its primary rules. Hart identified three principal types of secondary rules that remedy the defects of a pure system of primary rules:

The Rule of Recognition

This is the most fundamental secondary rule. It provides the ultimate criteria by which the validity of all other rules in the legal system is determined. It answers the question, “What counts as law in this system?” In modern states the rule of recognition is usually complex and may include written constitutions, statutes enacted by the legislature, judicial precedents, and customary practices. In India, for instance, the Constitution of India, together with the legislative competence of Parliament and the State Legislatures and the doctrine of judicial precedent, functions as the core of the rule of recognition.

The Rule of Change

This rule empowers designated authorities to introduce new primary rules, amend existing ones, or repeal obsolete rules. It supplies the formal procedures through which law can be deliberately altered. Parliamentary law-making procedures, constitutional amendment processes, and delegated legislation are all manifestations of the rule of change. Without such a rule, a legal system would remain rigid and unable to adapt to changing social needs.

The Rule of Adjudication

This rule confers authority on particular officials or institutions—primarily courts—to determine authoritatively whether a primary rule has been violated in a given case and to apply the appropriate sanctions or remedies. It also includes the power to interpret rules and to resolve disputes about their meaning and application. The existence of an independent judiciary with defined jurisdiction is the clearest institutional expression of the rule of adjudication.

The Union of Primary and Secondary Rules

Hart’s central insight is that a mature legal system is constituted by the combination of primary and secondary rules. Primary rules impose duties and thereby regulate conduct; secondary rules provide the means by which those duties can be identified with certainty, adapted to new circumstances, and authoritatively applied. The union of the two types of rules overcomes the uncertainty, rigidity, and inefficiency that afflict a pure system of primary rules. It produces a legal system that is simultaneously stable and flexible, certain yet capable of deliberate change, and equipped with institutions capable of resolving disputes in an authoritative manner.

This model also explains the internal aspect of rules—the critical reflective attitude that officials and, to varying degrees, ordinary citizens adopt towards the rules of the system. Officials, in particular, must accept the secondary rules (especially the rule of recognition) from the internal point of view if the system is to function as a genuine legal order rather than a mere system of coercion.

Characteristics of Legal Rules

Normative character – Legal rules prescribe what ought to be done or not done; they are not merely descriptive of actual behaviour.

Generality – They apply to classes of persons and situations rather than to specific individuals or isolated cases.

Abstractness – They regulate types of conduct in general terms, not concrete particular acts.

Systemic nature – Legal rules exist as part of an organised system linked by secondary rules (especially the rule of recognition).

Internal aspect – Officials and (to varying degrees) citizens adopt a critical reflective attitude towards them; they are accepted as standards of behaviour.

Obligation-creating or power-conferring – Primary rules impose duties; secondary rules confer powers to create, change, or adjudicate rules.

Institutional backing – They are identified, applied, and enforced through official institutions (legislatures, courts, enforcement agencies).

Enforceability – Breach generally attracts institutional sanctions or remedies, distinguishing them from mere social or moral rules.

Validity – A rule is legal only if it satisfies the criteria of validity laid down by the system’s rule of recognition.

Open texture – Legal rules have a core of settled meaning and a penumbra of uncertainty, requiring interpretation in borderline cases.

Publicity and accessibility – They are generally required to be published or made known so that subjects can guide their conduct by them.

Relative permanence and stability – Unlike fleeting commands or habits, legal rules are expected to have a degree of continuity until formally changed.

Criticism of H.L.A. Hart’s Definition of Law

Overemphasis on Rules and Neglect of Principles

Ronald Dworkin argues that Hart’s model reduces law to a system of rules and fails to account for legal principles, policies, and standards that have dimensions of weight and importance. Judges frequently decide hard cases by appealing to principles rather than clear rules, which Hart’s theory cannot adequately explain.

Inadequacy of the Rule of Recognition

The rule of recognition, which is central to Hart’s theory, is criticised as being vague, circular, or insufficiently determinate. Critics question how the ultimate rule of recognition itself is identified and validated and whether it can truly provide a clear criterion of legal validity in complex modern legal systems.

Excessive Separation of Law and Morality

Natural law theorists (including Lon L. Fuller and John Finnis) criticise Hart’s soft positivism for maintaining a sharp separation between law as it is and law as it ought to be. They contend that a purely formal or rule-based account ignores the necessary connection between law and moral purpose, justice, and the common good.

Insufficient Attention to the Internal Point of View of Citizens

While Hart emphasises the internal aspect of rules for officials, critics argue that his theory underplays the perspective of ordinary citizens and the reasons why people generally accept and obey the law. The theory is seen as overly official-centric.

Problem of Judicial Discretion

Hart acknowledges that rules have an “open texture” and that judges exercise discretion in hard cases. Critics (especially Dworkin) argue that this concedes too much discretionary power and undermines the claim that law provides a determinate guide to conduct.

Failure to Explain the Normative Force of Law

Hart’s descriptive, analytical approach is criticised for not adequately explaining why legal rules create genuine obligations or why they possess authority beyond the mere fact of social acceptance or official practice.

Abstract and Ahistorical Character

Sociological and critical theorists argue that Hart’s model is excessively abstract and formal. It pays insufficient attention to the social, economic, political, and power contexts in which legal systems operate and treats law as a relatively self-contained system of rules.

Limited Applicability to Certain Legal Systems

The theory is said to fit modern municipal legal systems better than international law, customary law systems, or transitional and revolutionary legal orders, where clear secondary rules (especially a stable rule of recognition) may be weak or contested.

Ambiguity in the Distinction Between Primary and Secondary Rules

Some critics maintain that the distinction between primary (duty-imposing) and secondary (power-conferring) rules is not always sharp or analytically clean, and that many rules perform both functions simultaneously.

These criticisms have generated extensive debate in jurisprudence, leading to refinements of positivism as well as alternative theories of law.

Conclusion

L. A. Hart’s theory of the union of primary and secondary rules marks a decisive advance in analytical jurisprudence. By moving beyond the command model, Hart provided a more sophisticated and realistic account of how modern legal systems actually operate. His framework illuminates the internal structure of law, explains the sources of its authority and efficacy, and continues to serve as a foundational reference point for contemporary debates in legal philosophy. The enduring value of the theory lies in its capacity to describe law not merely as an instrument of power, but as a structured system of rules that enables a society to govern itself with a measure of certainty, adaptability, and institutional integrity.

The Analytical School of Jurisprudence: Understanding Law as It Is

The Law v/s A Law: Understanding the Classification and Distinction

Functions of Civil Courts: Primary and Secondary Courts

Understanding Legislation as a Source of Law

I Remove Me (Ego): Covenant of Abandonment and Waiver of the Individual Ego see

Introduction L.
