Does Tiger Shroff Escaping Without a Gunshot Injury Change the Legal Position?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The actor&#8217;s reported escape without a gunshot wound is fortunate, but it does not by itself determine the legal classification of the alleged attack.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The law distinguishes between the intention behind an act and the result that ultimately follows.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Consider a situation in which a person deliberately fires a loaded firearm at the occupant of a vehicle. Those reports should be treated cautiously until supported by reliable medical information.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The legal significance of any injury will depend on its nature, how it occurred and its connection with the alleged act.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The reported injuries to the driver and the other person are also relevant. Their medical records and statements may assist the investigators in reconstructing the incident.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, the fact that someone was injured does not automatically establish every element of Section 109&#8217;s enhanced punishment provision. The prosecution must prove the necessary connection between the alleged offender&#8217;s act, the injury and the statutory requirements.<\/p>\n\n\n\n<h2 id=\"h-4-what-other-offences-could-apply-under-the-bharatiya-nyaya-sanhita\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"4_What_Other_Offences_Could_Apply_Under_the_Bharatiya_Nyaya_Sanhita\"><\/span>4. What Other Offences Could Apply Under the Bharatiya Nyaya Sanhita?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Depending on the evidence, the investigating agency may consider offences in addition to attempt to murder.<\/p>\n\n\n\n<h3 id=\"h-a-hurt-caused-by-dangerous-weapons\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"A_Hurt_Caused_by_Dangerous_Weapons\"><\/span>A. Hurt Caused by Dangerous Weapons<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Section 118 of the Bharatiya Nyaya Sanhita addresses voluntarily causing hurt or grievous hurt by dangerous weapons or means, subject to the relevant statutory ingredients.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Whether this provision is appropriate would depend on the evidence concerning the injuries, the weapon used and the relationship between the alleged conduct and the statutory offence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Where attempt to murder is alleged, the prosecution must carefully assess how the applicable offences relate to one another and whether the evidence supports each charge.<\/p>\n\n\n\n<h3 id=\"h-b-criminal-intimidation\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"B_Criminal_Intimidation\"><\/span>B. It applies to an agreement between two or more persons to do, or cause to be done, an illegal act or an act that is not illegal by illegal means, subject to the statutory requirements.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If investigators discover evidence of prior planning, coordination or an agreement to attack the actor, criminal conspiracy may be examined.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Potential evidence could include communications, surveillance, financial transactions, witness statements and other material connecting the suspected participants.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The mere fact that an attack appears coordinated does not dispense with the requirement to establish the elements of the alleged conspiracy.<\/p>\n\n\n\n<h2 id=\"h-5-can-the-arms-act-1959-apply-to-the-shooting\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"5_Can_the_Arms_Act_1959_Apply_to_the_Shooting\"><\/span>5. Section 27 addresses punishment for using arms or ammunition in contravention of specified provisions of the Act. The precise subsection, applicable penalty and required proof depend on the facts and the nature of the alleged contravention.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The police may need to establish:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Whether a firearm was recovered.<\/li>\n\n\n\n<li>Whether the firearm can be connected to the shooting.<\/li>\n\n\n\n<li>Whether recovered cartridge cases or bullets match the weapon.<\/li>\n\n\n\n<li>Whether the relevant possession or use was lawful.<\/li>\n\n\n\n<li>Whether the evidence identifies the person who possessed or used the weapon.<\/li>\n\n\n\n<li>Whether additional offences involving the supply, transfer or possession of the firearm are supported by evidence.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Ballistic analysis can be particularly important when investigators are attempting to link a recovered weapon to cartridge cases or bullets collected from a crime scene.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The forensic record must also establish the integrity of the recovered material and its chain of custody.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It would be premature to specify the precise Arms Act charges or punishment without the relevant evidence.<\/p>\n\n\n\n<h2 id=\"h-6-are-the-alleged-lawrence-bishnoi-gang-links-established\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"6_Are_the_Alleged_Lawrence_Bishnoi_Gang_Links_Established\"><\/span>6. Are the Alleged Lawrence Bishnoi Gang Links Established?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Media reports have referred to a social-media claim attributed to individuals allegedly associated with the Lawrence Bishnoi group. The claim purportedly took responsibility for the firing and referred to the actor&#8217;s alleged association with Salman Khan.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, the reports reviewed do not establish that Mumbai Police have conclusively verified the claim or proved that the group ordered or carried out the shooting.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This distinction is fundamental to criminal law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A person may claim responsibility for an offence for many reasons, including publicity, intimidation or an attempt to mislead investigators. A message may also be falsely attributed to another person.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Investigators should therefore establish:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Who created and published the alleged message.<\/li>\n\n\n\n<li>Whether the account or communication can be authenticated.<\/li>\n\n\n\n<li>Whether the persons named in the message had any involvement in the attack.<\/li>\n\n\n\n<li>Whether independent evidence connects any alleged organisation with the perpetrators.<\/li>\n\n\n\n<li>Whether communications, financial records, witness statements or other evidence support the claim.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">An unverified claim of responsibility is an investigative lead, not proof of guilt.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The same principle applies to reports that the shooting was motivated by the actor&#8217;s alleged association with another film personality.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The motive must be established through evidence rather than inferred solely from a message circulating online.<\/p>\n\n\n\n<h2 id=\"h-7-could-mcoca-apply\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"7_Could_MCOCA_Apply\"><\/span>7. Its authenticity and reliability may be challenged during the proceedings.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A video circulating online should not automatically be treated as conclusive evidence of the identity or guilt of a particular person.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The objective is to build a reliable evidentiary record capable of withstanding judicial scrutiny.<\/p>\n\n\n\n<h2 id=\"h-9-what-is-the-role-of-the-bnss-in-the-investigation\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"9_What_Is_the_Role_of_the_BNSS_in_the_Investigation\"><\/span>9. What Is the Role of the BNSS in the Investigation?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS), governs criminal procedure under the new criminal law framework.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Section 173 concerns information relating to cognizable offences, including the registration of information in accordance with the statutory requirements.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Sections 175 and 176 address aspects of police investigation and the procedure for conducting it.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Section 176(3) contains provisions concerning forensic examination for specified serious offences, subject to its statutory terms and implementation requirements.
