It includes the provisions of the Constitution, judicial interpretations, and other recognised constitutional principles.

Nature of Constitutional Law

Constitutional law is a branch of public law because it regulates the functioning of the state and its relationship with individuals. It is the supreme law of the land, and all other laws must conform to it. It defines the powers of the legislature, executive, and judiciary, establishes limits on governmental authority, and protects citizens against arbitrary action. In India, the Constitution is the supreme legal authority, and courts can declare laws unconstitutional if they violate its provisions.

Views of Different Jurists on Constitutional Law

Dicey

Dicey explained constitutional law in terms of the rules governing the distribution and exercise of state power. He distinguished between legal rules enforceable by courts and conventions that regulate political conduct but are not ordinarily enforced by courts.

John Austin

Austin viewed law primarily as the command of a sovereign backed by sanctions. From his perspective, constitutional rules may be understood as law where they derive their authority from the sovereign, although his theory faces difficulties in explaining constitutional limits on government.

Hans Kelsen

Kelsen regarded law as a hierarchy of legal norms, with lower rules deriving their validity from higher rules. Constitutional law occupies a superior position within the legal system because ordinary laws must conform to the Constitution.

L. A. Hart

Hart explained law as a union of primary and secondary rules. Constitutional rules help identify valid laws, establish lawmaking powers, and regulate how legal rules are created, changed, and applied.

Matter of Fact and Matter of Law

Matter of Fact

A matter of fact concerns what actually happened or what circumstances exist, established through evidence. For example, whether a public authority demolished a person’s property is a matter of fact.

Matter of Law

A matter of law concerns the interpretation, meaning, and application of legal rules. For example, whether the demolition violated a constitutional right is a matter of law. Constitutional disputes often involve both questions of fact and questions of law.

Difference Between a Matter of Fact and a Matter of Law

Basis

Matter of Fact

Matter of Law

Meaning

Concerns what actually happened or what circumstances exist.

Concerns the interpretation, meaning, and application of legal rules.

Basis

Established through evidence.

Determined by interpreting and applying legal rules.

Example

Whether a public authority demolished a person’s property.

Whether the demolition violated a constitutional right.

Is Constitutional Law a True Law?

The question of whether constitutional law is a true law has been debated by jurists. Some thinkers, particularly those influenced by Austin’s theory, question whether constitutional rules are genuine laws when they cannot be enforced against the ultimate sovereign in the same way as ordinary legal commands. They may regard certain constitutional restrictions as political rules rather than enforceable laws.

However, modern legal thinkers generally recognise constitutional law as true and binding law. It establishes legal authority, limits governmental powers, and provides remedies when constitutional provisions are violated. In India, the Constitution is legally enforceable through judicial review, and courts can invalidate laws and government actions that violate constitutional requirements. Constitutional conventions may not always be enforceable in court, but this does not diminish the legal status of the Constitution itself.

Key Constitutional Landmark Cases

Kesavananda Bharati v. Union of India (1980)

The Supreme Court reaffirmed the Basic Structure Doctrine by striking down provisions that gave Parliament unlimited amending power. The Court held that limited amending power and the power of judicial review are themselves basic features of the Constitution.

Marbury v. Madison (1803)

The U.S. Supreme Court established the foundational principle of judicial review, empowering courts to review legislative and executive actions and declare unconstitutional laws null and void.

These constitutional decisions demonstrate that constitutional provisions are the supreme, legally binding law of the land. They ensure that all governmental branches operate within defined constitutional limits subject to judicial oversight.

Conclusion

Constitutional law is the foundation of a constitutional government. It defines state powers, protects individual rights, and ensures that government operates within legal limits. Therefore, constitutional law is not merely a set of political principles; it is a recognised and enforceable body of law that upholds constitutional governance and the rule of law.

Meaning and Functions of Law Under Jurisprudence: Definitions, Characteristics, Theories & Importance Explained

Justice to the RAPED

Meaning, Nature and Scope of Jurisprudence

The Evolution of Islamic Jurisprudence: Foundations, Sources, and Contemporary Relevance

Adverse Possession in Indian Law: When Long Possession Becomes Title

Introduction to Constitutional Law Constitutional law is an important branch of public law that deals with the Constitution, the structure of government, the distribution of powers among different organs of the state, and the rights and duties of citizens.
