These disputes may concern property, recovery of money, contracts, family rights, injunctions, or other civil rights. In India, the procedure for adjudicating most civil suits is governed by the Code of Civil Procedure, 1908 (CPC). The CPC lays down the rules that civil courts ordinarily follow—from the institution of a suit to the delivery and enforcement of a judgement.

Table of Contents

Toggle

The Ten Main Stages of a Civil Case in India

The Ten Main Stages of a Civil Case

1. Conclusion

A clear understanding of these stages helps litigants, law students, and the general public appreciate how civil courts function and what to expect at each stage.

The Ten Main Stages of a Civil Case

1. Filing of the Plaint

A civil suit generally begins when the plaintiff (the person who institutes the case) files a plaint in the competent court. The plaint sets out the facts of the dispute, the cause of action, the relief claimed, and other necessary particulars.

Relevant provisions: Section 26 and Order VII of the CPC.

The plaintiff must pay the prescribed court fee and comply with procedural requirements. The court examines the plaint and may admit it, return it for presentation in the proper court, or reject it where the law permits.

Example: A person files a suit for recovery of money that another person has failed to repay.

2. Issuance and Service of Summons

Once the suit is instituted, the court issues a summons to the defendant requiring appearance and an answer to the plaintiff’s claim.

Relevant provisions: Sections 27–29 and Order V of the CPC.

The summons must be served in accordance with the prescribed procedure. Service may be effected through court process servers, permitted postal methods, or other legally recognised modes. The object is to give the defendant proper notice and a fair opportunity to defend the case.

3. Filing of the Written Statement

The defendant ordinarily files a written statement in reply to the plaint. It contains the defendant’s response to the allegations, including admissions, denials, and legal defences.

Relevant provision: Order VIII of the CPC.

Under Order VIII Rule 1, the ordinary period for filing the written statement is 30 days from the date of service of summons. The court may grant further time subject to the applicable law. In commercial disputes, the statutory outer limit is generally 120 days, after which the right to file the written statement is forfeited.

The written statement enables the court to identify which facts are admitted and which remain in dispute.

4. Framing of Issues

After examining the pleadings and hearing the parties, the court identifies the material questions of fact and law that require determination. These questions are called issues.

Relevant provision: Order XIV of the CPC.

Example: In a property dispute, the issues may include whether the plaintiff owns the property and whether the defendant is in unlawful occupation of it.

Framing of issues focuses the trial on the matters that are genuinely in controversy.

5. Plaintiff’s Evidence

The plaintiff must produce evidence in support of the claims made in the plaint. This may include documents, contracts, receipts, official records, and the testimony of witnesses.

Relevant provisions: Order XVIII of the CPC, read with the applicable law of evidence.

In many cases, witnesses submit their examination-in-chief by affidavit and are thereafter examined or cross-examined as required. The plaintiff ordinarily bears the burden of proving the facts on which the claim is based, subject to the rules of evidence.

6. Defendant’s Evidence

After the plaintiff closes the evidence, the defendant ordinarily presents evidence in support of the defence. The defendant may produce documents, examine witnesses, and explain why the plaintiff’s claim should not be accepted.

The court evaluates the evidence of both parties impartially. The precise order and scope of evidence depend on the issues framed and the directions of the court.

7. Cross-Examination of Witnesses

Cross-examination is a vital part of the trial. The opposing party or its advocate questions a witness to test the accuracy, reliability, and credibility of the testimony.

Relevant provisions: Order XVIII of the CPC, read with the applicable law of evidence.

Cross-examination may reveal inconsistencies, omissions, or contradictions. Not every witness is necessarily subjected to cross-examination in every case; the procedure depends on the circumstances and the applicable rules.

8. Final Arguments

Once the evidence is complete, the parties present their final arguments.

Relevant provision: Order XVIII Rule 2 of the CPC.

The advocates summarise the facts, discuss the evidence, refer to relevant legal provisions, and explain how the law should apply. The plaintiff argues why the relief claimed should be granted; the defendant presents reasons for dismissal of the claim or for grant of limited or alternative relief.

9. Judgement and Decree

After considering the pleadings, issues, evidence, and arguments, the court delivers its judgement.

Relevant provisions: Section 33 and Order XX of the CPC.

A judgement is the court’s reasoned statement explaining its decision. A decree is the formal expression of the adjudication of the rights of the parties, as defined in Section 2(2) of the CPC. The decree records the relief granted or the determination made.

There is no universal rule that every civil judgement must be delivered within 30 days or, in all cases, within a maximum of 60 days. The time taken depends on the applicable rules and the circumstances of the case.

10. Appeal and Execution of the Decree

An aggrieved party may challenge the decision by filing an appeal where the law permits.

Relevant provisions: Sections 96 and 100 and Order XLI of the CPC, among other applicable provisions.

A first appeal ordinarily lies from an original decree under Section 96. A second appeal to the High Court under Section 100 is generally limited to cases involving a substantial question of law. The limitation period depends on the applicable law and the court concerned.

If the decree-holder does not receive voluntary compliance, the decree may be enforced through execution proceedings.

Relevant provisions: Sections 36–74 and Order XXI of the CPC.

Depending on the nature of the decree, execution may involve attachment and sale of property, recovery of money, delivery of possession, or other legally permitted measures. There is no universal 12-year execution period applicable to every decree; the limitation depends on the governing provision and the circumstances of the case.

11. Important Principles Governing Civil Proceedings

The civil justice system is guided by several fundamental principles:

Natural justice: Both parties should receive a fair opportunity to present their cases.

Right to be heard: A party should ordinarily receive notice and an opportunity to respond before an adverse decision is made.

Burden of proof: Each party must prove the facts that the law requires it to establish.

Judicial impartiality: The court must decide the dispute fairly on the basis of the law and the evidence.

Finality of litigation: Appeals and other remedies are available only according to law. A decision may become final when the available remedies are exhausted or the time for pursuing them expires.

12. Conclusion

The civil case procedure under the Code of Civil Procedure, 1908 provides an organised framework for resolving disputes through the courts. From the filing of the plaint and service of summons to the presentation of evidence, hearing of arguments, delivery of judgement, and execution of the decree, each stage serves a distinct purpose.

Although the ten stages outlined above furnish a useful general overview, not every civil suit follows exactly the same sequence. Some cases may be decided on preliminary legal questions, disposed of through settlement or alternative dispute resolution, or concluded without a full trial. Special procedures may also apply to commercial disputes and certain other categories of cases.

A sound understanding of the CPC helps litigants protect their rights, comply with procedural requirements, and pursue civil remedies effectively.

Complete Guide to Drafting a Copyright Infringement Suit in India: Procedure, Evidence, Interim Relief & Court Process

Rejection of Plaint Under Order VII Rule 11 CPC: Grounds, Procedure & Supreme Court Judgements

Order VII Rule 11 CPC Explained: Grounds for Rejection of Plaint, Supreme Court Judgements & Complete Legal Guide

Can a Plaint Be Amended After Trial Begins?
