It occupies a central place in legal theory because the law both creates duties and protects the corresponding rights of others. A classic illustration is the relationship between a borrower and a lender: the borrower is under a legal obligation to repay the loan, while the lender holds a correlative right to recover the sum advanced.

Table of Contents

Toggle

Introduction

Meaning and Nature of Obligation

Definition of Obligation by Different Jurists

Justinian (Roman Law)

Friedrich Carl von Savigny

Sir John Salmond

Thomas Erskine Holland

Sir William Anson

W. A choice in action may be described as a valuable personal right, such as a debt, a share, or a claim for damages arising from a civil wrong.

Meaning and Nature of Obligation

An obligation is a legal bond or vinculum juris by which one person (the obligor) is bound to another (the obligee) to do or not to do a certain act. The obligor is the person upon whom the duty rests; the obligee is the person entitled to demand its performance.

A legal obligation is distinguished from a mere moral duty. A moral duty arises from conscience, ethical conviction or social expectation and is not, as such, enforceable by the machinery of the State. A legal obligation, by contrast, is recognised by the legal system and can be enforced through the courts. Its breach may attract remedies such as damages, specific performance, injunction or other consequences prescribed by law. Nevertheless, the boundary is not rigid: many moral duties have, over time, been elevated into legal obligations when the legislature or the courts have chosen to recognise them.

Definition of Obligation by Different Jurists

In jurisprudence, the concept of obligation has been defined by various jurists with slight variations in emphasis, reflecting Roman law roots, analytical, and proprietary perspectives.

Below are the principal definitions:

Justinian (Roman Law)

An obligation is a legal bond (vinculum juris) which binds us to the necessity of making some performance according to the laws of our state.

This classical definition emphasises the legal bond that creates a necessity of performance.

Friedrich Carl von Savigny

An obligation is the control over another person, yet not over his person in all respects (in which case his personality would be destroyed), but over single acts of his which must be conceived of as subtracted from his free will and subjected to our will.

Savigny views obligation as a limited dominion over specific acts of another person, preserving the personality of the obligor.

Sir John Salmond

An obligation, therefore, may be defined as a proprietary right in personam, or a duty which corresponds to such a right.

He further describes it as:

the vinculum juris, or bond of legal necessity, which binds together two or more determinate individuals.

Salmond stresses that obligations are correlatives of rights in personam (as opposed to rights in rem) and are proprietary in nature.

Thomas Erskine Holland

An obligation, as its etymology denotes, is a tie by which one person is bound to perform some act for the benefit of another.

Holland highlights the binding nature of the relationship and the benefit conferred on the obligee.

Sir William Anson

An obligation is a control exercisable by definite persons over definite persons for the purpose of definite acts or forbearances reducible to a money value.

Anson’s definition emphasises:

Definite parties

Specific acts or forbearances

Economic (monetary) value

W. In the classic Hohfeldian analysis, a right in one person corresponds to a duty in another. The creditor’s right to recover a debt is the correlative of the debtor’s obligation to repay it. Not every legal duty, however, corresponds to a private right vested in an identifiable individual; some duties are owed to the State or to the community at large (for example, the duty not to commit public nuisances or to observe criminal prohibitions).

Importance of Obligation in Jurisprudence

The concept of obligation is indispensable to an understanding of how law regulates human conduct. It explains the structure of legal relations in contract, tort, property, family law and criminal law; it distinguishes enforceable legal duties from purely moral or social responsibilities; and it underpins the mechanisms of accountability, remedy and social order. Without a coherent theory of obligation, the correlative notions of right, remedy and liability would remain incomplete.

Conclusion

Obligation is a foundational concept of jurisprudence. It describes the duties that the legal system imposes or recognises, their relationship to legal rights, and the various sources from which they arise. Through its classification and analysis, jurisprudence illuminates how legal systems create enforceable responsibilities, provide remedies for their breach, and thereby promote justice and ordered social life.

Jurisdiction In Rem Vs.
