Lodha Healthy Constructions and Developer Private Limited, 2026 INSC 1131, the Court examined a dispute arising from a residential apartment in Hyderabad that was not delivered within the promised period. Although the National Consumer Disputes Redressal Commission (NCDRC) had ordered a refund with interest and awarded compensation against the lender, the Supreme Court considered the appropriate monetary relief in light of the buyer’s payments, the outstanding loan-related issues and the claim for rent.

The Court directed the release of ₹1,27,34,726 to the homebuyer, together with simple interest at 12% per annum from the respective dates of deposit. It also awarded ₹15 lakh as consolidated compensation in full and final satisfaction of the buyer’s claims against the builder towards rent, mental agony, harassment and litigation expenses.

The Court declined to award rent separately on top of interest on the refund for the same underlying deprivation. It also upheld the finding of deficiency in service against the bank and the ₹2 lakh compensation awarded by the NCDRC.

The judgment is significant for anyone examining consumer appeals against NCDRC orders, particularly disputes involving delayed possession, refund claims, housing loans and the risk of receiving compensation twice for the same loss.

Importantly, the Court did not establish a universal rule that every delayed-possession case must attract 12% interest or ₹15 lakh in compensation. The relief depended on the facts, evidence and circumstances of this particular dispute.

1. Background: A Homebuyer Left Waiting for Possession

The dispute arose from the purchase of an apartment in the Lodha Bellezza residential project at Kukatpally, Hyderabad.

On 8 August 2009, the buyer booked the apartment for a total consideration of ₹2,30,73,876. He contributed ₹51,11,576 from his own funds, while HDFC Ltd. sanctioned a housing loan of ₹2 crore.

Under the financing arrangement, the lender disbursed approximately ₹1.69 crore directly to the builder in instalments between February 2010 and July 2011. The buyer also made payments to the bank, including interest and subsequent repayments.

The contractual possession deadline was 30 June 2011, subject to a six-month grace period. Despite the passage of time and the payment of nearly 95% of the consideration, possession was not delivered.

For the buyer, the consequences extended beyond a delayed handover. A substantial amount of money had been committed to the apartment, the expected use of the property remained unavailable, and the housing-loan arrangement continued to have financial implications.

The buyer approached the NCDRC on 13 May 2013, seeking relief for the builder’s failure to deliver possession.

What Did the NCDRC Decide?

By its order dated 1 July 2022, the NCDRC found the builder responsible for the delay and rejected its force majeure defence. It ordered the refund of the amount received, together with interest at 9% per annum, with the rate increasing to 12% in the event of non-compliance.

The Commission also found deficiency in service on the part of the bank because it had not established that the required verification of construction progress had been undertaken before the loan amounts were disbursed to the builder. It awarded ₹2 lakh in compensation against the bank.

The buyer’s review petition was dismissed on 7 December 2022.

The matter subsequently reached the Supreme Court through Civil Appeal No. 8994 of 2022 and connected Civil Appeal Nos. 4622–4623 of 2023.

The central question was no longer simply whether the buyer deserved relief. It was how that relief should be calculated and what could legitimately be recovered from each party.

2. The Main Legal Issues Before the Supreme Court

The appeals raised several connected questions:

What amount should be refunded when the apartment was financed partly through the buyer’s own funds and partly through a housing loan?

From which dates should interest be calculated?

Could the buyer claim rent in addition to interest on the refund?

What additional compensation was appropriate after such a prolonged delay?

Could the bank be held liable for failing to establish compliance with its verification obligations?

What should happen to the separate dispute concerning the lender’s right to recover the outstanding loan amount?

The Court’s approach is instructive because it distinguishes the existence of a service deficiency from the calculation of the remedy. A finding that a builder or lender has acted improperly does not, by itself, settle every question about the amount payable or the legal basis for each head of compensation.

3. Refund of Money: Why the Source of Funds Matters

One of the important aspects of the judgment concerns the relationship between the homebuyer’s own payments, the builder’s receipts and the housing loan.

The apartment had been financed through a combination of personal funds and lender disbursements. In such transactions, the builder may receive substantial money directly from a bank even though the purchaser remains responsible for repaying the loan.

These are related but legally distinct matters.

The builder’s receipt of loan money does not automatically establish that the borrower has repaid the same amount to the lender. Equally, a refund dispute between a buyer and a builder does not necessarily determine the borrower’s entire liability under the separate loan agreement.

The Supreme Court directed the release of ₹1,27,34,726 to the buyer, together with simple interest at 12% per annum from the respective dates of the deposits made by the buyer to the builder and the bank.

The Court’s directions must be read alongside its treatment of the connected bank proceedings. The remaining amount was kept in an interest-bearing account pending the bank’s appeal, and the High Court was directed to decide the bank’s recovery proceedings on their own merits.

The Court left open the parties’ contentions concerning the buyer’s liability under the housing loan.

Why This Distinction Matters

For homebuyers, the practical lesson is straightforward: maintain a clear record of every payment and identify the person or institution to whom it was made.

Relevant documents may include:

The apartment booking form and builder-buyer agreement.

The payment schedule and receipts issued by the builder.

The housing-loan sanction letter.

The tripartite agreement between the buyer, builder and lender.

Loan disbursement statements showing the amounts paid directly to the builder.

Bank statements showing interest payments and principal repayments.

Loan account statements recording the outstanding balance.

Correspondence concerning delayed possession, cancellation and refund.

These records help establish the amount paid, the source of each payment and the relief that can properly be claimed against each party.

The judgment should not be read as establishing that every buyer is automatically entitled to a refund limited to personal contributions in every financed property dispute. The result depends on the pleadings, contractual arrangements, evidence and directions applicable to the particular case.

4. Interest on Refund: Compensation for Being Deprived of Money

Interest serves an important purpose in delayed-possession disputes. It recognises that a purchaser who has paid money towards a property but has not received possession has been deprived of the use of those funds.

Money tied up in an uncompleted property transaction cannot readily be used for another home, invested elsewhere or applied to other financial needs.

In the present case, the Supreme Court directed payment of simple interest at 12% per annum on ₹12,734,726 from the respective dates of deposit until payment.

The direction is specific to the relief granted in this case. It does not mean that 12% is the mandatory interest rate for every consumer dispute involving a builder.

The appropriate rate and the period for which interest is payable must be determined in the light of the contract, the nature of the default, the evidence and the applicable legal principles.

Interest Is Not Merely an Additional Amount

Interest may compensate a purchaser for being kept out of money that should have been returned. Its significance becomes especially clear when the buyer has waited years for a refund after the promised possession date has passed.

At the same time, courts must examine how interest interacts with other compensation claims. A purchaser cannot necessarily claim every financial consequence of a delay as a separate head of damages without considering whether the same underlying loss has already been compensated.

That issue was central to the Supreme Court’s consideration of the buyer’s rent claim.

5. Why the Supreme Court Declined to Award Rent Separately

The buyer sought reimbursement of rent in addition to interest on the refund. The Supreme Court declined to award rent as a separate amount over and above the interest granted for the same period of deprivation.

The Court reasoned that the interest awarded on the refund already addressed the loss associated with being deprived of money that could have been used to secure a home.

If the buyer had retained the money, it could potentially have been applied towards another property. Awarding both a return on the money and rent for the same underlying deprivation could therefore result in double compensation.

The Court relied on the principles discussed in DLF Homes Panchkula Pvt. Ltd. v. D.S. Dhanda (2020), including the caution that consumer fora should not award interest and compensation by applying a mechanical rule of thumb.

The Evidence Was Also Important

The Court’s reasoning did not rest on the general proposition that rent can never be claimed in a delayed-possession dispute.

It also considered the way the claim had been presented and supported. The buyer’s rent claim had changed over the course of the proceedings, and the expanded claim before the Supreme Court was not supported by adequate contemporaneous evidence before the NCDRC.

In particular, the Court noted the absence of a lease deed, rent receipts or comparable evidence of tenancy before the Commission. The later claim was also based on material that did not adequately establish the full period and amount claimed.

The Court further considered the buyer’s earlier position concerning the loss he expected to suffer from the property transaction. That history was relevant to whether the subsequent claim for rent could be accepted as framed.

The decision therefore reflects two related principles: compensation must correspond to the loss legally established, and a party must support its claim with appropriate pleadings and evidence.

Does the Judgment Prohibit Every Rent Claim?

No.

The decision should not be treated as an absolute prohibition on seeking rent in every case involving delayed possession. The question is whether the claim is legally sustainable, properly pleaded, supported by evidence and distinct from loss already compensated through interest or another award.

A claimant seeking rent should be prepared to establish:

That rent was actually paid.

The period for which the property was rented.

The amount paid during that period.

The connection between the rental expense and the builder’s breach.

Why the claim is not duplicative of the interest or compensation sought.

The contractual and legal basis for recovering that expense.

A lease deed, rent receipts, bank statements, contemporaneous correspondence and other reliable records may be relevant, depending on the facts.

The wider lesson is that the remedy must be framed carefully from the outset. A genuine loss may still be difficult to recover if it has not been adequately pleaded or proved.

6. The ₹15 Lakh Compensation Award: Recognising the Wider Consequences

Although the Supreme Court declined to grant rent separately on top of the refund interest, it recognised that the buyer’s experience involved more than the temporary loss of use of money.

The buyer had paid nearly 95% of the consideration by July 2011 but remained without the apartment and without the full benefit of his money for more than fifteen years.

The delay also meant that he had lost the opportunity to benefit from any appreciation in the value of the apartment during that period. Prolonged uncertainty and the resulting financial and personal difficulties were relevant to the assessment of compensation.

The Court therefore directed that an additional ₹15 lakh be paid to the buyer out of the amount deposited before the NCDRC, within one month.

That amount was awarded in full and final satisfaction of the buyer’s claims against the builder towards rent, mental agony, harassment and litigation expenses.

This is an important qualification. The ₹15 lakh award was a consolidated amount intended to address the specified claims. It was not an award of ₹15 lakh for each category of loss.

Why the Amount Should Not Be Treated as a Standard Tariff

The Supreme Court did not prescribe ₹15 lakh as the normal compensation for delayed possession.

The amount was linked to the circumstances of the case, including the unusually long delay, the substantial amount paid and the period during which the buyer remained deprived of both the apartment and the use of his money.

In another case, the appropriate award may be higher or lower, depending on the evidence, contractual terms, duration of delay, actual loss and the nature of the relief sought.

The judgment reinforces the principle that compensation must be assessed on the facts rather than calculated mechanically.

7. Unjust Enrichment and the Purpose of Consumer Compensation

The principle against unjust enrichment is relevant when courts determine whether a party has received or retained a benefit that it has no legal justification to keep.

In consumer disputes, the principle must be applied alongside the contractual relationship, the statutory remedy and the actual loss established by the evidence.

The Supreme Court’s analysis is consistent with the broader principles considered in decisions such as:

Mahabir Kishore v. State of Madhya Pradesh (1989) 4 SCC 1.

Lucknow Development Authority v. M.K. Gupta (1994) 1 SCC 243.

Ghaziabad Development Authority v. Balbir Singh (2004) 5 SCC 65.

These authorities form part of the wider legal framework governing restitution, deficiency in service and compensation. They should not be understood as establishing that every claim for interest, rent or compensation must receive the same outcome.

The essential point is that a remedy should address the wrong suffered without producing an unjustified financial windfall.

Where a court has already awarded interest to compensate for the loss of use of money, a further claim must be examined carefully to determine whether it represents a distinct and recoverable loss or duplicates the same injury.

For advocates, this means identifying the legal basis for each head of relief and explaining how the amounts claimed relate to one another.

8. The Bank’s Liability: Verification Before Loan Disbursement

The dispute also raised an important question concerning the lender’s role in a builder-financed property transaction.

The bank had sanctioned a housing loan and disbursed amounts directly to the builder under the financing arrangement. The NCDRC found that the bank had failed to establish that the required verification of construction progress had been carried out before the disbursements.

The Supreme Court upheld the finding of deficiency in service against the bank and maintained the ₹2 lakh compensation award.

This part of the decision matters because homebuyers frequently rely on arrangements in which the lender pays the builder directly. The purchaser may have limited visibility into the process through which disbursements are approved and construction-related conditions are checked.

However, the precise obligations of a lender depend on the applicable agreements, representations, regulatory requirements and evidence. The judgment should not be interpreted as making banks automatically liable whenever a builder delays possession.

What Should a Buyer Examine in a Lender-Related Dispute?

A homebuyer considering a complaint against a bank should examine:

The loan agreement: What conditions govern the release of funds?

The tripartite agreement: What responsibilities did the builder, lender and purchaser undertake?

Disbursement records: When were payments made, and to whom?

Construction-related conditions: Was verification required before each disbursement?

The bank’s records: Is there evidence that the required checks were actually undertaken?

The buyer’s correspondence: Were concerns about construction, possession or disbursement raised with the lender?

The loss claimed: What specific deficiency is alleged, and how did it cause the loss for which compensation is sought?

The evidentiary burden must be assessed in the context of the claim and the applicable law. Where the bank is alleged to have failed to comply with a verification obligation, the relevant contractual terms and records become particularly important.

The Loan Recovery Dispute Remained Open

The Supreme Court did not finally decide the bank’s separate recovery claim or conclusively determine the buyer’s liability under the loan.

The remaining amount was kept in an interest-bearing account pending the bank’s appeal, and the High Court was directed to decide that appeal on its own merits. The parties’ contentions concerning the loan liability were left open.

This distinction matters. The finding of deficiency against the bank and the separate question of the borrower’s outstanding loan liability are not interchangeable issues. The latter must be resolved in the proceedings in which it remains pending.

9. Which Consumer Protection Law Applied?

The appeals arose under Section 23 of the Consumer Protection Act, 1986.

The Consumer Protection Act, 2019 subsequently replaced the 1986 legislation and established a revised framework for consumer disputes, including provisions governing appeals from decisions of the National Commission.

Section 67 of the 2019 Act addresses appeals from orders of the National Commission to the Supreme Court.

The statutory framework applicable to a particular dispute depends on the relevant dates, the proceedings involved and the applicable transitional provisions. The provisions of the 2019 Act should therefore not be applied retrospectively to an older matter without examining the governing law.

For practitioners, identifying the correct statute and appeal provision is an essential first step. A sound argument on the merits can be undermined if the procedural framework, limitation period or applicable provision is incorrectly identified.

10. Keep Separate Parties’ Liabilities Distinct

A builder’s failure to deliver possession does not automatically resolve every dispute between the purchaser and the lender.

The buyer should examine the builder-buyer agreement, loan agreement and tripartite arrangement separately, while considering how the different proceedings interact.

G. Act Promptly and Check Limitation

Consumer proceedings and appeals are subject to statutory requirements and limitation periods. The correct period and any available grounds for condonation depend on the applicable law and procedural history.

A consumer should not assume that a continuing dispute or ongoing correspondence automatically extends the time available to appeal.

11. What the Judgment Means for Consumer Appeals Against NCDRC Orders

For people considering consumer appeals against NCDRC orders, Madhu Kudapa illustrates why an appeal should identify the precise error alleged in the Commission’s decision.

A challenge may concern the finding of deficiency, the amount ordered to be refunded, the calculation of interest, the rejection of a particular head of damages or the liability of a separate party.

These issues should not be bundled together without analysis. Each requires its own legal and evidentiary foundation.

An Effective Appeal Should Ordinarily Identify

The relevant findings in the NCDRC order.

The legal or factual error alleged in each finding.

The contractual provisions and statutory rules relied upon.

The evidence supporting the proposed correction.

The relationship between the compensation sought and any amount already awarded.

The precise relief requested from the appellate court.

The Supreme Court’s approach demonstrates that an appellate court may preserve a finding of deficiency while modifying the relief payable. Liability and the appropriate remedy are connected, but they are not the same question.

It also illustrates the importance of consistency between the original complaint, the evidence placed before the Commission and the relief later sought on appeal.

12. Insurance Claim Rejection: A Related but Separate Consumer Issue

Insurance claim disputes frequently reach consumer commissions and appellate courts. However, the Madhu Kudapa judgment concerned delayed possession of a residential apartment, the refund of money and related compensation. It did not decide the merits of a rejected insurance claim.

The principles of careful pleading and evidence remain relevant, but insurance disputes involve their own contractual and regulatory considerations.

A Policyholder Challenging a Rejected Claim Should Examine

The precise terms and exclusions of the insurance policy.

The insurer’s stated reason for repudiation.

The proposal form and disclosures made when the policy was purchased.

The claim form and supporting records.

The surveyor’s report, medical records or other relevant assessment, where applicable.

The correspondence between the policyholder and insurer.

The applicable statutory, regulatory and limitation requirements.

A rejection may raise questions about policy interpretation, disclosure, compliance with policy conditions or the insurer’s assessment of the claim. The answer depends on the policy wording, the facts and the applicable law.

The broader lesson is that a consumer appeal should address the actual reason for rejection rather than rely on general allegations of unfairness.

13. Medical Negligence Claims: Evidence and Causation Remain Central

Medical negligence disputes are another important category of consumer litigation, but they require a distinct legal analysis. The Supreme Court’s decision in Madhu Kudapa should not be presented as determining the standard of medical negligence or the compensation payable in such cases.

A medical negligence claimant generally needs to establish the relevant duty of care, the alleged breach and the connection between that breach and the injury or loss claimed. The applicable standard must be assessed in the light of the medical evidence and the circumstances of the treatment.

Relevant Records May Include

Medical prescriptions and treatment notes.

Hospital admission and discharge records.

Diagnostic reports and test results.

Consent forms and treatment documentation.

Expert medical opinions, where appropriate.

Records of subsequent treatment and resulting expenses.

Evidence of the injury or loss alleged to have resulted from the treatment.

A poor medical outcome does not, by itself, establish negligence. The issue is whether the treatment fell below the applicable standard of care and whether the alleged breach caused the harm for which compensation is sought.

As in property disputes, the claim must be grounded in evidence. The nature of that evidence, however, differs significantly between medical negligence and delayed possession.

14. Why Madhu Kudapa Matters Beyond This Particular Dispute

The significance of the judgment lies in its treatment of remedies in a complex consumer dispute involving several parties and overlapping financial claims.

First, it highlights the importance of identifying the actual payments made by the purchaser and distinguishing them from amounts disbursed under a housing loan.

Second, it explains why interest and rent claims must be examined together when both are advanced as compensation for the same deprivation.

Third, it recognises that a prolonged delay may justify compensation beyond the return of the money deposited, while making clear that the amount depends on the facts of the case.

Fourth, it shows that a lender may face liability where a deficiency in its own conduct is established. That liability must nevertheless be considered separately from the borrower’s obligations under the loan agreement.

Finally, it demonstrates the importance of proper pleadings and contemporaneous evidence. A claim that is inadequately supported at the appropriate stage may not be cured simply by expanding the amount claimed later in the proceedings.

For homebuyers and their advocates, these are practical lessons in how to frame a consumer complaint, substantiate financial loss and seek relief that is both legally sustainable and consistent with the remedies already claimed.

15. What Did the Supreme Court Decide in Madhu Kudapa v. Lodha Healthy Constructions?

On 15 October 2026, the Supreme Court directed the release of ₹1,27,34,726 to the homebuyer with simple interest at 12% per annum from the respective dates of deposit. It also awarded ₹15 lakh in consolidated compensation covering the specified claims against the builder towards rent, mental agony, harassment and litigation expenses.

The Court declined to award rent separately on top of interest for the same underlying deprivation and upheld the ₹2 lakh compensation awarded against the bank for deficiency in service.

2. Can a Homebuyer Claim Rent as Well as Interest on a Refund?

Not automatically. The Court declined to award separate rent in this case because interest on the refund compensated the buyer for being deprived of money that could have been used to secure a home.

Whether rent can be recovered in another case depends on the pleadings, evidence, contractual terms, applicable law and whether the rental expense represents a distinct loss rather than duplicating compensation already awarded.

3. Is 12% Interest Compulsory in Every Delayed-Possession Case?

No. The 12% rate was part of the relief granted on the facts of this case. It is not a universal statutory rate for every delayed-possession dispute.

The appropriate rate depends on the applicable contract, the circumstances of the default, the relief sought and the governing legal principles.

4. Why Did the Supreme Court Award an Additional ₹15 Lakh?

The Court took account of the prolonged deprivation suffered by the buyer, who had paid nearly 95% of the consideration but remained without the apartment and the benefit of his money for more than fifteen years.

The amount was a consolidated award in full and final satisfaction of the specified claims against the builder towards rent, mental agony, harassment and litigation expenses. It should not be treated as a fixed amount payable in every delayed-possession case.

5. Can a Bank Be Held Liable When a Builder Fails to Deliver an Apartment?

A bank is not automatically liable merely because the builder has delayed possession. Liability depends on the lender’s own conduct, its contractual or other applicable obligations and the evidence.

In Madhu Kudapa, the finding of deficiency against the bank was upheld because it had not established that the required verification of construction progress had been undertaken before disbursement.

6. Did the Supreme Court Decide Whether the Buyer Still Owed Money to the Bank?

No. The Court left the parties’ contentions concerning the buyer’s loan liability open. The bank’s recovery appeal was to be decided by the High Court on its own merits.

The finding of deficiency against the bank did not, by itself, determine the borrower’s outstanding liability under the loan agreement.

7. What Should a Consumer Include When Appealing an NCDRC Order?

An appeal should identify the specific finding being challenged, the legal or factual error alleged, the relevant evidence, the applicable statutory provisions and the precise relief requested.

The appellant should also address limitation, the contractual terms and any overlap between the compensation claimed and the relief already granted.

8. Does This Judgment Apply Directly to Insurance or Medical Negligence Cases?

No. The judgment concerned delayed possession of a residential apartment, refund of money and related compensation. It did not decide the substantive issues in insurance repudiation or medical negligence disputes.

Those cases require separate analysis of the relevant policy, treatment records, contractual obligations, applicable standards and evidence.

9. Which Consumer Protection Act Applied to the Appeals?

The appeals arose under Section 23 of the Consumer Protection Act, 1986. Section 67 of the Consumer Protection Act, 2019 deals with appeals from orders of the National Commission under the later statutory framework.

The applicable provision in another matter must be determined by reference to the governing statute, the relevant dates and any applicable transitional provisions.

10. What Is the Main Practical Lesson for Homebuyers?

Keep clear records of payments, loan disbursements, contractual deadlines and communications with the builder and lender. Decide carefully which remedy is being pursued, support each claimed loss with evidence and avoid seeking overlapping compensation for the same injury.

These steps can make a material difference to the quality and outcome of a consumer complaint or appeal.

Conclusion

The Supreme Court’s decision in Madhu Kudapa v. Lodha Healthy Constructions and Developer Private Limited, 2026 INSC 1131, is a useful reminder that consumer justice involves more than identifying a service deficiency. The court must also determine what remedy follows from that deficiency and ensure that the compensation awarded corresponds to the loss established.

The judgment protects the homebuyer’s right to meaningful relief while drawing a clear distinction between refund, interest, additional compensation and liability under a separate housing-loan arrangement. It also underscores that claims for rent and other expenses must be properly pleaded, supported by evidence and examined for overlap with compensation already awarded.

For anyone pursuing consumer appeals against NCDRC orders, the message is practical: establish the breach, document the financial consequences and frame each head of relief carefully. A well-supported claim should explain not only what went wrong, but also why the particular remedy sought is justified.

⚖️ Facing a Builder Delay, Homebuyer Refund Dispute or Unfavourable NCDRC Order?

Don’t let uncertainty about your legal rights delay your next step.
