Closely associated with the writings of Karl Marx and Friedrich Engels, this school rejects the idea that law develops autonomously or purely from moral, rational, or cultural sources. Instead, it maintains that the legal system is fundamentally shaped by the prevailing mode of production and the interests of the economically dominant class. Law, in this view, is not a neutral arbiter of justice but a reflection—and instrument—of underlying economic power.
<div id="ez-toc-container" class="ez-toc-v2_0_89 counter-hierarchy class="ez-toc-section-end">

Karl Marx (1818–1883)

Karl Marx was the founder of Marxist theory. He argued that the economic system of a society plays a major role in shaping its laws, politics, and social institutions. According to Marx, society consists of an economic base and a superstructure. The economic base includes the means of production, such as land, factories, machines, and labour, as well as the relationships between those who own them and those who work for them. The superstructure includes law, government, politics, and social ideas.

Marx believed that under capitalism, laws often protect the interests of the wealthy class, which owns the means of production, while workers depend on wages for their livelihood. Therefore, he viewed law as closely connected with economic power and class struggle. He believed that a classless society would eventually remove the economic inequalities that give rise to class-based legal systems.

Friedrich Engels (1820–1895)

Friedrich Engels was Marx’s close collaborator and helped develop Marxist ideas. He explained how the growth of private property, economic inequality, and divisions between social classes contributed to the emergence of the state and its legal system. According to Engels, as society became divided between those who owned property and those who did not, the state developed institutions to maintain order and protect existing property relations.

He argued that law often reflects the interests of the economically powerful class. For example, laws protecting private property may benefit property owners more directly than people who own little or no property. Engels also believed that when class divisions disappeared under communism, the state would gradually lose its role as an instrument of class domination and eventually cease to exist in its traditional form.

Vladimir Lenin (1870–1924)

Vladimir Lenin developed Marxist theory in the context of the Russian Revolution of 1917 and the establishment of the Soviet state. He argued that the state and law were not neutral institutions but instruments through which one social class exercised power over another. According to Lenin, under capitalism, the state generally protected the interests of the capitalist class.

He believed that after a socialist revolution, the working class should use state power and law to end capitalist domination, control major means of production, and establish a socialist economic system. Lenin regarded this as a transitional stage between capitalism and communism. During this period, law and state institutions would be used to reorganise society and reduce class inequalities. In the long run, he expected that as class divisions disappeared, the need for the state as an instrument of class control would gradually decline.

In Short: Contributions of the Principal Thinkers

In short: Marx explained the relationship between the economy and law, Engels examined the role of private property and class divisions in the development of the state and legal system, and Lenin adapted these ideas to revolutionary action and the establishment of a socialist state. Together, their ideas form the foundation of the economic or Soviet school of jurisprudence.

Core Principles of the Economic or Soviet School

The school rests on several interconnected propositions:

Economic determination of law: The legal system is conditioned by the economic structure of society. Rules governing property, contract, labour, and commerce typically mirror the requirements of the dominant mode of production.

Class struggle: Society is divided into antagonistic classes with conflicting economic interests. Under capitalism, the central conflict is between the bourgeoisie (owners of capital) and the proletariat (wage labourers). Law functions, in significant measure, to stabilise the power of the economically stronger class.

Law as an instrument of the ruling class: Far from treating all citizens equally in substance, law frequently operates to protect and legitimise the privileges of the dominant class.

Critique of private property in the means of production: Marx and Engels distinguished personal possessions from private ownership of factories, land, and other means of production. The latter, they argued, generates exploitation and systemic inequality.

Origin and function of the state and law: Both the state and its legal institutions arise within specific economic and class configurations and serve to maintain the existing social order.

Law and social transformation: Changes in economic relations produce corresponding changes in law and political institutions. A fundamental transformation of the economic base is therefore expected to transform the legal superstructure.

Vision of a socialist and ultimately communist society: The Soviet School sought the replacement of capitalist relations with social ownership of the means of production. In classical Marxist theory, the eventual achievement of a classless communist society would render the coercive apparatus of the state and law unnecessary.

The Soviet School in Practice

Following the October Revolution of 1917, Marxist ideas profoundly influenced the development of Soviet legal theory and institutions. Soviet jurisprudence treated law as a tool for advancing socialist economic planning, consolidating state ownership, and constructing a new social order. In practice, however, the Soviet legal system was characterised by extensive state control, centralised authority, and significant restrictions on political and civil liberties. The gap between the ideal of a classless society and the realities of concentrated state power became a persistent feature of Soviet legal experience.

Criticisms of the Economic or Soviet School

The Economic or Soviet School has been criticised for economic reductionism—for attributing excessive causal weight to material conditions and class interests while underestimating the independent roles of morality, individual rights, culture, religion, and legal tradition. Not every legal rule can be explained as serving the interests of a single dominant class; law has also been used, at times, to protect vulnerable groups and to constrain arbitrary power. The historical record of the Soviet Union further demonstrated that a state claiming to act in the name of the working class could itself become an instrument of extensive coercion and repression.

Conclusion

The Economic or Soviet School of Jurisprudence makes a lasting contribution by highlighting the intimate connection between law, economic structure, property relations, and class power. It usefully reminds us that legal systems do not float free of material conditions and that economic inequality can distort the administration of justice. At the same time, its explanatory reach is limited: economic factors alone cannot fully account for the complexity, diversity, and normative aspirations of law. A balanced understanding of jurisprudence requires attention to multiple sources of legal development—economic, moral, cultural, and institutional.

Collapse of the Soviet Union (1989-1991): Gorbachev, Perestroika & the August Coup

Prior Use Versus Goodwill in Passing Of

Student Rights in Schools: Landmark U.S. Supreme Court Cases That Shaped Education Law

Trademark Filing in India: Step-by-Step Guide for 2025

Supreme Court: Section 138 NI Act Conviction Can Be Quashed After Settlement Between Parties

Introduction The Economic School of Jurisprudence, also known as the Marxist or Soviet School, interprets law primarily through the lens of economic conditions and class relations.
