In simple terms, substantive law determines legal rights and duties, whereas procedural law provides the methods for enforcing those rights and duties.

General Legal Understanding

Procedural law is also known as adjective law or adjectival law. It prescribes the methods and rules through which legal rights and duties are enforced by courts. While substantive law determines the rights and liabilities of parties, procedural law regulates the process of administering justice.

Evidence and Proof

Evidence refers to the material presented before a court to establish or disprove facts. It includes oral statements, documents, electronic records and other legally admissible material.

Proof means establishing a fact to the satisfaction of the court according to the applicable legal standard. Evidence is the material used to prove a fact, whereas proof is the result of evaluating that material.

For example, a witness’s statement may be evidence, while the court’s conclusion based on that statement and other material determines whether a fact has been proved.

Valuation of Evidence

Valuation of evidence means examining the credibility, reliability and importance of the evidence presented before the court. A judge considers whether a witness is trustworthy, whether documents are genuine, whether statements are consistent and whether the evidence supports the facts in dispute.

The court must assess the evidence as a whole rather than relying blindly on a single statement or document. The weight given to evidence depends on its quality, reliability and legal admissibility.

Kinds of Evidence

Evidence may be classified into several kinds:

1. Presumptions help courts decide facts when direct proof is difficult or unnecessary.

Presumptions are commonly classified into three kinds:

1. Rebuttable Presumption of Law

A presumption that the law recognises but which can be disproved by contrary evidence.

3. Irrebuttable Presumption of Law

A presumption that the law treats as conclusive, so contrary evidence cannot be used to disprove the presumed fact within its legal scope.

For example, the law may presume certain facts from the ordinary course of human conduct or from particular established circumstances. However, the precise effect of a presumption depends on the relevant law.

Standard and Burden of Proof

The burden of proof refers to the responsibility of a party to establish the facts necessary to support its case or defence. Generally, the party asserting a fact must prove it, subject to applicable legal rules.

The standard of proof is the degree of certainty required by law. In civil cases, the usual standard is the balance of probabilities, meaning that a fact is more likely than not to be true. In criminal cases, the prosecution generally must prove guilt beyond reasonable doubt. These standards reflect the different consequences of civil and criminal proceedings.

Comparison of Civil and Criminal Standards

Basis of Comparison

Civil Cases

Criminal Cases

Standard of Proof

Balance of probabilities

Beyond reasonable doubt

General Meaning

A fact is more likely than not to be true.

Guilt must be established beyond reasonable doubt.

General Burden

The party asserting a fact generally bears the burden of proving it, subject to applicable law.

The prosecution generally bears the burden of proving the accused’s guilt, subject to applicable legal rules.

Procedural Law and Substantive Law

Substantive law defines legal rights, duties, liabilities and offences. It explains what the law requires, prohibits or permits. For example, criminal law defines offences and prescribes punishments, while contract law establishes rights and obligations arising from agreements.

Procedural law lays down the methods by which legal rights and duties are enforced in courts. It regulates matters such as filing cases, conducting trials, presenting evidence, examining witnesses and hearing appeals.

In simple terms, substantive law determines the rights and obligations of parties, whereas procedural law explains how those rights and obligations are determined and enforced. Both are necessary for the proper administration of justice.

Key Differences Between Procedural Law and Substantive Law

Basis of Comparison

Substantive Law

Procedural Law

Meaning

Defines legal rights, duties, liabilities and offences.

Regulates the process of administering justice.

Purpose

Determines what the law requires, prohibits or permits.

Establishes the methods for enforcing legal rights and duties.

Scope

Includes legal rights, obligations, offences and liabilities.

Includes court proceedings, trials, evidence and appeals.

Example

Contract law establishes rights and obligations arising from agreements.

Procedural rules govern how a claim is filed and decided by a court.

Importance of Evidence and Procedural Law

Evidence and procedural rules ensure fairness, reliability and consistency in judicial decisions.
