Setting aside an earlier decision of the Family Court at Karaikal, the High Court held that compelling the couple to continue their marriage was not sustainable in the circumstances presented before it.

The ruling highlights the importance of carefully examining evidence, statements made by spouses during judicial proceedings, and allegations of cruelty when deciding matrimonial disputes. It also underscores a fundamental principle: disability does not diminish a person’s dignity or their right to seek legal relief from a troubled marriage.

The division bench comprising Justice M. Dhandapani and Justice A.D. Maria Clete allowed the husband’s appeal against the Family Court’s order dated May 22, 2020, which had rejected his divorce petition.

Background of the Matrimonial Dispute

The couple married on September 8, 2013, in accordance with Hindu customs. The husband was a resident of Karaikal in Puducherry, while the wife belonged to Nagapattinam in Tamil Nadu. They subsequently had a son.

Over time, however, differences arose between the spouses, and the wife began living with her parents. The breakdown of the relationship eventually led the husband to approach the Family Court in 2017, seeking dissolution of the marriage.

The husband, who has hearing and speech impairments, alleged that he had faced cruelty during the marriage. Among his allegations was that his wife had locked him inside a bathroom.

According to the submissions made on his behalf, he had attempted to preserve the relationship despite the difficulties. His counsel told the High Court that he was even prepared to leave his mother and mentally ill sister to live with his wife in an effort to save the marriage.

Those efforts, however, did not result in a reconciliation.

What Did the Husband Argue Before the High Court?

A central part of the husband’s case concerned his wife’s statement during cross-examination before the Family Court.

His counsel submitted that the wife had admitted that she was not interested in continuing the marriage. According to the husband, this statement, considered alongside the allegations of cruelty and the circumstances of their separation, supported his request for divorce.

The wife’s counsel disputed the significance attributed to that admission. The defence argued that stating an unwillingness to continue the relationship did not, by itself, necessarily establish that she had no intention of living with her husband or automatically entitle him to a divorce.

The dispute therefore required the High Court to examine the wife’s statement in the context of the other circumstances brought before it.

Why Did the Madras High Court Grant Divorce?

After considering the submissions, the division bench found that the wife’s statement demonstrated her unwillingness to continue living with her husband. The court also took note of the allegation that she had locked her hearing and speech-impaired husband inside a bathroom.

The bench reasoned that compelling the spouses to remain together was not sustainable when the wife herself had stated that she was not interested in continuing the relationship and the husband had raised allegations of mistreatment.

The Court’s Observations on the Allegations

In its observations, the court stated:

“Further, it is alleged that the respondent (wife) had locked the appellant (husband) inside the bathroom. When such being the position, forcing the appellant and the respondent to live together – that too, when she herself had stated that she is not interested in living with him – is not sustainable.”

The court also found fault with the Family Court’s approach to the case. It described the earlier order as “perverse” and liable to be set aside.

Allowing the husband’s appeal, the High Court overturned the Family Court’s decision and ordered the dissolution of the marriage.

The outcome provided the husband with the relief he had sought through the matrimonial proceedings.

Key Details of the Divorce Case

Case Detail

Information

Court

Madras High Court

Judges

Justice M. The precise statutory ground on which a decree is ultimately granted must, however, be confirmed from the full judgement.

1. Section 13(1)(ia) of the Hindu Marriage Act, 1955 — Cruelty

Section 13(1)(ia) permits either spouse to seek divorce where the other party has treated them with cruelty.

Cruelty may involve conduct that causes serious physical or mental suffering. Whether particular conduct amounts to cruelty depends on the evidence and the circumstances of the individual marriage.

In this case, the husband alleged that his wife had subjected him to cruelty, including an incident in which he was allegedly locked inside a bathroom. Such allegations must be assessed judicially rather than treated as established facts merely because they appear in a party’s case.

2. The statutory requirements, including the relevant intention and circumstances, must be established.

Although the couple had been living separately, the available account does not establish that desertion was the specific ground on which the High Court granted divorce. It should therefore not be presented as the court’s confirmed legal basis without checking the judgement.

3. Its legal effect, however, depends on the precise words used, the context in which they were spoken, and the other evidence on record.

An unwillingness to continue a marriage does not automatically establish every legal ground for divorce. In this case, the High Court considered the wife’s statement alongside the surrounding circumstances.

4. Appellate courts can correct errors by family courts.

When a Family Court’s decision is challenged, the appellate court examines the matter within the scope of its jurisdiction and the applicable law. Where the decision under challenge cannot be sustained, the appellate court may set it aside and grant appropriate relief.

Here, the High Court found the Family Court’s order to be perverse and overturned it.

5. Reconciliation cannot be considered in isolation from the evidence.

Efforts to preserve a marriage may be relevant to the court’s understanding of the dispute. However, the circumstances of the relationship, the parties’ statements, and the evidence of alleged mistreatment must also be considered.

The judgment illustrates the importance of evaluating the actual circumstances rather than treating the continuation of a marriage as the only acceptable outcome.

Conclusion

The Madras High Court’s decision to grant divorce to a hearing and speech-impaired husband highlights the importance of fairness in matrimonial adjudication. By setting aside the Family Court’s earlier order, the division bench recognised that the circumstances before it did not justify compelling the parties to continue their married life.

The case also raises a broader question about how matrimonial disputes are evaluated: are the experiences and allegations of both spouses receiving equal judicial consideration?

Ultimately, the decision reinforces the importance of examining the evidence, evaluating the parties’ statements in context, and applying matrimonial law without assumptions based on gender or disability.

Legal Note

Legal note: The complete judgment should be consulted to verify the appeal number, judgment date, precise statutory ground for divorce, and the court’s full reasoning before citing the decision as authority in subsequent proceedings.

Domestic Violence & Matrimonial Disputes in India: Legal Rights, Remedies & Strategy

Madras High Court: Children Cannot Bar Divorce When Cruelty and Desertion Are Proved

Supreme Court on Section 498A IPC: Mere Silence Between Spouses Is Not Cruelty, Conviction Set Aside

How to File Divorce in Delhi (2026): Complete Guide to Jurisdiction, Maintenance, Child Custody, and Family Court Procedure

Refusal to Have Children as Mental Cruelty in India: Can It Lead to Divorce?

Madras High Court Grants Divorce to Disabled Husband After Examining Cruelty Allegations The Madras High Court overturned a Family Court order refusing to dissolve a marriage after considering a husband’s allegations of cruelty, his wife’s statement that she was unwilling to continue the relationship, and the circumstances of their troubled marriage.
