Conversely, should an educated wife lose her right to maintenance merely because she has the qualifications to work?

Neither proposition accurately reflects Indian maintenance law.

The legal position is more nuanced. Courts must examine the parties’ actual financial circumstances, their independent income, reasonable needs, liabilities and the evidence presented. In appropriate cases, a spouse’s employment history or evidence of deliberately avoiding work may also be relevant.

Recent judicial decisions have brought these questions into sharper focus. Some courts have declined interim maintenance to wives found capable of maintaining themselves, while others have adjusted maintenance after examining the financial circumstances of both parties.

The broader principle is clear: maintenance should be determined by genuine financial need and the applicable statutory requirements, not by gender stereotypes or income comparisons alone.

Here are five important judicial decisions that help explain how courts approach maintenance for an earning wife in India, alongside the legal principles that govern such claims.

1. Selvakumar

Court: Madras High Court

Judge: Justice M. Dhandapani

Date: 8 July 2025

Maintenance proceedings are not exclusively a matter of husbands supporting wives. Indian matrimonial law recognises that a husband may also seek financial support from his wife when the relevant statutory requirements are satisfied.

In this case, a husband sought interim maintenance under Section 24 of the Hindu Marriage Act, 1955, from his wife, who was employed in the Tamil Nadu Police Department.

The husband reportedly argued that an accident had left him disabled and unable to earn a livelihood. His wife’s counsel opposed the claim, pointing to her own financial responsibilities, including supporting their son.

The dispute raised a fundamental question: Was the husband’s inability to earn sufficiently established by the evidence before the Court?

The High Court set aside the maintenance order after finding that the husband had not established a physical or mental disability preventing him from earning.

The significance of the decision lies in its fact-specific assessment of financial incapacity. A claim for maintenance cannot necessarily succeed merely because one spouse has a lower income or asserts an inability to work.

What does this mean for maintenance claims?

Section 24 of the Hindu Marriage Act allows either the husband or the wife to seek interim maintenance and litigation expenses, provided the statutory conditions are met.

A husband who seeks maintenance must establish the basis of his claim. Similarly, when a wife seeks maintenance, the Court may examine her actual financial position and the evidence relating to her needs.

The legal test is not that every claimant must be completely incapable of working. Rather, the Court must determine whether the statutory requirements for financial support are satisfied.

Important distinction: The judgment should not be interpreted as establishing that husbands are generally ineligible for maintenance. The decision concerned the evidence and circumstances of the particular case.

2. Rajat Kapoor

Court: Delhi High Court

Judge: Justice Chandra Dhari Singh

Date: 19 March 2025

Case Number: CRL.REV.P. 273/2023

One of the more closely watched questions in matrimonial disputes concerns the difference between being capable of earning and actually earning.

In Megha Khetrapal v. Rajat Kapoor, the Delhi High Court examined a challenge to the rejection of an application for interim maintenance under Section 125 of the Code of Criminal Procedure, 1973.

The wife held a Master’s degree in international business from the University of Wollongong, Australia. Her professional background included employment as an audit associate at KPMG in Dubai, work in her father’s business and experience in a jewellery-related business.

Her husband argued that she had deliberately remained unemployed despite possessing substantial educational qualifications and professional experience.

The husband also relied on WhatsApp conversations that allegedly suggested she was avoiding employment because having a job could affect her maintenance claim.

The wife disputed aspects of the material relied upon against her. The authenticity and evidentiary significance of the disputed conversations were matters that required appropriate judicial consideration.

The Delhi High Court ultimately declined to interfere with the lower court’s rejection of her interim maintenance application.

The decision was influenced by the particular combination of circumstances before the Court, including her educational qualifications, professional history, the material relating to alleged deliberate unemployment and the limited scope of revisional interference.

Does an educational qualification automatically defeat a maintenance claim?

No.

This distinction is critical.

In Shailja v. Khobbanna, the Supreme Court made it clear that a person’s ability to earn and their actual earnings are two different matters. The mere fact that a wife is capable of earning does not, by itself, justify reducing maintenance.

The Delhi High Court’s decision in Megha Khetrapal must therefore be understood in the context of the evidence before it rather than as a blanket rule against maintenance for educated women.

A court may examine whether a claimant has deliberately avoided employment, particularly where there is supporting evidence. However, qualifications alone do not establish that a person has sufficient income to meet reasonable living expenses.

The legal question is whether the claimant’s actual financial circumstances satisfy the applicable statutory test, not simply whether the claimant holds a degree.

3. Frequently, the real question is how much one spouse should pay the other.

In Ashutosh Rai Asthana v. Yamita Rai Asthana, the Delhi High Court examined an interim maintenance order requiring the husband to pay ₹30,000 per month.

The husband’s reported annual income exceeded ₹63 lakh in the relevant income-tax return.

However, the Court also considered the wife’s financial circumstances, including her MBA qualification, monthly rental income of ₹10,450 and fixed-deposit interest of ₹4,400. The parties’ accommodation arrangements and the husband’s responsibility for their children’s expenses were also relevant.

After considering the circumstances, the Court reduced interim maintenance from ₹30,000 to ₹25,000 per month.

The order did not eliminate the wife’s maintenance entitlement. Instead, it modified the amount after considering the relevant financial factors.

Why is this decision important?

A maintenance award should not ordinarily be calculated by looking at the paying spouse’s salary in isolation.

The Court must assess the financial circumstances of both parties and the relevant statutory considerations.

A husband may earn a substantial income, but his financial obligations, dependants and reasonable expenses can affect the amount he can pay.

Likewise, a wife’s independent income or property may be relevant when determining the amount of maintenance required.

The decision demonstrates that a maintenance award must reflect a reasoned assessment of the parties’ circumstances rather than a mechanical comparison of their salaries.

It also illustrates an important distinction: a court may find that maintenance is justified while concluding that the amount initially awarded requires adjustment.

5. She sought interim maintenance of ₹60,000 per month from her husband.

The husband disclosed a monthly income of approximately ₹1.63 lakh.

Despite the difference between their reported earnings, the Court dismissed her application for interim maintenance, finding that her independent income was sufficient for her to maintain herself in the circumstances presented.

The decision highlights an important distinction between income disparity and demonstrated financial need.

A husband earning substantially more than his wife does not automatically become liable to pay her the amount she claims. The Court must assess whether the legal requirements for interim monetary relief have been established.

Did the Court dismiss the domestic violence case?

No such conclusion should be drawn from the rejection of the interim maintenance application.

The reported decision concerned the wife’s application for interim maintenance. The underlying allegations of domestic violence were not thereby finally determined.

This distinction matters because a court may assess the evidence relevant to interim financial relief without finally deciding every allegation in the wider proceedings.

What is the wider legal lesson?

Employment and independent income are relevant factors, but they do not operate as automatic disqualifications.

The Court must consider the applicable statutory requirements and the available financial evidence.

The ruling therefore supports a case-specific approach rather than a general rule that working wives cannot seek maintenance.

What Does Indian Maintenance Law Say in 2026?

Indian law provides several routes through which a spouse may seek maintenance or monetary relief. A decision concerning one should not automatically be treated as resolving the other.

3. Educational qualifications alone do not establish that she is financially independent.

Similarly, a husband’s allegation that his wife could earn more money is not, by itself, conclusive proof that she can maintain herself.

4. Khobbanna, decided on 18 January 2017.

The case is frequently cited for an important principle: the ability to earn and actual earnings are not the same thing.

The Supreme Court rejected the reasoning that maintenance should be reduced merely because the wife was capable of earning.

The relevant consideration is not simply whether a person has the potential to earn. The Court must examine the evidence and determine whether the person’s financial circumstances justify the maintenance awarded.

This principle prevents courts from assuming that an educated woman is financially self-sufficient simply because she possesses marketable qualifications.

A professional degree does not guarantee employment. Previous work experience does not necessarily establish current income. Nor does a period of unemployment automatically demonstrate deliberate financial dependence.

At the same time, evidence of actual earnings, property, rental income, investments or deliberate concealment of financial information may be relevant to a maintenance determination.

The law requires an examination of the circumstances, not assumptions based on educational background alone.

The central distinction is between potential earning capacity and demonstrated financial independence.

Rajnesh v. Neha: Why Financial Disclosure Matters

Another important Supreme Court authority is Rajnesh v. Neha, decided on 4 November 2020.

The judgment established important guidelines for maintenance proceedings, including the disclosure of assets and liabilities by the parties.

Financial disclosure helps courts assess the actual economic circumstances of both spouses and avoid decisions based on incomplete or misleading information.

Relevant information may include:

Salary and other employment income.

Business income and professional earnings.

Rental income and investment returns.

Bank balances, assets and liabilities.

Regular household and personal expenses.

Financial responsibilities towards children and other dependants.

Existing maintenance obligations and other relevant liabilities.

These disclosures are important regardless of which spouse is seeking maintenance.

A husband who believes that his wife has concealed her earnings may place relevant evidence before the Court and seek appropriate relief.

Equally, a wife may challenge an incomplete disclosure of her husband’s income, assets or financial resources.

The objective is to enable the Court to make a reasoned decision on reliable financial information.

Equality Must Work Both Ways—but Maintenance Is Not Simply About Gender

The debate surrounding maintenance often becomes polarised.

One side argues that a husband should not be expected to support an earning wife. The other points out that employment does not necessarily eliminate a wife’s need for financial assistance.

Both concerns deserve careful consideration.

A wife who has sacrificed career opportunities for childcare, domestic responsibilities or the needs of the family may face genuine economic disadvantages after separation.

A woman who has been out of the workforce for several years may struggle to secure employment despite holding professional qualifications.

Similarly, a husband who is disabled, unemployed or financially dependent may have a legitimate claim to maintenance if the statutory conditions are satisfied.

The law should not assume that every husband is financially secure or that every wife is financially dependent.

Nor should it presume that every unemployed spouse has deliberately avoided work.

What Factors Should Determine Maintenance?

The relevant questions are factual:

What income does each spouse actually receive?

Does the claimant have sufficient independent resources?

What are the reasonable financial needs of each party?

Are there dependent children whose interests must be considered?

Has either party concealed relevant financial information?

Is there credible evidence of deliberate unemployment or financial manipulation?

What does the applicable statutory provision require?

These questions are more useful than arguments based on gender alone.

Should a Higher-Earning Husband Automatically Pay Maintenance?

Not necessarily.

A difference in income is relevant, but it is not always sufficient by itself to establish entitlement to a particular amount.

The Court must consider the applicable legal test, the claimant’s financial position and the other circumstances of the case.

A financially independent spouse cannot necessarily demand maintenance solely to equalise both parties’ incomes.

However, a spouse’s employment does not automatically defeat a legitimate claim where the income is insufficient to meet reasonable needs under the applicable law.

Should an Educated Wife Be Expected to Work?

The answer depends on the circumstances.

Educational qualifications and professional experience may be relevant, particularly where there is credible evidence that a claimant has deliberately avoided employment.

But the Court must distinguish genuine financial dependence from assumptions about what a person ought to be earning.

Childcare responsibilities, health, career interruptions, employment opportunities and the realities of the labour market may all matter.

A maintenance application should therefore be decided on evidence rather than speculation.

What About the Rights of Children?

Children’s financial interests must be considered separately and carefully.

A dispute between spouses over maintenance should not become a reason to disregard a child’s reasonable needs.

The financial responsibilities of both parents, the applicable law and the child’s circumstances are relevant to determining appropriate support.

The central issue is not whether one parent should be favoured because of gender. It is how the law should fairly address the child’s needs and each parent’s financial capacity.

Conclusion: Maintenance Should Protect Genuine Need, Not Reward or Punish a Spouse

The recent maintenance decisions discussed above demonstrate why courts must look beyond a simple comparison of salaries.

A wife who is educated or employed is not automatically disqualified from claiming maintenance. Equally, a husband’s higher salary does not, by itself, establish that every maintenance claim against him must succeed.

The evidence matters.

Actual income, independent resources, financial obligations, reasonable needs and the applicable statutory requirements must guide the decision. Where supported by evidence, deliberate unemployment or concealment of financial information may also be relevant.

The Supreme Court’s ruling in Shailja v. Khobbanna remains an essential reminder that earning capacity and actual earnings are distinct. Meanwhile, Rajnesh v. Neha underscores the importance of transparent financial disclosure in maintenance proceedings.

A fair legal framework must recognise genuine vulnerability without treating one spouse as the permanent financial guarantor of the other.

Maintenance is intended to provide legally justified financial support—not to punish a spouse for earning more, nor to deny relief to someone merely because they are educated.

Equality requires courts to examine the circumstances of both parties with consistency and fairness. The outcome should depend on the law and the evidence, not on assumptions about what husbands or wives are expected to do.

Frequently Asked Questions (FAQs)

1. Can an Earning Wife Claim Maintenance in India?

Yes. An earning wife may claim maintenance if she satisfies the requirements of the applicable law. The Court will consider her actual income, reasonable needs and other relevant circumstances. Employment does not automatically disqualify her.

2. Can an Educated Wife Be Denied Maintenance?

Yes, depending on the evidence and the applicable statutory requirements. Educational qualifications alone, however, do not automatically defeat a maintenance claim. Courts must distinguish the ability to earn from actual earnings and sufficient financial resources.

3. Can a Husband Claim Maintenance From His Earning Wife?

Yes. Section 24 and Section 25 of the Hindu Marriage Act permit either spouse to seek maintenance, subject to the relevant statutory conditions. A husband must establish the basis of his claim just as a wife must establish hers.

4. Can a Husband Challenge Maintenance if His Wife Conceals Her Income?

Yes. A husband may place relevant financial evidence before the Court and seek appropriate relief. The financial disclosure guidelines in Rajnesh v. Neha are relevant to assessing the parties’ assets, income and liabilities.

5. Is Maintenance Compulsory if the Husband Earns More Than His Wife?

No. A difference in income does not automatically establish entitlement to a particular amount of maintenance. Courts consider the applicable statutory test, the claimant’s actual financial needs, independent income and the parties’ overall circumstances.

6. Can a Wife Who Earns a Good Salary Still Receive Maintenance?

Yes, in appropriate circumstances. A substantial income does not automatically defeat a claim if the claimant can establish entitlement under the applicable law. The Court must assess the actual financial position rather than relying on salary figures alone.

7. Does Section 144 of the BNSS Replace Section 125 of the CrPC?

Section 144 of the Bharatiya Nagarik Suraksha Sanhita, 2023, provides the corresponding maintenance remedy under the new procedural law. The treatment of older proceedings depends on the applicable transitional and savings provisions.

8. Can Maintenance Be Reduced if the Wife Receives Rental Income?

Rental income may be relevant when a Court assesses a spouse’s independent financial resources. However, the effect of that income depends on the evidence, the claimant’s reasonable needs and the applicable legal framework. Rental income does not automatically eliminate maintenance entitlement.

Disclaimer

Disclaimer: This article provides general legal information and is not a substitute for advice on an individual case.
