The Statutory Framework

Order XLI Rule 33 CPC empowers the appellate court to pass any decree and make any order which ought to have been passed or made, and to pass or make such further or other decree or order as the case may require. The power may be exercised although the appeal is only against a part of the decree, and even in favour of a respondent or other party who has not appealed or filed a cross-objection. Where two or more decrees are passed in one suit, or in cross-suits, the power extends to all or any of them although no appeal has been filed against some.

The Rule’s Illustration and Its Purpose

The rule’s own illustration shows its purpose. A sues X and Y for a sum due from one or the other and a decree against X alone. X appeals, with A and Y as respondents. If the appellate court finds for X, it may pass a decree against Y. The decrees must fit together. That is the logic of Rule 33: it repairs the decree when interference with one part would otherwise leave another part inconsistent or unworkable.

Relationship Between Order XLI Rule 33 and Rule 22

Order XLI Rule 22 is the ordinary route for a respondent who wants a decree modified in a matter the appellant has not challenged. The question this article answers is when Rule 33 can do the work that a cross-objection under Rule 22 would normally have to do.

II. The Governing Principle: Banarsi v. Ram Phal

The leading statement is in Banarsi v. Ram Phal, (2003) 9 SCC 606. The Supreme Court described Rule 33 as a power of the widest amplitude, meant to do complete justice between the parties, and then warned that the wider the power, the higher the need for caution. It identified the usual occasion for its exercise and the boundaries that confine it (para 15):

“Usually the power under Rule 33 is exercised when the portion of the decree appealed against … is so inseparably connected with the portion not appealed against or left untouched that for the reason of the latter portion being left untouched either injustice would result or inconsistent decrees would follow. The power is subject to at least three limitations: firstly, the power cannot be exercised to the prejudice or disadvantage of a person not a party before the Court; secondly, a claim given up or lost cannot be revived; and thirdly, such part of the decree which essentially ought to have been appealed against or objected to by a party and which that party has permitted to achieve a finality cannot be reversed to the advantage of such party. A case where there are two reliefs prayed for and one is refused while the other one is granted and the former is not inseparably connected with or necessarily depending on the other, in an appeal against the latter, the former relief cannot be granted in favour of the respondent by the appellate court exercising power under Rule 33 of Order 41.”— Banarsi v. Ram Phal, (2003) 9 SCC 606, para 15

Key Takeaways from Banarsi v. Ram Phal

Two points follow. First, the decisive question is the relationship between the two portions of the decree, not the merits of the refused relief. Second, the final sentence of the passage answers the illustration in this article almost word for word.

The Limitation Imposed by a Legal Interdict

Banarsi also records (para 7) the Court’s earlier holding in Samundra Devi v. Narendra Kaur, (2008) 9 SCC 100 (para 21), that the Rule 33 power cannot be exercised ignoring a legal interdict. The same reasoning was later quoted with approval in State of A.P. v. B. Ranga Reddy, (2020) 15 SCC 681.

III. The Principle Applied: Lakshmanan v. G. Ayyasamy

Lakshmanan v. G. Ayyasamy (C.A. Nos. 3224-25 of 2016, decided 29 March 2016; reported at (2016) 13 SCC 165) is a clean example. The plaintiff’s prayer for removal of three windows in the defendants’ wall had been rejected by the courts below. The plaintiff filed neither a cross-appeal nor a cross-objection. In the defendants’ second appeal the High Court nevertheless ordered the windows closed, invoking Order XLI Rule 33.

The Supreme Court’s Decision

The Supreme Court set that part of the judgment aside. Relying on Banarsi and on Pralhad v. State of Maharashtra, (2010) 10 SCC 458, it held that where an independent appeal or cross-objection has not been filed by the aggrieved party, a relief denied by the courts below cannot be granted in the other side’s appeal. The Court also noted that the plaintiff had not even questioned the setting aside of the injunction granted by the first appellate court. The refused relief was independent of the relief under appeal, and Rule 33 did not reach it.

IV. Companion Authorities

A Plaintiff Who Has Appealed Does Not Need Rule 33

In S. Nazeer Ahmed v. State Bank of Mysore, (2007) 11 SCC 75 (para 8), the High Court had invoked Rule 33 to grant the plaintiff bank a decree in a suit the trial court had dismissed. The Supreme Court observed that where the plaintiff has itself appealed, it can seek the full decree prayed for and there is no occasion to apply Rule 33.

If the suit is barred by Order II Rule 2, Rule 33 offers no route to a decree. The case marks the other boundary: the rule neither replaces an appeal that was filed nor cures a bar that defeats the claim.

A Legal Interdict Is Never Overridden

Samundra Devi is a reminder that Rule 33 yields to statute. A power of the widest amplitude is still a power exercised within the law.

Rules 22 and 33 Are Not Mutually Exclusive

In Mahant Dhangir v. Madan Mohan ([1988] 1 SCR 679; (1987) Supp SCC 528), the Supreme Court dealt with the maintainability of a cross-objection against a co-respondent.

It held that Rules 22 and 33 are not mutually exclusive and that, where a cross-objection is not maintainable, Rule 33 may still enable the appellate court to give complete relief.

This is the authority for the proposition that the absence of a cross-objection does not wholly exclude Rule 33 where rights between respondents need readjustment to avoid inconsistency or injustice.

V. Application to the Illustration

A plaintiff claims two reliefs: A, which is granted, and B, which is refused. Only the defendant appeals, and only against A. The plaintiff files neither an appeal against the refusal of B nor a cross-objection under Order XLI Rule 22.

When Relief B Is Independent of Relief A

If B is independent of A, the appellate court cannot grant B. To do so would give the plaintiff, without appeal or cross-objection, a benefit refused below and allowed to attain finality.

That is the position in Banarsi (para 15) and Lakshmanan.

When Relief B Is Consequential to Relief A

If B is consequential to A (for instance, setting aside A would leave an inconsistent or unworkable decree, or rights between parties need adjusting) the appellate court may invoke Rule 33.

The question is therefore not whether the plaintiff deserves B. It is whether B is legally and practically inseparable from the part of the decree under appeal.

VI. The Pleadings Boundary

Rule 33 also cannot supply what was never pleaded. The Supreme Court’s settled position is that a decision cannot rest on grounds outside the pleadings (Trojan & Co. v. Nagappa Chettiar, AIR 1953 SC 235).

This position was reaffirmed in Akella Lalitha v. Konda Hanumantha Rao (decided 28 July 2022), where the Court held that granting a relief for which no prayer or pleading was made deprives the other side of an opportunity to resist it and leads to a miscarriage of justice.

Complete justice under Rule 33 means completing the decree before the court, not enlarging the suit.

VII. If so, Rule 33 is unavailable.

Legal interdict or pleadings bar? If a statute forbids the relief or it lies outside the pleadings, Rule 33 yields.

For the respondent: where the decree is partly against you and the relief is independent, file the cross-objection under Rule 22 within time. Rule 33 is a safety net for connected reliefs, not a plan.

VIII. Conclusion

Order XLI Rule 33 is broad, but it is not boundless. It is a power to render complete and consistent justice. It is not a power to confer an independent benefit on a party who chose not to challenge an adverse finding.

The controlling test remains inseparable connection or necessary dependence between the relief appealed against and the relief sought to be granted.

Where the connection exists, Rule 33 bridges the gap. Where it does not, the party’s remedy lay in a timely appeal or cross-objection, and the bridge does not extend to it.

Citation Table

Case Name and Citation

Legal Principle

Banarsi v.
