Myanmar), is one of the most consequential proceedings concerning State responsibility under international law.

At its heart lies a difficult legal question: can Myanmar be held responsible for genocide against the Rohingya under the 1948 Genocide Convention?

The answer will depend not simply on the scale of the violence or the suffering of the Rohingya population, but on whether the evidence satisfies the legal requirements for establishing genocide and the international responsibility of a State.

The distinction matters. International law recognises the gravity of mass atrocities, but a finding of genocide requires proof of specific elements, including the intention to destroy, in whole or in part, a national, ethnical, racial or religious group. Establishing that intent before an international court presents particular evidentiary challenges.

The proceedings also have significance beyond Myanmar. They test the effectiveness of the Genocide Convention, the ability of States to invoke responsibility for violations of obligations owed to all parties to a treaty, and the role of international judicial decisions in shaping the response to mass atrocities.

For India, the case raises an additional question: what weight might an eventual ICJ judgment carry in domestic proceedings involving Rohingya refugees, deportation and the protection available under Indian law?

This article examines the legal framework, the principal evidentiary issues, the possible outcomes and the implications for India.

Also Read: The Rohingya Crisis: An International Human Rights Law and United Nations Security Council Analysis

1. Current Status of the Gambia v Myanmar Proceedings

The Gambia instituted proceedings against Myanmar on 11 November 2019, alleging violations of the Genocide Convention in connection with the treatment of the Rohingya.

The case is significant because The Gambia is not required to demonstrate that it suffered direct injury from the alleged violations in order to invoke Myanmar’s responsibility under the Convention. In its judgment of 22 July 2022, the ICJ rejected Myanmar’s preliminary objections and recognised The Gambia’s standing to bring the case in respect of obligations owed to all States parties to the Convention.

Earlier, on 23 January 2020, the Court indicated provisional measures requiring Myanmar to take measures within its power to prevent acts prohibited by Article II of the Convention against the Rohingya, preserve relevant evidence and report periodically on its compliance.

These measures were provisional. They were not a final determination that genocide had occurred. Their purpose was to protect the rights at issue while the proceedings continued.

The merits hearings took place in January 2026. According to the procedural record described in the Court’s announcement following the hearings, the proceedings concluded on 29 January 2026, after which the Court began its deliberations.

The crucial distinction is between the conclusion of hearings and the delivery of judgment. Once oral proceedings end, the Court must consider the parties’ submissions, the evidence and the applicable law before reaching its decision.

The status of the merits judgment and any announced delivery date should be confirmed against the ICJ’s latest official case records before publication. Statements by government representatives about when a judgment might be delivered should not be treated as an official announcement by the Court.

Until the Court issues its decision, any discussion of the likely outcome remains analysis rather than a statement of what the judges have decided.

2. What Must the ICJ Decide?

The central issue in the ICJ Rohingya genocide case is whether Myanmar breached its obligations under the Genocide Convention in connection with the operations against the Rohingya in northern Rakhine State, particularly during 2016 and 2017.

The legal questions extend beyond whether serious violence occurred. The Court must examine the conduct alleged, the evidence supporting the claims, the applicable rules of attribution and the obligations imposed on States by the Convention.

Several provisions are particularly important.

Article I: The Duty to Prevent and Punish Genocide

Article I requires States parties to prevent and punish genocide.

These obligations are related but distinct. A State may be responsible for failing to prevent genocide even where the genocidal acts themselves are not attributable to that State. Responsibility for commission, by contrast, requires the Court to establish the relevant conduct and its attribution under the applicable rules of international law.

The obligation to prevent genocide is not simply a general political commitment. It is a legal obligation whose application depends on the circumstances, including the State’s capacity to influence the conduct in question.

Article II: The Definition of Genocide

Article II identifies the acts that may constitute genocide when committed with the required intent against a protected group.

The listed acts include:

killing members of the group,

causing serious bodily or mental harm,

deliberately inflicting conditions of life calculated to bring about its physical destruction,

imposing measures intended to prevent births, and

forcibly transferring children of the group to another group.

The commission of one or more of these acts does not, by itself, establish genocide. The specific intent to destroy the protected group, in whole or in part, must also be established.

This requirement is central to the case against Myanmar.

Article III: Other Punishable Acts

Article III addresses genocide, conspiracy to commit genocide, direct and public incitement to commit genocide, attempt to commit genocide and complicity in genocide.

The Convention therefore extends beyond the completed commission of genocide. However, each alleged violation must be assessed according to its own legal requirements.

The Question of State Responsibility

The Court must also distinguish between findings concerning particular acts and findings concerning Myanmar’s responsibility under international law.

A conclusion that prohibited acts occurred is not necessarily identical to a conclusion that the State committed genocide. Equally, a failure to prevent or punish genocide involves legal questions different from those arising when the State itself is alleged to have committed the acts.

Keeping these distinctions clear is essential to understanding the possible judgment.

3. Genocidal Intent: The Most Difficult Evidentiary Question

The principal legal difficulty may lie in establishing dolus specialis, the specific intent to destroy a protected group, in whole or in part, as such.

The scale of violence, the destruction of villages, sexual violence, killings and the displacement of a population may be highly relevant evidence. Yet the Court must assess that evidence against the legal definition of genocide rather than treating the occurrence of grave atrocities as sufficient in itself.

The ICJ’s earlier judgments provide the framework.

Lessons from Bosnia and Herzegovina v Serbia and Montenegro

In its judgment of 26 February 2007, the Court considered allegations arising from the conflict in Bosnia and Herzegovina.

It found that genocide had occurred at Srebrenica. However, it did not find Serbia responsible for committing that genocide. It held Serbia responsible for failing to prevent the genocide and for failing to cooperate fully with the International Criminal Tribunal for the former Yugoslavia in punishing those responsible.

The judgment illustrates the distinction between establishing that genocide occurred and establishing the international responsibility of a State for its commission.

It also demonstrates the demanding evidentiary standard applied by the Court to allegations of exceptional gravity.

Lessons from Croatia v Serbia

In its judgment of 3 February 2015, the Court examined competing claims of genocide arising from the conflict between Croatia and Serbia.

The judgment addressed the circumstances in which genocidal intent may be inferred from a pattern of conduct rather than established through direct evidence.

Where the inference of genocidal intent is drawn from a pattern of conduct, the Court has required that this be the only reasonable inference that could be drawn from the established facts.

That approach makes the evaluation of circumstantial evidence particularly important.

How These Precedents May Affect the Myanmar Case

The Gambia’s case rests on its interpretation of the evidence concerning the scale, nature and targeting of operations against the Rohingya, considered alongside the broader circumstances in which those operations took place.

Myanmar, for its part, has contested the allegations and advanced a security-based explanation for its operations.

The Court must evaluate the competing positions against the evidence and the applicable legal standard.

The question is not whether security operations can ever be legitimate. It is whether the evidence establishes the acts and specific intent required by the Convention, and whether the conduct gives rise to the state responsibility alleged.

The Court’s treatment of independent fact-finding reports, the weight of circumstantial evidence and the relationship between military objectives and genocidal intent will therefore be important aspects of its reasoning.

4. What Role Will Other States Play?

The proceedings have also attracted interventions by States under Article 63 of the ICJ Statute.

Article 63 allows a State party to a convention to intervene in proceedings where the construction of that convention is in question. Such intervention concerns the interpretation of the treaty; it does not give an intervening State the same role as a party to the dispute.

In the Myanmar proceedings, the interventions provide an opportunity for participating States to address the interpretation of the Genocide Convention and the legal principles relevant to the Court’s decision.

Questions concerning the standard of proof, the inference of genocidal intent and the interpretation of the Convention may have significance well beyond the immediate dispute.

The precise number and procedural status of the interventions should be checked against the Court’s relevant orders before publication.

The eventual judgment may clarify how the Court approaches these issues, but it would be premature to assume that the interventions will produce any particular change in the law.

5. Five Possible Outcomes of the ICJ Rohingya Genocide Case

Until the judgment is delivered, several legal outcomes remain possible. These are analytical possibilities, not predictions of the Court’s decision.

Outcome 1: A Finding That Myanmar Committed Genocide

The Court could conclude that the evidence establishes genocide and that Myanmar bears State responsibility for its commission.

Such a finding would be of major significance for international law, particularly in the context of the Court’s earlier treatment of State responsibility under the Genocide Convention.

The precise significance would depend on the findings concerning the acts, intent, attribution and obligations breached.

Outcome 2: A Finding That Myanmar Failed to Prevent or Punish Genocide

The Court could find breaches of the duties to prevent or punish without finding that genocide was committed by Myanmar itself.

The Bosnia judgment illustrates why these forms of responsibility must be distinguished.

Such an outcome would still represent a serious legal finding. Its implications would depend on the specific obligations the Court found to have been breached.

Outcome 3: A Finding Concerning the Provisional-Measures Order

The Court could address whether Myanmar complied with the provisional measures indicated in January 2020.

Compliance with that order is a distinct issue from the final determination of whether genocide occurred.

The two questions should not be conflated: the provisional measures were designed to protect the rights at issue while the case was pending, whereas the merits judgment must determine the claims presented to the Court.

Outcome 4: A Mixed Judgment

The Court could reach different conclusions on different allegations or obligations.

For example, its findings concerning particular acts, genocidal intent, the duty to prevent, the duty to punish and compliance with provisional measures need not all have the same outcome.

A mixed judgment would require close attention to the Court’s reasoning and operative findings rather than a simple headline characterisation of the result.

Outcome 5: Dismissal of the Genocide Claim

The Court could conclude that the evidence does not establish one or more of the required elements to the applicable standard of proof.

That would not necessarily mean that serious violence or other atrocities did not occur. It would mean that the particular legal claim before the Court had not been established to the required standard.

The distinction between the historical evidence of atrocities and the legal requirements for a finding of genocide is fundamental to understanding such an outcome.

6. Enforcement, Remedies and the Limits of International Judgments

An ICJ judgment is final and binding on the parties to the case. The Court’s judgments are not subject to appeal.

However, the practical consequences of a judgment depend on more than its legal authority.

The ICJ does not have its own police force. Compliance with its decisions depends on the obligations of the parties and, where relevant, the international mechanisms available under the United Nations Charter.

The Gambia has sought findings of breach and remedial measures in connection with the alleged violations. The precise remedies available would depend on the Court’s findings and the legal principles governing State responsibility.

Possible Remedies for Breaches of the Genocide Convention

Possible consequences may include declarations of breach, obligations to cease wrongful conduct where applicable, assurances or guarantees of non-repetition, and reparation where the relevant legal requirements are satisfied.

Reparation may take different forms, depending on the nature of the breach and the harm established. It should not be assumed that every remedy requested by a party will be granted.

The Court’s reasoning on remedies will therefore matter alongside its conclusions on the merits.

7. The ICC and Other Accountability Proceedings

The ICJ case forms part of a broader effort to establish accountability for alleged crimes against the Rohingya, but it must be distinguished from proceedings involving individual criminal responsibility.

Difference Between the ICJ and ICC

The ICJ determines disputes between States within its jurisdiction. It does not conduct criminal trials of individual military or political leaders.

The International Criminal Court, by contrast, deals with individual criminal responsibility for crimes within its jurisdiction. Proceedings concerning alleged deportation and persecution connected with the Rohingya situation therefore raise questions different from those before the ICJ.

Universal Jurisdiction and National Courts

Universal-jurisdiction proceedings in national courts may provide another avenue for pursuing individual accountability, subject to the relevant domestic and international legal requirements.

Verification of Accountability Proceedings

The procedural status of the ICC application and the Argentine proceedings should be verified against current official records before publication, as applications, warrants and subsequent decisions are separate procedural events.

An ICJ judgment may be relevant to the broader legal and factual context of these proceedings. It would not, however, automatically determine the criminal responsibility of any individual. That question must be resolved under the applicable rules and procedures governing the relevant criminal proceedings.

8. What Does the ICJ Rohingya Genocide Case Mean for India?

For Indian readers, the case has a particular significance because it intersects with questions concerning the legal status, treatment and possible deportation of Rohingya refugees.

India is not a party to the ICJ dispute and did not intervene in the proceedings. Under Article 59 of the ICJ Statute, the Court’s decision has binding force between the parties and in respect of that particular case.

An eventual judgment against Myanmar would therefore not, by itself, bind India or automatically determine the outcome of litigation before Indian courts.

Nevertheless, the judgment could be relevant to the factual and legal arguments advanced in proceedings concerning the Rohingya.

Three aspects deserve attention.

India’s Reservation to Article IX of the Genocide Convention

India’s declaration concerning Article IX of the Genocide Convention is relevant to the question of the Court’s jurisdiction over disputes involving India.

Article IX provides for the submission of disputes concerning the interpretation, application or fulfilment of the Convention to the ICJ, subject to its terms and the applicable rules of international law.

India’s reservation addresses the conditions under which such disputes may be submitted to the Court.

However, the jurisdictional question must be distinguished from the substantive obligations imposed by the Convention. A reservation affecting the Court’s jurisdiction does not, by itself, answer whether a State is bound by a particular substantive obligation.

The precise scope and legal effect of India’s reservation should be assessed by reference to its official text and the applicable treaty law.

The Supreme Court’s Decision in Mohammad Salimullah v Union of India

The Supreme Court of India considered issues concerning the proposed deportation of Rohingya persons in Mohammad Salimullah v. Union of India, in an order dated 8 April 2021.

The proceedings raised questions about the protection available to non-citizens under the Constitution, the legal framework governing deportation and the relevance of the ICJ’s provisional-measures order concerning Myanmar.

The Court addressed the relationship between Articles 14, 19 and 21 of the Constitution and the statutory framework governing foreigners. It declined the interim relief sought while requiring that deportation be carried out in accordance with the prescribed procedure.

The decision must be understood in its procedural and legal context. It did not amount to a final determination of every issue concerning the rights of Rohingya persons in India.

The ICJ’s provisional-measures order and a final judgment on the merits are also different in legal character. The former protects rights pending the resolution of the dispute; the latter determines the claims that the Court decides on the merits.

An eventual merits judgment could provide further authoritative material concerning conditions in Myanmar. Its relevance to Indian proceedings would nevertheless depend on the particular issues before the domestic court and the applicable Indian law.

Deportation, Detention and Constitutional Protection

Questions concerning Rohingya persons in India involve the interaction of immigration legislation, constitutional protections and the legal obligations applicable to the circumstances.

The Immigration and Foreigners Act, 2025 has replaced the Foreigners Act, 1946. Any contemporary discussion of detention or deportation must therefore identify the legislation currently in force and the applicable judicial directions.

A judgment finding Myanmar responsible for genocide or other breaches of the Convention would not automatically prohibit every deportation from India. Nor would it automatically settle the scope of the constitutional protection available to a particular individual.

It could, however, become relevant when courts assess the factual circumstances in Myanmar, the risks alleged by affected persons and the legal arguments advanced under domestic law.

The precise effect would depend on the findings in the ICJ judgment and the issues requiring determination before the Indian court.

Earlier Indian jurisprudence concerning the protection of non-citizens, including cases addressing constitutional safeguards and the treatment of international norms where relevant, would remain important to that analysis.

For lawyers and affected families, the practical lesson is to distinguish the evidentiary significance of an international judgment from its binding legal effect.

9. What Lawyers and Researchers Should Watch For

When the ICJ delivers its judgment, the reasoning will matter as much as the final result.

Readers should pay particular attention to three questions.

1. Assessment of Genocidal Intent

First, how does the Court assess genocidal intent? The judgment may provide important guidance on the relationship between circumstantial evidence, patterns of conduct and the demanding legal test for establishing the specific intent required by the Convention.

2. Evaluation of Independent Fact-Finding

Second, how does the Court evaluate independent fact-finding? Its treatment of reports and other evidence may be significant in cases where access to the relevant territory has been restricted or the parties dispute the reliability of the available material.

3. Remedies Following an Established Breach

Third, what remedies follow from any established breach? The Court’s approach to declarations of responsibility, prevention, punishment and reparation may influence how future cases under the Genocide Convention are argued.

Importance of the ICJ’s Operative Judgment

The operative part of the judgment will identify the Court’s formal decisions. Those findings should be read alongside the reasoning rather than reduced to a headline or a single statement about whether genocide was established.

Impact of the Judgment on Indian Proceedings

For Indian practitioners, it will also be important to examine how the judgment is subsequently cited or considered in domestic proceedings. Its practical influence will depend on the legal questions arising in those cases, not merely on the international significance of the ruling.

Conclusion: A Defining Test for International Law

The ICJ Rohingya genocide case places a fundamental question before international law: can the legal framework of the Genocide Convention establish State responsibility for alleged genocide where the evidence must be assessed against a demanding standard of proof?

The answer will depend on the Court’s evaluation of the evidence, its application of the law on genocidal intent and State responsibility, and its conclusions on the obligations alleged to have been breached.

Whatever the outcome, the judgment will need to be read with care. A finding that genocide occurred, a finding that a State committed genocide, a finding that a State failed to prevent or punish genocide, and a finding concerning compliance with provisional measures are legally distinct conclusions.

For India, the judgment will not automatically dictate the outcome of Rohingya-related proceedings. Its potential significance lies instead in the authoritative material it may provide concerning conditions in Myanmar and the legal questions that Indian courts may be called upon to consider.

The wider importance of the case extends beyond either country. It will contribute to the continuing development of the law governing genocide, the responsibility of States and the practical limits of international judicial enforcement.

The final judgment will be important not only for what the Court decides, but also for how it explains the relationship between evidence, intent and State responsibility under the Genocide Convention.

⚖️ Need Legal Guidance? What Is the ICJ Rohingya Genocide Case Against Myanmar?

The ICJ Rohingya genocide case, formally known as The Gambia v. Myanmar, is a case before the International Court of Justice concerning allegations that Myanmar violated the 1948 Genocide Convention through its treatment of the Rohingya, a predominantly Muslim minority group. The Gambia initiated proceedings in November 2019, seeking to establish Myanmar’s responsibility under international law.

2. What Is the International Court of Justice Examining in the Rohingya Genocide Case?

The International Court of Justice is examining whether Myanmar violated its obligations under the Genocide Convention. Key legal questions include whether prohibited genocidal acts occurred, whether they were committed with the specific intent to destroy the Rohingya group, in whole or in part, and whether Myanmar breached its international legal obligations.

3. What Did the ICJ Order Myanmar to Do in the Rohingya Genocide Case?

In January 2020, the ICJ ordered provisional measures requiring Myanmar to take steps to prevent acts prohibited by the Genocide Convention, preserve evidence relating to the allegations, and submit reports on its compliance. These measures were intended to protect the rights at issue while the case proceeded; they were not a final determination that genocide had occurred.

4. What Could Be the Consequences of an ICJ Judgment Against Myanmar in the Rohingya Genocide Case?

If the ICJ finds Myanmar responsible for violations of the Genocide Convention, its judgment could address State responsibility and the legal consequences of those violations, potentially including obligations to cease wrongful conduct, provide assurances against repetition where appropriate, or make reparation. The precise consequences would depend on the Court’s findings and orders. Enforcement may present practical and political challenges.

5. How Could the ICJ Rohingya Genocide Case Affect India and Refugee Law?

The ICJ Rohingya genocide case could influence wider discussions about international human rights, State responsibility, refugee protection, and the prevention of genocide. For India, these issues may be relevant to legal debates concerning Rohingya refugees, detention, deportation, and the relationship between international obligations and domestic law. However, the case does not automatically determine India’s legal obligations or the outcome of individual refugee cases; those questions depend on applicable Indian law and relevant judicial decisions.

Key Takeaways: ICJ Rohingya Genocide Case

The ICJ Rohingya genocide case: The Gambia brought proceedings against Myanmar before the International Court of Justice (ICJ), alleging violations of the 1948 Genocide Convention against the Rohingya population.

The Genocide Convention is central to the case: The Court must consider whether Myanmar breached its obligations under the Convention, including the duty to prevent and punish genocide.

Genocidal intent is a key legal issue: Establishing genocide requires more than proof of widespread violence. The case raises the difficult question of whether prohibited acts were committed with the specific intent to destroy, in whole or in part, a protected group.

The ICJ has jurisdiction to hear the dispute: In its 2022 judgment on preliminary objections, the Court rejected Myanmar’s objections to its jurisdiction and the admissibility of The Gambia’s application.

Provisional measures were ordered in 2020: The ICJ directed Myanmar to take measures to prevent acts prohibited by the Genocide Convention, preserve relevant evidence, and report on compliance.

Third-party intervention may influence the legal analysis: Proceedings under Article 63 of the ICJ Statute allow other States that are parties to the Genocide Convention to intervene on questions concerning its interpretation, subject to the applicable legal requirements.

The judgment could clarify State responsibility for genocide: The Court’s findings may help explain the evidentiary standards for proving genocidal intent and the obligations States have under international law.

Enforcement remains a separate challenge: Although ICJ judgments are binding on the parties to a case, implementation and enforcement can raise practical and political difficulties.

Other accountability proceedings are distinct: Proceedings before bodies such as the International Criminal Court (ICC) operate under different legal frameworks and should not be confused with the ICJ’s determination of State responsibility.

The case has implications for India: The proceedings raise broader questions about international human rights obligations, refugee protection, deportation, and the relationship between international law and domestic legal frameworks. The effect on Indian law depends on the relevant treaties, constitutional principles, statutes, and judicial decisions.

Why the ICJ Rohingya genocide case matters: Beyond the allegations against Myanmar, the case is significant for the interpretation of the Genocide Convention, the accountability of States under international law, and the international community’s response to alleged genocide.

Editorial Note

This article examines the proceedings from a pre-judgment perspective.
