However, the provision does not, by itself, classify every such offence as bailable or non-bailable. Following the expiry of the temporary provisions of the Essential Commodities (Special Provisions) Act, 1981, the question of bailability is generally determined by the applicable procedural law, the punishment prescribed for the particular offence and any valid state-specific amendment.

In West Bengal, offences under Section 7 of the Essential Commodities Act, 1955, are cognisable under Section 10A of the Act. Where the applicable provision prescribes imprisonment which may extend to seven years, the offence is generally classified as non-bailable under the First Schedule to the Bharatiya Nagarik Suraksha Sanhita, 2023, subject to any relevant special statutory provision or binding judicial decision.

Key Legal Principles Laid Down by Courts

Courts have consistently held that Section 7 is a penal provision and must be applied strictly. Several important principles have emerged:

A. Existence of a Valid and Subsisting Control Order Is Essential

No conviction under Section 7 is possible unless a specific Control Order under Section 3 was in force on the date of the alleged offence.

In Manoj v. State of Maharashtra (2026 INSC 152), the Supreme Court set aside convictions relating to the storage of cement in 1994 because the Central Government had already deregulated cement through notifications issued in 1989 and 1990. In the absence of a subsisting control order under Section 3, prosecution under Section 7 was held legally untenable.

In Pitambar Das v. State of U.P. (Allahabad High Court, 2026), the Court held that the prosecution must specifically identify and prove the particular control order that was allegedly contravened.

B. Preparation Versus Attempt

Mere preparation does not constitute an offence. In Malkiat Singh v. State of Punjab (1969), the Supreme Court held that transporting goods within the State (with the possibility of the person changing his mind before crossing the border) amounts only to preparation and not an attempt to export in violation of a control order.

C. Culpable Mental State (Mens Rea) – Section 10C

Under Section 7 of the Essential Commodities Act, 1955, mens rea is not an essential ingredient that the prosecution is required to prove once the factum of contravention of a control order issued under Section 3 is established (State of Madhya Pradesh v. Narayan Singh, (1989) 3 SCC 596). Further, Section 10C of the Act creates a statutory presumption of culpable mental state. The court shall presume the existence of such mental state, and it is open to the accused to rebut the presumption by proving that he had no such mental state.

D. Liability of Corporate Officers – Section 10

In Food World Super Markets Ltd. v. State of Karnataka (Karnataka High Court, 2007; (2008) 3 KCCR 1629), applying the fundamental principles on corporate vicarious liability laid down in State of Madras v. C.V. Parekh (1970) and subsequently reaffirmed in Aneeta Hada v. Godfather Travels (2012), the High Court held that:

Directors or officers cannot be held vicariously liable under Section 10 of the Essential Commodities Act, 1955, unless the complaint contains specific allegations that they were, at the relevant time, in charge of and responsible to the company for the conduct of its business; and

Arraignment of the company as the principal accused is a condition precedent before its directors or officers can be proceeded against under the said provision.

E. Judicial Discretion in Sentencing

The proviso to Section 7(1)(a)(ii) permits the court to impose a sentence of imprisonment for a term of less than three months for adequate and special reasons to be mentioned in the judgement (Sopana Trimbak Wani v. State of Maharashtra, AIR 1976 SC 1840).

The maximum imprisonment under Section 7(1)(a)(ii) is seven years (Nirmal Kanti Roy v. State of West Bengal, AIR 1998 SC 2322).

F. Benefit of Probation for First-Time Offenders

In Dhurukumar v. State of Maharashtra (2017) (Criminal Appeal No. 1760 of 2009, decided on 4 October 2017), the Supreme Court held that first-time offenders under the Essential Commodities Act, 1955, who have no previous criminal antecedents, should ordinarily be given the benefit of the Probation of Offenders Act, 1958, or Section 360 of the Code of Criminal Procedure, 1973 (now corresponding to Section 401 of the Bharatiya Nagarik Suraksha Sanhita, 2023), rather than being sentenced to imprisonment.

G. Investigation Bias and Neutrality

In Deonath Prasad v. State of Bihar (2007 SCC OnLine Pat 275: (2007) PLJR 627), the Patna High Court held that where the officer who conducts the search and seizure under the Essential Commodities Act, 1955, also acts as the complainant and conducts the investigation, it compromises the neutrality of the probe and casts reasonable doubt on its fairness and impartiality.

Main Takeaways

No active control order on the date of the alleged act = no offence under Section 7.

Most general violations carry a mandatory minimum imprisonment (3 or 6 months), which can only be reduced if the court records “adequate and special reasons” (such as absence of substantial harm).

Repeat offenders face higher mandatory minimums and a compulsory business ban of at least six months.

Neutrality of Investigation: Combining the roles of search/seizure officer, complainant, and investigator undermines trial fairness (Deonath Prasad).

Forfeiture: Commodity forfeiture is mandatory; conveyance forfeiture is discretionary.

Corporate Safeguards: Company officers cannot be prosecuted without specific operational nexus and without making the company an accused.

Conclusion

Section 7 of the Essential Commodities Act, 1955, is a stringent provision designed to prevent hoarding, black marketing and artificial scarcity of essential goods. It provides for minimum terms of imprisonment, business bans and mandatory forfeiture of property. At the same time, the judiciary has insisted that the provision can be invoked only when a valid and subsisting control order is proved to have been in force and specifically contravened. This balanced approach protects the public interest while safeguarding individuals and businesses from arbitrary or unfounded criminal prosecution.

Regulatory Role of Control Orders in Preventing Price Escalation

Punishment under BNS

Forfeiture of Tenancy under the Transfer of Property Act

The Essential Commodities Act, 1955 – A Complete Overview

Law Enforcement and Price Control of Essential Commodities

Introduction The Essential Commodities Act, 1955 (ECA), ensures that everyday items such as food grains, fuel and medicines remain available at fair prices and in adequate quantities.
