id="The_Sentence_Before_the_Sentence">The Sentence Before the Sentence

Before a court passes judgement, another “sentence” may already have begun—shaped by untreated mental illness, trauma, addiction, isolation, or lack of care.

Conditions such as bipolar disorder, ADHD, severe depression, or other disorders can impair emotional regulation, judgement, and impulse control. Mental illness does not automatically cause crime; the vast majority of people with mental health conditions are neither violent nor criminal.

The real risk arises when illness remains untreated and combines with other vulnerabilities and absent support.

When Warning Signs Go Unnoticed

Symptoms often appear as mood swings, agitation, impulsivity, or emotional instability. Families may see only indiscipline or aggression; schools and workplaces may respond with exclusion rather than help.

Stigma, financial barriers, and shortage of professionals delay treatment. Early intervention cannot prevent every offence, but it can reduce avoidable crises that later reach the police and courts.

The Role of the Criminal Justice System

Police are frequently the first responders to mental health crises. Without training, unusual behaviour can be misread as defiance.

Crisis-intervention training, screening, and referral pathways help distinguish medical needs from pure law-enforcement situations. Courts, guided by proper medical evidence, can balance accountability with recognition of genuine mental health factors.

Compassion and justice are not opposites.

Prison Is Not a Substitute for Treatment

Prisons house many people with significant mental health needs. Imprisonment can worsen conditions through isolation, overcrowding, and interrupted care.

Access to psychiatric assessment, medication, counselling, and post-release continuity of treatment is essential. Rehabilitation must address psychological needs alongside discipline and vocational training.

The Indian Context

Awareness has grown, yet stigma, uneven access, and shortage of professionals remain major barriers. For many, contact with the criminal justice system becomes the first serious encounter with mental healthcare.

India’s Mental Healthcare Act, 2017 provides a strong legal framework, but effective implementation, trained personnel, and coordinated action across schools, primary healthcare, police, courts, prisons, and community services are still needed.

Accountability and Compassion

Mental illness must never be used to stigmatise, nor treated as an automatic defence. Victims deserve justice, and society needs safety.

A fair system examines relevant medical evidence, protects rights, and ensures that those who need treatment receive it—even after entering the justice system.

Punishment may be necessary; it is rarely sufficient on its own.

Conclusion

A just society must protect victims, uphold the law, and hold offenders accountable. It must also recognise that early identification, accessible treatment, and meaningful rehabilitation can prevent some crises from becoming crimes.

The most important intervention is often the one that happens before the police complaint, the courtroom, and the prison door. For some people, the struggle that precedes a legal sentence has already gone unnoticed for years.

Judicial activism by expanding the scope of Article 21 and recognising mental health as a fundamental right

Medical Bail and the Right to Treatment: When Should Illness Justify Release from Custody?

Sentencing Principles and Guidelines: A Model Framework

The Evolving Landscape of Sentencing in India: Principles, Judicial Trends, and the Road Ahead

Parameshwari v.
