A defence lawyer must critically examine every stage of the process, including the collection, preservation, examination, interpretation, and linkage of fingerprint evidence to the alleged offence. Such scrutiny protects the accused against wrongful conviction and upholds the principles of a fair trial, scientific integrity, and constitutional justice.

Table of Contents

Toggle

Introduction

Legal Framework Governing Fingerprint Evidence in India

Important Distinction

Key Principle

Constitutional Safeguards

A. The legality of collection and the evidentiary value of the resulting comparison must be assessed separately under the applicable law.

Key Principle

The admissibility of expert opinion does not make it conclusive proof of guilt. Protection Against Self-Incrimination — Article 20(3)

Fingerprints are generally regarded as physical identifying evidence rather than testimonial communication. In State of Bombay v. Kathi Kalu Oghad AIR 1961 SC 1808 / 1961 SCR 172, the Supreme Court distinguished physical evidence from compelled testimonial evidence; in Selvi v. State of Karnataka (2010), it further examined the constitutional protection against compelled testimonial responses. Accordingly, a challenge based solely on Article 20(3) is unlikely to succeed in the case of ordinary fingerprint collection. The defence should instead examine whether the collection was legally authorised, procedurally compliant, and scientifically reliable.

B. Puttaswamy (Retd.) v. Union of India (2017). State interference with privacy must satisfy applicable constitutional requirements, including legality, a legitimate state objective, and proportionality. In criminal investigations, the defence should examine whether fingerprint collection and retention were authorised by law, whether prescribed procedures were followed, and whether the use of the data exceeded its lawful purpose.

C. Jai Lal, 1999). The court must independently assess the expert’s reasoning, the reliability of the methodology, and the evidence as a whole. Fingerprint evidence may carry significant probative value when the print is of good quality, the comparison is scientifically sound, the chain of custody is intact, and the findings reliably connect the accused to the alleged offence. However, weak, inconclusive, or inadequately explained fingerprint evidence must be scrutinised carefully and cannot, without sufficient supporting evidence, justify a conviction beyond reasonable doubt.

Conclusion

Fingerprint evidence can be a valuable tool in criminal investigations, but its evidentiary worth depends on whether it has been lawfully collected, properly documented, securely preserved, scientifically examined, and reliably connected to the alleged offence. A fingerprint match, by itself, should not automatically be treated as conclusive proof of guilt. The circumstances in which the print was deposited, the possibility of contamination or transfer, the quality of the impression, the methodology adopted by the examiner, and the limitations of the forensic analysis must all be carefully scrutinised.

The defence lawyer’s responsibility is not to reject forensic science, but to ensure that it is applied objectively, transparently, and in accordance with the law. Every stage—from collection and preservation to comparison, interpretation, and presentation before the court—must withstand rigorous legal and scientific scrutiny. The defence must also have a fair opportunity to examine the underlying evidence, question the expert’s conclusions, and challenge any inconsistencies or procedural irregularities.

Ultimately, the objective is not to discredit science, but to prevent the misuse or overstatement of scientific evidence. In a criminal trial, the burden remains on the prosecution to establish guilt beyond reasonable doubt.
