You open the envelope, see the name of a court, a case number and a date, and your mind immediately starts asking questions. Who has filed a case against me? What exactly am I accused of? Do I have to appear personally? What happens if I cannot attend? And, perhaps most importantly, how much time do I have to respond?

These are understandable concerns. But before you panic or assume the worst, understand one fundamental point: a court summons is not a judgement against you.

The court has not necessarily decided anything about the merits of the dispute merely because it has issued a summons. Depending on the proceedings, the summons may require you to appear, answer a claim, file a written statement, respond to a complaint, give evidence or produce documents.

What matters now is how you respond.

In legal practice, the difficulty often begins when people either ignore a summons because they believe the case is false or become so anxious that they make hurried decisions without understanding the documents. Both approaches can create avoidable problems.

If you have received a court summons, your first responsibility is to establish which court has issued it, understand why you have been summoned, check the relevant dates and obtain appropriate legal advice before an important deadline passes.

This guide explains what to do, how to verify the case, which deadlines may apply, what can happen if you fail to respond and which documents you should prepare before meeting an advocate.

1. Its purpose depends on the nature of the case and the capacity in which you have been summoned.

For example:

Civil Suit: You may have to respond to a claim for money, property rights, an injunction or another civil remedy.

Criminal Proceedings: You may be required to appear before a Magistrate in connection with a criminal complaint or prosecution.

Cheque Dishonour Case: You may have been summoned in a complaint under Section 138 of the Negotiable Instruments Act, 1881.

Family Proceedings: The matter may concern divorce, maintenance, child custody or another matrimonial dispute.

Commercial Dispute: A business-related disagreement may have resulted in proceedings before a court exercising commercial jurisdiction.

Witness Summons: The court may require you to give evidence or produce documents, even if you are not a party to the dispute.

Execution Proceedings: The court may be considering the enforcement of an existing decree or order.

These distinctions are important because the procedure is not the same in every case.

A defendant in a civil suit, an accused person in a criminal complaint and a witness summoned to give evidence have different legal responsibilities. The steps required of one may be entirely inappropriate for another.

Start by reading the summons carefully. Examine every page, including any attached notice, complaint, plaint, petition or court order. These accompanying documents often explain what the dispute concerns and what the court expects you to do.

Do not decide how to respond until you understand the nature of the proceedings and your role in them.

2. Identify the Court and Verify the Case Number

The first practical step is to establish which court is dealing with the matter.

Look at the heading of the summons. It will generally identify the court or tribunal, the location, the case number and the names of the parties. It may also mention the presiding officer, the statutory provision involved and the next hearing date.

Make a note of the following:

Name of the court or tribunal.

District and State where the case is pending.

Case number and case type.

Names of the parties.

Your position in the proceedings.

Date on which the summons was issued.

Date on which you received it.

Date and time fixed for appearance.

Any specific direction or deadline mentioned in the document.

These details will help you or your advocate identify the case and determine the applicable procedure.

How to Check a Court Summons Online

You can begin with the official eCourts Services portal.

Depending on the court and the information available, you may be able to search by CNR number, case number, party name or other details. Compare the results with the summons you received. Check that the court, parties, case type and hearing date correspond with the document.

High Courts and certain tribunals also maintain their own case-status facilities.

However, an online search should be treated as a verification aid, not as a substitute for examining the actual court papers. Information may not appear immediately, and some records may not be easily traceable through a basic search.

If you cannot find the case online, do not immediately assume that the summons is fake. Ask an advocate to verify the record or contact the court registry through independently verified official contact details.

The important thing is to establish authenticity promptly, particularly when the hearing date is approaching.

3. Find Out Why the Case Has Been Filed

Once you have identified the court and case number, turn your attention to the substance of the matter.

What is the other party alleging? What relief are they seeking? What documents are they relying upon? And what, if anything, does the court require you to do at this stage?

The answers may be found in the plaint, complaint, petition, application or order accompanying the summons.

If the matter concerns recovery of money, examine the underlying transaction, the amount claimed and the documents relied upon. In a criminal complaint, read the allegations and the relevant order carefully. In a cheque dishonour case, review the cheque, bank return memo, statutory notice and complaint, where available.

Do not rely solely on what the opposite party tells you about the case. Equally, do not assume that an allegation can be ignored simply because you believe it is incorrect.

A proper response must be based on the facts, the available evidence and the applicable law.

Preserve relevant emails, messages, contracts, payment records and other documents. Avoid sending angry messages, making threats or publishing details of the dispute on social media. Such conduct can complicate an already difficult situation.

If communication with the other party is necessary, consider obtaining legal advice before making admissions, promising payment or signing any document.

4. Check the Hearing Date and Any Separate Response Deadline

One of the most common mistakes people make is assuming that the next hearing date is the deadline for everything they need to do.

That is not necessarily correct.

A summons may require you to appear on a particular date, while the applicable law or a court order may impose a separate deadline for filing a written statement, reply or other document.

You should therefore establish three separate dates or requirements:

Date or Requirement

What You Need to Check

Date of Service

When were the summons and relevant papers served?

Next Hearing Date

When must you appear or take the required step before the court?

Response Deadline

By what date must any written statement, reply or other document be filed?

The date on which the summons was issued may differ from the date on which it was served. That distinction can be important when calculating a statutory deadline.

Whether you must attend personally also depends on the proceedings and any specific direction of the court.

In some civil matters, an advocate may appear on your behalf in accordance with the applicable procedure. In criminal proceedings, personal attendance may be required unless an exemption or another legally permissible arrangement is available. A witness summoned to give evidence cannot simply assume that an advocate’s appearance will be sufficient.

If illness, travel or another genuine difficulty prevents you from attending, contact your advocate promptly. An application for exemption or adjournment may be appropriate, depending on the circumstances.

Do not simply stay away and hope that the court will automatically grant another date.

5. How Much Time Do You Have to Respond to a Court Summons?

There is no single deadline that applies to every court summons in India.

The applicable period depends on the type of proceeding, the governing statute, the date of service and any specific direction issued by the court.

The following distinctions are particularly important.

A. Ordinary Civil Suits: The Written Statement Deadline

In an ordinary civil suit, the Code of Civil Procedure, 1908 (CPC), governs the procedure.

Order V deals with the issue and service of summons. Order VIII Rule 1 deals with the defendant’s written statement—the formal response to the plaintiff’s case.

Ordinarily, the written statement must be filed within 30 days from the date of service of summons.

In non-commercial civil suits, the court may permit filing beyond that period in appropriate circumstances. Although the provision refers to an outer period of 90 days, the Supreme Court has held that the 90-day limit is directory rather than an inflexible bar in ordinary civil suits.

Relevant decisions include:

Kailash v. Nankhu, (2005) 4 SCC 480.

Salem Advocate Bar Association, Tamil Nadu v. Union of India, (2005) 6 SCC 344.

This does not mean that a defendant can safely postpone filing a written statement. Extensions are not automatic, and a court may refuse to accept a delayed filing depending on the circumstances.

If you have received a summons in a civil suit, arrange for the relevant papers to be examined promptly. Your advocate should determine the applicable deadline and prepare the response in time.

B. Commercial Disputes: The Mandatory 120-Day Limit

Commercial disputes may be subject to stricter procedural rules under the Commercial Courts Act, 2015.

Not every money recovery suit qualifies as a commercial dispute. The matter must fall within the categories recognised by the Act and satisfy the applicable specified-value requirement. Whether the special commercial procedure applies depends on the nature of the dispute and the relevant statutory provisions.

For qualifying commercial suits, the defendant ordinarily has 30 days from service of summons to file a written statement. The court may permit an extension for reasons recorded and on payment of costs, but the total period cannot exceed 120 days from the date of service.

Once that period expires, the defendant forfeits the right to file the written statement, and the court cannot take it on record under the applicable provision.

The Supreme Court considered this issue in SCG Contracts India Pvt. Ltd. v. K.S. Chamankar Infrastructure Pvt. Ltd., (2019) 12 SCC 210, holding the 120-day limit applicable to commercial suits to be mandatory.

The distinction matters. The flexibility recognised in ordinary civil suits cannot automatically be applied to commercial proceedings.

If the summons concerns a business transaction, commercial contract or recovery claim, ask your advocate to determine whether the Commercial Courts Act applies before calculating your deadline.

C. Criminal Proceedings Under the BNSS

The Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS), came into force on 1 July 2024, replacing the Code of Criminal Procedure, 1973, subject to the transitional and saving provisions.

Section 531 contains the relevant repeal and savings provisions. Broadly, proceedings pending immediately before the BNSS commenced may continue under the earlier Code in accordance with those provisions.

Several BNSS provisions are relevant to summons and criminal process:

Section 63: Form of summons.

Section 64: Service of summons.

Section 90: Issue of warrant in lieu of, or in addition to, summons in the circumstances specified by law.

Section 94: Summons or order to produce a document or other thing.

Section 227: Issue of process in criminal proceedings.

The precise provision depends on the type and stage of the proceeding.

A criminal summons generally requires you to appear before the court on the specified date. It does not ordinarily involve filing a civil written statement in the same sense as a civil suit.

Do not apply civil written-statement deadlines to criminal proceedings. Read the summons carefully and obtain advice on the obligation it creates.

D. Cheque Dishonour Cases Under Section 138

If you have been summoned in a cheque dishonour case, examine the complaint and the relevant documents. These may include the cheque, bank return memo, statutory demand notice, proof of service and records relating to the underlying transaction.

Section 138 of the Negotiable Instruments Act, 1881, deals with cheque dishonour in the circumstances specified by the statute.

An important Supreme Court decision in this area is Sanjabij Tari v. Kishore S. Borcar & Anr., Criminal Appeal No. 1755 of 2010, 2025 INSC 1158, decided on 25 September 2025.

The judgment addressed delays in cheque dishonour proceedings and issued directions intended to improve their disposal. Among other measures, the Court directed that summons in Section 138 cases should be served through the usual prescribed modes as well as dasti service, and that electronic service should be used in accordance with applicable rules. It also directed district courts to establish secure online payment facilities to facilitate early settlement where appropriate.

These directions are specifically relevant to cheque dishonour proceedings. They should not be treated as a universal procedure governing every type of court summons.

If you have received a cheque dishonour summons, do not assume that a private payment or settlement discussion will automatically close the case. Any settlement, compounding or closure must be handled in accordance with the applicable law and the court’s directions.

E. Summons Requiring You to Produce Documents

A summons may require you to produce documents, electronic communications or other material rather than respond to a claim as a defendant or accused.

Section 94 of the BNSS contains provisions concerning the production of documents and other things in the circumstances covered by that section.

Read the direction carefully. Identify what must be produced, the date by which it is required and whether your personal attendance is also necessary.

If you do not possess the requested material or have a genuine difficulty complying, obtain legal advice before the date fixed by the court. Do not alter, destroy or conceal potentially relevant records.

The practical rule is simple: never calculate a deadline solely from a general article or an informal opinion. Have the applicable period determined from the actual summons, the date of service, the governing law and any court order.

6. What Happens If You Ignore a Court Summons?

Some people believe that if a case is false or unjustified, they can simply refuse to participate. That assumption can be costly.

The consequences depend on the nature of the proceedings and the circumstances, but ignoring a summons can affect your ability to protect your interests.

In a Civil Case

Where the legal requirements are satisfied, a court may proceed in the defendant’s absence. This may lead to ex parte proceedings or a decree.

Failure to file a written statement within the applicable period may also affect your ability to present a defence in the ordinary manner.

Remedies may be available in appropriate cases, including an application to set aside an ex parte decree. However, such relief is not automatic. The reason for non-appearance, the service of summons, the procedural history and applicable limitation requirements may all matter.

In a Criminal Case

Failure to comply with a criminal summons may lead the court to take further steps permitted by law. Depending on the circumstances and statutory requirements, this may include issuing a warrant or taking other appropriate procedural action.

That does not mean every missed hearing automatically results in arrest. The court must act within the applicable legal framework. Nevertheless, ignoring a criminal summons without seeking advice can create serious and avoidable complications.

If You Have Already Missed the Hearing

Do not assume that the case has ended or that no remedy is available.

Check the latest court order and the current status of the proceedings. Consult an advocate promptly to determine what happened in your absence and whether an application or other remedy is available.

The appropriate response will depend on the case and the stage it has reached.

7. What If You Suspect the Summons Is Fake?

Fraudulent communications sometimes imitate court notices or use official-looking details to pressure people into making payments.

At the same time, a genuine summons should not be ignored merely because it arrived electronically or contains unfamiliar information.

Check the court’s name, case number, parties, issuing authority and any seal, signature or electronic authentication. Where possible, verify the case through the official court-status system or contact the registry using independently verified contact details.

Be especially cautious if someone demands payment into a personal bank account, asks you to use an unrelated payment link or threatens immediate consequences unless money is transferred.

Electronic issuance or service of summons may be permitted under the applicable law and rules. Therefore, receiving a document by email or another electronic method does not, by itself, establish that it is fraudulent. Equally, an official-looking logo or case number alone does not prove that the document is genuine.

Preserve the original message, email, document, sender details and any payment demand. If you remain uncertain, ask an advocate to verify the record promptly.

Do not allow the verification process to become a reason for inaction. If the hearing date is approaching, treat the matter as urgent until its authenticity has been established.

8. Documents You Should Take to an Advocate

A legal consultation becomes more productive when the relevant documents are organised in advance.

You do not need to know the legal answer before meeting your advocate. You do, however, need to provide the papers and facts that will allow the matter to be assessed properly.

Essential Documents

Where applicable, carry:

The complete summons, including all pages and attachments.

The envelope in which it arrived or proof of electronic receipt.

The plaint, complaint, petition or application supplied with the summons.

Any accompanying court order.

Identity and address documents, where relevant.

Previous legal notices and replies.

Contracts, agreements, invoices and transaction records.

Bank statements, payment receipts and transaction confirmations.

Relevant emails, letters, messages and other communications.

Earlier court papers or orders concerning the same dispute.

A short chronology of events, including important dates.

Preserve original electronic records wherever possible. What If You Cannot Afford a Lawyer?

If you cannot afford private legal representation, you may be eligible for free legal services under the Legal Services Authorities Act, 1987.

Eligibility depends on the statutory categories and applicable conditions. It may include certain income-based categories and other groups specified by law.

You can approach the District Legal Services Authority, the State Legal Services Authority or the National Legal Services Authority for information about eligibility and assistance.

Official website: National Legal Services Authority (NALSA).

If your hearing is approaching, explain the urgency when seeking assistance. Do not assume that applying for legal aid automatically changes a hearing date or suspends a deadline.

11. Can the Dispute Be Settled Without a Contested Trial?

In suitable cases, settlement, negotiation or mediation may resolve a dispute more efficiently than prolonged litigation.

Some civil, commercial, financial and matrimonial disputes may be capable of resolution through a properly documented settlement. Depending on the nature of the case, the settlement may need to be placed before the court or recorded in accordance with the applicable procedure.

Criminal proceedings require greater care. Some offences may be compounded under the relevant law, sometimes with the court’s permission. Others cannot be disposed of merely because the parties have privately agreed to settle.

A private payment, oral assurance or signed document does not necessarily bring court proceedings to an end.

Before agreeing to settlement terms, admitting liability or signing an undertaking, understand the legal consequences. Where a court order or formal approval is required, ensure that the necessary steps are completed.

12. It does not, by itself, establish that you are liable or guilty. You should examine the accompanying papers and prepare an appropriate response.

How Can I Check a Court Summons Online in India?

Start with the official eCourts Services portal at https://services.ecourts.gov.in/. Search using the available case details and compare the result with the document you received. If the case cannot be located, seek verification through the court registry or an advocate.

Can I Ignore a Summons If the Allegations Are False?

No. Even if you believe the allegations are entirely false, ignoring the summons may put you at a procedural disadvantage. Examine the case papers and respond through the appropriate legal procedure.

How Many Days Do I Have to Respond to a Court Summons?

There is no universal deadline. In an ordinary civil suit, a written statement is ordinarily due within 30 days of service, subject to the applicable rules on extensions. In qualifying commercial suits, the outer limit is 120 days and is mandatory. Criminal summons generally require appearance on the date specified, subject to the applicable law and court orders.

The precise deadline should be calculated from the documents and the circumstances of your case.

Can My Advocate Attend Court Without Me?

Sometimes, but not in every case. It depends on the nature of the proceedings, the applicable law and any direction issued by the court. If personal attendance is required, an advocate’s appearance alone may not be sufficient.

What Happens If I Miss the Hearing Date?

The consequences depend on the proceeding and the circumstances. The court may proceed in your absence or take further steps permitted by law. Obtain the latest order and consult an advocate promptly about any available remedy.

Can a Court Summons Be Sent Electronically?

Electronic issuance or service may be permitted under the applicable law and rules. However, the authenticity of a particular communication should still be verified. Do not assume that an electronic summons is necessarily fake or that an official-looking message is necessarily genuine.

What Should I Do If the Summons Asks Me to Produce Documents?

Identify the documents required, note the date by which they must be produced and check whether personal attendance is also necessary. If the documents are unavailable or you have a genuine difficulty complying, obtain legal advice before the date fixed.

What Should I Do If I Receive a Cheque Dishonour Summons?

Read the complaint and collect the cheque, bank return memo, statutory notice, proof of service and documents relating to the transaction. Consult an advocate familiar with Section 138 of the Negotiable Instruments Act. Do not assume that a private payment or settlement discussion automatically closes the case.

Is a Court Summons the Same as a Legal Notice?

No. A legal notice is generally a communication asserting a claim or demanding action. A court summons is a formal process issued in connection with court proceedings. The legal consequences and response requirements may therefore differ.

Can I Get Free Legal Assistance?

You may be eligible under the Legal Services Authorities Act, 1987. Conclusion: Do Not Panic, but Do Not Delay

A court summons deserves your immediate attention, but it is not a reason to assume the worst.

The first questions are straightforward: Which court has summoned me? What is the case about? What exactly am I required to do? When must I take that step?

Once those questions are answered, the next steps can be planned sensibly.

Read the documents, verify the case, distinguish the hearing date from any separate filing deadline and seek legal advice based on the actual record. Do not rely solely on what a friend says, what the opposite party tells you or what you read in an online discussion.

The law provides procedures through which a person can present a defence, answer allegations, produce evidence and seek appropriate relief. But those opportunities may be affected when deadlines are missed or court directions are ignored.

If you have received a court summons, the sensible course is to understand it properly and act within the time allowed.

Received a Court Summons? Whether you have received a summons in a civil dispute, a cheque-bounce case, a criminal proceeding, or a commercial matter, understanding the next legal step can make a significant difference.

Missing a deadline, overlooking a court direction, or responding without understanding the allegations may complicate your case. In ordinary civil suits, the written-statement period is generally 30 days from service of summons, subject to the applicable rules and the court’s power to extend time. Commercial suits have stricter timelines.

Consult a Lawyer Promptly

A lawyer can examine the summons and accompanying documents, explain your legal obligations, identify deadlines, and help you determine the appropriate response.

Prepare the Relevant Documents

Keep the summons, plaint or complaint, annexures, contracts, payment records, correspondence, notices, and other documents connected with the dispute ready for legal review.

Understand the Consequences of Non-Appearance

Depending on the type of proceeding, the court may proceed in your absence, pass an ex parte order, issue further directions, or take other action permitted by law. The consequences depend on the applicable procedure and circumstances.

Know Your Rights in Cheque-Bounce Cases

Proceedings under Section 138 of the Negotiable Instruments Act, 1881, have specific procedural requirements. The Supreme Court’s decision in Sanjabij Tari v. Kishore S. Borcar, 2025 INSC 1158, addressed measures intended to improve the handling of cheque-dishonour cases.

Do Not Assume That Receiving a Summons Means You Have Lost the Case

A summons is not, by itself, a final judgment. It is an opportunity or direction to participate in the legal process in the manner required by the court.

Act Early to Protect Your Legal Position

Promptly verifying the summons, checking deadlines, organising documents, and obtaining appropriate legal advice can help you avoid preventable procedural mistakes.

Need Legal Guidance After Receiving a Court Summons?

Contact Adv.
