At such condition, what does court do? Does it protect right to life or dignity of person? The families sitting on the edge, doctors holding their breath, law feelings little old and new questions medicine asks. That difficult situation addressed by the Supreme Court in the case of Harish Rana v. Union of India , the court delivered a most important judgment to develop the constitutional and medical law by the placing human dignity at the centre of the life ending decision. Under certain circumstances we can stop life supporting system, that was a huge decision.
<div id="ez-toc-container" class="ez-toc-v2_0_89 counter-hierarchy ez-toc-counter ez-toc-grey Also, study about medical ethics, sanctity of life, safeguards and autonomy. Still, we don’t have a clear law that covers end-of-life choices. This case makes it obvious and maybe painfully obvious that India needs proper comprehensive legislation to guide these decisions, so no family is left navigating such painful choices alone.

Introduction

The growth of modern medical technology has made it possible to keep patients alive even in conditions where recovery is no longer possible expected. While this can extend biological existence, it also brings forward difficult questions about dignity, personal choice, and humane treatment. In such situations, law and medicine often collide, and the answer is rarely simple.

At such situations the birth of the Passive Euthanasia. First time this term legally introduces in India in the case of Aruna Ramachandra Shanbagh v. Union of India, in which the court allowed the passive euthanasia with the circumstances. After that in Common Cause v. Union of India, the constitutional bench of 5-judges developed the judgment of Shanbagh case and add passive euthanasia in Article 21 (Right to die with dignity) and recognize the living will / advance directive.

Harish Rana is the first person in India to be granted permission for passive euthanasia by supreme court. He died at the All India Institute of Medical Science (AIIMS) in New Delhi. He passed away at 4.10 pm on 24th March 2026 at AIIMS, New Delhi. He was under the care of doctor’s team and was admitted to the Palliative Oncology Unit (IRCH) led by Dr (Prof) Seema Mishra, HoD, Onco-Anaesthesia.

In Harish Rana v. Union of India, the Supreme Court had to deal with exactly this kind of painful situation. The Court was faced with a man who had remained in a permanent vegetative state for many years, and it had to decide whether continuing life-sustaining treatment was truly serving his interests. After examining the matter, the Court held that in exceptional cases, withdrawing such treatment can be allowed under the Constitution and can fit within Article 21 when dignity is at stake.

This decision matters because it shows that the right to life is not only about staying biologically alive at any cost. It also involves the right to live, and in very rare situations, to die, with dignity. The judgment therefore adds an important constitutional and ethical layer to end-of-life care in India.

Research Objective

To analyse the constitutional basis of passive euthanasia.

To examine Supreme Court’s reasoning in Harish Rana Case.

To study relationship between Article 21 and Right to die with dignity.

To suggest reforms in Indian law.

This paper follows doctrinal methodology of research paper writing based on two sources. The primary sources include ‘The Constitution of India’ and ‘Supreme Court Judgement’ and the secondary sources include legal article, news article, commentaries and scholarly publication.

Fact of the Case

Harish Rana’s story is heart-breaking from the very beginning. He was a B.Tech student at Punjab University. On August 20, 2013, while he was still a student, he fell from the fourth floor of his accommodation and suffered serious brain injuries. After that, his life changed completely. He was left in a Permanent Vegetative State (PVS), with quadriplegia (it is paralysis affecting all four limbs and the torso, usually caused by damage to the cervical spinal cord, brain, or nerves) and complete disability, so basically his body was there but recovery was no longer really happening.

For more than thirteen years, his parents kept caring for him with a kind of patience that is honestly hard to imagine. They kept hoping, even while doctors eventually made it clear that there was no chance of recovery. At some point, the family felt they had reached a point where continuing treatment was only prolonging suffering, so they went to court and asked for permission for passive euthanasia.

At first, the Delhi High Court felt that the usual guidelines for passive euthanasia did not really apply here, because Harish was not being kept alive by normal mechanical life-support in the conventional sense. But the matter did not end there. It went to the Supreme Court, where the judges took a deeper look at the medical reports and the constitutional questions around dignity, life, and compassion.

Legal Issues

The principal legal issues arise before the Court were:

Whether Article 21 involves the right to die with dignity.

Whether Permissibility of Passive Euthanasia and Impermissibility of Active Euthanasia under Article 21 of the Constitution of India.

Whether withdrawal of clinically assisted nutrition and treatment amount to passive euthanasia.

Whether court can authorise withdrawal of life sustaining treatment.

Court Reasoning

The two judge bench of the Supreme Court of India consisting of Justice J. B. Pardiwala and Justice K. V. Viswanathan observed that Article 21 protects not only biology existence but also protect the dignity of the individual. When medical evidence established that recovery of patient is becoming impossible.

The Court said something that feels simple on paper, but very heavy in real life: in exceptional situations, Article 21 can include the right to die with dignity. It’s not about ending life casually or anything like that. It’s more about those painful moments when a patient has no real chance of recovery, and the treatment is only keeping the body going, not bringing the person back.

The Court made it clear that allowing passive euthanasia is about respecting a patient’s dignity, and not about directly causing death. That distinction matters a lot, because the idea was to let nature take its course when treatment is no longer really helping, instead of forcing life at any cost.

So, the judges leaned on the principles already set out in Common Cause v. Union of India (2018) 5 SCC 1 and followed that line of thinking. In simple terms, they said that under Article 21, only passive euthanasia can be permitted, not active steps to end life.

The Court basically said that when a person is in an irreversible medical condition. At such situations stopping medical support like assisted nutrition, hydration, and other life-sustaining treatment can be treated as passive euthanasia.

The courts can step in and allow life-sustaining treatment to be withdrawn. That sounds very legal and strict, sure, but the real point is that the Court wanted to make sure these decisions are not taken lightly or in a rushed way.

So, it leaned on the safeguards from Common Cause v. Union of India (2018), which were meant to keep things fair and careful. The idea was simple enough, even if the situation itself was not judicial supervision helps stop misuse and makes sure the decision is really being taken in the patient’s best interests, and not for some wrong reason.

Ratio Decidendi and Obiter Dicta

Ratio Decidendi

The Ratio Decidendi is that, under Article 21, withdrawal or withholding of medically unprofitable life-sustaining treatment with including CANH. It may be constitutionally permissible as passive euthanasia in an irreversible medical condition, as such cases the medical treatment is not recovery, only the extension of suffering.

The principal of Ratio Decidendi can be understood as the following points:

Right to Life Under Article 21 It includes the right to die with dignity, on the circumstances such as there is no possibility to recover their health and continued treatment is not meaningful therapeutic benefits.

Passive Euthanasia Is Constitutionally Permissible It’s one of those topics where legal language sound becomes cold, but human reality says anything. Families and doctor often end up in impossible situations, trying to figure out what is compassionate and what is legally okay, and the Court basically said that passive euthanasia can be constitutionally acceptable, but only when it is handled carefully and not casually.

Clinically Assisted Nutrition and Hydration (CANH) It was not seen as just basic care in the abstract. It was treated as part of medical set up that may be keeping a person alive. Withdrawing CANH in a proper case can fit within the idea of passive euthanasia. The Court reasoning behind the withdrawal of CANH was basically this, if the treatment is only prolonging biological in a situation where recovery is not possible, then stopping it may be legally and morally should be correct and it different from actively causing death.

Application of Common Cause The Court took the pattern of Common Cause v. Union of India to give much clearer shape in Harish Rana. It was not just about theory anymore. It was first times that the passive euthanasia is rules were used to allow withdrawal life sustaining treatment. So, in a way, the judgment moved the idea out of the textbooks and into real life.

Obiter Dicta

The principal of Obiter Dicta can be understood for the following points:

Need for Comprehensive Legislation The court didn’t stop here the decision of Harish Rana’s case. It was also pointed out something much bigger than the case that is the core background of the case end-of-life and passive euthanasia. There still isn’t any specific law in India which clearly deal with the end-of-life and passive euthanasia. This one case is decided but the whole system still need for the proper legislation which deals that type of cases in future.

Importance of Human Dignity The Court thinks about dignity, autonomy, self-determination and privacy especially when the person is facing the end of the life. Court say a bigger story of article 21 that how right to die with dignity is involved in it which give the shaping of constitution in very personal situation. It was not only decision of legal issue but also trying to give scope of the human rights. So, the judgment is more than the settle of difficult case.

Protection Against Misuses Keeping safety measures in mind, the court stated once life-sustaining treatment is withdrawn, then there is no chances of reversal. And in many of these cases, the patient may not be able to speak for themselves at that moment, so the choice has to be made very carefully, not casually. That’s why the court stressed on close medical and procedural checking before anything is done.

Critical Analysis

The decision shows that why the judiciary is supreme from all organs of the government because only judiciary is that branch who ensure the true consciousness of any government to keep in favourable of constitution also with the legislation and dynamics constitution.

It represents the deeply analysis of the human rights especially Article 21 by recognizing of importance of the dignity of person which is always stay with them in every stage of life, even at the very last stage.

To keeping all things in mind, the court open a very narrow path to allow using euthanasia with a limited boundaries and carefully but not for every serious case, only in rare situations such as where the recovery or medical condition completely irreversible and the case under the close supervision.

The Legal Background of the Harish Rana Case

That writ petition was filed on 3rd April 2024 on behalf of Harish Rana regarding to die with dignity in the Delhi High Court. But the Court rejected the writ after 3 month on dated 2nd July 2024 at such condition where the person had been suffering traumatic injury since 2013, also there is no chance of recovery, instead the court ignored the right to die with dignity which is already allowed in the Common Cause case in 2018.

After all that the appellate challenge the court decision in supreme court, the first hearing on August 20th, 2024. Prima facie, the Supreme Court agreed with the High Court that the case does not fall within the ambit of passive euthanasia since the patient does not appear to be on life support.

The Court has not granted any relief on euthanasia at this stage. Still the matter is pending for further consideration, and no new precedent is set to this interim order.

Later a long time period of 568 days, a gracious day becoming on March 11th, 2026, when the court pass the judgment in the favour of the Harish Rana.

Delay of Justice and the Struggles of the Family

Along this time period the parents (aged more than 62 year and 55 years respectively) faces many problems such as financial issues, struggle in medicine arrangements and so on.

These all things have done by Delay of Justice, ‘Justice May be Delayed but not Denied’. This is the major loop of the judiciary of India, delay of Justice as same as denied to Justice.

At that context William Ewart Gladstone gives the phase (popularized during an 1868 House of Commons speech) “Justice delayed is Justice denied”

How Judicial Delay Affects Human Dignity

In such case, Justice delay can become dignity die. It can damage when decision is held up for months or years, families are forced to keep asking courts for relief while the patient’s condition worsens.

A delay may turn a right that looks good on paper into something hollow in real life.

If a person is suffering, old, terminally ill, or unable to speak for themselves, then waiting too long for a decision can make the person endure pain, helplessness, and loss of control that could have been avoided.

The Need for Comprehensive Legislation on Passive Euthanasia

Still, the story does not end with the judgment. It gives only a guideline of the law, but that’s not a full law.

In India needs a comprehensive legislation on the passive euthanasia with keeping merit and demerit in mind.

So, the bigger point is clear, the court has taken big step on it, but now parliament needs to make a proper law on passive euthanasia.

Conclusion

The whole discussion around Passive Euthanasia and Constitution, it comes a strong balancing between the sanctity of life and the dignity of life.

Article 21 is not only talk about the biological existence, but also for dignity of person at the end stage of life. It also protects respect, autonomy and dignity of patient.

In Harish Rana Case, we saw the view of court through the judgment that gives the practical meaning of this principle in irreversible medical condition, it allowed to life-sustaining treatment including Clinically Assisted Nutrition can be withdrawn.

In a way, we can imagine that the court facing a deeply human problem and deal with human emotions, it not just a legal case.

Everyone (includes Judges, Doctors and families) trying to give answer what sympathy can we do with that person whose recovery is not possible, almost die only he’s breathing.

Through the reference of Common Cause principal, the court easily able to reach this decision.

Thus, the judgment differentiates the passive euthanasia and active euthanasia through the withdrawal of futile medical treatment and allows the natural death rather than intentionally causing death.

It is also clarified that all those things done under the medical assessment and safeguards.

At the same time, it saw the absence of comprehensive legislation in this area.

Parliament should need to make law that protects patient choice or what is beneficial at that stage of life with restrictions against the misuse.

References

Book

P.M.
