For instance, international human rights treaties often guide national courts in the interpretation and enforcement of constitutional rights.

A clear understanding of the relationship between international law and municipal law is therefore essential for appreciating the manner in which international norms are received, applied, and given effect within a domestic legal system.

Main Differences Between International Law and Municipal Law

International law and municipal law differ in several fundamental respects:

Basis of Difference

International Law

Municipal Law

Scope

Primarily regulates relations between States and international organisations.

Governs the conduct of individuals, institutions, and the government within the territorial limits of a State.

Sources

Treaties, international custom, and the general principles of law recognised by civilised nations.

The Constitution, statutes, judicial decisions, and local customs.

Authority

Rests largely on the consent of States and on rules accepted as binding by the international community.

Derives its authority from the Constitution and the established legal order of the State concerned.

Subjects

States are the primary subjects, although individuals and international organisations also possess certain rights and duties under contemporary international law.

Individuals are the principal subjects of municipal law.

Enforcement

Depends on international judicial bodies, diplomatic processes, the doctrine of state responsibility, and collective measures, including sanctions.

Enforced through domestic institutions such as the police, administrative authorities, and national courts.

Courts

The International Court of Justice is the principal judicial organ for the settlement of legal disputes between states.

National courts adjudicate disputes arising under domestic law and may, in appropriate circumstances, apply rules of international law.

Law-Making

Develops primarily through treaties, customary practice, and recognised general principles. Nevertheless, international law remains binding upon states, and its rules carry legal force within the international legal order.

Theories of International Law and Municipal Law

Several theories explain the relationship between international law and municipal law. These theories address how international rules operate within domestic legal systems and how conflicts between the two systems may be resolved.

A. Monistic Theory (Monism)

Monism regards international law and municipal law as integral parts of a single, unified legal system. Under this theory, rules of international law may become directly applicable within the domestic sphere without the need for separate transforming legislation, subject to the constitutional framework of the state concerned.

For instance, in the Netherlands, treaty provisions that satisfy certain constitutional conditions are capable of direct application by domestic courts.

B. Dualistic Theory (Dualism)

Dualism treats international law and municipal law as two distinct and independent legal systems. Consequently, a rule of international law does not automatically form part of domestic law.

It acquires domestic enforceability only after it has been expressly incorporated through national legislation. The United Kingdom traditionally follows this approach in respect of treaties.

India adopts a mixed or hybrid approach, in which the application of international law is governed by a combination of constitutional provisions, parliamentary legislation, and judicial interpretation.

C. Transformation Theory (Specific Adoption Theory)

According to the Transformation Theory (also known as the Specific Adoption Theory), rules of international law must be deliberately converted into municipal law through legislative action before they can be enforced by national courts.

An international obligation becomes domestically binding only after it has been transformed into a provision of national law. Thus, if a treaty requires amendment of a state’s criminal law, Parliament must enact the requisite legislation before domestic courts can give effect to those obligations.

D. Delegation Theory

The Delegation Theory posits that international law leaves it to each state to determine, through its own constitutional and legal mechanisms, the precise manner in which international rules are to be implemented within its domestic system.

International law does not prescribe a uniform method of incorporation; rather, it delegates the choice of technique to the national legal order. Transformation of every international rule is therefore not invariably required.

E. Coordination or Harmonisation Theory

The Coordination (or Harmonisation) Theory views international law and municipal law as two separate yet complementary legal systems. Neither is inherently superior to the other within its own sphere.

The two systems operate in distinct domains and ought to be interpreted, so far as possible, in a manner that minimises conflict and promotes mutual consistency.

How National Courts Use International Law

National courts use international law in different ways, depending on the country’s constitution and legal system. They may directly apply international treaties or customary international law where domestic law permits it.

They may also apply international rules after Parliament passes the necessary legislation. Courts can interpret national laws in a way that is consistent with international obligations, provided this does not conflict with the Constitution or clear statutory provisions.

Courts may also refer to international human rights treaties to understand, interpret and develop constitutional rights. Thus, the application of international law by national courts depends on domestic legal rules and constitutional principles.

British Practice

The United Kingdom follows the dualist approach to international treaties. This means that a treaty does not automatically become part of domestic law simply because the government has ratified it.

If the treaty creates new rights or duties that must be enforced by domestic courts, Parliament must pass the necessary legislation.

However, courts may refer to international law when interpreting domestic laws or developing common-law principles. Recognised rules of customary international law are generally treated as part of British common law, subject to existing legislation.

Thus, the UK distinguishes between its international obligations and the laws that domestic courts can directly enforce.

Latin American Practice

Many Latin American countries give international treaties an important place in their domestic legal systems. Some countries give treaties priority over ordinary national laws, while others, such as Argentina, grant constitutional status to certain human rights treaties.

Although the approach differs from country to country, the general trend is to give importance to international cooperation and the protection of human rights.

Thus, there is no single uniform practice throughout Latin America.

Indian Practice

India follows a mixed approach to the relationship between international law and domestic law. The Constitution recognises the importance of international law, but its application within India depends on constitutional provisions, legislation and judicial decisions.

Article 51(c): Respect for International Law

It directs the State to respect international law and treaty obligations. However, it is not directly enforceable by courts.

Article 253: Implementation of International Treaties

It empowers Parliament to make laws to implement international treaties and agreements, even on matters normally falling under the State List.

Article 73: Executive Powers of the Union

It deals with the executive powers of the Union, including the power to enter into international agreements. Bank of Cochin (1980)

The Supreme Court clarified that an international treaty does not automatically become enforceable in India or override domestic law, though it may guide the interpretation of national laws.

Thus, Indian courts can use international law to interpret and develop domestic law, but they cannot override the Constitution or disregard clear provisions of Indian legislation.

“The Law of Nations Is Part of the Law of the Land”

This traditional common-law principle holds that recognised rules of customary international law form part of the domestic law of the land and may be applied by national courts, provided they do not conflict with the Constitution or existing municipal legislation.

The doctrine is closely associated with the British legal tradition and finds classical expression in the writings of William Blackstone.

It must be emphasised, however, that the principle does not extend to treaties. An international treaty does not automatically become enforceable in domestic courts merely by virtue of ratification.

In India, courts may apply customary international law as part of the law of the land (subject to constitutional and statutory consistency). Treaties, by contrast, primarily serve as aids to the interpretation of domestic statutes.

Where a treaty necessitates a change in municipal law, it must first be given effect through appropriate legislation enacted by Parliament.

Conflict Between International Law and Municipal Law

A conflict between international law and municipal law arises when a country’s domestic law is different from or inconsistent with its international obligations.

At the international level, a state cannot generally escape its international obligations by claiming that its domestic law requires otherwise. However, within a country, the Constitution determines which law the national courts must follow.

In India, the Constitution is supreme, and courts try to interpret domestic laws in a manner consistent with international obligations. However, if a clear conflict exists, the Constitution and applicable domestic legislation prevail in domestic courts.

Nevertheless, the state may still be held internationally responsible for violating its international obligations. Thus, international law and municipal law should be interpreted harmoniously as far as possible, while respecting constitutional supremacy.

Example of a Conflict Between International and Municipal Law

If India enters into an international treaty requiring certain legal changes, but Parliament has not yet passed the necessary legislation, Indian courts cannot automatically enforce the treaty as domestic law. India may, however, remain internationally bound by its treaty obligations.

In short: International law governs a state’s obligations towards the international community, while municipal law determines the law applicable within the country. A conflict between the two may create domestic legal consequences as well as international responsibility.

Starke’s Views on the Conflict Between International Law and Municipal Law

According to J.G. Starke, international law and municipal law constitute two distinct and separate legal systems. Any conflict between them must therefore be examined from both the international and the domestic perspectives.

A State cannot evade its international obligations merely by invoking the provisions of its own municipal law. Consequently, where a State’s domestic legislation is inconsistent with its international obligations, the State incurs international responsibility for the breach, regardless of the internal validity of that legislation.

Within the domestic sphere, however, national courts are bound to apply the Constitution and municipal statutes in accordance with the hierarchical rules of their own legal system.

As a result, a rule may be perfectly valid and enforceable under domestic law while simultaneously constituting a violation of international law.

Starke’s analysis thus underscores the fundamental distinction between a State’s international responsibility on the one hand and the exclusive authority of national courts to determine the applicability of law within their own jurisdiction on the other.

Conclusion

International law and municipal law serve different but closely connected purposes. International law governs relations between states, while municipal law regulates matters within a country.

In the United Kingdom, treaties generally become part of domestic law only when Parliament passes the necessary legislation. In many Latin American countries, treaties, particularly those relating to human rights, enjoy a higher status in domestic law.

India follows a balanced approach in which the Constitution, Parliament and judiciary play important roles. Indian courts may use international law to interpret and strengthen Fundamental Rights, as seen in Vishaka v. State of Rajasthan (1997).

However, international law cannot automatically override the Constitution or clear domestic legislation.

Thus, the relationship between the two systems depends on constitutional supremacy, respect for international obligations and the proper role of national courts in upholding the rule of law.

International Law and Municipal Law: Meaning and Key Differences

International Human Rights Treaties and also Regional Systems of Human Rights

The Jurisdictional Bridge: Navigating the Intersection of International and Municipal Law

Safeguarding Shelter and Human Dignity: Demolition Law, Due Process, and Constitutional Protection in Urban India

Supreme Court Stray Dog Judgement 2026: Euthanasia, Public Safety & Constitutional Balance Explained

Introduction Law operates at two distinct levels: international law and municipal law.
