States generally have full international legal personality, while most non-state entities have only limited or functional legal personality.

Primary Subjects of International Law: States

States are the original and primary subjects of international law. Their legal personality is determined by their constituent instruments, functions and the recognition accorded by states.

Examples: United Nations, WHO, ILO, WTO.

In the Reparation for Injuries case (1949), the ICJ held that the United Nations possesses international legal personality and can bring international claims within the scope of its functions.

Individuals

Modern international law recognises individuals as limited subjects. They enjoy certain rights (life, liberty, protection from torture, fair trial, and human rights guarantees) and can be held personally accountable for international crimes (genocide, war crimes, and crimes against humanity).

The International Criminal Court prosecutes individuals for such crimes. Such entities have only those international rights and duties that are recognised or granted to them; they do not enjoy the full legal status of states. For example, the United Nations has international legal personality, but its powers are limited to the purposes and functions given to it under the UN Charter.

Non-Governmental Organisations (NGOs)

NGOs lack full international legal personality, but it is worth remembering that they participate via consultative status (e.g., with ECOSOC) rather than as direct subjects of international treaties. They nevertheless influence the development and application of international law through advocacy, monitoring, humanitarian work and participation in international forums.

Examples: Amnesty International and the International Committee of the Red Cross (which enjoys a special status under international humanitarian law).

The International Committee of the Red Cross (ICRC) is unique because, despite being a private Swiss NGO under domestic law, it is explicitly mandated by international Geneva Conventions, giving it a sui generis status close to an intergovernmental body in times of armed conflict.

Special Entities Under International Law

Certain entities are recognised under international law as having a special or limited legal status because of their history, functions or international recognition. They include:

Holy See: Maintains diplomatic relations with several states and enjoys international legal personality.

Sovereign Order of Malta: Enjoys a special international status and maintains diplomatic relations with many countries.

National Liberation Movements: May receive recognition under international law, particularly in the context of the right to self-determination.

Belligerents and Insurgents: Under certain conditions, they may acquire limited rights and duties under international humanitarian law.

These entities do not enjoy the same legal status as states, but they may have certain rights and responsibilities under international law.

Theories Regarding Subjects of International Law

A. Barcelona Traction Case (1970)

The ICJ recognised that certain obligations, known as erga omnes, are owed by every state to the international community as a whole, such as the prohibition of genocide and racial discrimination.

Conclusion

The subjects of international law are no longer limited to states. Today, international organisations, individuals and certain special entities are also recognised as subjects of international law. However, states remain the primary subjects because they enjoy the fullest legal rights and duties. Other entities have limited rights and responsibilities according to their roles.
