It is a fundamental part of being an independent state. This sovereignty gives a country the authority to make laws, enforce justice, maintain peace, and govern everything within its borders. Under international law, countries can gain control over new territory or lose control over land they once held through specific legal methods. These rules are guided by key principles of international law, including respect for national borders, peaceful coexistence, and the right of peoples to decide their own future (self-determination).

Table of Contents

Toggle

Introduction

How Countries Gain Territory (Modes of Acquisition)

A. Occupation

Occupation means taking control of land that belongs to no state (terra nullius) with the clear intent to rule it. Two conditions must be met:

Actual Possession: The country must establish real, effective administration and control over the area.

Intent to Rule: The country must clearly demonstrate its intent to hold the territory as a sovereign.

Key Case: Island of Palmas Case (1928) The arbitrator held that peaceful and continuous display of state authority is more important than mere discovery in establishing sovereignty.

B. Prescription

A prescription happens when a country gains legal ownership of land by peacefully governing and administering it for a long, continuous period without effective objections from other countries. Simply letting time pass is not enough. The country must actively administer the area without protest.

C. Cession

Cession is the voluntary transfer of land from one country to another through an official treaty or agreement. This can happen through a sale, trade, or gift. Examples:

The United States purchased Alaska from Russia in 1867.

The United States acquired Louisiana from France in 1803 (Louisiana Purchase).

D. Accretion

Accretion refers to natural geographical changes that add new land to an existing territory. Examples include soil slowly building up along a riverbank or island formation.

E. Conquest and Annexation (Now Illegal)

Historically, countries could take land by winning a war (conquest) and officially declaring it their own (annexation). Modern Law: Taking territory by force is strictly illegal today. Article 2(4) of the UN Charter prohibits the threat or use of force against any country’s territorial integrity. Example: When Iraq invaded and tried to annex Kuwait in 1990, the UN Security Council declared the takeover completely invalid under international law.

How Countries Lose Territory (Modes of Loss)

A country can lose sovereignty over its land in several ways.

Mode

How It Works

Real-World Example

Cession

Voluntarily handing land over to another country by treaty or sale.

Russia selling Alaska to the US in 1867.

Secession

A region breaks away from a parent country to become independent.

Bangladesh separated from Pakistan in 1971.

Merger

Two or more countries join together into a single new country.

East and West Germany unifying in 1990.

Dissolution

A country completely breaks apart into multiple separate states.

The breakup of the Soviet Union in 1991.

Abandonment

A state gives up physical control and officially intends to surrender land.

Great Britain’s 1774 withdrawal from Port Egmont in the Falkland Islands.

Natural Loss

Physical land disappears due to natural events like severe coastal erosion.

Total submergence of New Moore Island in the Bay of Bengal under rising sea levels in 2010.

4.
