In a March 2025 interview with NBC News journalist Kristen Welker, Trump acknowledged that one possible method of securing another presidential term would involve Vice President JD Vance running for president and subsequently resigning, allowing Trump to assume the office through constitutional succession. Although Trump did not present this as a settled legal strategy, the suggestion has revived an important debate concerning the relationship between the Twelfth and Twenty-Second Amendments to the United States Constitution.

Table of Contents

Toggle

Can Trump Become President for a Third Term? The Twenty-Second Amendment clearly prohibits that. The more difficult question is whether a person constitutionally barred from being elected president can nevertheless become vice president and subsequently assume the presidency through succession. In my view, such an arrangement is inconsistent with the constitutional structure established by the Twelfth and Twenty-Second Amendments, although the precise question has not yet been conclusively determined by the United States Supreme Court.

The Twenty-Second Amendment and Presidential Term Limits

The Twenty-Second Amendment, ratified in 1951 following Franklin D. Roosevelt’s election for four presidential terms, provides that no person shall be elected to the office of President more than twice. Donald Trump was elected president in 2016 and again in 2024. Consequently, he has exhausted the number of presidential elections constitutionally permitted to him.

The Difference Between Election and Succession

The argument advanced in favour of a possible third term relies principally on the language of the Twenty-Second Amendment. It prohibits a person from being elected president more than twice; it does not expressly state that such a person can never again hold or exercise presidential powers. Accordingly, proponents of the proposed arrangement argue that a twice-elected president could become vice president, succeed to the presidency following the resignation of the incumbent president and thereby assume office without being elected president for a third time.

Considered in isolation, the distinction between being elected to an office and subsequently succeeding to it presents a textual argument. However, constitutional provisions cannot be interpreted independently when they regulate connected aspects of the same constitutional office. The Twelfth Amendment becomes particularly relevant here.

The Twelfth Amendment and Vice-Presidential Eligibility

The final clause of the Twelfth Amendment provides that no person constitutionally ineligible to the office of President shall be eligible to that of Vice President of the United States. Ratified in 1804, the amendment established a separate electoral process for the president and vice president. Its final clause prevents a person who is constitutionally ineligible to become president from obtaining the vice-presidency as an alternative route to presidential authority.

What Does Constitutional Ineligibility Mean?

The central interpretative question is whether a person restricted by the Twenty-Second Amendment from being elected President is also constitutionally ineligible for the office of President within the meaning of the Twelfth Amendment.

The contrary interpretation maintains that the word ‘ineligible’ in the Twelfth Amendment originally referred to the qualifications prescribed by Article II of the Constitution, namely the requirements concerning age, citizenship and residency. Since the Twenty-Second Amendment was adopted much later, it is argued that a restriction on being elected president twice should not automatically be treated as a disqualification from serving as president through succession.

However, this interpretation encounters a significant textual difficulty. The Twelfth Amendment does not restrict its application to the eligibility requirements existing when it was ratified in 1804. It refers broadly to a person constitutionally ineligible for the office of President. The Twenty-Second Amendment subsequently became part of the Constitution and must therefore be considered when determining the constitutional eligibility of a person seeking the vice-presidency.

Eligibility to Be Elected Versus Eligibility to Hold Office

A distinction must nevertheless be maintained between being constitutionally prohibited from being elected president again and being constitutionally prohibited from holding the office altogether. The Twenty-Second Amendment expressly addresses the former. The argument advanced in this article is that the Twelfth Amendment supplies the necessary constitutional connection between that restriction and eligibility for the vice-presidency.

This interpretation is supported by the constitutional reasoning advanced by Georgetown University law professor David A. Super. Explaining the relationship between the two amendments, Super has argued that the Twelfth Amendment makes the qualifications for the offices of President and Vice President effectively identical. Under this interpretation, a person constitutionally barred from being elected president cannot avoid the restriction by seeking election to the vice-presidency instead.

The Counterargument: Does the Twenty-Second Amendment Prohibit Succession?

The competing interpretation, however, cannot be dismissed without examination. The constitutional text of the Twenty-Second Amendment deliberately employs the expression ‘elected to the office’ rather than expressly prohibiting a twice-elected president from holding the office again. The drafting history also indicates that broader language prohibiting a person from holding the office was considered during the amendment process. This distinction forms the foundation of the argument that succession remains constitutionally possible.

Constitutional Purpose and the Risk of Circumvention

Nevertheless, the interpretation of the two amendments must account for the purpose of the Twelfth Amendment. If a person who cannot be elected president can nevertheless become vice president and immediately assume presidential powers through succession, the constitutional restriction could be substantially weakened. Such an interpretation would allow the constitutional limitation on presidential elections to be circumvented through an alternative electoral route.

U.S. Term Limits, Inc. v. Thornton: A Constitutional Analogy

The United States Supreme Court’s decision in U.S. Term Limits, Inc. v. Thornton, 514 U.S. 779 (1995), offers a useful, although not directly controlling, constitutional analogy. In that case, Arkansas attempted to prevent candidates who had served specified numbers of terms in Congress from appearing on the general election ballot. The restriction was framed as a ballot-access measure rather than an additional formal qualification for congressional membership.

By a majority of five to four, the Supreme Court held that the state restriction violated the Federal Constitution because states could not introduce additional qualifications for membership in Congress beyond those prescribed by the Constitution. Justice John Paul Stevens, writing for the majority, examined the substance and constitutional effect of the restriction rather than accepting its formal description as a ballot-access regulation.

The Limits of the Thornton Precedent

The significance of Thornton for the present discussion must not be overstated. The Court did not interpret the Twelfth or Twenty-Second Amendments, nor did it decide whether a twice-elected president could become vice president. Its relevance lies in the broader constitutional principle that a legal arrangement cannot necessarily escape constitutional limitations merely because it adopts a different procedural form.

Applying that reasoning to the present controversy, the question is whether succession through the vice-presidency would indirectly achieve what the Twenty-Second Amendment prohibits directly. If the constitutional purpose of presidential term limits is to prevent a person from obtaining presidential office through repeated electoral mandates beyond the permitted limit, an arrangement designed to restore that person to the presidency through an alternative route raises a serious constitutional objection.

Trump v. Anderson and Constitutional Eligibility

The issue also requires consideration of Trump v. Anderson, 601 U.S. 100 (2024). In that decision, the Supreme Court held that individual states lack constitutional authority to enforce Section 3 of the Fourteenth Amendment against federal officeholders and candidates, particularly candidates for the presidency. The decision is relevant to the institutional difficulties that may arise when questions of federal constitutional eligibility are raised during an election. However, it did not decide the meaning of the Twelfth or Twenty-Second Amendments and should not be treated as authority resolving the present controversy.

Legal Challenges and Procedural Difficulties

There is also a practical distinction between the constitutional validity of such an arrangement and the procedure through which its validity could be challenged. A political party might attempt to nominate a twice-elected president for the vice-presidency, and the ticket might even secure electoral victory. Whether an effective legal challenge could be brought, by whom, and at what stage would raise separate questions concerning standing, jurisdiction and the appropriate constitutional remedy.

These procedural difficulties do not themselves establish that the proposed arrangement is constitutionally permissible. Nor should the absence of a direct Supreme Court ruling be mistaken for an affirmative constitutional authorisation.

Constitutional Interpretation: The Final Analysis

Ultimately, the Twenty-Second Amendment cannot be interpreted without considering the restriction imposed by the Twelfth Amendment on eligibility for the vice-presidency. Although the distinction between election and succession provides a serious textual counterargument, the constitutional structure supports the interpretation that a person barred from being elected President cannot use the vice-presidency as an alternative route to the same office.

The American Constitution does not expressly address every conceivable method of circumventing its institutional restrictions. Its provisions must therefore be interpreted together, with due regard to their language, structure and constitutional purpose. The vice-presidential route to a third presidential term presents precisely such a question. The Supreme Court has yet to settle it, but the interaction between the Twelfth and Twenty-Second Amendments provides substantial grounds for rejecting the proposed arrangement.

References and Endnotes

Constitution of the United States, Amendment XXII, ratified February 27, 1951.

Constitution of the United States, Amendment XII, ratified June 15, 1804.

Congressional Research Service, Twenty-Second Amendment: Doctrine and Practice, Constitution Annotated, Legal Information Institute, Cornell Law School.

Alan Jaffe, ‘Legal Scholars Dispute Constitutional “Loophole” for a Third Trump Term’, FactCheck.org, April 3, 2025.

David A.
