Its rules emerge through recognised processes of creation and identification. The most authoritative enumeration of these sources is contained in Article 38(1) of the Statute of the International Court of Justice (ICJ), 1945.

The sources of international law, authoritatively set out in Article 38(1) of the Statute of the International Court of Justice, consist of international treaties and conventions, customary international law (formed through consistent State practice accompanied by opinio juris), and the general principles of law recognised by civilised nations.

Judicial decisions and the teachings of the most highly qualified publicists serve as subsidiary means for determining these rules, while UN resolutions, unilateral declarations of states, and soft-law instruments further contribute to the identification and progressive development of international law.

Classification of Sources Under Article 38(1)

Article 38(1) lists the sources that the ICJ shall apply in deciding disputes. They operate on the contractual principle of consent.

Treaties may be bilateral (between two parties) or multilateral (between several parties). Notable examples include the Charter of the United Nations (1945), the Geneva Conventions (1949), the Vienna Convention on the Law of Treaties (1969), and the Paris Agreement (2015).

Key Principles and Jurisprudence

Pacta sunt servanda: Every treaty in force is binding upon the parties to it and must be performed by them in good faith (Article 26, Vienna Convention on the Law of Treaties).

In the North Sea Continental Shelf Cases (ICJ, 1969), the Court held that a treaty provision does not automatically become customary international law; widespread and representative state practice accompanied by opinio juris is required.

In Reservations to the Convention on the Prevention and Punishment of the Crime of Genocide (ICJ, 1951), the Court recognised that States may formulate reservations to multilateral treaties provided the reservations are compatible with the object and purpose of the treaty.

B. Judicial Decisions

Article 38(1)(d) treats judicial decisions as a subsidiary means for the determination of rules of law. Decisions of the ICJ, other international courts and tribunals, and, to a lesser extent, national courts, assist in identifying and clarifying the content of international law.

Under Article 59 of the ICJ Statute, a judgement is binding only between the parties and in respect of the particular case. Nevertheless, the Court’s decisions carry significant persuasive authority and contribute to the progressive development and crystallisation of the law.

Notable illustrations include the Lotus Case (PCIJ, 1927) on the limits of state jurisdiction, Nicaragua v. United States (1986) on the use of force and non-intervention, and the Corfu Channel (1949) on state responsibility.

B. Teachings of the Most Highly Qualified Publicists

The writings of eminent scholars serve as a subsidiary means of determining rules of law. Works by Hugo Grotius (De Jure Belli ac Pacis), Lassa Oppenheim, Malcolm N. Shaw, James Crawford and others have exerted considerable influence on the understanding and application of international legal principles. Courts occasionally refer to such writings when ascertaining the state of the law, as illustrated in the Lotus Case (1927).

Other Materials Contributing to the Development of International Law

Although not enumerated in Article 38(1), certain additional materials play an important role in the formation, identification and progressive development of international law.

A. Resolutions of International Organisations

Resolutions of the United Nations General Assembly are generally recommendatory. However, when they reflect widespread acceptance and consistent practice, they may constitute evidence of customary international law or contribute to its crystallisation. In the Legality of the Threat or Use of Nuclear Weapons Advisory Opinion (ICJ, 1996), the Court examined relevant General Assembly resolutions as indicators of international opinion but declined to find a comprehensive customary prohibition applicable in all circumstances.

B. Unilateral Declarations

A state may bind itself through a public unilateral declaration made with the intention of creating legal obligations. The Nuclear Tests Cases (1974) confirmed that such declarations can produce binding effects when the requisite intention is present.

C. Soft Law

Instruments such as the Universal Declaration of Human Rights (1948), the Stockholm Declaration (1972) and the Rio Declaration (1992) lack formal binding force yet exert significant normative influence. They often guide State behaviour, shape subsequent treaty-making and contribute to the emergence of customary rules.

Decision Ex Aequo et Bono

Article 38(2) of the ICJ Statute permits the Court to decide a case ex aequo et bono (according to what is equitable and just) if the parties expressly agree. This power allows the Court to depart from strict legal rules in favour of a fair and reasonable solution, but only with the consent of the parties. The Court has never exercised this competence.

Significance of the Sources

The sources of international law perform several essential functions:

They provide a common normative framework for peaceful coexistence among sovereign equals.

They facilitate the peaceful settlement of disputes.

They promote cooperation in areas of shared concern, including human rights, trade and environmental protection.

They establish standards of accountability for internationally wrongful acts.

They contribute to the maintenance of international order and the rule of law among nations.

Conclusion

Article 38(1) of the ICJ Statute remains the authoritative starting point for identifying the sources of international law. Treaties, custom and general principles constitute the principal law-creating processes, while judicial decisions and the teachings of publicists serve as important means of determination and interpretation. Resolutions of international organisations, unilateral acts and soft-law instruments further enrich the normative landscape.

Collectively, these sources undergird the international legal system, enabling States to conduct their relations on the basis of consent, reciprocity and shared legal standards.
