class="wp-block-paragraph">Over the centuries, thinkers have offered different answers. These answers form the main “schools” or theories of international law. Below is a clear, simple explanation of the most important ones, including the Grotian School.

The main schools of international law include the Natural Law School, the Grotian School, the Positivist School, the Sociological School, and the Realist School, along with modern approaches such as the New Haven School, Third World Approaches (TWAIL), and feminist and critical theories.

Natural Law School

This is one of the oldest approaches. It says international law is based on universal principles of reason, justice, and morality that exist independently of any country’s will.

According to this view, certain rules are binding simply because they are right and fair—for example, the prohibition of genocide or the principle that promises must be kept. Early writers such as Francisco de Vitoria and Samuel Pufendorf strongly supported this idea.

In simple words, law is not just what states agree to; it is what is naturally just.

Grotian School

Named after the Dutch jurist Hugo Grotius (often called the “Father of International Law”), the Grotian School occupies a middle path between pure natural law and strict positivism.

Grotius argued that international law has two foundations:

Natural law: Principles of reason and justice that apply to all human beings.

Positive law: Rules created by the mutual consent and practice of states, such as treaties and customs.

He believed that even sovereign states live in an “international society” and are bound by both moral principles and the agreements they make. The Grotian tradition emphasises the idea of an international community where states have rights and duties toward one another, not merely a system of competing sovereign powers.

Later scholars in the Grotian tradition (sometimes linked to the English School of international relations) continued to stress the importance of international society, common rules, and the balance between morality and state practice.

In simple words: International law comes from both natural justice and the actual agreements of states living together in a shared society.

Positivist School

Positivism became dominant in the 19th and 20th centuries. It argues that international law comes only from the actual will and practice of states. Rules are binding because states have consented to them through treaties or long-standing customs.

Key Features

Focus on observable state behaviour rather than moral ideals.

Consent is central—states are bound only by rules they have accepted.

Major sources are treaties and customary international law.

Important positivist thinkers include Alberico Gentili, Cornelius van Bynkershoek, and later Hans Kelsen.

In simple words: International law is what states have actually agreed to, not what philosophers think is fair.

Consent or Auto-Limitation Theory

Closely linked to positivism, this theory (associated with Georg Jellinek) explains how sovereign states can still be bound by international rules. A state voluntarily limits its own freedom by accepting certain obligations. Sovereignty remains intact because the limitation is self-imposed.

In simple words: Countries choose to restrict themselves, and that self-restriction creates binding law.

Sociological School

This approach views international law as a product of social needs and the realities of international society. Law develops to meet the practical requirements of coexistence, cooperation, and order among nations.

Thinkers such as Léon Duguit emphasised that law arises from social facts and solidarity rather than abstract will or pure morality.

In simple words: International law grows out of the actual needs of the world community.

Realist School

Realists take a more sceptical view. They argue that power and national interest ultimately determine whether countries follow international law. Law is followed when it serves a state’s interests or when stronger states enforce it. Without power backing it, law remains weak.

This view is influential in international relations theory and has been applied to international law by scholars such as Hans Morgenthau and later rational-choice writers.

In simple words: Power politics often matters more than legal rules.

Other Important Modern Approaches

New Haven School (Policy-Orientated Approach)

Developed at Yale by Myres McDougal and Harold Lasswell. It sees international law as a continuous process of decision-making aimed at promoting values such as human dignity, rather than a fixed set of rules.

Third World Approaches to International Law (TWAIL)

These scholars examine how international law historically favoured colonial powers and seek to make it fairer for developing countries.

Feminist and Critical Approaches

These highlight how traditional international law has often overlooked gender, power imbalances, and the experiences of weaker groups.

Why These Schools Matter

No single school fully explains international law today. Modern practice combines elements of several approaches:

Treaties and customs (positivism): Remain the main sources.

Principles of justice and human rights (natural law): Shape many rules, especially jus cogens.

The Grotian tradition: The idea of an international society continues to influence thinking about cooperation, common interests, and the balance between sovereignty and shared rules.

Social needs and cooperation: Drive institutions such as the United Nations.

Power realities: Still influence compliance.

Understanding the Different Schools of International Law

Understanding these different schools helps us see why international law sometimes appears strong and sometimes weak and why debates about its authority continue.

In short, international law is not one single idea. It is a living system shaped by competing visions of justice, consent, society, and power — with the Grotian School offering a practical middle path that still resonates strongly today.

Conclusion

In conclusion, the different schools of international law — from natural law and the Grotian tradition to positivism, sociological, realist, and modern critical approaches — each offer valuable insights into why international rules exist and how they work. While no single school provides a complete answer, together they show that international law rests on a mix of moral principles, state consent, social needs, and power realities. Understanding these perspectives helps us appreciate both the strengths and the limitations of the international legal system in today’s complex world.

Legal Realism: The Ideas of Holmes and Llewellyn

The Architecture of Obedience: Analysing Why Sovereign States Comply with International Law

Student Rights in Schools: Landmark U.S. Supreme Court Cases That Shaped Education Law

The Philosophical School of Jurisprudence: Law, Justice, and Morality

Law, Justice, Morality, and Ethics in Jurisprudence: Meaning, Relationship, Theories & Indian Constitutional Perspective

Introduction International law governs relations between countries, international organisations, and sometimes individuals.
