One of its important sources is the general principles of law recognised by civilised nations, listed in Article 38(1)(c) of the Statute of the International Court of Justice (ICJ). These principles are basic legal rules commonly found in the domestic legal systems of different countries. Courts use them when treaties or customary international law do not provide a clear answer. In this way, they fill gaps in international law and help ensure fair decisions.

Table of Contents

Toggle

Introduction

Meaning of General Principles of Law

Legal Basis: Article 38(1)(c) of the ICJ Statute

Important General Principles of Law

Important Case Laws on General Principles of Law

1. They rest on ideas of fairness, justice, good faith and natural justice. International courts apply these principles when no specific treaty rule or customary rule exists. They enable the court to reach a just and reasonable result. A common example is the principle that no person should be condemned without being heard. This rule is recognised in most national legal systems and is also applied in international proceedings.

Legal Basis: Article 38(1)(c) of the ICJ Statute

Article 38(1)(c) of the ICJ Statute expressly recognises general principles of law as a source of international law. It directs the Court to apply:

“the general principles of law recognised by civilised nations.”

This provision allows the ICJ to draw upon legal principles that are common to different national systems when deciding disputes. The phrase “civilised nations” is an older expression used in the Statute. Today it is understood in an inclusive sense and refers to the general legal principles accepted across the major legal systems of the world.

Important General Principles of Law

Some of the well-recognised general principles in international law are:

General Principle

Meaning

Good Faith

States must act honestly and perform their obligations sincerely.

Natural Justice / Audi Alteram Partem

Every party must be given a fair opportunity to present its case.

Res Judicata

A matter finally decided by a competent court should not be reopened between the same parties.

Estoppel

A state may be prevented from denying a position on which another state has reasonably relied.

Nemo Judex in Causa Sua

No one should be a judge in his or her own cause.

State Responsibility and Reparation

A state that commits an internationally wrongful act must make full reparation for the injury caused.

Pacta Sunt Servanda

Agreements must be kept and performed in good faith.

No One Should Benefit from His Own Wrong

A state or person cannot gain an advantage from its own unlawful conduct.

Important Case Laws on General Principles of Law

1.
