The Legal Framework Governing Cybercrime in the UAE<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The principal legislation governing cyber offences in the UAE is Federal Decree-Law No. 34 of 2021 on Countering Rumours and Cybercrimes, which came into force on 2 January 2022.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The legislation provides a comprehensive framework for addressing offences committed through information networks, websites, electronic information systems and other information technology facilities.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It replaced the earlier Federal Decree-Law No. 5 of 2012 concerning combating cybercrimes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, the Cybercrime Law cannot be examined in isolation. The procedural aspects of criminal investigations, questioning, arrest, detention, provisional release and prosecution are primarily governed by Federal Decree-Law No. 38 of 2022 Promulgating the Criminal Procedures Law, as amended.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A further development relevant to persons facing criminal proceedings is Federal Decree-Law No. 34 of 2024 concerning the Regulation of Penal and Correctional Institutions, which provides an additional statutory framework governing the treatment and rights of persons held in such institutions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Accordingly, a cybercrime complaint may involve the application of several legal provisions. The Cybercrime Law determines the nature of the alleged offence and its punishment, while the Criminal Procedures Law regulates how the investigation and prosecution are conducted.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Understanding this distinction is essential when assessing the legal position of an accused person.<\/p>\n\n\n\n<h2 id=\"h-2-what-conduct-can-lead-to-a-cybercrime-complaint\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"2_What_Conduct_Can_Lead_to_a_Cybercrime_Complaint\"><\/span>2. What Conduct Can Lead to a Cybercrime Complaint?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">One common misconception is that cybercrime is limited to hacking, identity theft or financial fraud. In reality, the scope of UAE cybercrime legislation is considerably wider.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">An offence may arise from the use or misuse of social media platforms, messaging applications, email services, websites, electronic devices and other digital communication systems.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The nature of the conduct, the intention behind it and the surrounding circumstances determine which legal provision may apply.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Some important provisions are discussed below.<\/p>\n\n\n\n<h3 id=\"h-a-electronic-threats-and-extortion-article-42\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"A_Electronic_Threats_and_Extortion_%E2%80%93_Article_42\"><\/span>A. Electronic Threats and Extortion \u2013 Article 42<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Article 42 of Federal Decree-Law No. 34 of 2021 deals with cyberextortion and cyber threats.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A person who uses an information network or information technology equipment to threaten or extort another individual, with the intention of compelling that person to do something or refrain from doing something, may attract criminal liability.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Under Article 42(1), the prescribed punishment includes imprisonment for up to two years and a fine ranging from AED 250,000 to AED 500,000.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The provision also addresses more serious threats involving demands connected with committing a crime or dishonourable acts. Online Insult, Defamation and Slander \u2013 Article 43<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Article 43 addresses defamation and slander committed through information networks, information technology equipment or information systems.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The provision covers electronically communicated insults and the attribution of characteristics to another person that may expose that person to punishment or public contempt.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The prescribed punishment includes imprisonment and\/or a fine ranging from AED 250,000 to AED 500,000.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The provision also recognises an aggravating circumstance where the offence is committed against a public official or a person entrusted with a public service during or because of the performance of their duties.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Consequently, a social media argument should never be dismissed as legally insignificant merely because it took place online.<\/p>\n\n\n\n<h3 id=\"h-c-breach-of-privacy-and-disclosure-of-private-information-article-44\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"C_Breach_of_Privacy_and_Disclosure_of_Private_Information_%E2%80%93_Article_44\"><\/span>C. What Happens After a Cybercrime Complaint Is Filed?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The filing of a complaint generally initiates the criminal investigation process.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A complaint may be submitted to the police or the competent Public Prosecution, depending on the applicable procedure and jurisdiction.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The investigating authorities will ordinarily begin by examining the allegations and collecting information that may assist in establishing whether an offence has occurred.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This may involve:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Recording the complainant&#8217;s statement.<\/li>\n\n\n\n<li>Obtaining supporting documents and electronic material.<\/li>\n\n\n\n<li>Identifying persons who may have knowledge of the incident.<\/li>\n\n\n\n<li>Examining the communications or online activities forming the basis of the complaint.<\/li>\n\n\n\n<li>Calling the person complained against for questioning.<\/li>\n\n\n\n<li>Referring the matter to the Public Prosecution where appropriate.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The police investigation is not the same as a final determination of guilt.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">At this stage, the authorities are concerned with establishing the relevant facts and collecting evidence. The Importance of Electronic Evidence in UAE Cybercrime Cases<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Electronic evidence frequently occupies a central position in cybercrime investigations.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Unlike many conventional criminal cases, where the investigation may depend primarily on eyewitness accounts or physical documents, a cybercrime investigation can involve extensive digital material.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Examples include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>WhatsApp and other messaging application conversations.<\/li>\n\n\n\n<li>Instagram, Facebook and other social media posts.<\/li>\n\n\n\n<li>Emails and electronic correspondence.<\/li>\n\n\n\n<li>Audio recordings and video files.<\/li>\n\n\n\n<li>Photographs and screenshots.<\/li>\n\n\n\n<li>Information stored on mobile phones and computers.<\/li>\n\n\n\n<li>Account access information and relevant electronic records.<\/li>\n\n\n\n<li>Communication and location-related data.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">An important provision in this regard is Article 65 of Federal Decree-Law No. 34 of 2021.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It expressly provides that evidence derived or extracted from electronic devices, equipment, media, drives, information systems, computer programs and other information technology equipment has the same probative force as physical forensic evidence in criminal proceedings.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This provision gives electronic evidence considerable legal significance.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, the existence of an electronic record does not mean that every allegation made on the basis of that record must automatically be accepted.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The circumstances in which the material was obtained, its authenticity, completeness, relevance and connection with the accused remain important matters for examination.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For example, an isolated screenshot may not tell the entire story. The preceding messages, subsequent replies, identity of the account holder and circumstances in which the communication took place may materially alter the interpretation of the exchange.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Similarly, where an account has been accessed by another individual, the question of who actually controlled or used that account may become relevant.<\/p>\n\n\n\n<h3 id=\"h-should-you-delete-messages-after-learning-about-a-complaint\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Should_You_Delete_Messages_After_Learning_About_a_Complaint\"><\/span>Should You Delete Messages After Learning About a Complaint?<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">No.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Deleting messages, resetting a mobile phone, changing account information to conceal activity or attempting to destroy potentially relevant material after becoming aware of an investigation can create additional complications.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A person should preserve relevant electronic material in its original form and avoid making unauthorised alterations.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If there is a concern that a device contains sensitive personal information, the appropriate course is to obtain legal advice about protecting that information while complying with lawful investigative procedures.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The objective should be to preserve evidence, not to manipulate it.<\/p>\n\n\n\n<h2 id=\"h-5-what-should-you-do-if-the-uae-police-call-you-for-questioning\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"5_What_Should_You_Do_If_the_UAE_Police_Call_You_for_Questioning\"><\/span>5. A statement that appears harmless in isolation may have a different significance when examined alongside the electronic evidence.<\/p>\n\n\n\n<h3 id=\"h-fifth-comply-with-lawful-directions\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Fifth_Comply_With_Lawful_Directions\"><\/span>Fifth, Comply With Lawful Directions<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Do not ignore a formal summons or attempt to obstruct the investigation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The objective is to ensure that the accused person&#8217;s explanation is properly understood and that relevant evidence is not overlooked.<\/p>\n\n\n\n<h2 id=\"h-6-what-are-your-rights-when-the-matter-reaches-the-public-prosecution\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"6_What_Are_Your_Rights_When_the_Matter_Reaches_the_Public_Prosecution\"><\/span>6. Article 65 of the Cybercrime Law recognises the evidentiary value of material extracted from electronic devices and systems.<\/p>\n\n\n\n<h3 id=\"h-4-can-i-get-bail-in-a-uae-cybercrime-case\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"4_Can_I_Get_Bail_in_a_UAE_Cybercrime_Case\"><\/span>4. Can I Get Bail in a UAE Cybercrime Case?<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Provisional release may be available under Articles 108 and 109 of the Criminal Procedures Law. The Public Prosecution or the competent court may impose conditions such as personal guarantees, financial bail or a travel ban.<\/p>\n\n\n\n<h3 id=\"h-5-can-a-cybercrime-complaint-be-withdrawn-in-the-uae\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"5_Can_a_Cybercrime_Complaint_Be_Withdrawn_in_the_UAE\"><\/span>5. Can a Cybercrime Complaint Be Withdrawn in the UAE?<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The effect of withdrawal depends on the offence. Article 68 of the Cybercrime Law specifically permits the accused to invoke amicable settlement with the victim in certain offences, including Articles 42(1), 43 and 44, before the judgment becomes final.<\/p>\n\n\n\n<h3 id=\"h-6-can-a-person-facing-a-cybercrime-investigation-leave-the-uae\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"6_Can_a_Person_Facing_a_Cybercrime_Investigation_Leave_the_UAE\"><\/span>6. A travel ban may be imposed under the Criminal Procedures Law. Anyone involved in an ongoing investigation should verify whether a travel restriction exists before attempting to leave the country.<\/p>\n\n\n\n<h3 id=\"h-7-can-an-expatriate-be-prosecuted-for-a-cybercrime-committed-outside-the-uae\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"7_Can_an_Expatriate_Be_Prosecuted_for_a_Cybercrime_Committed_Outside_the_UAE\"><\/span>7. Can an Expatriate Be Prosecuted for a Cybercrime Committed Outside the UAE?<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">In certain circumstances, yes.
