Notwithstanding these structural differences, international law remains indispensable for orderly coexistence and cooperation in the international community.<\/p>\n\n\n\n<h2 id=\"h-definition-of-international-law\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Definition_of_International_Law\"><\/span>Definition of International Law<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">J.G. Starke defines international law as that body of law which consists of rules and principles governing the relations between States and other entities possessing international legal personality.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">According to Lassa Oppenheim, international law is the body of customary and conventional rules which are considered legally binding by civilised States in their relations with one another.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In essence, international law is a system of legally binding norms that regulate the conduct of States and other international legal persons in their mutual relations.<\/p>\n\n\n\n<h2 id=\"h-nature-and-characteristics-of-international-law\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Nature_and_Characteristics_of_International_Law\"><\/span>Nature and Characteristics of International Law<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The distinctive features of international law may be summarised as follows:<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><thead><tr><th>Characteristic<\/th><th>Explanation<\/th><\/tr><\/thead><tbody><tr><td><strong>Absence of a Central Legislature<\/strong><\/td><td>There is no world parliament empowered to enact laws binding on all States. International rules primarily emanate from treaties (conventional law), international custom, and general principles of law recognised by civilised nations (Article 38(1) of the Statute of the International Court of Justice).<\/td><\/tr><tr><td><strong>Absence of a Central Executive Authority<\/strong><\/td><td>No single international organ possesses a monopoly of coercive power to enforce all international obligations.<\/td><\/tr><tr><td><strong>Consent-Based Character<\/strong><\/td><td>Treaty obligations bind only those States that have expressed their consent. Customary international law, however, may bind States on the basis of widespread, consistent practice accepted as law (opinio juris).<\/td><\/tr><tr><td><strong>Sovereign Equality of States<\/strong><\/td><td>All States are equal in law, irrespective of differences in size, population, economic strength or military power (Article 2(1) of the UN Charter).<\/td><\/tr><tr><td><strong>Emphasis on Peaceful Settlement of Disputes<\/strong><\/td><td>International law prioritises negotiation, mediation, conciliation, arbitration and judicial settlement over the use of force (Article 2(3) and Chapter VI of the UN Charter).<\/td><\/tr><tr><td><strong>Expanding Scope<\/strong><\/td><td>Contemporary international law is no longer confined to inter-State relations. It extends to international organisations, individuals (particularly in the fields of human rights and international criminal law), non-State actors, and global commons such as the environment and outer space.<\/td><\/tr><tr><td><strong>Decentralised Enforcement<\/strong><\/td><td>Enforcement is achieved through a combination of international judicial and quasi-judicial institutions, unilateral or collective countermeasures, economic and diplomatic sanctions, reputational costs, and cooperative mechanisms rather than through a central police force.<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<h2 id=\"h-is-international-law-a-true-law\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Is_International_Law_a_True_Law\"><\/span>Is International Law a True Law?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The question whether international law qualifies as \u201ctrue\u201d law has long been debated.<\/p>\n\n\n\n<h3 id=\"h-arguments-against-its-character-as-true-law\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Arguments_Against_Its_Character_as_True_Law\"><\/span>Arguments Against Its Character as True Law<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">John Austin, the leading proponent of the command theory of law, maintained that law is the command of a sovereign backed by the threat of sanctions. Since international society lacks a determinate superior capable of issuing and enforcing commands, Austin classified international law as mere \u201cpositive international morality.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Sir Thomas Erskine Holland went further and described international law as the \u201cvanishing point of jurisprudence,\u201d arguing that it lacks the essential attributes of a mature legal system\u2014namely, a central law-making authority and effective compulsory enforcement.<\/p>\n\n\n\n<h3 id=\"h-why-international-law-is-recognised-as-true-law\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Why_International_Law_Is_Recognised_as_True_Law\"><\/span>Why International Law Is Recognised as True Law<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Modern jurists and practice overwhelmingly reject the Austinian and Hollandian views for the following reasons:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Recognition of Legal Obligation<\/strong> \u2013 States consistently treat rules of international law as creating legal (and not merely moral or political) duties.<\/li>\n\n\n\n<li><strong>Institutional Application<\/strong> \u2013 Permanent judicial organs, notably the International Court of Justice, the International Tribunal for the Law of the Sea, and various arbitral tribunals, interpret and apply international law in binding decisions.<\/li>\n\n\n\n<li><strong>Sanctions and Consequences<\/strong> \u2013 Breaches attract legal consequences, including countermeasures, Security Council sanctions under Chapter VII of the UN Charter, diplomatic isolation, and, in extreme cases, individual criminal responsibility before international criminal tribunals.<\/li>\n\n\n\n<li><strong>Treaty and Customary Practice<\/strong> \u2013 The continuous conclusion and observance of treaties, together with the formation and invocation of customary rules, demonstrate that States regard these norms as legally binding.<\/li>\n\n\n\n<li><strong>High Degree of Compliance<\/strong> \u2013 Empirical observation shows that most States comply with most of their international obligations most of the time, motivated by reciprocity, reputation, and long-term interest in a stable legal order.<\/li>\n\n\n\n<li><strong>Individual Criminal Responsibility<\/strong> \u2013 The development of international criminal law (genocide, war crimes, crimes against humanity, aggression) has extended legal accountability beyond the State to individuals, reinforcing the normative force of the system.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The absence of a world government does not deprive international law of its legal character; it merely reflects a different structural model of law adapted to a society of sovereign equals.<\/p>\n\n\n\n<h2 id=\"h-international-law-as-the-vanishing-point-of-jurisprudence\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"International_Law_as_the_%E2%80%9CVanishing_Point_of_Jurisprudence%E2%80%9D\"><\/span>International Law as the \u201cVanishing Point of Jurisprudence\u201d<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Holland\u2019s characterisation reflected the relatively underdeveloped institutional framework of the late nineteenth and early twentieth centuries.<\/p>\n\n\n\n<h3 id=\"h-meaning-of-vanishing-point-of-jurisprudence\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Meaning_of_Vanishing_Point_of_Jurisprudence\"><\/span>Meaning of Vanishing Point of Jurisprudence<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Vanishing Point of Jurisprudence means a point where law seems to lose its essential features or authority. In simple words, Holland used this expression to suggest that international law is not a complete system of law because it lacks a central government, legislature and compulsory enforcement authority like domestic law.<\/p>\n\n\n\n<h3 id=\"h-modern-developments-in-international-law\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Modern_Developments_in_International_Law\"><\/span>Modern Developments in International Law<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Subsequent developments\u2014the establishment of the League of Nations and later the United Nations, the proliferation of specialised international organisations, the growth of compulsory and optional jurisdiction of international courts, the codification of large areas of customary law, and the emergence of enforcement mechanisms under the UN Charter\u2014have substantially strengthened the legal quality of the system.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">While structural weaknesses remain, the description of international law as a vanishing point of jurisprudence is now widely regarded as outdated.<\/p>\n\n\n\n<h2 id=\"h-leading-case-law\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Leading_Case_Law\"><\/span>Leading Case Law<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The following landmark judgments illustrate the legal character and enforceability of international law:<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><thead><tr><th>Case Name<\/th><th>Year<\/th><th>Legal Principle and Significance<\/th><\/tr><\/thead><tbody><tr><td><strong>The S.S. United States of America)<\/strong><\/td><td>1986<\/td><td>The International Court of Justice applied customary international law on the prohibition of the use of force and the principle of non-intervention, demonstrating that customary rules possess independent normative force capable of judicial application even in the absence of a relevant treaty.<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">These decisions illustrate that international law contains determinate, justiciable rules which courts treat as legally binding.<\/p>\n\n\n\n<h2 id=\"h-codification-of-international-law\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Codification_of_International_Law\"><\/span>Codification of International Law<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Codification of international law means the systematic collection, clarification and written arrangement of existing international rules, particularly those based on customs and State practices.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">International law has been codified to a considerable extent, but not completely. The United Nations International Law Commission (ILC), established in 1947, plays an important role in this process.<\/p>\n\n\n\n<h3 id=\"h-important-examples-of-codification\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Important_Examples_of_Codification\"><\/span>Important Examples of Codification<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Important examples include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Vienna Convention on the Law of Treaties, 1969.<\/li>\n\n\n\n<li>Vienna Convention on Diplomatic Relations, 1961.<\/li>\n<\/ul>\n\n\n\n<h3 id=\"h-difficulties-in-the-codification-of-international-law\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Difficulties_in_the_Codification_of_International_Law\"><\/span>Difficulties in the Codification of International Law<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">However, complete codification faces several difficulties, such as:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Differences in the political, economic and legal interests of States.<\/li>\n\n\n\n<li>Lack of agreement on common rules.<\/li>\n\n\n\n<li>State sovereignty.<\/li>\n\n\n\n<li>Changing international practices.<\/li>\n\n\n\n<li>Unwillingness of powerful States to accept certain restrictions.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Thus, codification is a continuous process aimed at making international law clearer, more uniform and effective.<\/p>\n\n\n\n<h2 id=\"h-conclusion\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">International law is a genuine, though decentralised and evolving, legal system.
