Every state exercises exclusive authority over its territory, including the airspace superjacent to its land territory and territorial waters. This sovereignty, however, does not extend in the same manner to outer space. Outer space is governed by a distinct legal regime that treats it as an area free for exploration and use by all states, subject to the principles of international law and the prohibition of national appropriation.

<p The Boundary Question

International law has not yet established a universally accepted legal boundary between national airspace and outer space. Various proposals exist, including the Kármán Line (approximately 100 km above mean sea level), but none has achieved the status of a binding rule of customary international law or treaty law. The absence of a fixed demarcation creates continuing uncertainty, particularly as states develop sub-orbital flight and commercial space activities. The distinction nevertheless remains of practical importance: sovereignty applies below the boundary (wherever it may ultimately be drawn), while the freedom of exploration and the prohibition of appropriation apply above it.

Conclusion

International law maintains a clear conceptual and legal distinction between national airspace and outer space. Under the Chicago Convention, 1944, every state enjoys complete and exclusive sovereignty over the airspace above its territory. The freedoms of the air permit international civil aviation, but only on the basis of state consent. By contrast, the Outer Space Treaty, 1967, establishes outer space as an area free for exploration and use by all States and expressly prohibits national appropriation of outer space, the Moon and other celestial bodies. These complementary regimes seek to reconcile the sovereign rights of states with the common interest of humanity in the peaceful use of areas beyond national jurisdiction.

Core Proposition

Airspace is subject to the complete and exclusive sovereignty of the territorial State.
