It depends on what kind of employee the law says you are. A factory worker, a software manager and a contractual engineer in a State department stand on three different footings. The Supreme Court has said something useful about two of them this year.

In this article I explain those three footings, what notice and compensation you can actually demand, and where to go if the termination was unlawful. I will also tell you what to do in the first forty-eight hours, because that is usually where cases are won or lost.

Can My Employer Terminate Me Without Notice or Reason? The Short Answer

The law does not give one answer for the whole country. It gives three.

Private employees who are not “workers”: If you are a private employee who is not a “worker” (usually managerial or administrative staff), your contract governs. Where it allows termination on notice or pay in lieu, the employer can generally end the relationship without stating a reason. If it skips the notice, you can claim damages, typically the salary for the notice period.

Workmen or “workers”: If you are a “workman”, now called a “worker” under the Industrial Relations Code, 2020, the answer is no. Retrenchment needs written notice and statutory compensation. A dismissal for misconduct needs a fair inquiry. Skip those steps and the termination can be set aside.

State or public-body employees: If you are an employee of the State or a public body, the action must not be arbitrary under Article 14. A contractual label does not protect the State from scrutiny.

Everything else in this article is the detail behind those three lines.

Two 2026 Supreme Court Rulings Every Employee Should Know

Two recent decisions, both written by Justice Vikram Nath, show how differently the Court treats the two ends of the spectrum. I have read both orders in full.

1. Arjun Gupta (22 May 2026)

Citation: Civil Appeal arising out of SLP (Civil) No. 26434 of 2024, decided on 22 May 2026 by Justice Vikram Nath and Justice Sandeep Mehta, setting aside the Allahabad High Court’s judgment of 13 March 2024 in Writ-C No. 8077/2024.

The Facts of the Case

The facts are simple, which is why the case is useful. A molder who had joined in 2006 stopped coming to work on 14 May 2012 without telling anyone. Four days later the company sent him a registered notice at the permanent address he had given when he joined, asking him to explain. He never replied.

His story was that he came back on 8 June 2012 and was turned away. The dispute travelled through conciliation to the Labour Court, which ordered reinstatement with 50 per cent back wages. The High Court upheld it.

What the Supreme Court Decided

The Supreme Court reversed all of it. An employer can only write to the address the employee has given. If he moves, telling the employer is his job, and he cannot gain from his own silence.

His claim that he had informed his superior orally, and that his mother was ill, had no document behind it. In the whole period of absence he had not sent a single written word. His claim that he was refused entry on 8 June 2012 was equally unsupported.

The Labour Court and the High Court therefore should not have granted relief. Reinstatement, back wages and every consequential direction were cancelled.

Why This Judgment Matters to Employees

Now a word of caution, because the headlines were louder than the order. This is a short order that turns on its facts. Nothing in the text I have read says an employer may terminate at will. It says that a worker who alleges he was thrown out must prove it with more than his own word, and that an employer who keeps proper records stands on firmer ground.

For you the lesson is blunt: paper beats memory. Explain absences in writing, keep your address current with HR, and if you are stopped at the gate, send a message the same day.

2. The appellants were Junior Engineers (Agriculture) appointed in 2012 against sanctioned posts, after an advertisement and a selection process. The State kept them on one-year contracts and renewed them until 2023, when it refused any further extension and pointed to the word “contractual”.

What the Supreme Court Decided

The Court was not impressed. Ending a long-standing engagement merely because of its label, with no recorded reasons or speaking order, is manifestly arbitrary and violates Article 14.

Accepting contractual terms is not a waiver of fundamental rights, and a contract cannot shield arbitrary State action. The State is a “model employer” and cannot lean mechanically on State of Karnataka v. Umadevi (2006) 4 SCC 1.

The State was directed to regularise the appellants against the sanctioned posts, with consequential benefits from the date of the judgment.

Important Legal Precedents Relied Upon

The Bench drew on Central Inland Water Transport Corporation v. Brojo Nath Ganguly (1986) 3 SCC 156, where the Court refused to enforce unfair terms imposed on a party with no real bargaining power.

It also relied on Jaggo v. Union of India (2024 INSC 1034, decided 20 December 2024) and Shripal v. Nagar Nigam, Ghaziabad (2025 INSC 144, decided 31 January 2025).

In Shripal, workmen had been terminated orally in 2005, without notice or retrenchment compensation, and the Court ordered their reinstatement.

Does Bhola Nath Apply to Private Employers?

Please do not over-read this one either. Bhola Nath is a public-law decision. Legitimate expectation, which features in parts of its reasoning, operates against public authorities. A private company is not bound in the same way.

First, Work Out Which Kind of Employee You Are

Indian law looks at what you do, not what your visiting card says. The Industrial Relations Code, 2020, in force since 21 November 2025, protects a “worker” (Section 2(zr)).

Comparison of Employee Categories and Termination Rights in India

Feature

Private Employee (Non-Worker)

Workman / “Worker”

State / Public-Sector Employee

Who is covered

Mainly managerial or administrative staff, and supervisors earning above the wage ceiling (Rs. 18,000 a month)

Anyone employed in an industry doing manual, skilled, technical, operational, clerical or supervisory work, within the wage ceiling

Employees of the State, its agencies and instrumentalities

Main source of rights

Contract, appointment letter, HR policy, state Shops and Establishments Act

Industrial Relations Code, 2020 and standing orders

Articles 14, 16 and 21 of the Constitution, service rules

Termination without a reason?

Often yes, if the contract permits and notice or pay in lieu is given

No for retrenchment without the statutory conditions; misconduct needs a fair inquiry

Not arbitrarily; reasons and fairness are required

Notice

As per contract (commonly 30 to 90 days) or the state Shops Act

One month’s written notice with reasons, or wages in lieu, for retrenchment

As per rules; natural justice applies

Main forum

Civil court for damages; the state Shops Act authority where applicable

Conciliation Officer, then Industrial Tribunal

High Court under Article 226; Supreme Court under Article 32 or by special leave

The Dominant Nature of Duties Test: Why Your Job Title Is Not Decisive

Courts apply the dominant nature of duties test. A person called “Manager” who really does clerical or operational work may still be a worker, and a person called “Executive” is not automatically outside the net.

Since the supervisory ceiling is Rs. 18,000 a month, anyone close to that line should have their classification examined carefully before assuming anything.

Can a Private Employer Terminate Without Notice or Reason in India?

If You Are Outside Industrial Law

Your relationship with the employer is a contract. Most appointment letters say either side can end it on 30, 60 or 90 days’ notice, or salary in lieu. Where that clause exists and the employer honours it, no reason has to be given. Courts are slow to read a “reasons” requirement into a private contract, and they rarely order reinstatement, because a contract of personal service is not ordinarily specifically enforceable. The traditional exceptions, discussed in Sirsi Municipality v. Cecelia Kom Francis Tellis (1973) 1 SCC 409, are public servants protected by the Constitution, workmen under industrial law, and statutory bodies that breach mandatory provisions.

That is not a licence to do anything. Terminating without the contractual notice is a breach, and you can claim notice pay and dues. If the letter alleges misconduct, the termination is really a punishment and should be tested for fairness. And if the timing suggests retaliation — after a sexual harassment complaint, a pregnancy, or whistleblowing — the relevant statute may give you a separate challenge.

Do Not Skip Your State’s Shops and Establishments Act

This is the layer people forget. Each state has its own Act, and they differ. Please read the one for the state where you work. Three examples:

Delhi

Section 30 of the Delhi Shops and Establishments Act, 1954 bars an employer from dispensing with an employee who has three months’ continuous service without one month’s written notice or wages in lieu, with a proviso for misconduct. A magistrate can examine whether the dismissal was without reasonable cause and may award limited additional compensation.

Karnataka

Section 39 of the Karnataka Shops and Commercial Establishments Act, 1961 requires reasonable cause and one month’s notice or pay in lieu for an employee with six months’ continuous service, again with an exception for proved misconduct. There is a right of appeal.

Maharashtra

The current Maharashtra Shops and Establishments (Regulation of Employment and Conditions of Service) Act, 2017 prescribes no statutory notice period. Your contract and, if you are a “worker”, the Industrial Relations Code carry the weight.

These Acts apply only to the establishments they cover. If you are unsure whether yours is covered, have an advocate read the Act against your facts.

Probation, Fixed-Term and Contract Roles

A probation clause gives the employer more room, but it does not authorise a punitive or stigmatic termination without a fair process, and it does not take a “worker” outside the Code.

A genuine fixed-term contract that simply expires is not retrenchment. But repeated renewals with no real break, a mid-term termination with no contractual power, or a “contract” label on work that is plainly permanent can all be challenged. The label on the letter will not decide the matter.

If You Are a Workman or Worker, the Rules Are Stricter

Under Section 25F of the Industrial Disputes Act, a workman with one year of continuous service (240 days in twelve months) could not be retrenched without notice, compensation and notice to the Government. The same safeguard now sits in Section 70 of the Industrial Relations Code, 2020:

One month’s written notice stating the reasons for retrenchment, or wages for that period in lieu;

Retrenchment compensation of 15 days’ average pay for every completed year of continuous service, with a part of a year exceeding six months counted as a full year;

Notice to the appropriate Government in the prescribed manner.

Establishments with 300 or more workers need prior Government permission for lay-off, retrenchment or closure. The older threshold was 100. Termination on expiry of a genuine fixed-term contract is excluded from “retrenchment”, which is why I ask employees to read the fixed-term clause in their letters very carefully.

If the employer says the termination is for misconduct, the safe route is a proper domestic inquiry: a charge-sheet, a chance to defend, a reasoned finding and a proportionate punishment. An oral termination, a gate pass, or a sudden “your services are no longer required” message to a workman is exactly what Labour Courts have repeatedly found illegal. Shripal is a recent example.

What the Numbers Look Like

Take a worker with seven completed years of continuous service and average pay of Rs. 30,000 a month.

Component

Calculation

Amount

Retrenchment compensation (Section 70)

15 days’ pay = Rs. 15,000 × 7 years

Rs. 1,05,000

Wages in lieu of one month’s notice

If no notice was given

Rs. 30,000

Statutory minimum

Rs. 1,35,000

Leave encashment, bonus and gratuity, where eligible, come on top. Your contract or standing orders may give you more, never less. The Code has its own way of working out “average pay”, so an exact figure needs your payslips.

Gratuity and Other Dues

The Code on Social Security, 2020, brought into force on 21 November 2025 with the other labour codes, now governs gratuity. In general it is payable after five years of continuous service on events that include resignation. For fixed-term employees it is payable pro rata after one year. Forfeiture is possible only on the limited grounds the law allows. These dues are separate from notice pay and retrenchment compensation.

Where to Go If the Termination Was Unlawful

1. Labour Court or Industrial Tribunal (Workmen and Workers)

Under the Code, a dismissed worker first raises the dispute before the Conciliation Officer. If conciliation fails, the worker may apply to the Industrial Tribunal after 45 days from the date of the conciliation application. The application must be made within two years of the termination. Please do not wait. The Tribunal can order reinstatement, back wages, or compensation instead of reinstatement.

A Word on the Transition

The Code came into force by notification S.O. 5320(E) of 21 November 2025. The Industrial Relations Code (Removal of Difficulties) Order, 2025 (S.O. 5683(E), 8 December 2025) clarified that the existing Labour Courts and Industrial Tribunals continue to hear existing and new cases until the Code’s tribunals are in place. The Industrial Relations Code (Amendment) Act, 2026 later adjusted the repeal and savings provisions. Which forum and which law govern your dispute depends on the date of termination and the position in your state, so please have an advocate confirm both before filing.

Reinstatement, Back Wages and Supreme Court Decisions

Do not assume you will be reinstated. The Supreme Court has repeatedly moulded relief, awarding a lump sum in place of reinstatement where service was short, the worker was a daily-wager, or years had gone by. In Deepali Gundu Surwase v. Kranti Junior Adhyapak Mahavidyalaya (2013) 10 SCC 324, the Court treated reinstatement with continuity of service and full back wages as the ordinary result of an illegal termination, but later decisions show that each case turns on its facts and evidence. The burden of proving 240 days of service lies on the workman, as Range Forest Officer v. S.T. Hadimani (2002) 3 SCC 25 holds. Rifilis makes the same point from another angle: relief follows evidence.

2. Civil Suit (Non-Workers in Private Employment)

A civil suit lies for damages for breach of contract, for unpaid salary, notice pay and other dues, and in limited cases for a declaration that the termination is void. It must be filed within limitation, which is generally three years. Courts seldom force a private employer to take someone back, so the realistic goal is compensation, a clean record and, often, a negotiated settlement.

3. Writ Petition Under Article 226 (Public Bodies)

If your employer is the State, a statutory corporation or another authority that counts as “State” under Article 12, the High Court can examine whether the termination was arbitrary, whether natural justice was followed and whether service rules were breached. Bhola Nath shows how far this remedy can go, and Brojo Nath Ganguly shows that even a termination clause can be struck down if it is unconscionable. Writ courts are reluctant to decide heavily disputed facts, though, and may send the parties to the Tribunal.

What to Do in the First 48 Hours After a Sudden Termination

Do not sign a resignation letter, a “voluntary separation” form, a full and final settlement or a release until someone has reviewed the papers.

Collect your documents: appointment letter, offer letter, increments, appraisals, payslips, bank statements showing salary, ID card, the termination email, and any HR policy or standing orders.

Reply in writing. Bhola Nath says so plainly where the State is concerned.

Myth 3: “My Title Is Manager, So Labour Law Does Not Apply.”

The work you actually do decides it, not the designation.

Myth 4: “They Paid My Notice Period, So It Must Be Lawful.”

For a worker, notice pay is one requirement among several. In a misconduct case, an inquiry is needed.

Frequently Asked Questions About Employee Termination in India

Is a Notice Period Mandatory in India?

No single national statute fixes one for every employee. It comes from your contract, the standing orders, your state’s Shops and Establishments Act and, for workers, the Industrial Relations Code (one month’s notice or wages in lieu for retrenchment). If the contract is silent, courts ordinarily expect reasonable notice.

Can a Private Company Terminate an Employee Without Giving a Reason?

If the contract permits termination on notice or pay in lieu, and the employee is not a worker or in a protected category, the company can generally do so without a stated reason. If it gives a stigmatic reason, or the employee is a worker, the position changes.

Can My Employer Terminate Me Without Notice or Reason in India During Probation?

Often the contract allows shorter notice during probation, but that is not a blank cheque. A punitive termination without a fair process can be challenged, and a probationer who qualifies as a worker keeps the protection of the Code.

Can I Go to the Labour Court Against a Private Company?

Yes, if you are a “workman” under the old Act or a “worker” under the Code and the employer carries on an “industry”. The route begins with conciliation and then the Industrial Tribunal. Until the Code’s own tribunals are constituted, the existing Labour Courts and Tribunals continue to hear disputes.

Can I File a Writ Petition Against a Private Employer?

Ordinarily not. A writ under Article 226 is for the State and bodies performing public functions. Private employment disputes go to the Tribunal, the civil court or the statutory authority.

Will I Get My Job Back If the Termination Was Illegal?

Not necessarily. Reinstatement with back wages is possible, but courts often award compensation instead, depending on length of service, the nature of the job and the delay.

What If My Employer Says I Abandoned My Job?

That is the situation in Rifilis Engineering. Answer every notice in writing, explain your absence with documents, and keep proof of any attempt to rejoin. Silence and oral assertions are risky.

Does the Industrial Relations Code Apply If I Was Terminated Before 21 November 2025?

Not automatically. The legality of termination depends on the employee’s employment status, appointment letter, applicable labour laws and the circumstances of dismissal.

Private companies can terminate certain employees without stating a reason, provided the employment contract permits termination and the employer complies with applicable notice-period or salary-in-lieu requirements.

Workers enjoy additional protection under the Industrial Relations Code, 2020. Retrenchment generally requires one month’s written notice or wages in lieu, retrenchment compensation and statutory compliance.

Managerial designation does not automatically exclude an employee from labour law protection. Courts examine the actual nature of duties rather than relying solely on job titles.

Contractual employees also have legal rights. In Bhola Nath v. State of Jharkhand (2026 INSC 99), the Supreme Court emphasised that public authorities cannot justify arbitrary termination merely by describing an employee as contractual.

The Supreme Court’s decision in M/s Rifilis Engineering Pvt. Ltd. v. Arjun Gupta (22 May 2026) highlights the importance of documentary evidence. Employees should maintain written records of attendance, communications, addresses and attempts to resume work.

Termination during probation is not automatically immune from legal challenge. A punitive or stigmatic dismissal may require procedural fairness, depending on the employee’s status and applicable law.

Employees terminated unlawfully may claim reinstatement, back wages or compensation, depending on the facts, evidence and applicable legal provisions.

Notice pay, retrenchment compensation, gratuity, unpaid salary, bonus and leave encashment are separate employment entitlements. Eligible employees should examine each component before accepting a final settlement.

The appropriate legal remedy depends on the employment relationship. Workers may approach the conciliation machinery and Industrial Tribunal; non-worker private employees may pursue contractual remedies; and eligible public-sector employees may challenge arbitrary action through a writ petition.

Employees should avoid signing resignation letters or full-and-final settlement documents under pressure. They should first examine the termination letter, appointment terms, salary records and outstanding dues.

The first 48 hours after termination are important. Preserve evidence, communicate with HR in writing, request reasons for dismissal and obtain legal advice before taking further steps.

Important Supreme Court Judgments on Employee Termination

Judgment

Key Legal Principle

Bhola Nath v.
