It focuses on a special rule called Rebus Sic Stantibus, which means a fundamental change in circumstances.

What Is a Treaty and How Does It End?

A treaty is a formal written agreement between two or more countries (called ‘states’). It creates legal rights and duties that both sides must follow.

The main rule in international law is that countries must keep their promises. This is called Pacta Sunt Servanda, which means “agreements must be kept”. However, treaties do not always last forever.

Termination means ending a treaty completely so that no country is bound by it any more. “Rebus Sic Stantibus” is a Latin phrase that means “things remaining as they are”. In simple words, it allows a country to end a treaty if the situation changes completely and unexpectedly from the time the treaty was signed.

So, Pacta Sunt Servanda says treaties must be honoured. Rebus Sic Stantibus is the exception that lets a country leave a treaty when circumstances change in a big way.

Ten Ways a Treaty Can End

Under international law, a treaty can end in several ways:

No.

Method of Termination

Explanation

1

By Mutual Agreement

All the countries in the treaty agree to end it.

2

By Expiration

The treaty was made for a fixed time (for example, 10 years), and that time runs out.

3

By Completing Its Goal

The treaty achieved its specific purpose, so it is no longer needed.

4

By Notice (Withdrawal)

One country leaves by giving proper notice, as allowed by the treaty or agreed by the parties.

5

By Making a New Treaty

The same countries sign a new treaty on the same subject that replaces the old one.

6

By Serious Breach

One country breaks an important part of the deal, allowing the other side to cancel or pause the treaty.

7

By Permanent Impossibility

Something essential to the treaty is permanently destroyed or lost, making performance impossible.

8

By Unexpected Change of Circumstances (Rebus Sic Stantibus)

The world situation changes so deeply that the original promises no longer make sense.

9

By New Fundamental Rules of Law (Jus Cogens)

A new, supreme international rule is created that conflicts with the existing treaty.

10

By War or Armed Conflict

War does not automatically end all treaties, but it can pause or destroy certain agreements depending on their nature.

The Principle of Rebus Sic Stantibus (Article 62)

The main rules about treaties are found in the Vienna Convention on the Law of Treaties (1969). Article 62 deals with fundamental change of circumstances.

To use Rebus Sic Stantibus to end a treaty, a country must prove all four of these conditions:

The change was completely unexpected when the treaty was signed.

The original situation was a main reason why the countries made the deal.

The change completely transforms the obligations that still need to be performed.

The country claiming the change did not cause the situation itself by breaking its own duties.

Important Limits of Rebus Sic Stantibus

There are important limits. A country cannot use this rule to cancel treaties that fix international borders. It also cannot escape a treaty if it caused the change by violating international law.

Simple Example

Two countries sign a treaty to share water from a river. A severe and unexpected natural disaster permanently changes the river’s path, making it impossible to share the water as agreed. The affected country may invoke Rebus Sic Stantibus to adjust or end the agreement.

Difference Between Termination and Suspension

It is important not to confuse ending a treaty with pausing it.

Basis of Difference

Termination

Suspension

Meaning

Termination means the treaty ends permanently.

Suspension means the treaty is put on hold temporarily.

Effect

Countries have no future obligations under it.

The duties resume once the suspension ends.

Step-by-Step Procedure to End a Treaty

Under Article 65 of the Vienna Convention, a country cannot simply walk away. It must follow a clear process:

The country sends a formal written notice to the other parties and explains its reasons.

The other countries are given time to review the notice and raise any objections.

If no one objects, the treaty can be ended.

If someone objects, the parties must try to settle the dispute peacefully.

Quick Reference: Key Articles of the Vienna Convention (1969)

Article

Subject

Article 54

Ending a treaty by consent or by the rules written in the treaty itself

Article 56

Withdrawing when the treaty has no specific withdrawal clause

Article 59

Ending an old treaty because a new one was signed

Article 60

Ending a treaty because another party broke it

Article 61

Ending a treaty because performance became impossible

Article 62

Fundamental change of circumstances (Rebus Sic Stantibus)

Article 63

Effect of breaking diplomatic relations

Article 64

Conflict with a new supreme international rule (Jus Cogens)

Article 65

Formal procedure for ending or leaving a treaty

Summary Checklist

Termination = permanently ending a treaty.

Suspension = temporarily pausing a treaty.

Pacta Sunt Servanda = treaties must be kept in good faith.

Rebus Sic Stantibus = an exception that allows termination if things change fundamentally and unexpectedly.

Strict Limits Apply: Countries cannot use this rule to change borders or to avoid duties they themselves broke.

Conclusion

Treaties form the foundation of international peace and cooperation. The general rule is that promises must be kept. At the same time, international law recognises that world conditions can change drastically.

The principle of Rebus Sic Stantibus under the 1969 Vienna Convention gives countries a fair and controlled legal way to withdraw from outdated promises. It does this without allowing abuse or letting countries escape valid duties.

Main Reference

Vienna Convention on the Law of Treaties (1969), United Nations.

Interpretation of Treaties: Understanding the Meaning and Scope of International Agreements

International Human Rights Treaties and also Regional Systems of Human Rights

Wrongful Termination in India: Employee Rights, Supreme Court Judgements, Legal Remedies & Compensation (2026 Guide)

The Lifecycle Of A Treaty – A Comprehensive Guide

Bail After Conviction Under Section 430 BNSS: Principles, Procedure, and Key Rules

How Can a Treaty Be Terminated Under International Law?
