The Vienna Convention on the Law of Treaties, 1969 (VCLT) provides the main rules regarding the formation, interpretation and operation of treaties.<\/p>\n\n\n\n<h2 id=\"h-stages-in-the-formation-of-a-treaty\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Stages_in_the_Formation_of_a_Treaty\"><\/span>Stages in the Formation of a Treaty<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The formation of a treaty generally involves the following stages:<\/p>\n\n\n\n<h3 id=\"h-1-negotiation\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"1_Negotiation\"><\/span>1. Negotiation<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The first step is negotiation between the representatives of the states. They discuss the subject, terms and conditions of the proposed treaty.<\/p>\n\n\n\n<h3 id=\"h-2-adoption-of-the-text\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"2_Adoption_of_the_Text\"><\/span>2. Adoption of the Text<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">After negotiation, the participating states agree upon and adopt the final text of the treaty.<\/p>\n\n\n\n<h3 id=\"h-3-authentication-of-the-text\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"3_Authentication_of_the_Text\"><\/span>3. Authentication of the Text<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The final text is officially confirmed as correct and genuine. It ensures that the agreed text will not be changed without proper consent.<\/p>\n\n\n\n<h3 id=\"h-4-signature\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"4_Signature\"><\/span>4. Signature<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The authorised representatives sign the treaty. In some cases, the signature itself makes the treaty binding. In other cases, it only shows the intention of the states to accept the treaty, subject to ratification.<\/p>\n\n\n\n<h3 id=\"h-5-ratification\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"5_Ratification\"><\/span>5. Ratification<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Ratification is the formal approval of a treaty by a state through its competent constitutional authority. After ratification, the State expresses its final consent to be legally bound by the treaty.<\/p>\n\n\n\n<h3 id=\"h-6-exchange-or-deposit-of-instruments\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"6_Exchange_or_Deposit_of_Instruments\"><\/span>6. Exchange or Deposit of Instruments<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The States may exchange their instruments of ratification or deposit them with a designated authority, such as the Secretary-General of the United Nations.<\/p>\n\n\n\n<h3 id=\"h-7-entry-into-force\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"7_Entry_into_Force\"><\/span>7. Entry into Force<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">A treaty becomes legally effective when the conditions mentioned in it are fulfilled. It may enter into force after ratification by a fixed number of states or on a specified date.<\/p>\n\n\n\n<h2 id=\"h-reservation-to-a-treaty\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Reservation_to_a_Treaty\"><\/span>Reservation to a Treaty<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A reservation is a statement made by a state when signing, ratifying, accepting, approving or acceding to a treaty. Through reservation, a state intends to exclude or modify the legal effect of certain provisions of the treaty in their application to that state.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For example, if a treaty contains ten provisions and a state does not agree with one particular provision, it may make a reservation regarding that provision, if permitted.<\/p>\n\n\n\n<h3 id=\"h-main-rules-regarding-reservation\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Main_Rules_Regarding_Reservation\"><\/span>Main Rules Regarding Reservation<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The main rules governing reservations to treaties are as follows:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>A state can make a reservation unless the treaty prohibits it.<\/li>\n\n\n\n<li>A reservation cannot be made if the treaty allows only certain specific reservations and the proposed reservation is not included.<\/li>\n\n\n\n<li>A reservation must not go against the object and purpose of the treaty.<\/li>\n\n\n\n<li>Other states may accept or object to a reservation.<\/li>\n\n\n\n<li>A reservation generally modifies the treaty obligations between the reserving State and the accepting State to the extent of the reservation.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Thus, reservation allows states to become parties to a treaty even when they do not agree with every provision, while respecting the basic purpose of the treaty.<\/p>\n\n\n\n<h2 id=\"h-ratification-of-a-treaty\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Ratification_of_a_Treaty\"><\/span>Ratification of a Treaty<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Ratification means the formal approval of a treaty by a state after its signature. It confirms the State&#8217;s final consent to be legally bound by the treaty.<\/p>\n\n\n\n<h3 id=\"h-the-main-purposes-of-ratification\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Main_Purposes_of_Ratification\"><\/span>The Main Purposes of Ratification<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The main purposes of ratification are:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>To give the State time to examine the treaty carefully.<\/li>\n\n\n\n<li>To obtain approval from the competent constitutional authority.<\/li>\n\n\n\n<li>To ensure that the treaty is consistent with the country&#8217;s laws and policies.<\/li>\n\n\n\n<li>To make the State legally bound by the treaty.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">For example, a state may sign an international treaty first and later ratify it after completing its required constitutional procedures.<\/p>\n\n\n\n<h3 id=\"h-legal-effect-of-signature-before-ratification\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Legal_Effect_of_Signature_Before_Ratification\"><\/span>Legal Effect of Signature Before Ratification<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">It is important to note that a signature does not always make a treaty binding. However, under Article 18 of the Vienna Convention, a state that has signed a treaty subject to ratification must avoid acts that would defeat its object and purpose until it makes its intention clear not to become a party.<\/p>\n\n\n\n<h2 id=\"h-accession-to-a-treaty\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Accession_to_a_Treaty\"><\/span>Accession to a Treaty<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Accession means joining a treaty by a state that did not sign it during the initial signing period.
