class="ez-toc-section-end">

Two important laws established the separation between administrative authorities and ordinary judicial courts:

Law of 16–24 August 1790: Officially separated administrative work from judicial courts. Ordinary judges were banned from interfering in government decisions.

Law of 16 Fructidor, Year III (1795): Re-confirmed that ordinary courts could not judge government actions.

The “Minister-Judge” System

Because ordinary courts were banned from hearing administrative cases, citizens had no independent court to go to. If you had a problem with a government action, you had to complain directly to the minister in charge. This was known as the Doctrine of Minister-Judge.

Development During Napoleon’s Rule (1799–1815)

Napoleon Bonaparte built the structural foundation of French administrative law:

Creation of the Council of State (Conseil d’État) in 1799: Created to write laws, advise the government, and resolve administrative disputes.

Creation of Prefectural Councils in 1800: Set up to handle local government disputes.

Retained Justice (Justice Retenue): At first, the Council of State could only suggest. The Head of State held the ultimate power to accept or reject those suggestions.

Development During the 19th Century

During the 1800s, the Council of State grew into a fully independent court system through key events and court cases:

Law of 24 May 1872 — Delegated Justice (Justice Déléguée)

A major turning point.
