In my years at the Bar, I have found that airline disputes are among the most winnable consumer matters, for a simple reason: your entitlements are not a matter of airline goodwill. They are written into a regulatory document that binds every operator. The difficulty is that very few passengers have read it, and airline staff seldom quote it.

So let me do that for you. This article sets out what the rules actually say, where airlines can honestly refuse, where they cannot, and what to do when your refund or compensation is being held back.

Your Rights at a Glance: Flight Cancellation and Delay Compensation

What Happened

What the DGCA Rules Give You

Cancelled, and you were informed at least two weeks before departure.

Alternate flight or refund, as acceptable to you. Let us start there.

Where These Rights Come From: CAR Section 3, Series M, Part IV

The source is the Civil Aviation Requirements (CAR), Section 3 – Air Transport, Series ‘M’, Part IV, titled “Facilities to be provided to passengers by airlines due to denied boarding, cancellation of flights and delays in flights.” The DGCA first issued it on 6 August 2010 under Rule 133A of the Aircraft Rules, 1937, with the approval of the Ministry of Civil Aviation. The current text is Revision 4, dated 25 January 2023 and effective from 15 February 2023, and the paragraph numbers in this article follow that revision.

Three things about it are worth knowing before you argue with anyone:

1. It Covers Everyone

Para 1.7 applies it to all scheduled and non-scheduled operators, and Para 1.2 extends the protection to foreign carriers flying to and from India.

2. The Airline That Flies You Is the Airline That Answers

Under Para 1.3, responsibility rests with the operating airline, whether it uses its own aircraft or a leased one. Pointing to a code-share partner or a booking portal does not discharge that duty.

3. The Airline Must Tell You Your Rights

Para 3.10.2 requires every airline to publish its compensation, refund and facilities policy on its website as a Charter of Rights and to make sure passengers are informed of it when they book.

A second document governs refunds: CAR Section 3, Series ‘M’, Part II. It was revised on 24 February 2026 and took effect on 26 March 2026. I come to it shortly.

When Your Flight Is Cancelled

Notice, and the Choice Between a New Flight and Your Money

Para 3.3.1 puts the first obligation on the airline: tell the passenger about a cancellation at least two weeks before departure, and arrange an alternate flight or a refund, whichever the passenger accepts. If the passenger learns of it less than two weeks ahead but still up to 24 hours before departure, the airline must again offer an alternate flight or a refund. The choice is yours, not the airline’s.

Cash Compensation When the Notice Is Too Short

Cash becomes payable under Para 3.3.2 when you are not informed in the manner Para 3.3.1 contemplates. Read the two paragraphs together, and the position is this: if you found out within 24 hours of departure, or not at all until you reached the airport, you are in compensation territory. The same applies if the cancellation made you miss a connecting flight booked on the same ticket number.

The airline must then either give you an alternate flight acceptable to you or pay compensation on top of a full refund. The amount depends on the flight’s block time, meaning the time from when the aircraft first moves for take-off until it comes to rest at the end of the flight:

How Much Compensation Can You Claim for a Cancelled Flight?

Block Time

Compensation (Whichever Is Less)

Up to and including 1 hour

₹5,000, or the booked one-way basic fare plus airline fuel charge

More than 1 hour, up to and including 2 hours

₹7,500, or the booked one-way basic fare plus airline fuel charge

More than 2 hours

₹10,000, or the booked one-way basic fare plus airline fuel charge

A Practical Example: Calculating Your Compensation

A quick example makes the arithmetic clear. Say you were booked on a flight with a block time above two hours, and the airline cancelled it a few hours before departure. Your basic fare plus fuel charge was ₹4,200. The cap is ₹10,000, but the lower figure applies, so you are owed ₹4,200 in compensation along with your full refund. Taxes and convenience fees do not form part of that fare component, though they are refundable separately.

If you had already reported at the airport, the airline must also feed you while you wait for the alternate flight (Para 3.3.2 read with Para 3.8.1(a)).

The range is not theoretical. When thousands of IndiGo flights were cancelled in December 2025 after the carrier struggled with pilot rosters under the new duty-time rules, the DGCA publicly reiterated that the statutory compensation for such cancellations is ₹5,000 to ₹10,000 and noted that the airline’s additional travel vouchers were over and above that entitlement.

The Contact Details Trap

One condition catches people out. Under Para 3.3.3, no financial compensation is payable if you did not give the airline an email address or phone number when booking. You would still get your refund or an alternate flight, but not the cash. If you booked through an agent or portal, check that your own number and email reached the airline, and not just the agent’s.

When Your Flight Is Delayed

This is the area where the public misunderstands the law most and where a great deal of online content is simply wrong. The honest position is that the DGCA rules do not prescribe a fixed sum of cash for a delay by itself. What they give you are facilities and, for long domestic delays, a way out.

When Are Airlines Required to Provide Free Meals and Refreshments?

Block Time of Your Flight

Delay Beyond Scheduled or Revised Departure That Triggers Free Meals and Refreshments

Up to 2½ hours

2 hours or more

More than 2½ hours, up to 5 hours

3 hours or more

More than 5 hours

4 hours or more

These facilities are owed if you checked in on time (Para 3.4.1). Beyond meals, the CAR gives you three more protections:

1. The Six-Hour Exit (Para 3.4.2)

If a domestic flight is expected to be delayed by more than six hours, the airline must offer either an alternate flight within six hours or a full refund.

2. A Hotel (Para 3.4. 3)

If the total delay exceeds 24 hours or exceeds six hours for a flight scheduled between 2000 and 0300 hours, you must be offered hotel accommodation, including transfers, where necessary.

3. The Burden of Proof (Para 3.4.5)

Whether and when you were told about the delay is a question the airline must prove. If it cannot produce a timely message, that silence counts against it, not you.

The government confirmed this framework in a written reply in the Rajya Sabha on 10 March 2025 (Unstarred Question No. 1122): meals for long delays, hotel accommodation for overnight delays, and an alternate flight or full refund beyond six hours.

I would caution you about blogs that promise cash for every 24-hour delay. The CAR does not say that. If a delay hardens into a cancellation, or if the airline’s treatment of you amounts to deficiency in service, a claim for compensation certainly lies. But it lies through consumer law, which I explain further down, and not through a table in the CAR.

Denied Boarding and Downgrading

Overbooking is the usual cause of denied boarding. Para 3.2 requires the airline to first ask for volunteers. If you are bumped against your will, you get nothing only if the airline puts you on a flight departing within one hour of your original time. Otherwise, the compensation is 200% of the booked one-way basic fare plus fuel charge, capped at ₹10,000, if the alternate flight leaves within 24 hours. It is 400%, capped at ₹20,000, if the alternate flight leaves later, or if you decline the alternate flight, in which case the full ticket value is also refunded.

Revision 4 added a protection that many passengers still do not know about. Under Para 3.5.1, if you are involuntarily moved to a class lower than the one you paid for, the airline must reimburse 75% of the ticket cost, including taxes, on a domestic sector. In international sectors the figure is 30% for flights up to 1,500 km, 50% for flights between 1,500 and 3,500 km, and 75% beyond 3,500 km.

When an Airline Can Lawfully Refuse Compensation

I always tell clients the uncomfortable half of the story before they spend money on a notice. Airlines do have genuine defences.

Paras 1.4 and 1.5 relieve the airline of compensation where the cancellation or delay arises from extraordinary circumstances beyond its control, which could not have been avoided even with all reasonable measures. The CAR gives examples: political instability, natural disaster, civil war, riot, flood, explosion, government orders affecting the aircraft, and strikes. It separately excludes delays and cancellations clearly attributable to air traffic control, weather and security risks.

Having said that, three points deserve your attention.

1. The Airline Must Establish the Defence

“Operational reasons” is a label, not a circumstance. An airline that pleads force majeure should be put to strict proof, with documents.

2. The Defence Has a Built-In Test

The event must be one that reasonable measures could not have avoided. Crew shortages and poor scheduling are matters within an airline’s own control, which is why the December 2025 roster-driven cancellations ended in refunds and statutory compensation, and not in a force majeure exemption.

3. Refund Rights Survive

Even where cash compensation is excused, an unused ticket must still be refunded under Part II.

Refund Rules From 26 March 2026

The refund CAR, issued on 24 February 2026, put hard timelines on something airlines had long treated as discretionary:

How You Paid or Booked

Refund Timeline

Credit card

Within 7 days

Cash, at the airline office

Immediately

Travel agent or online portal

Within 14 working days, with the airline responsible, since agents are its appointed representatives

The airline cannot force a credit shell on you. Choosing between a refund and a credit shell is the passenger’s right.

Statutory taxes and charges, including User Development Fee, Airport Development Fee and Passenger Service Fee, are refundable on cancelled or unused tickets.

Passengers who book directly on an airline’s website get a 48-hour “look-in” window for penalty-free cancellation or amendment, subject to conditions. It does not apply to airline-initiated cancellations, but it is useful to know.

Para 3.3.5 of Part IV ties the two documents together by providing that the refund for a cancelled flight follows Part II. So if your money is sitting beyond these timelines, you have a dated breach to point to, which is exactly what a notice or complaint needs.

International Flights and Foreign Airlines

For foreign carriers, Para 3.6.1 says compensation is as provided under the regulations of the carrier’s home country, or as given in Paras 3.2.2, 3.3.2 and 3.5.1 of the Indian CAR. For international carriage there is a second layer: the Carriage by Air Act, 1972, which gives effect to the Montreal Convention, makes the carrier liable for damage caused by delay, subject to the limits in its Schedule. The Supreme Court has dealt with carrier liability under that Act alongside the consumer statute, so a well-framed international claim should keep both in view.

What to Do When Your Flight Is Cancelled or Delayed in India: A Practical Sequence

Over time I have come to believe that most failed claims fail on paperwork, not on law. Complaints must be handled online and carry a unique reference number (Para 3.10.5). Quote the exact paragraph of the CAR, state the sum you claim, and keep that reference number safe.

Step 3: Go to AirSewa

Para 3.9.2 allows you to lodge the grievance on the Air Sewa app or portal. If the airline is stonewalling, do this in parallel without waiting.

Step 4: Send a Legal Notice

A properly drafted notice that cites the CAR, the Consumer Protection Act, 2019 and the airline’s own Charter of Rights tends to move your file from the customer care queue to someone with authority to settle. It also fixes a clear date from which interest and costs can be argued.

Step 5: File a Consumer Complaint

Para 3.9.3 expressly preserves your right to approach any statutory body or court if you remain dissatisfied. For most passengers, that means the Consumer Commission.

Filing a Consumer Complaint Against an Airline

Air travel is a “service”, and a failure in it can amount to “deficiency in service” under the Consumer Protection Act, 2019. The practical points are these:

Limitation

Section 69 gives two years from the date the cause of action arises, with power to condone delay for sufficient cause.

Which Forum

Under the Consumer Protection (Jurisdiction of the District Commission, the State Commission and the National Commission) Rules, 2021, the District Commission hears complaints where the consideration paid is up to ₹50 lakh. The State Commission handles claims above ₹50 lakh up to ₹2 crore, and the National Commission above ₹2 crore. An airline ticket will almost always go to the District Commission.

Where to File

Section 34(2) allows you to file where the opposite party carries on business or the cause of action arose, and also where you reside or work for gain. The Supreme Court has held in Charan Singh v. Healing Touch Hospital, (2000) 7 SCC 668, and Ghaziabad Development Authority v. Balbir Singh, (2004) 5 SCC 65, that compensation must reflect the actual loss, injury, harassment and suffering, and must not become a source of unjust enrichment. That is a useful discipline for claimants as well: a modest, well-documented claim is more likely to succeed than an inflated one.

Air France v. O.P. Srivastava: NCDRC Decision

The NCDRC applied these principles to an airline in Air France v. O.P. Srivastava (decision dated 22 March 2018). It held that passengers travelling on official work remain “consumers” in respect of the airline’s service, and that compensation under the consumer statute is not confined to the Air Act. In a 2026 decision reported in June, the NCDRC also upheld ₹20 lakh in compensation against Air India for a defective business-class seat on a long-haul flight, again looking at substance and proportionate loss.

Airline Conditions of Carriage and Consumer Rights

Airlines often rely on their Conditions of Carriage to cap what they will pay. The District Commission at Ernakulam rejected that plea in a case against IndiGo, observing that statutory remedies under the Consumer Protection Act cannot be overridden by one-sided clauses in a standard-form contract. I agree with the principle. A contract of carriage cannot contract out of a statute.

Common Myths and the Actual Position

What People Say

What the Rules Provide

“Any delay entitles me to cash.”

No. A delay brings meals, a hotel for very long or late-night delays, and a refund or alternate flight beyond six hours on domestic routes.

“The airline can fob me off with a voucher.”

Compensation is payable in cash or by bank transfer. However, passengers may be entitled to free meals, refreshments, hotel accommodation, or an alternative flight or full refund, depending on the duration of the delay.

Domestic Flight Delayed Beyond Six Hours: Under DGCA CAR, passengers must be offered an alternative flight within six hours or a full refund.

Denied Boarding Compensation: Passengers involuntarily denied boarding due to overbooking may be entitled to compensation of 200% or 400% of the booked one-way basic fare plus fuel charge, subject to prescribed monetary limits and conditions.

Involuntary Downgrading: If an airline places a passenger in a lower class than the one booked, DGCA rules provide for reimbursement of a prescribed percentage of the ticket cost, including taxes.

Airline Refund Deadlines: Under the revised DGCA refund requirements effective 26 March 2026, refunds must generally be processed within seven days for credit card payments, immediately for cash payments at the airline office, and within 14 working days for bookings through travel agents or online portals.

Force Majeure Is Not an Automatic Defence: Airlines may be exempt from cash compensation in circumstances such as extraordinary events, adverse weather, air traffic control restrictions or security risks. However, applicable refund rights remain protected.

Consumer Court Remedy Against Airlines: Passengers can approach the Consumer Commission for deficiency in airline services, including unjustified refund refusals, financial loss, harassment and failure to provide legally mandated facilities.

Legal Notice and Consumer Complaint: Passengers can first submit a written complaint to the airline, escalate the matter through AirSewa, issue a legal notice and, where justified, file a consumer complaint.

Limitation Period: Under Section 69 of the Consumer Protection Act, 2019, a consumer complaint must ordinarily be filed within two years from the date the cause of action arises, subject to condonation of delay for sufficient cause.

Legal Assistance: Where an airline refuses a legitimate refund or compensation claim, an appropriately drafted legal notice and consumer complaint can help passengers enforce their rights under applicable aviation and consumer protection laws.

From Boarding to Baggage Claims: Rethinking Passenger Rights in Indian Aviation Law

Cancellation of Bail: Legal Principles, Grounds, and Judicial Approach

Are Air Crashes An Act Of God?
