In India, thousands of such cases occur, but only a few are reported. Rapes are often treated casually. Women have become victims repeatedly. Even in today\u2019s modern society, male-dominated mentality often refuses to accept women as human beings \u2014 as essential elements of society. From female foeticide to taking a woman&#8217;s life for money, the injustices continue. Hence, numerous laws and regulations for women had to be enacted.<\/p>\n<p>Every man and woman should know about these laws as responsible citizens of India.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"General_Assumptions_About_Violence_Against_Women\"><\/span>General Assumptions About Violence Against Women<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<ul>\n<li><strong>Myth:<\/strong> Rapists are always strangers.<br \/>\n<strong>Reality:<\/strong> Many rape victims know their rapists \u2014 they may be neighbours, relatives, family members, or friends.<\/li>\n<li><strong>Myth:<\/strong> Rapes happen only late at night.<br \/>\n<strong>Reality:<\/strong> Most rapes occur at home and can happen at any time of the day.<\/li>\n<li><strong>Myth:<\/strong> Women invite rape by wearing revealing clothes.<br \/>\n<strong>Reality:<\/strong> A civil rights group survey found that rural, tribal, and Dalit women \u2014 often wearing modest clothing \u2014 are frequently targeted. In the recent Baladapur case, the girl was in school uniform, yet she was raped.<\/li>\n<li><strong>Myth:<\/strong> Women who go out at night are more likely to be raped.<br \/>\n<strong>Reality:<\/strong> A woman is raped every 16 minutes in India, regardless of time or location.<\/li>\n<\/ul>\n<h3><span class=\"ez-toc-section\" id=\"Legal_Provisions_under_Bharatiya_Nyaya_Sanhita_BNS_Bharatiya_Nagarik_Suraksha_Sanhita_BNSS_2023\"><\/span>Legal Provisions under Bharatiya Nyaya Sanhita (BNS) &amp; Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p><strong>Section 63 \u2013 Rape (BNS)<\/strong><br \/>\nRape is defined as penetration without consent, under force or fear.<br \/>\nConsent below the age of 18 is not valid.<br \/>\n<strong>Punishment:<\/strong> Section 64 provides for a minimum of 10 years of imprisonment, extendable to life. In aggravated cases, the death penalty may apply.<\/p>\n<p><strong>Section 101 \u2013 Murder (BNS)<\/strong><br \/>\nWhen an act is done with the intention of causing bodily injury known to be likely to cause death.<br \/>\n<strong>Punishment:<\/strong> Life imprisonment or the death penalty.<\/p>\n<p><strong>BNSS Provisions:<\/strong><\/p>\n<ul>\n<li>Rape and murder cases can be tried in Special Courts.<\/li>\n<li>Zero FIR: Victims can report the crime at any police station.<\/li>\n<li>Mandatory forensic investigation.<\/li>\n<li>Victims have the right to be informed about the progress of the investigation.<\/li>\n<\/ul>\n<h3><span class=\"ez-toc-section\" id=\"The_Law_Has_Changed_But_What_About_the_System\"><\/span>The Law Has Changed, But What About the System?<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>If offenders do not think twice before committing rape and murder, why should the justice system hesitate in giving them a sentence?<\/p>\n<p><strong>Article 21<\/strong> of the Constitution guarantees the right to life. The judiciary, even while sentencing offenders, ensures that their fundamental rights are not infringed. But justice must be swift and firm \u2014 just like India\u2019s response to Pulwama and Pahalgam attacks. Police claimed the culprits attacked officers while trying to escape. All four were shot dead in an encounter. This act drew widespread support and appreciation. Though justice prevailed, it came without due process or trial \u2014 raising deeper questions about justice and procedure.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"Candle_March_A_Symbol_of_Protest\"><\/span>Candle March: A Symbol of Protest<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>One person\u2019s silence can echo louder than a crowd\u2019s roar.<\/p>\n<p>In India, whenever such incidents occur, people often respond with <strong>Candle Marches<\/strong> \u2014 symbolic of peaceful protest and solidarity. These marches aim to raise public awareness and send a visual message.
