forfeit the benefit.<\/li>\n<li><strong>Intention of Transferor:<\/strong> The benefit must be intended as compensation or inducement to secure the owner&#8217;s acceptance of the unauthorized transfer.<\/li>\n<\/ul>\n<h3><span class=\"ez-toc-section\" id=\"Consequences_of_Election\"><\/span>Consequences of Election<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>If the owner uses or enjoys the benefit for two years without formally accepting or rejecting it, it is presumed that they have impliedly accepted the transaction. This is particularly relevant in practical, long-standing arrangements.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"Exception_to_the_Doctrine\"><\/span>Exception to the Doctrine:<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<ul>\n<li><strong>Independent Benefit:<\/strong> If the benefit is independent of the transaction, the owner can retain it without validating the unauthorized transfer.<\/li>\n<li><strong>Lack of Knowledge:<\/strong> If the owner was unaware of the circumstances or implications, acceptance for the benefit may not count as an election.<\/li>\n<li><strong>Inaction for Over a Year:<\/strong> If no decision is made within one year, the transferor can demand a response. Continued inaction may be treated as implied consent.<\/li>\n<li><strong>Disability:<\/strong> If the owner is under disability (e.g., minor, mentally ill), the election is postponed until the disability ends or a guardian makes the decision.<\/li>\n<li><strong>Fraud or Undue Influence:<\/strong> If the election was made due to fraud, coercion, or undue influence, it is not valid.<\/li>\n<\/ul>\n<h3><span class=\"ez-toc-section\" id=\"Case_Laws\"><\/span>Case Laws:<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<div class=\"case\"><strong>Mst. Dhanpatti vs. Devi Prasad (1970) 3 SCC 776<\/strong><br \/>\n<strong>Facts:<\/strong> A person transferred property not belonging to them and granted benefit to the real owner.<br \/>\n<strong>Held:<\/strong> For the doctrine to apply, two conditions are necessary:<\/p>\n<ol type=\"a\">\n<li>Unauthorized transfer of property<\/li>\n<li>Conferring of benefit on the actual owner who then must elect<\/li>\n<\/ol>\n<\/div>\n<h3><span class=\"ez-toc-section\" id=\"Practical_Examples\"><\/span>Practical Examples:<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<div class=\"example\"><strong>Example 1:<\/strong> A transfers a land owned by B to C. In the same deed, A gifts Rs. 10 lakhs to B.<br \/>\n<strong>B must choose:<\/strong><\/p>\n<ul>\n<li>Accept the Rs. 10 lakhs \u2192 Approves transfer to C.<\/li>\n<li>Reject the transfer to C \u2192 Forfeits the Rs. 10 lakhs.<\/li>\n<\/ul>\n<\/div>\n<div class=\"example\"><strong>Example 2:<\/strong> If B uses the Rs. 10 lakhs for over 2 years without objection, it will be presumed that B accepted the transfer (Implied Election).<\/div>\n<h3><span class=\"ez-toc-section\" id=\"Rationale_Behind_the_Doctrine\"><\/span>Rationale Behind the Doctrine:<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<ul>\n<li>Prevents inconsistent behavior.<\/li>\n<li>Promotes certainty in property transactions.<\/li>\n<li>Protects the interest of innocent transferees and ensures fairness.<\/li>\n<\/ul>\n<h3><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion:<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>The Doctrine of Election ensures that one cannot cherry-pick benefits from a transaction while rejecting its burdens.
