The Bangladesh Bar Council, constituted under this Order, includes elected representatives of the advocates, with the Attorney General of Bangladesh as its ex-officio Chairman.<\/p>\n<p>The Bar Council grants licences to qualified individuals to practise law before either the subordinate courts or the Supreme Court of Bangladesh.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Enrolment_Procedure_and_Types_of_Advocates\"><\/span>Enrolment Procedure and Types of Advocates<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>In Bangladesh, various categories of advocates are authorized to practise law before the subordinate courts and the Supreme Court.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"Becoming_an_Advocate_Enrolment_Steps\"><\/span>Becoming an Advocate: Enrolment Steps<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<ol>\n<li>Practice before the Subordinate Courts (Judges Court)<\/li>\n<li>Practice before the High Court Division<\/li>\n<li>Practice before the Appellate Division<\/li>\n<li>Advocate for the State (appearing on behalf of the prosecution)<\/li>\n<\/ol>\n<h3><span class=\"ez-toc-section\" id=\"Step_1_Practice_before_the_Subordinate_Courts\"><\/span>Step 1: Practice before the Subordinate Courts<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p><strong>Advocates to the Subordinate Court:<\/strong> Entitled to practice only in all subordinate courts of Bangladesh.<\/p>\n<h4><span class=\"ez-toc-section\" id=\"Enrolment_Procedure_%E2%80%93_How_to_become_an_Advocate_in_the_Judges_Court\"><\/span>Enrolment Procedure \u2013 How to become an Advocate in the Judges Court?<span class=\"ez-toc-section-end\"><\/span><\/h4>\n<ol>\n<li>A Bangladeshi citizen with a law degree from a recognized university (domestic or abroad) or called to the Bar must qualify in an enrolment exam conducted by the Bangladesh Bar Council.<\/li>\n<li>After LL.B., the candidate must undergo 6 months of pupilage under a practicing advocate with at least 10 years of standing. This is formalized via an affidavit contract on non-judicial stamp paper.<\/li>\n<li>Upon completion of pupilage, the candidate must submit a registration form, bank slip, and pupilage affidavit to the Bar Council within 30 days of contract execution.<\/li>\n<li>Registration remains valid for 5 years. Failure to pass the written exam within this period results in cancellation.<\/li>\n<li>The enrolment exam has three stages:\n<ul>\n<li>MCQ (100 questions, 100 marks; 1-hour duration; pass mark: 50)<\/li>\n<li>Written Exam (100 marks; 4-hour duration; pass mark: 50)<\/li>\n<li>Viva Voce (50 marks; pass mark: 25)<\/li>\n<\/ul>\n<\/li>\n<li>Candidates must pass each stage in sequence. Failure in written means reappearing in MCQ. Viva must be passed within 3 attempts over 3 years from the written exam result.<\/li>\n<li>After passing, candidates must become members of the local Bar Association of their chosen practice area.<\/li>\n<\/ol>\n<p><em>* To practise before the High Court Division, a separate written and viva voce exam is required.<\/em><\/p>\n<h3><span class=\"ez-toc-section\" id=\"Step_2_Practice_before_the_High_Court_Division\"><\/span>Step 2: Practice before the High Court Division<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p><strong>Advocates to the High Court:<\/strong> Entitled to practice in both the High Court and subordinate courts.<\/p>\n<h4><span class=\"ez-toc-section\" id=\"Permission_Procedure_%E2%80%93_Eligibility\"><\/span>Permission Procedure \u2013 Eligibility<span class=\"ez-toc-section-end\"><\/span><\/h4>\n<ol>\n<li><strong>Eligibility Criteria:<\/strong>\n<ul>\n<li>Minimum 2 years of practice before subordinate courts;<\/li>\n<li>Bar-at-Law from UK or second-class LL.M. with 1 year experience under a senior Supreme Court advocate;<\/li>\n<li>Retired judicial officers with 10 years of service (viva required, written exempted).<\/li>\n<\/ul>\n<\/li>\n<li>Collect the &#8220;Agreement of Pupilage for Permission to Practice in the High Court Division&#8221; form from the Bar Council. It must be signed by a Senior Advocate (enrolled by the Chief Justice).<\/li>\n<li>After pupilage, collect the registration\/exam form and pay the prescribed fees.<\/li>\n<li>Attend and pass the written and viva voce examinations.<\/li>\n<li>Post-qualification, an interview after one year is required to obtain membership in the Supreme Court Bar Association.<\/li>\n<\/ol>\n<h3><span class=\"ez-toc-section\" id=\"Step_3_Practice_before_the_Appellate_Division\"><\/span>Step 3: Practice before the Appellate Division<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p><strong>Advocates to the Appellate Division:<\/strong> Under Rule 3 of Order IV of the Appellate Division Rules, 1988, one must have practised in the High Court Division for at least 5 years.<\/p>\n<p><strong>Advocates-on-Record:<\/strong> Only they can file cases or appear in appeals unless special permission is granted. Senior Advocates and others can plead under their instruction.<\/p>\n<p><strong>Senior Advocate:<\/strong> As per Rule 11 of Order IV, the Chief Justice and judges may confer this status based on knowledge, ability, and experience. A Senior Advocate cannot be an Advocate-on-Record (Rule 16).<\/p>\n<h3><span class=\"ez-toc-section\" id=\"Step_4_Advocate_for_the_State_Prosecution\"><\/span>Step 4: Advocate for the State (Prosecution)<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p><b>There are four categories of state advocates in Bangladesh:<\/b><\/p>\n<ol>\n<li><strong>Attorney General:<\/strong> Appointed by the President, has the right of audience in all courts. Leads a team including Deputy and Assistant Attorney Generals.\n<ul>\n<li><strong>Article 64:<\/strong> Defines duties assigned by the President.<\/li>\n<li><strong>Article 26(1):<\/strong> Grants pre-audience rights over all other advocates.<\/li>\n<li><strong>Article 26(2):<\/strong> Pre-audience among others determined by seniority.<\/li>\n<\/ul>\n<\/li>\n<li><strong>Public Prosecutor (PP):<\/strong> Appointed for criminal matters, mainly in Sessions Courts or Special Tribunals. Includes:\n<ul>\n<li>Public Prosecutor<\/li>\n<li>Additional Public Prosecutor<\/li>\n<li>Assistant Public Prosecutor<\/li>\n<\/ul>\n<\/li>\n<li><strong>Government Pleader (GP):<\/strong> Appointed in civil matters to represent the State in court.<\/li>\n<li><strong>Court Sub Inspector (CSI):<\/strong> Police officers appointed to represent the State in Magistrate or subordinate criminal courts.
